Right now at four attorneys for the suspected Raleigh mass shooter, Austin Thompson, now pushed to have evidence suppressed why they say Thompson was not prepared for questioning after the Heddingham community shooting.
And we are getting an update on the deputy shot during a standoff in Chatham County.
We'll also have the latest from the SBI investigation and what we know about the suspect.
Plus a major victory for the Lumbie tribe of North Carolina after years of fighting for federal recognition.

I Witness News. The trial for the alleged heading him mass shooting suspect is months away and
today attorneys for Austin Thompson asking a judge to suppress statements they say he made in
the hospital immediately following that shooting.

Austin Thompson is charged with killing five people,
including his own brother and a Raleigh police officer in the 2022 mass shooting.
John Dowding has been digging into the motion filed by Thompson's legal team today.
He joins us now live from outside the Raleigh Abadis News Center.
John, good afternoon to you.
What are his attorneys arguing?
Well, good afternoon to you both.
Well, his attorneys are saying all of these alleged statements happened in front of police officers
while he was undergoing treatment in the hospital.
His attorneys are claiming in this motion here
that the statements were made after he was shot in the forehead
and when was undergoing treatment in the hospital.
But they're also saying in the motion that was filed earlier today
that officers did not read him his Miranda rights
before they started recording those statements.
Tonight calls to suppress statements made by the Raleigh team
facing charges for his role in the 2022 heading him mass shooting.
Attorneys for Austin Thompson filing a motion in court Wednesday
asking a judge to suppress statements Thompson apparently made during his hospital stay.
Thompson was shot in the forehead in the incident and underwent medical treatment for injuries to his skull.
During his treatment, officers were stationed at his bedside.
But attorneys say officers also recorded statements and gestures of Thompson that could be described as violent.
According to the motion, his attorneys want these statements suppressed because, quote,
providing the jury with information that Thompson made comments and gestures that could be classified as violent in nature is inflated.
in the context of the charges and allegations.
His attorneys go on to say Thompson never had his Miranda rights read to him and say his juvenile rights were violated, seeing as several of the statements or gestures occurred outside the presence of a parent.
North Carolina law requires a minor under the age of 16 to have a parent present during any custodial questioning.
Well, Thompson faces five counts of first degree murder for his alleged role in that shooting.
His trial is set to start in February.
Wake County District Attorney's Office reached out to eyewitness news this afternoon telling us they have no comment about the motion filed earlier today in court.
Now, we also spoke with legal experts about the motion as well.
Coming up in the next hour, the questions they say they have about some of the allegations alleged here in this motion.

Developing now, we continue to follow the deadly standoff in Chatham County.
This was breaking news here last night at 5 o'clock.
And we now know the suspect was killed and the sheriff's deputy was shot.
Elena Athens has been following that story.
She joins us live from outside the sheriff's office.
Elena, good afternoon.
What can you tell us about the deputy's condition?
Yeah, a spokesperson from the Chatham County Sheriff's Office tells me in the last hour or so
that the deputy who was shot is doing well right now.
He's still in the hospital, but in good spirits.
The office, however, is still not sharing any information about the circumstances that led
up to this standoff or who was held inside of that home.
Eyewitness news was on scene last night when the Chatham County Sheriff's Office says
50-year-old Kevin Dean Hammer barricaded himself and a hostage inside this ranch home.
The Sheriff's Office says an armed standoff escalated.
We're being told deputies entered the home because of serious concerns for the hostages' safety
and that person was rescued.
Hammer was killed during a shooting.
Senior deputy Matthew Mitchell was shot multiple times in the hand and leg.
He is expected to make a full recovery.
A law enforcement expert says it was a great risk, getting the hostage out of the home safely.
Certainly a barricaded hostage situation makes it difficult on law enforcement because of the way we have to approach it.
If we try to do a dynamic entry, meaning by force, the likelihood of that hostage or hostages being injured is as much greater.
So the State Bureau of Investigation says it cannot share how many deputies fired their weapons.
that information would have to come from the Chatham County Sheriff's Office.
It's something that we're continuing to work on at this hour.
This is the second recent standoff in our area within just a week time period.
So what a law enforcement expert is saying about those back-to-back incidents,
we'll have that coming up all new at 5 o'clock.

