Right now in Iowa News at 4, we're tracking the chance for rain tonight. The triangle under level two risk for severe storms are also tracking dangerous heat with feels like temperatures in the triple digits. Right share company Lyft is being sued after a local woman is reportedly assaulted during a ride. The lawsuit also involves a deadly crash that killed a Durham couple. We're hearing from civil rights attorney Ben Crump, who is in the triangle today representing the family's impacted. And the I team investigating a hit and run crash involving an assistant chief of police in Durham. What we're learning about the charges he's now facing. Plus, the state auditor is back in Wake County today as the investigation continues into the town of Kerry.

Here's what's happening where you live. This is ABC 11I witness news. And good afternoon. We have your first alert to the chance for strong storms tonight. Thank you for joining us for the news at four. I'm Barbara Gibbs. And I'm Lauren Johnson. Amber is off. We are bracing for the potential for severe weather with storms possible and dangerous heat across Central Carolina. Wayne, Samson, and Cumberland counties all under a heat advisory until 8 p.m. tonight. All right. Meteorologist Cruz Medina is in our first look forecast center with all the details. Hey, Cruz.

Hi there. Well, we're expecting some waves of storms to move in as we go throughout this evening. The risk highest back to our northwest, but a level two out of five risks from the triangle back to our northwest. That does include areas like Roxborough and back toward the triad. If you were not in that level two, you are in a level ones. That means all of us have to be on guard for that severe weather potential. And you can see back to our northwest where the storms are originating from. So we have some moving out of West Virginia into Virginia and North Carolina. We also have another cluster.

The stronger one is back in Ohio right now. That could track through in the overnight hours. First, Doppler net. You could see most of Central North Carolina pretty quiet at this time. A few storms popping up down in the sandhills right now and we'll be tracking back to our west. So in the triad, there's a line of storms forming there. That could impact our western rows of counties and that could also lead to a flash flood risk as those storms are moving very slowly. Down in Hoke and Cumberland County starting to see a few storms pop up there.

Most areas are going to be dry at least for another few hours. The rain chances do increase as we get closer to 7, 8, 9 p.m. And then, of course, we could see another round in the overnight hours as well. So expected to stay unsettled tonight, definitely a night to make sure that you can receive warnings on your phone in case you need them. And then for tomorrow, we will start off dry in most areas, although there could be a lingering shower or storm. Temperatures will be in the mid-80s by noon. And afternoon highs just like today should be back in the 90s for tomorrow. So that's going to be the normal going forward, mid-90s through Friday, a little cool down on the way this weekend.

Today, prominent civil rights attorney Benjamin Crump was in Durham to talk about two different incidents he's working on from our area. In one of the cases, his suing ride share company Lyft after police say one of their drivers from care. allegedly kidnapped and assaulted a woman on her way home from work earlier this year. A second incident involves a Durham couple who died in February after a Lyft driver was allegedly driving recklessly in Detroit.

Dwan Hoggard has been following the story. Dwan Crump says he is calling for more accountability from Lyft. We're afternoon to Lauren. We actually heard from attorney Ben Crump today where right now in Durham County was filed just this afternoon a $50 million lawsuit against Lyft. he and other attorneys are alleging that a Raleigh woman was allegedly sexually assaulted while she was a rideshare passenger earlier this year. Today, high-profile civil rights attorney Ben Crump announcing a $50 million lawsuit against Lyft after a Raleigh woman was allegedly sexually assaulted during a ride on March 31st of this year. Crump arguing that he believes Lyft should be held responsible for what allegedly happened to his client. Rideshare companies have a duty to their passengers.

who are trusting them to transport them safely. There is no excuse for this level of negligence. That client, Diamond Kennedy, who previously spoke anonymously with eyewitness news and is now publicly coming forward, says she's doing so so that other women can be on alert. I think the main thing is I just don't want to see a family go through what I'm going through. Kennedy was joined by her grandmother as well as by family members of Durham couple, Carla and Andre Boynton, who were killed during a lift ride in Detroit earlier this year, where the driver was alleged to have been speeding.

