Here's what's happening where you live. This is ABC 11. I Witness News. Right now, before we're working to learn more about the person found dead at Raleigh Beach today near the News River Greenway. This was the scene from Chopper 11, around 1 o'clock this afternoon. The cause of death is also still not clear. Thanks for joining us here at 4. I'm Amber Repenta. And I'm Lauren Johnson.

In for Barbara Gibbs. We begin with that breaking news in Raleigh, after an eyewitness alerted police to that body floating in the Neuse River along Raleigh Beach. DeWan Hoggard joins us live on that scene. And DeWan, we know that you spoke to some eyewitnesses out there. What can you tell us about this investigation? Well, yeah, Lauren, even just first things first,

less than a month ago, I was out here when a 12-year-old girl, she was pulled from the water. She unfortunately died the very next day. This also comes just two days after a man jumped into a pond in Raleigh and never came back up. But I actually spoke with the man just moments after making that discovery today. And he walked me through what he saw and what he did next. The Way County Sheriff's office is in the middle of a death investigation near the News River Greenway and Lock Raven Parkway. This comes after a 911 call made by eyewitness Kevin Ortega, who was in the area to pick up trash and clean up when he made that grimly discovery. I was shaking at first. I was like, dude, I never seen it before. I come to this river a lot, and I'm not here about the stories of drownings, but seeing it right in front of you, it's crazy. He shared this video with us of him finding that body and alerting the authorities.

I literally just confirmed it. I literally just walked in here. He says there were no signs of foul play. The alleged drowning comes just two days after a weekend drowning off Millbrook Road in Raleigh in a pond, and after a 12-year-old little girl died after swimming in the river last month. Today, emergency crews responding quickly. They were asking me if they're like, you think it's response, like they could respond back. Like, there's some life to them.

And I was like, no, I think this body's fully dead. Like, I don't think they could come back. Despite the signs posted, Ortega says the water can still be dangerous. You guys want to continue swimming here, swim at your own wrist. And we also did reach out to the Wake County Sheriff's Office for more information. They were out here investigating earlier today. They don't have any further details that they can release. to us. So at this hour, we're still working to learn more details surrounding the circumstances

who this person was, if they were from the area and so on, so forth. When that information does come into our newsroom, we'll be sure to pass that along to you. Kevin Ortega also tells me he believes that that man was out here alone. We're live in Raleigh this afternoon. Duane Hogarth, ABC 11, IWitness News. Turning now to First Alert Weather, we have a live look right now. into downtown Raleigh from our Pindo Skycam and you can see some clouds, some kind of dark clouds hanging overhead. We have your first alert to the chance for some storms this evening and rain chances will increase throughout the week. Meteorologist Cruz Medina in our first alert forecast center with a look at the evening ahead. Hi, Cruz.

Hi there. Right now, storm chances are pretty low, at least in the near term. We should see a few isolated storms popping up throughout this evening. Those will be favored along the I-95 corridor and we could even see a few pop up in the triangle much later in the evening between seven. And 9 p.m. Tomorrow is going to be a wetter day. So for many of us that will stay dry this evening, it's going to look like this, partly cloudy outside like you can see at RDU right now, 88 degrees, 86 in Roxborough, 89 in Fayetteville. Tiptors will stay in the 80s for the next several hours. You get some sunshine mixed with those clouds. And again, just a few spotty storms that pop up throughout the evening. As we go into tonight, we will start mostly cloudy. There could be a spotty shower or storm, especially as we go toward daybreak. Tipters only fall into the storm. the lower half of the 70s tonight. So a very warm and muggy start to your Tuesday. And tomorrow is one of those days you'll want to have an umbrella handy. So throughout the mid morning, late morning hours, we see showers develop. Your commute could feature wet roads, kind of like what you're seeing here. And tipters will be a little limited tomorrow due to the rainfall that we're expecting. So right around 79 by noon, we only hop into the low 80s

briefly and tomorrow with slow moving showers and storms out there. We could even see some ponding on the road. So there is a low in flood risk. We'll break down the late. the latest timing of this with first alert predictor coming up in your extended forecast. Lauren. All right, Cruz, thank you. Now at 4 o'clock, the body of Sergeant Michael Emmanuel Swinton, who was killed in action during a controlled detonation from a down drone in Iraq is back here at home. Chopper 11 was over the special escort from the Patriot Guard in Fayetteville today.