We are tracking some breaking news unfolding in Johnston County.
Right now, hi everyone. I'm Steve Daniels in the breaking news center. We have Chopper 11 over a dump truck that's flipped over near Four Oaks, between Four Oaks and Benson. Take a look, Chopper 11 flying over the scene there. That is a dump truck from a company called Express Trucking. They are based in Zebulon. This is on Raleigh Road, and it's right near Johnson's Chapel Road. This is a little north of the I-40-I-95 interchange in Johnson County between Benson and Four Oaks. You can see they're trying to make quick work of that. That guy in that red tractor there is trying to clean up all that grass.

Not clear exactly why it flipped over.
This is a long two-lane roadway there.
There's no curve there.
So perhaps the driver ran off the side of the road over corrected and then flipped over.
The thing to understand as we enter the evening rush hour here,
Raleigh Road is a major north-south thoroughfare there in Johnson County coming off of
Highway 301 just north of that 4095 interchange.
So this could really delay and mess up the evening drive home for a lot of people in that part of Johnson
County. We'll keep an eye on the cleanup there. The breaking news from Chopper 11 overhead,
more as we get it in the hour ahead, Barbara. Thank you, Steve. A big day for one of North Carolina's
largest tribes. The Lumby tribe is one step closer to getting full federal recognition.
Penelope Lopez has been live in Pembroke. Penelope, good afternoon to you. I know that you
have been at the watch party at today's Senate vote as it passed, and I know that there's still
another hurdle. What was it like inside when that motion was passed?
Lots of cheers today and hugs.
You know, the tribal members say it's been a long time coming.
Their fight spanning back generations with at least 29 failed attempts.
It's finally puts a standpoint who we really are.
We know we've been native forever.
My whole life, that's all I've ever been taught is native.
Lumby tribal members emotional as they learn they are one step closer to getting full federal recognition.
The recognition comes after years of fighting for vital resources like education and healthcare.
The move would grant the tribe's sovereignty, granting them the ability to self-govern
while also receiving federal benefits.
But not all are supportive of the move.
I rise today to express my strong opposition to the NDAA provision that seeks to circumvent
the established merit-based process for federal tribal recognition and instead grant unchecked
federal recognition to the Lumby community.
While there were many cheers in the room, this vote was met with opposition from some political leaders and other tribal nations like the Eastern Band of Cherokee Indians who criticized their process.
Despite the pushback, Lumbie tribal member John Oxendine says Congress is finally listening.
So with Congress, I think they finally got it right.
And now the bill is headed to the president's desk.
President Trump will visit North Carolina this Friday in Rocky Mount. It's still unclear whether he will address.

it was a nice day to see the trolls over at Dix Park, drone 11, capturing these kids,
enjoying that giant troll and great weather for it. Yeah, and they're cool to see if you haven't
been out there. Definitely worth a visit, clear skies today, but meteorologist Cruz Medina,
tracking some rain in the forecast. Hi, Bruce. Hi there. Yeah, we've had some clouds around today that
have filtered in ahead of the system that's going to bring us the rain, but I want to show you
what to expect throughout the day tomorrow. So if you have early morning plans, you're likely
going to be dry, but areas west of on 95, including the triangle, that rain chance for you
really starts to spike by the noon hour and continues increasing as we go into the evening. So all
of us will see rain tomorrow. Just some areas could get a little bit more rain compared to others.
Now I mentioned the clouds spilling on in so this is all tied to that system that's going to bring us the rain tomorrow. It's well displaced to our west. So for this evening, we at least can expect dry conditions. And this is what it looks like outside. So some areas are seeing thicker clouds. Others of you have thinner clouds. But with the sun kind of shining through those clouds, I'd bank on a really nice sunset tonight like you see here in Durham. So 56 degrees, the sun will set around 503 today. But if you're heading out in Durham to depack tonight, here's what to expect before the show.
It would be a bit milder than previous evenings.
Tipters will be in the mid-40s before the show and in the upper 30s as that show is wrapping up.
Now, tonight we do drop into the 30s again, but it's going to stay above freeings.
That's also a nice change of pace.
And then going into tomorrow, we should see tipgers rising into the low 60s for many areas.
We will have that rain chance that we'll track out with First Alert predictor coming up in your seven-day forecast.