90 miles an hour on city highways and city streets where the speed limit was 25 and 35 miles an hour. I mean continuously, recklessly. He was going 90 miles an hour and caused their mother and father to be tragically killed. And the ironic part is that he survived. This 18-page lawsuit filed in Durham County Superior Court on behalf of Kennedy only

alleges that since the alleged assault by her driver, Ryan James Davy, her ability to enjoy life and life's pleasures have suffered. We still months down the line and I'm still trying to get back to who I was before this happened. And we did reach out to lift on this. They said that they do not comment on ongoing litigation. However, they did say a statement that I do want to share with you this afternoon. They write in part, our goal is for everyone to feel safe and respected on the Lyft platform. And there is no place in our community for acts of violence, dangerous behavior, or inappropriate actions behind the will.

A Lyft continues its work to promote safety for the millions of people who use Lyft every day. Now, we're also awaiting from the attorneys that you heard from earlier today. They actually say that they plan to file a lawsuit on behalf of the Boynton family at a later date, while they continue to away. details in that incident that happened up in Detroit earlier this year. We're live in Durham this afternoon. Dwan Hoggard. Abis 11, eyewitness news. A lot of questions. I know you'll continue to follow this story for us to Juan. Thank you. New here at 4 o'clock, the ITEM learning of an apparent hit and run crash on 540 on Friday involving an assistant police chief from Durham in his city-owned vehicle. The I-team uncovered a crash report involving Raul Garcia.

According to the city's website, he works as an assistant chief of field operations and is now on administrative leave. The report says he allegedly veered into the lane next to him, hit the side of someone's car, and drove off. He's facing three charges, including hit and run. In a statement to eyewitness news, Durham Mayor Leo Williams said, quote, I've been made aware of the allegations and am keeping a close eye on the investigation. The state highway patrol is investigating the case a little bit more, but coming up at 5 o'clock, John Dowding shares more about what we learned in that report and the questions we are asking the Durham Police Department tonight. Well, now to some of the local headlines in your speed feed.

First, the Wake County Sheriff's Office is remembering Deputy Ned Byrd. The Sheriff's Office posting this photo of the fallen deputy on social media. Ned Byrd was shot and killed in the line of duty four years ago today. He had stopped to check on a suspicious vehicle near the intersection of Battlebridge Road and Auburn Nightdale Road in Raleigh, when he was shot. Last year, two brothers pleaded guilty to killing Deputy Byrd. In Durham, a man is fighting for his life this afternoon after a shooting last night. police finding the victim around 8 o'clock this morning outside Braley's sports bar on Hillsborough Road. That man was rushed to the hospital so far. No one's in custody. A death investigation is

underway in Goldsboro. Around 5.30 this morning, police found a person dead inside a car when officers responded to a car crash in the 600 block of West Holly Street. At this point, police have not said how the victim died and their identity has not been released yet. Today, the North Carolina Labor Commissioner announces record-breaking results from the department's wage and hour bureau. And all three $1.7 million in unpaid wages was recovered for North Carolina workers. The recovery has reached workers in 89 of North Carolina's 100 counties. According to Luke Farley, the historic milestone represents the Labor Bureau's greatest annual impact to date in protecting workers. And that's your speed feet. Lauren back to you. All right, Barbara, as feels like temperatures

near the triple digits across the triangle, many are closely tracking their energy usage. Today, expert witnesses providing testimony to the State's Utility Commission over how much Duke Energy is hoping to increase energy rates. Michael Perchick joins us from our downtown Raleigh, Eyewitness News Center with those details. Michael, a lot of people having a tough time paying the bills. Yeah, Lauren, good afternoon. Duke Energy has amended its request during this month-long process. Still, advocates believe that their current ask is too high. Swealturing heat may have you reaching for the thermostat, but that desire balanced out by the cost in doing so. Duke Energy initially saw a 15 to 16 percent residential rate increase over the

next two years, a proposal which faced strong pushback. Their newest ask is down to an average of roughly 3.4 to 3.7 percent each year. And for a typical residential customer using a thousand kilowatts per month, the monthly bill would rise to $9.62s, would rise $9.62 effective in January, and then followed by $5.89 increase in January of 28. That percentage increases roughly the current rate of inflation. But Dan Crawford with the North Carolina League of Conservation Voter says that's still too much when factoring in the company's profits. Not everybody's getting those cost of living adjustments. You know, you look at the retired state employees, they're not getting the cost of living adjustments.