His body was carried to the Pinecrest funeral home in Hope Mills. And that's where we find Penelope Lopez. She has more on a very heartfelt homecoming today. Penelope. Good afternoon. You know, emotions ran high today as friends and families came together to honor him during this special escort. We're about six minutes away from where it actually happened right next to the Fayetteville Regional Airport at a signature aviation hangar. This happened just two hours ago. Tonight, the Fayetteville community unites to bid farewell to one of its own. Sergeant Swinton, a soldier who dedicated his life to serving our country, died on top. July 19th during a controlled detonation of an Iranian drone. He served with Fort Bragg's 55th Air Defense Artillery Regiment after enlisting as an air

defense early warning system operator in 2017. The ceremony concluded with a procession led by the Patriot Guard riders, a nonprofit dedicated to honoring fallen military heroes, first responders and veterans at memorial services. Veterans, they don't ask to do this. They do this because they want to. they want to look out for us. And so especially when one pays that sacrifice and they lose their life. So paying that homage to him and to his family also too is a big, big thing for us. That's right. There were many people there just honoring him. You know, this is this is Fort Prague.

This is so special for them. And later on in the week on Saturday, the 8th, right here, there's going to be a viewing service at the Pryne Crest funeral service here in Hope Mills. That starts at 11 a.m. following that is a funeral service at 1 p.m. New at 5 will hear from a family friend and how she hopes people can remember him. Live in fate, Bill on Penelope Lopez, ABC 11, eyewitness news. Yeah, gut-wrenching to see his wife there laying across his casket now that he's back home. Penelope, thank you. Breaking now here at 4, the first known deaths tied to the cyclospora outbreak have now been reported. Health officials in Michigan say two people died after becoming infected.

with the parasite. Both had serious underlying health conditions. Health officials stress that deaths from the cyclospora are uncommon, and federal investigators have linked that outbreak to shredded iceberg lettuce served at some Taco Bell restaurants. The lettuce supplier has issued a voluntary recall, and Taco Bell says it has stopped using that supplier. The CDC says more than 18,000 cases have been reported nationwide since May 1st. And here in Wake County, cases are steadily rising this afternoon. The county reporting five. new cases today bringing the total now to 473 at least 12 people have been hospitalized in Wake County no deaths reported and there are now more than 700

cases statewide the state health department meantime has released an online dashboard to keep you up to date on the latest cases you can find that information on the North Carolina Department of Health and Human Services website now to new developments in the murder case of UNC student fate Hedgepeth today the suspect Miguel Salgura Alvarez pleaded not guilty to all charges in a Durham County courtroom. Meantime, more than a dozen key motions were heard today as the case heads to the trial next month. Akela Davis live at the courthouse in Durham with the latest from today's hearing.

Hi Akela. Hi, Lauren. You know, Judge Keith Gregory heard motions to say today deciding what will be used as evidence in this case. The state says there's conflicting information about how much alcohol UNC student faith hedge pef consumed in September of 2012 prior to her death. Her roommate at the time, Karina Rosario, says she saw Faith drink two drinks that night while at Thrill Nightclub. Another source says Faith didn't have any drinks at all.

The defense argues Karina Rosario remembers what happened that night. She remembered being sick from drinking too much. She remembered Faith helping her through her sickness. And she remembers Faith only having a shot of Hennessy and a red slushy drink while at that club. Prosecutors asked the judge to exclude forensic expert Paul Glover from the case because they say the Chapel Hill Police Department did not provide accurate timelines on events in this case, evidence showing that surveillance

cameras at the real nightclub were inaccurate that night. Prosecutors also asked the judge to exclude references to 911 calls, a request the defense did not oppose. Prosecutors asked the judge to exclude forensic expert Paul Glover. The judge saying he can't let that motion move forward. He's not questioning Glover's expertise. He just can't rely on his face. facts and sufficient as sufficient because he doesn't have all the facts ahead at 530.