Wednesday. First, we're learning new details on the fire at the Super 8 motel in the north Durham area
on Guess Road. You can see from Chopper 11 the damage to the roof there. Officials say the first
arriving unit reported smoke coming from the rooftop and the entire hotel was evacuated.
The cause of that fire remains under investigation. There were no injuries.
in this and the Red Cross is being called in to help those forced out by the fire.
And we're working to learn more about a house fire that started in Raleigh.
It happened early this morning on Shepard Valley Street just off of Rock Corey Road.
Iwood News on the scene here showing the significant damage to that home.
There's nowhere yet if anyone was inside at the time.
And we have an update on a school bus crash in Wake County.
This was the scene from Chopper 11 on 540 West near Bell's Lake Road.
It happened just after 8 o'clock this morning.
telling us a Wake County school bus and an Acura.
We're traveling westbound on 540 when the Accura failed to reduce speed hitting the back of the school bus.
There were no students on the bus at the time of the crash.
Authorities have not released any details about injuries or possible charges being filed.
The State Health Department is reporting the first pediatric flu-related death this season.
We're learning a child in the western part of the state recently died,
and that brings the total number of deaths this season to 10.
There was also an increase in ER visits and hospital admission during the past week.
Health officials are urging everyone to get a flu shot to regularly wash your hands and stay home if you are sick.

A big donation to help with a growing hunger crisis across the state.
Today, the state employee's credit union gave a $500,000 grant to food banks across the state.
The milestone investment in the region's hunger relief network feeding the Carolinas.
comes as families seek additional support during the holiday season, and food banks struggle to match near unprecedented demand.
Some of the food banks benefiting from the grant are the Food Bank of Central and Eastern North Carolina,
the Interfaith Food Shuttle, and the Second Harvest Food Bank of Southeast North Carolina.

And Nick Reiner made his first court appearance in Los Angeles charged with killing his parents.
The request from his attorney today.
We're back now with breaking news just coming in,
the state health department reporting measles exposure in Wake County.
Authorities say a person traveled through Terminal 2 of Raleigh-Dermin International Airport last week.
While infected, health leaders say that the person is from another state.
They arrived at the terminal last Wednesday morning.
Officials say there is no health risk at the airport at this time.
However, anyone who was in Terminal 2 between 4 and 8 a.m. last Wednesday could have been exposed and should monitor for symptoms until January 1st.

And now at 4, there are now 150 new license examiners at the North Carolina DMV.
A special ceremony in Rocky Mount today celebrates the newest class of examiners to graduate from training.
The agency hopes it will help reduce long lines and wait times across the state.
Governor Stein attended the event to welcome the class.