People on fixed income are not getting those type of adjustments. And so, you know, if Duke's got to give a little bit off the top of their profit, and so make electric rates are more affordable for every North Carolina, then I'm for that. And coming up at 5, the other part of Duke Energy's proposal, they believe is going to help support lower-income customers. I'm Michael Perchick, ABC 11, eyewitness news. Neighbors in need especially. Michael, thank you. New here at 4 o'clock, the state auditor was back in carry today after a crackdown on wasteful spending. Yeah, today, Dave Bullock addressed their carry rotary club. And this comes just weeks after state auditors exposed lavish spending on fancy meals, hotels, even Rayban sunglasses for all council members, all at the taxpayer's expense. Today, Bullock tells eyewitness news the investigation into the town's finances continues.

There are additional town visa card transactions and issues around those town visa cards that our team is investigating. There also is spending outside of the town visa card context that our team is working to assure the taxpayers of Kerry that their money is being spent the way they intended to be spent. In the meantime, Kerry Town Leaders agreed to create a plan, boosting checks, and balances. All right, we are counting down to the first day of traditional calendar school for most Triangle School districts. Wake and Durham County students returning just 13 days. Yeah, as we look ahead to the new school year, some students in Wake County will be in a brand new building. All right, that's awesome. New Swift Creek Elementary School set to open in time for the first day of school. Today, parents and students got a chance to tour the new building. The school, which was built on the side of the old school on Trion Road in Raleigh. It includes modern technology and new spaces for students and staff.

I would as soon spoke to the principal about the excitement to welcome the kids back. We have wonderful, big, bright classrooms, and within each of those grade levels, there's the learning commons where students can come together and collaborate. Teachers have plenty of spaces to meet. We are so thrilled. We can't wait to see these hallways filled with students and our families. The new school will hold about 500 students the same. as before, but so many more new amenities.

A major push from President Trump in Washington to change how children are vaccinated, signing an executive order recommending the measles, mumps, and rebella vaccine be split into three separate shots. The order also calls for fewer childhood vaccines now recommending children get vaccinated against 11 diseases down from 18. the American Academy of Pediatrics coming out against the recommendations saying children will suffer. If we end up not giving the same kinds of vaccines that we're giving now,

children are going to end up contracting diseases that could otherwise avoid, and some percent of those are going to die. Republican Senator Bill Cassidy, a doctor, also pushing back saying the order will, quote, make children less safe. Senator Cassie also urged parents to talk to their doctors before making any decisions. At least 224 people are dead. more injured after a 7.4 magnitude earthquake hit Columbia yesterday. Crews are now searching the rubble in multiple cities for any survivors, and officials are warning

the death toll may rise. ABC's Rena Roy has the latest. It's a race against the clock in Colombia, where rescuers are searching rubble for any signs of life. Entire apartment buildings splitting open, collapsing, trapping people under debris after a 7.4 magnitude earthquake rocked the country Monday. This six-month-old baby covered in dust pulled alive from the rubble. This woman pulled through this hole in a hospital that partially collapsed. She was tied to a rescuer who then repelled down the wall to safety. Thousands of structures across multiple cities destroyed.

This man walking through a neighborhood in the city of Kali that was flattened, saying he's speechless over the loss. You can see the moment the quake hit. travelers at the airport taking cover under a counter. Part of the ceiling falling just feet away. Silvana Botero, who lives in Chicago, was visiting family in Meredijin when everything started shaking. Like, I just hear like some shaking and I'm like,

I hear my mom screaming like, oh, there's an earthquake. The injured lining the streets, eight groups stressing the need for help. The epicenter that was Chocco is very known for its poverty. So a lot of people are in it right now. The president of Columbia has declared an emergency to expedite funding for recovery. The U.S. alone has promised more than $15 million for emergency shelter, food, and other aid. Rina Roy, ABC News, New York. And we'll have more on the search and rescue efforts in Colombia coming up on world news tonight with David Muir at 630.