I did speak with Faith, Hedgepats family, what her father told me as they were walking out of the courtroom. Back to you. All right, Akela, thank you. Now to some other local headlines in your speed feed. First, a Wake County Sheriff's deputy is on administrative leave tonight after being arrested on domestic violence charges. The sheriff's office says Carly Greenlee was arrested by another law enforcement agency last week. Court documents say deputy greenly used physical force against a victim by biting and grabbing the victim's wrist. Documents also say greenly was recently in a relationship with the victim. She faces several charges. The sheriff's office says it takes any violation of the law seriously and will continue to take the appropriate actions.

Today the city of Raleigh lifting stage one water restrictions. It comes after recent rain helped our local drought and led to a rebound at Falls Lake, which is now at 84% capacity. Meantime, Durham city leaders will get an update on conditions today, but plan to keep tougher stage two restrictions in place for now. In your voice here, vote today the public got a chance to weigh in on proposed changes to voting rules in North Carolina. The state board of elections holding a public hearing, collecting public comments on four rules related to campaign finance disclosures and complaints. The in-person hearing happened earlier this morning at the Dobbs building on Salisbury Street. You can also share your thoughts online through the end of the month. That is the speed feed. Lauren, thanks now to Capitol Hill. Acting Attorney General Todd Blanche could be one step closer to becoming Attorney General. Today, Blanche reached a deal with the senators who were blocking his path to confirmation, officially backing off of his controversial plan with President Trump to use nearly $2 billion of taxpayer money to pay out Trump's political allies. In a post on social media, Blanche confirmed in writing that the fund, which could have compensated January 6 rioters using taxpayer money, is, quote, rescinded and shall have no force or effect, in quote. And it comes after North Carolina Republican Senator Tom Tillis and Senator John Cornyn refused to support Blanche unless he confirmed the fund is dead. My reaction is the president's getting bad advice.

He should listen to Blanche and others who think if it's dead, it should be rendered completely dead. The Senate Judiciary Committee is scheduled to vote tomorrow on Blanche's nomination. If the majority votes for him, it could then, would then go to the full Senate for a vote. In Garner, a stepfather charged after a young child drowned in a bathtub. We'll have the latest on the investigation. Cindy Bay will join us live with new reaction from the child's mother.

New here for a Garner Man is charged with murder and the death of his young stepson. 19-year-old Angel Revis made his first court appearance in Wake County Court today. Cindy Bay is live in Raleigh after talking with that young boy's mother. Hi, Cindy. Hey, guys, yeah, a sad story. I spoke with the victim's mom who is grieving the loss of her 14-month-old son.

Police say he died after being left unattended in a bathtub, but she says it was a tragic accident. One day after her son's death, Isabel Deras returned to Wake County Court to support her husband, who now faces murder charges. It was just a mistake. And I love my baby, but I can't, I'm grieving and I can't be without my husband. 19-year-old Angel Rivas is charged with second-degree murder and felony child abuse inflicting serious injury. Investigators say he left the 14-month-old alone in a bathtub filled with water. Dera says Rivas is the boy's stepfather and insists what happened was not intentional.

You are also here on a murder charge. In court, prosecutor said Rivas is also being held on a federal immigration retainer. The judge ordered him held without bond. After the hearing, Deras and Rivas's mother embraced as they wept in the courtroom. New questions about negotiations between the U.S. and Iran to end the war. Over the weekend, President Trump saying a deal was imminent and calling off what he said would be massive strikes. But Iran's saying there are no negotiations with the U.S. at all. As ABC's Olivia Rubin reports, Trump is publicly pushing back at Iran. Today, President Trump trading public jabs with the Iranians, all after he said he held off on a massive attack in pursuit of diplomacy at the request of regional allies. every last chance before decapitation. It's the seventh time Trump has said he's backing off a major strike for negotiations.