The DMV says this boost in staffing could mean shorter lines, faster service, and a more efficient experience for residents, especially during peak times.
Officials say they plan to continue investing in training and hiring to keep up with demand and improve customer service statewide.
Well, Nick Reiner, the 32-year-old son of Hollywood director Rob Reiner and his wife, photographer.
Michelle Singer-Riner was in court today for a brief hearing related to the murder of his parents.
The hearing was short as his attorney, Alan Jackson, asked to delay the formal reading of charges against his client until early next year.
ABC's Tim Caputo has more on the court appearance and the investigation from Los Angeles.
Charged with the murder of his parents, Rob and Michelle Reiner, today Nick Reiner in a Los Angeles courtroom behind a glass partition.
The judge asked that the defendant not be shown on camera.
Reiner wore a suicide prevention smock and shackles, quiet and calm, speaking only briefly to the judge.
Do you waive your right to speeding arraignment to get your right on January 7, 2026?
Reiner's attorney asking the judge to delay arraignment.
Your Honor, if we could, I would like to ask for a continuance of the arraignment.
I want to get a plea at this judge here.
It's too early.
Reiner is charged with two counts of first-degree murder with special circumstances.
He did not enter a plea today.
These charges carry a maximum sentence of life in prison without the possibility of parole or the death penalty.
Reiner is being represented by defense attorney Alan Jackson, who famously defended Karen Reed, who is acquitted of murder.
Our hearts go out to the entire Reiner family.
There are very, very complex and serious issues that are associated with this case.
They need to be thoroughly, but very carefully.
dealt with. New video shows Ryan are inside a gas station and his arrest nearby just hours
after the murders. His parents' bodies were discovered in their Brentwood home by his sister on
Sunday and now the LAPD revealing exactly where those bodies were found. Both victims were
found in the master bedroom of the area of the home. Officers conducted a thorough search of the
residence to determine whether there were any additional victims or suspects and no one else
was located.
The Reiner's two other children, Jake and Romy, releasing a joint statement saying that they are
grateful for the outpouring of support and condolences, but that words can't even describe
the unimaginable loss that they are experiencing, saying they weren't just our parents,
they were our best friends.
Their brother Nick expected to be back in this courthouse on January 7th.

So it's going to be a busy weekend.
Let's talk about what to expect throughout throughout the last weekend.
what to expect throughout this upcoming weekend because many of you are going to be running around and trying to get those last minute gifts. So if we can get the weather graphics back, I'll show you what to expect throughout this weekend. Tipters will be in the 50s for Saturday. And then as we go into Sunday, we will be in the 60s. So it's dry even for outdoor plans. It's just Sunday's obviously going to be much warmer. Now before we can get to that nice weekend forecast, we've got some rain on the way. And this comes throughout the day tomorrow. So we've got a front that's going to be moving in late in the day and into early.
Friday, but even ahead of that, we'll have some showers coming in off the Atlantic.
So when that passes through, we're left with drier conditions into Friday outside of our
early morning shower.
It'll be breezy, but we'll be back to sunshine.
And that sunshine sticks around.
Once again, as we go into the start of this upcoming weekend.
So let's get into tonight's forecast.
You don't have to worry about the rain right now.
I would capitalize on that.
And if you have outdoor plans, just soak that in, soak in the dry weather.
Tipters will be a little milder than previous evenings in the 40s for most.
most of tonight. Now, first alert predictor, this shows that tonight we do go down into the 30s again, but it's going to stay above freezing finally. So we've had several cold nights throughout this week. By tomorrow morning, we're starting the day in the 30s. So chilly in the morning with some clouds around, those clouds stay put. And by the time we get into the midday, some of our western counties could be seeing that rain. Now, some of the latest data here from predictors showing that this could be a little later for that arrival. But as we go into the evening hours, that's when the rain becomes white.
So scattered showers expected through tomorrow evening and overnight.
Most of that will start to clear all as we get past midnight.
So one or two in that morning, that's when we start to see the heavier rain push east.
Then we're just left with a few isolated showers to start off the day on Friday.
So how much rain could we see here?
Well, most areas could get from a half inch to an inch.
Isolated higher amounts are possible,
but that's going to depend on where those heaviest rain bands set up in time.
So tonight, dry, no rain in this forecast, but lots of clouds.
lots of clouds that'll keep tipters in the 30s for tomorrow we will see tipter starting out pretty chilly and then we've got the showers for the second half of the day. So when you walk out the house tomorrow, make sure you've got an umbrella with you. Then the second half of the day, obviously looking very wet. High temperatures will top out around 60 degrees tomorrow. And that's not the only warm day that you're going to see in the seven day forecast. It'll stay warm as we go into early Friday. But tipters throughout the day on Friday are actually dropping throughout the day. So we should go back into the 50s for high Saturday.
Sunday, we're in the 60s, cooling down to start off next week, and then look at Christmas Eve, turning warm.
Heise will be in the 60s again, likely in the upper 50s for Christmas Day.