Okay, I don't know how to describe the heat today in any other way, but downright miserable. I was about to say, in nice language. Oh, in nice language. downright miserable. You know, it is so hot and humid outside. Like truly feeling like the dog days of summer. Really? Right?

Feeling like over 100 degrees. And that heat humidity could feel our storms that we have on the way for this evening. Now the positive there is depending on when the storms arrive in your area, that can actually cool you down. But it's going to be hot until then. And like I said, this is just fuel for the storms to work with. So we could have two different rounds of rain coming through, multiple clusters of storms tracking back to our northwest, which I'll show you in just a moment.

moment. Six to about 10 p.m. That's the timeline of round one. As we go into the overnight hours, there could be a second round. Now, the strength of that round is kind of up in the air right now. It's going to depend on how well these storms hold together moving out of the Midwest, given we will already be past sunset at that time. The storm fuel overall goes down. It's just not going to be zero. So the severe risk for the rest of this evening, a level two out of five from the triangle back to the northwest. If you're not in that level two, you're at least in a level one. These storms are going to be scattered in nature, like I said, multiple rounds. So evening and overnight, and the main threat here is damaging winds, although some of these storms could be slow moving,

and that does present at least a low end flash flood risk as well. The big picture here, this is the stronger cluster of storms. That one's moving through southern Indiana and Ohio right now. That's what we're expecting to arrive in the overnight. The other round is the one that's in Virginia right now and starting to pop up in parts of North Carolina. That's the one that will be concerned with in the near term. So already seeing storms move out of Guilford County into Alamance County, severe thunderstorm back toward Greensboro, but in our area, relatively quiet right now outside of a few storms down in Hoke and Cumberland counties. So for the rest of your evening, if you have plans to be out, it will be hot and humid. Again, there will be some

storms around, so make sure that you plan around that. If you can, try to avoid outdoor plans for this evening. First alert predictor shows that through the next few hours, those storms get going. Again, that could be slow moving at first. They're going to be noisy. They're going to carry a lot of rain with them. And there is the isolated severe risk there. Into the overnight hours, this is predictor picking up on that second round that I showed you back in the Midwest right now. As that one moves through, we could have some remnants into tomorrow morning. This is not a slam dunk forecast, by the way. So tomorrow, you could wake up completely dry. There could be some areas with storms. But for the afternoon, we're back to hot and humid conditions in the 90s. Now, there is a low-end

severe risk for tomorrow as well, level one out of five, so it's not as impressive of a risk as today, but still isolated strong storm as possible during the afternoon and evening and feels like temperatures again will be over 100 degrees for the afternoon hours. So an active pattern that we have setting up shop here. As long as this front stays to our north, that hot and humid weather will continue. Thursday, looking like a mainly dry day by the time we get into Friday, there will be another late day storm risk. And we have more of those risks going forward as we go into the weekend as well. get here in your first alert seven day forecast. Mid-90s all the way through Friday by Saturday, a little cooler.

So that's behind a front. We dropped to 90. Low 90s on Sunday. Isolated storms in the afternoon. Better chance on Monday. Monday's going to be hot around 96 and then dropping back into the low 90s for the middle of next week. Back to you. If Cruz calls Monday hot, what's today?

New Vehicle Total Registrations for calendar year 2025 for the Cadillac definition of luxury. All right, time now for some news you can use. The Federal Trade Commission is warning social media user about fraudulent ads. Since consumers reported losing more than $95 million to those ads last year. The commission says platforms don't always vet companies that advertise with them. That allows scammers to place links to fake retail sites where shoppers pay money for items they never receive. The FTC recommends checking out companies instead of trusting social media ads. Well, the FDA is tracking so-called food fraud when what you buy isn't quite what the label claims. It can include diluting expensive olive oil with cheaper oils or mixing honey and maple syrup

with lower-cost sweeteners. Seafood can also be misled. labeled with cheaper fish sold as more expensive species. Experts estimate put the global cost of food fraud at billions of dollars every year. The FDA says it can also pose health risks, including hidden allergens or dangerous substances added to food. Fiat Chrysler automobiles recalling more than 48,000 vehicles. The company says a faulty seatbelt issue could cause drivers to suffer from injuries. Impacted cars were built with rear outboard seatbelts that may become twisted, preventing them from retracting. There have not been reports of injuries, but the company has received warranty claims connected to the issue.