This time, Trump claiming a deal was, quote, imminent. The threat of escalation is only going to work so many times as a negotiation tacked if it doesn't come to fruition. But the Iranian saying there are no negotiations underway with the U.S. to end the war. Iran's foreign ministry spokesperson saying they're currently in talks with Oman, strictly about the Strait of Horvian. In a post on social media, Trump calling the Iranian leaders, quote, unbelievably duplicitous. Ships are passing through the Strait of Hormuz at a trickle, just nine ships making it through on Sunday, according to Kepler. The economy also trying to navigate it all as the war enters its sixth month.

Oil prices falling about 5% today on hopes of a deal. But the national average for a gallon of regular is more than 93 cents higher than a year. ago, according to Gas Buddy. We're seeing a little bit of relief, not a ton, so there's still a lot of details here. In fact, after August 8th, if the national average is still above the $4 mark, it'll be the latest in the calendar year that we've ever seen that $4 a gallon mark still stick around. So just a lot of uncertainty. And drivers could soon see some relief as kids head back to school, people travel less,

and refiners switch to that cheaper blend of winter gasoline. In Washington, Olivia Rubin, ABC News. Olivia, thank you. A wildfire emergency on the West Coast where dozens of fires are burning, including in the area of Spokane, Washington. Nearly 400 square miles have burned across the state, and some of the fires have not been contained. 60,000 people have been forced to evacuate as the fires continue to threaten homes and businesses, and authorities are calling it the worst natural disaster the region has ever seen. More than 7,000 acres are burning. All right, Cruz Medina here joining us on this Monday morning or afternoon at this point, evening.

I'm lost track of the day at this point. It's a Monday. It's a Monday, but let's talk about the work week. Yeah, keep your umbrella. Yes, especially for tomorrow. Tomorrow's going to be a very wet day and so could have some impacts on your commute depending on the time of the day you're going to be heading out. For this evening, nothing more than isolated storm. So a lot of us will stay dry completely throughout this evening.

Overnight, it stays cloudy though and that sets us up for what's to come tomorrow. what's to come tomorrow. So showers develop throughout the mid to late morning hours. Those will linger into the afternoon and evening. And the later we get into the afternoon, the more likely it is that we get some storms. There is a low end flood risk for tomorrow. So mainly ponding on roads, but also poor drainage areas could see some problems as well. As we go into later parts of the week, the storm jets has become more spotty in nature. And so tipters are going to rise back to near 90 degrees. And so that's kind of where we should be for this time of the month. First, Solar Doppler net shows just very small isolated storm is popping up.

A few of those on the wake and Johnston County line starting to pop up. I also have a few down in Hope County. These are all going to move off to the north and east so we could see more of those developed throughout this evening. Otherwise it'll probably be partly cloudy and tipters in the 80s for most of Central North Carolina this evening. So tipters don't fall into the 90 or the 70s, I should say, until after sunset. That'll be closer to 9 or 10 p.m.

We're only going to cool down into the lower half of the 7th of the 7th year. tonight. So we'll be warm and muggy as we go into the start of tomorrow. Here's first alert predictor walking us through tonight. So notice any of those showers and storms in our southern communities right now will likely move to the north and east. We could see more of those develop closer to nine or ten. And then throughout most of the night, it's dry but mostly cloudy. Here's tomorrow morning, 9 a.m., the first shower starting to pop in our southern counties. These will become more numerous as we go into midday. So right around lunchtime should be pretty wet in most locations. A few storms starting to develop. Those will linger into the evening.

This is a snapshot of 7 p.m. and you can see maybe a few lines of storms moving through. Nothing severe is expected at this time and we should get a brief break in that rain as we go into early Wednesday morning. So over the next three days, this is what the weather prediction center is putting out for possible rain totals. So they're like there could be some decent pockets of a half inch to an inch of rain. Farther to the south, there could be some gaps in that rain. It really is going to depend on how these bands of rain set up shot over the next few days, but still looking like a decent shot at seeing rain across most of the region throughout tomorrow. So tipters will generally be in the 70s for most of the day tomorrow. There's a brief

window of opportunity that we could hop into the low 80s. That'll depend on how quickly the showers move out and the storms move in for the second half of the day. Definitely bring an umbrella with you tomorrow whether you're going to work or just have plans to be out and about. The weather conditions are not going to be the best for tomorrow. We should see some improvement as we go into Wednesday. So there is still a rain and storm risk there and Thursday. It's about 40%. That's a huge drop from what we see tomorrow.