First, some cakes sold at Kroger stores are being recalled.
U-Crop's home-style foods is recalling four of its decorated pound cakes.
The company says that these cakes may contain undeclared soy, which can pose a potential
health threat for people with related allergies.
The cakes have buttercream icing and pink or red roses.
Customers can return them to the retailer for a full refund.
Mega millions officials are warning customers about a new fake lottery scam that's popping
up online.
They say scammers are using the mega million's logo to create a special drawing that does not actually exist.
They target victims by getting them to buy tickets for the fake drawing or even contacting victims to say they've already won a large prize.
The scammers then get money from the victims by getting them to hand over bank account numbers or personal information in order to receive that prize.
Officials say that no real lottery would ever ask you to put up your own money to claim a prize.
They also say to always go to the official lottery site to verify any drawings.
Durham's getting a new sandwich shop.
LRB Provisions is set to open tomorrow.
The shop is located along Guest Road, the former location of the doghouse, hot dog stand.
The counter service spot will focus on takeout lunch to start with hours from 11 a.m. to 3 p.m.
Thursday through Monday.
The name LRB Provisions pays tribute to LRB Creek, which winds through Durham neighborhoods.

Thank you. Well, now to the new ways to use customer service chatbots as holiday shopping enters the final stretch.
Many big retail companies use chatbots as the first level of customer service.
And tech experts say as the technology advances, more people are giving AI a chance.
ABC News spoke with the CEO of the company that provides AI agents for thousands of e-commerce sites.
The technology is moving very fast. It's literally getting better every single day.
and it learns more, the more that you use it.
At some point, it's not working if you're using Salesforce's system.
At any moment, you can always say, please escalate me to a human.
They just want to make sure you're happy.
Well, you shared some tips about how to use the chatbots.
First, whenever you talk to an AI agent,
make sure that you're logged in so that they have your history,
like if you have to send a product back.
Many bots these days can authorize a return or track your shipment
without ever escalating to an actual human being.
Many bots speak other languages.
So he says you could try your native language if that is more comfortable.
Usually just wind up screaming representatives.
Me too, pushing zero, zero.
Zero, zero.

It's aimed at finding ways to curb gun violence in the Bull City.

Happening now, an initiative is underway in Durham
where community members are addressing gun violence.
The three-phase violence reduction plan
is a joint effort between the city of Durham
and Durham County to build safer communities.
And Cindy Bay is joining us live.
She's at the Durham County Library,
public library, where phase one is kicking off.
Hi, Cindy.
Hi, guys.
Well, we just stepped out of the auditorium
here at the Durham Library,
where phase one just started half an hour ago and tonight is the first of a series of educational
sessions that are planned over the next three months. So tonight's speaker is from the University
of Maryland, the founding director of its violence reduction center. He will be highlighting how
data-driven community-centered interventions can reduce violence. For example, how it's worked in
places such as Milwaukee or Tennessee. Now leaders hope to apply some of that here in the Bull City.
Now we have an opportunity to get an actual framework, get local experts, people with lived experience, you know, people who have, you know, have different ideas to come together and see what we can do as accounting.
We still have a major issue in our community with violence, and so there really needs to be something done that's a collective and collaborative effort.
Now inside the auditorium, there are dozens of community members, some of whom we spoke with about
how the impact of gun violence has been in their community.
And so we'll have more from them on how they hope to come up with more practical solutions
to reduce gun violence ahead on eyewitness news at 530 in Durham.