Affected owners will be notified by September 24th. And that is news you can use. Lauren back to you. All right, new at four. As students return to campus, Food Lion Feeds is helping stock campus food pantries at local universities all across North Carolina, including schools right here in the Triangle. Today, there was an event held at Shaw University in Raleigh. Food Lion is donating $2,000 in pantry products to each school providing students with food throughout the school year.

Students do have the ability to eat downstairs in the cafeteria, but it's always not an option just due to hours and availability. So being able to have food right here on campus and not only our students, but our staff and faculty as well. So have this resource here is a great help. Tomorrow, an event will be held at NC Central University in Durham. Today, university leaders at UNC Chapel Hill, providing an update on the university's equality and inclusion policies after DEI effort. were rolled back. We are local news. ABC 11 eyewitness news continues now. All right, welcome back. I'm going to use it for it. It is the first alert day, Lauren. Cruz is over there at the thesaurus looking up other words for hot. We have no other way to describe these things today, right? Look, you guys are going to have to help me out with the synonyms. Okay, we'll help you. We got you. Humid, hot.

Miserable. A little bit of everything. All right. Summer. That's what it is today. With that comes some summer storms and so we're in an active pattern. We're in what we call the ring of fire. So storms are riding around the edges of a ridge of high pressure and that's swinging them in our direction.

So a level two out of five risk from the triangle back to the northwest, level one risk toward the I-95 corridor. So you can see some clusters of storms. One is back in Ohio and Indiana. Another one just starting to move out of Virginia into the mountains and foothills. That is the spot that we'll be watching for the next few hours. So in the short term, that's kind of where our rain chance comes from. So you could see some storms back toward the triad. A few popping up down in the sand hills as well right there in Hoke and Cumberland County.

So heads up, south side of Fayetteville, likely to get some rain here pretty soon. Otherwise, most of that rain back toward Ashboro. Getting the dog out for a walk this evening, there could be some storms around, especially as we go from 6 to 10 p.m. That's kind of the first run of storms we're expecting. Another one possible overnight, and that could also feature some strong storms. I'm uncertain right now of how well those are going to hold together

coming out of the Midwest, but that's something to keep an eye on for tonight. Make sure you have a way to receive warnings in the overnight hours. And then for tomorrow, we should be back to dry weather from most areas in the morning, reaching the mid-80s by noon, another day in the 90s tomorrow, and it stays hot through the end of the week.

All right, well, new it for today, the UNC Board of Trustees discussing policy on quality and inclusion. It comes after the university eliminated DEI programs. Akila Davis joins us live in Chapel Hill with more. Hi, Akela. Hi there, Lauren. You know it's now been two years since UNC Chapel Hill rolled back its diversity, equity, and inclusion policy. I went one-on-one with Chancellor Lee Roberts about its impact here.

Carolina is for everybody. You see on the banners outside, first and for all, the for all is something we take seriously here. I witness news speaking one-on-one with U.N.C. Chapel Hill Chancellor Lee Roberts, as the Board of Trustees Governance Advisory Committee gave an update on the university's compliance with the policy that rolled back diversity, equity, and inclusion efforts on campus. The equality policy was adopted in May of 2024, replacing the university's diversity, equity and inclusion policy.

The university says it has since closed all DEI offices and eliminated DEI programs and committees. 61 positions have been eliminated and 27 others realigned. The university says those changes are saving $5.3 million, money that's now being reallocated to what UNC calls student success. For students who might say that you and C might be backing out of its commitment

to supporting diverse communities, what are your words to them? We want all kinds of students here at Carolina. I've said many times that Carolina is for everybody. We work hard to recruit students from every nook and cranny of this state. And I ask the Chancellor if there have been any measurable changes in enrollment among black, Latino, first generation, LGBTQ plus students ahead at 530. I'll have that answer. Right, Akela, thank you. Now to some other headlines in your speed feed tonight, Cumberland County Commissioners holding an input session as they work on new regulations for the centers. As you know, several local governments, including the city of Durham and Durham County, are considering new ordinances for the massive facilities as concerns grow about energy usage and the impact on the environment. Tonight's meeting in Cumberland County begins at 6 o'clock at the J.D. Pone Recreation Center in Hope Mills.