As we go into the end of the week, nothing more than spotty storms. Tip just rise to around 90 degrees on Friday and Saturday and stay in the upper 80s through next weekend. Back to you. Milder. And if you're using 365, consider passwordless login options like pass keys or multi-factor authentication. American Airlines has

updated its refund policy. Passengers will now be eligible for a full refund if the trip is canceled within 24 hours of booking as long as the flight is one week away. American previously granted full refunds if the departure date was within two days of booking. The new policy matches the refund policies from Southwest JetBlue and United Airlines. Senate Republicans on Capitol Hill working to prevent a government shutdown this fall. Members of the Senate Appropriations Committee rolled out a bill Sunday that would fund the government through December 11th. Both parties expressed support for the bill with Minority Leader Chuck Schumer calling it a quote, responsible path forward. A vote is expected this week before the August recess.

ABC 11 eyewitness news continues now. New here for the leaders of CJF America, a Durham nonprofit at the center of an ABC11 troubleshooter investigation into unpaid work. have now been taken into custody. It's a new development after the two led person county deputies on a high speed chase that ended in a crash.

Courtney Jordan and Nick Gallardo were taken to Duke Hospital with injuries. But when deputies returned to arrest them, both men had disappeared from the hospital. Felony warrants were issued, including felony fleeing to allude arrest. In addition to existing Durham County warrants, today both men were located and arrested at a home on Oaks Lane in Timberlake on their existing charges. More charges are expected as this investigation. continues. A popular art museum in downtown Raleigh is now closed. And today, I witness news learned that Cam Raleigh is now selling its building on West Martin Street after closing in June. It comes as museums all across the country are facing decreased

attendance and in some cases a loss of government grants in rising inflation. Elena Athens spoke with museum staff about the closure. She joins us live in Raleigh with much more. Hi, Elena. Good afternoon to you. Lauren, yeah, I spoke with the vice chair today who says and stress that this was a tough decision. She tout. me that medium and small-sized museums really have been facing financially hard times ever since the pandemic and that the board itself wanted to free itself from the mortgage here. The contemporary art museum of Raleigh is on the market after 15 years of highlighting the work of artists and hosting events such as this party for Dreamville.

I'm disappointed to hear that we'll be coming back. I've also taken my children quite a bit over the years. Cam Raleigh wrote in a social media post this morning, the decision to sell was not sudden. A year was spent working with a consultant and studying the options. The museum paused exhibitions and in-house programming beginning June 15th. Cam Raleigh said then it was navigating the realities of a rapidly changing world where the cost of operations had outpaced traditional support.

I tried to speak on camera today with someone from the board of directors. I was told there's no staff left at Cam Raleigh and was able to talk to the vice chair on the phone about the sale. The market will drive the price. This is by no means a fire sale. This is a deliberate step forward to really get Cam in a place where we come back stronger than ever. First Bishop William Barbara was among several people arrested today following a demonstration inside the Hart Senate office building in Washington, D.C. The civil rights leader who is also the president of repairs of the breach was demonstrating after Senate Majority Leader John Thune refused to meet with that group to hear their opposition to what they call voter suppression in the Save America Act. The proposed federal bill would require individuals to provide proof of U.S. citizenship, such as a passport or birth certificate, when registering to vote. mandate a government issued photo ID to cast a ballot. Enrollment is now open for a new artificial intelligence-powered school. The private school is called Alpha Raleigh, and its curriculum is built around a unique two-hour learning model. Students interact with AI-powered tutors for two hours each morning. They cover course subjects like math, reading, science, and social studies in that time frame. And then in the afternoons, the focus shifts to guided hands-on workshops and life skills development.