The Manhunt is intensifying in Providence, Rhode Island, as investment.
Investigators combed through surveillance video that they believe shows the suspect in Saturday's mass shooting at Brown University that left two students dead.
And now police have a new image of a second individual they're trying to identify who they say was seen near the person of interest.
Christian Cordero has the latest now from Providence.
Today, a trail of digital evidence points to who officials believe is the suspect of Saturday's mass shooting on the campus of Brown University.
This man described as stocky and roughly five foot eight is seen around two people.

beloved students, just as final exams and winter break were on the horizon. I decided to move up my
departure because I preferred to be with family during this anxious time. Flowers are piling up on
campus with several of the victims still in the hospital. Campus officials are addressing
security concerns raised in recent days, saying like most college campuses, most buildings here at
Brown are accessible during daytime hours. A school spokesperson adds there are more than

Christian, thank you. Now to the Georgia man facing charges after allegedly shooting two
teenagers who he says tried to seal a package from his porch. Rakeem Bradford accused of shooting
a 15 and 16-year-old. Both teens are expected to survive.
Our investigation was determined that we believe a property crime was a
occurring that some packages were being taken off of a front porch, which is not in common
this time of year. And the homeowner did discharge his weapon to stop that. In this particular
case, this is not a reasonable use of force. Because in Georgia, although you are allowed to
protect your property, you are not allowed to use deadly force unless there is either someone
breaking into your home or there's a forcible felony that's about to be committed.
Bradford now facing two counts of aggravated assault.
Well, right now at four, the second doctor convicted in the fatal overdose of actor Matthew Perry will not face prison time.
A judge sentenced Mark Chavez to eight months of home detention, three years of supervised release, and 300 hours of community service after he admitted to illegally providing Perry with large amounts of the powerful anesthetic ketamine.
Prosecutors say Chavez, along with fellow Dr. Salvador Placencia,
took advantage of Perry's addiction issues to enrich themselves.
Salvador Placencia was sentenced earlier this month to two and a half years in prison.
The different roles between the two doctors is that one was considered the ringleader.
He solicited the patient being Matthew Perry.
On the other hand, Dr. Chavez was a supplier of the ketamine to Dr. Placencia.
He was not interacting with Matthew Perry.
Five defendants in the case have all pleaded guilty.

Weekday mornings on ABC 11, I Witness News.
In your health check, we are diving into the latest guidance on cervical cancer
screenings.
Earlier this month, the American Cancer Society updated its recommendations, and we're getting
a breakdown of the changes.
Today, Iwood's news spoke with Dr. Areth Kamal with the American Cancer Society
on a new acceptable form of screening that's available.
So both FDA approval and now our endorsement and our guidelines for what is called self-collection.
There are both technologies for doing self-collections.
This is women actually doing the brushing themselves, avoiding a pap smear or a pelvic exam, either in their home or in the office.
It's brand new technology so women should talk to their doctors about whether it's the right choice for them.
But certainly now something that's exciting because it gets another chance or opportunity or choice for women who may be a little hesitant to get a pap smear.
That's what we're really looking for is early changes consistent with cervical cancer.
So that's what we're screening for.
Anyone with the cervix is a risk for cervical cancer.
What's interesting is 99% of all cervical cancers are caused by a virus called the HPV virus.
So that's really what we're looking for.
So what we want to do is have every person with the cervix start at the age of 25 to have their HPV tested every three to five years through the age of 65.
Once they've had multiple negative tests, they can actually stop at the age of 65.
And Dr. Kamal says the HPV vaccine reduces the risk of cervical cancer mortality by two-thirds.

And that's evident here as we look through the next 10 days.
So if we look through the middle of next week, Wednesday, which you'll see in the forecast, that's Christmas Eve.
We should have highs in the low 60s.
It'll cool down just a little bit, but we should be at least in the upper 50s as we go into Christmas days.

working-class lives who wanted to be entertainers. And they just, it's this beautiful love story.
These two people found each other. They found some magic as performers. They never let go of
their dream. But somehow the two of them stuck by each other.