Also happening tonight, supporters of Apex Fire Station 1 are expected to rally outside town council chambers ahead of tonight's town meeting. The town says no decisions have been made about the future of the firehouse, which was built in 1954, but residents worried the building on Salem Street could be torn down. Tonight's council meeting begins at 6 o'clock. Tom George will be there live coming up on eyewitness news at 6 o'clock. Near this hour, a big honor for Raleigh Native and former member of the North Carolina National Guard. Robert McLemore Jr. was awarded the Soldiers Medal by the Army Decorations Board for his heroic actions to help rescue a woman from a burning car on I-40 in Raleigh back in 2015 and today there was a ceremony to formally recognize him

as he received his medal. A lot of us are heroes here. We put the uniform on, we serve our country, first responders to everybody, whether it's Haley or Nationalism Disasters overseas, you know, a lot of us are heroes. I just so happened to be at the right place at the right time. Hungers created the soldiers medal in 1926 to recognize U.S. military or friendly foreign nationals who perform acts of heroism, not involving enemy conflict. And that is the speed feed, Barbara.

All right, Lauren, GoTriangle is helping get students ready for the first day of school. A catering food truck, a decoy Air Force One, and a reported secret mission. The Washington Post reports. President Donald Trump was hidden on a flight out of Turkey last month. As ABC's Devin Dwyer reports from Washington, the president secretly flew out of Turkey on a military plane. due to security concerns, according to reports. The Secret Service reportedly using elaborate deception to protect President Trump from an Iranian threat while leaving the NATO summit in Turkey last month. They want to take out the U.S. leader, me, I'm on every list.

At the time, the Secret Service said he would be taking the older Air Force one home and not the Qatari gifted jet he had arrived on. ABC News reported Trump was advised not to take that plane due to security concerns amid escalations with Iran. The president claimed he sent the new Air Force One ahead to show it off to American troops in England. But now it turns out the president wasn't on the older Air Force One jet either. According to the Washington Post,

the president was secretly put on a smaller military jet. In video from that day, you can see the president bored that older Air Force One as a catering truck is seen just below the plane. The post reporting, after walking up the steps, Trump slipped out a door on the other side. of the plane and got into that catering container, which was driven to a smaller Air Force jet, the C-32A. All three planes later landed in the UK. The deception came after our sources say the Secret Service learned of a credible Iranian threat against the president.

I think, first of all, we have to recognize if there's any threat that is deemed even remotely serious, the president has no choice but to take precautions. Reporters and some White House staff who were on the old Air Force One had no eye. idea the president was not on the plane. The passengers were only aware of the intense security concerns because they were directed to close their window shades. The president asked about that once he was back on the new Air Force One headed to the U.S. Do you know why they had us close our window blinds? That was no. Yes, this event is hosted every year by the British Lawnmower Racing Association. The drivers in full racing gear now. They race on modified mowers with their blades removed for additional speed. ABC's Yori Benadahu had more on how this shot could help more kids out of the hospital. Each year, up to 80,000 children under five years old land in the hospital from an RSV infection. With respiratory season around the corner, doctors are urging parents to look into options that can help slash that hospitalization risk by more than half. In the past few years, multiple shots have been FDA approved that have been found to reduce the risk of severe illness from the viral infection.

A new study published in JAMA pediatrics found that the RSV monoclonal antibody shot, known as Bayfordis was up to 72% effective against hospitalizations. While the timing varies each year, the virus usually starts spreading in the fall and peaks in the winter. Kids that may be more at risk include premature infants, those with weakened immune systems, or kids with respiratory conditions. Children entering their first RSV season that are younger than eight months are recommended to get the shot. And some high-risk infants may also be eligible for another dose in their second season. A vaccine is also available for pregnant woman at 32 to 36 weeks passing down protection from mother to child before birth. Uri Benijout, ABC News, New York.