The school year, Alpha plans to open campuses in 27 markets, including Raleigh, Charlotte, and Nashville. Now to downtown Raleigh, where it will now cost you more to park. Hundreds of people in this crowded shopping center running for their lives. Everybody's running. That Good Samaritan identified by the Idaho statesman as 35-year-old Jordan Salinas, telling us, the outlet he had just pulled into the parking lot when he heard gunfire. He said he felt no fear, adding there's a task that needs to be done and we're the ones who need to do it and that the gunmen did not like it when bullets started firing both ways. Three people were killed, seven others injured, two in critical condition. Lindsay Tangi says she found several victims, including her friend Terry Dudley, a taxi driver and army veteran who had been shot in his car.

Walked over and Terry was in his front seat still conscious at the moment, but not really able to communicate. Police say the 24-year-old shooter identified as Chad Williams died by a self-inflicted gunshot wound at the scene. A law enforcement source confirming to ABC News that this is a photo of Williams. Investigators are still working to pin down a motive. Rina Roy, ABC News, New York. Now to the seaplane that crashed in the Bahamas with 10 Americans on board. They were all rescued in this morning. One of those passengers is sharing her story. Gene O'Brien was one of those 10 Americans on board.

Authorities say the small plane was trying to take off Saturday morning when it ran into boat traffic. Police say while taxying on the water, the aircraft started pulling left and despite attempts to correct it, slammed into a dock near a resort. All of a sudden, the dock started getting closer and closer. And one of the people in the plane behind me said, where are you going? and then it just was boom and it hit. This investigation will, of course, look at what the captain was doing, how the airplane was being handled, why they could not be kept free and clear of hitting the stock, and that, of course, takes some time. You rule nothing in and you rule nothing out.

All aided passengers and two crew members were safely evacuated. This month you can adopt a pet for free. The Wake County Animal Center is taking part in the nationwide, clear the shelters event. The campaign waiving all adoption fees encouraging more people to open their hearts and their homes to pets who are in need. The Animal Center currently has 102 dogs, 26 cats and 33 kittens available. Pet adoptions are on a first come first serve basis. You must be at least 18 years old to take home an animal. Now to today's top trending stories in real news. First, let's start with a bear invasion in 10. Tennessee, a family of black bears surprised vacationers by opening a car door and climbing right inside their vehicle at a cabin. You can see a mama bear and her four cubs exploring the video. One of those cubs started eating leftover ice from a cup and there was no damage to the vehicle, surprisingly, though the bears did leave paw prints all over the car. The encounter left the family they said in shock, but they still say it was the highlight of their trip.

Those little babies are cute. In Alaska, a fisherman had a close encounter with a grizzly bear and he caught it all in a selfie. The man was able to film the moment a grizzly bear came really close to his boat. The grizzly bear was fishing. He says the mother grizzly bear found a piece of salmon and ate it right next to his head. As you can see, the man saying, quote, he works in an extremely unique location where bears and humans coexist unlike anywhere else in the world. He said he wasn't scared because she was so preoccupied with all the salmon she was fishing.

looks dangerous. Now to a hilarious site in Georgia, a man lying on top of a pile of furniture on the back of a moving truck. That man who captured this video says he and his wife were driving on the highway. When they saw a group of men moving the furniture, this video has

All right, over the weekend, Rocky Mount began rolling back its water restrictions. The city moving from mandatory stage one restrictions to voluntary stage two. Residents are still being asked to avoid unnecessary outdoor watering. They are also asking you repair leaky faucets and only run dishwashers and those washing machines when you have a full load. So we can't waste water crews. You know, we can't work out and then wash your clothes. You've got to work out a couple times this week before you get your clothes wash. That sounds gross.

All right. Well, one thing for certain, we are going to see some rain throughout the next three days, especially as we go into tomorrow. That's likely the wettest of the next seven days. Scattered showers developed throughout mid to late morning, and we'll see showers and storms throughout the afternoon and evening tomorrow. By Wednesday and Thursday, it's more of a spotty storm chance, so only 40% there and Tipter should start to warm up as we see those rain chances lessen. Going forward into Wednesday and Thursday, I mentioned those days were more spotty as far as rain chances goes. Friday, probably the best day that we have over the next seven.
