Starting point is 00:05:50 She helps feed the other people that was housed there. Also, if you needed something, she was just a nice lady all around. Michelle's family released the following statement to eyewitness news saying,
Starting point is 00:06:22 This was a senseless crime that took the life of a woman deeply loved by so many. It has left another child without a mother, another family grieving, and another community forced to carry the weight of preventable violence. This has to stop. Just devastated, you know, I see a lot of people in the community all the time just walking their kids or walking their dogs. And, you know, this used to be a nice community, but now it seems like it's gotten a little out of hand. And ahead of five, I'll introduce you to a woman who says, says this shooting was the last straw for her. She's now planning to move. Reporting live in Durham,

The guard, Tova Noel, is believed to be the last person to have seen Epstein before his death. Epstein died by suicide according to an autopsy conducted by the New York medical examiner, though a series of missteps by prison officials have long-fueled, conspiracy theories about his death. And happening now, negotiations continue as a strike shuts down North America's largest commuter rail system. The Long Island Railroad stopped running Saturday after five unions representing half its workforce
Starting point is 00:10:34 walked off the job. The two sides are trying to come to a deal on a new contract. About a quarter of a million people use the transit system to commute to work, and concerns are growing about the strike extending into the busy Memorial Day weekend. A judge tosses out key evidence in the high. A high-profile murder trial of the man accused of gunning down a health care CEO will break down the details in the case against Luigi Mangione. And the CDC confirms at least one person has tested positive for Ebola how the U.S. is working to reduce the risk of the disease spreading. Only on ABC 11, I Witness News. Eyewitness News. We are local news weeknights four to six 30 and 11. Hi again, everyone. I'm Steve Daniels back live in the breaking news center with an update coming in from San Diego in that active shooter situation I told you about off the top of the hour at the Islamic Center in San Diego.
Starting point is 00:12:07 According to the San Diego Police Department, we now know that the threat has been neutralized. Those are their words. That generally means that the shooter has been shot and killed, has been neutralized, is no longer a threat there. Here's what we know. Just coming in, the threat neutralized, according to the San Diego Police Department. We do know at least one person is dead there. This is the largest mosque in that part of Southern California, the San Diego area. It is an Islamic center and a school. The scene active but contained, according to police. That was the last word we got in. This is in the Claremont Mesa section of San Diego, about nine miles north of the downtown area.
Starting point is 00:12:42 Still waiting to learn more about the one person who was killed, the person who has been neutralized, and exactly what led to this shoot. at about 2.40 p.m. Eastern time there at the Islamic Center of San Diego. More as we get it this hour here on eyewitnesses, Amber. All right, Steve, thank you. A critical decision today in Luigi Mangione's state murder trial and the killing of United Health Care CEO Brian Thompson. A judge ruling what certain key evidence prosecutors say was found in Mangione's backpack
Starting point is 00:13:09 that the jury will be allowed to see. ABC's Rainer Roy has the latest. A mixed decision on some key evidence for Luigi Mangione in his state murder case for allegedly killing United Health Care CEO Brian Thompson. I think the prosecution's a little bit happier with this ruling than maybe the defense. This morning, the judge ruling to suppress certain evidence that prosecutors say was found in Mangione's backpack, which was seized during an initial search at an Altoona, Pennsylvania McDonald's, moments before his arrest. The judge deciding a magazine, cell phone, passport, computer chip, and wallet should be suppressed.
Starting point is 00:13:46 The backpack was not within the immediate control or grabable. area of the defendant and further the people failed to demonstrate exigent circumstances. And we saw the video or the picture of Mangione at one table and a bag at another. And because of that separation in New York law, that means that those items are not coming in. But the alleged murder weapon and a notebook of Mangione's writings that prosecutors argue amounts to a confession will be allowed. Those were also in the backpack, but later seized at the Altoona police station. Those are all coming in because those are a proper search procedure. And those are probably the more damning piece of evidence for the prosecution. Defense attorneys arguing that evidence was obtained
Starting point is 00:14:24 illegally because police who confronted and arrested Mangione didn't immediately get a warrant. But prosecutors argue all evidence was collected lawfully. Mangione is accused of gunning down Thompson in December of 2024 on a Manhattan street. He has pleaded not guilty to all charges against him. Mangione is also facing federal charges. Back in January, a judge in that case issued a ruling saying the same evidence will be allowed in that trial. Rina Roy, ABC News, New York. New at four, the CDC confirms at least one American tested positive for Ebola.
Starting point is 00:15:00 This comes after the World Health Organization declared a global health emergency over the Ebola outbreak for some parts of Central America and Central Africa. The CDC says the person contracted the disease while working in the Democratic Republic of the Congo and is being moved now to Germany for treatment. The CDC says it is preparing to restrict entry for travelers from several countries in Africa to curb the risk. Right now, the risk in the U.S.
Starting point is 00:15:24 is low. The cruise ship at the center of that deadly hauntavirus outbreak is now in the Netherlands. The NV. Honduras arriving in Rotterdam overnight for disinfection. The ship spent the past six days sailing from the Canary Islands where the remaining passengers were escorted off the vessel. Now the 25 crew members on board will immediately head to quarantine. There have been 11 haunted virus cases during the outbreak and three passengers died on board the ship. It's got a meteorologist Steve Stewart and this afternoon it's almost like snap your fingers and it's hot summer. She was saying wasn't it chilly last week and now it's like hot. Yeah, here we go. Yeah and it's days of this. So this is you know a little bonafide mini
Starting point is 00:16:05 heat wave that we're dealing with so be careful hang on. Yeah it's gonna be with us for a little bit. A couple of fair weather clouds out there right now but even looks hot doesn't it. Yeah, we're in the mid 90s right now. I bet you those splash pads are going to be fairly popular over the next couple of days as the heat stays with us all the way through Wednesday. Front comes in on Thursday late in the day. Shows and some thunderstorms around. The front settles to our south. It'll be a little bit cooler with some showers on Friday. And then the thing is this weekend we could stay unsettled. There'll be moisture around. That front should lift back to the north as a warm front. It will likely be in the 80s. The warmth and the moisture we should get some scattered showers and thunderstorms in the afternoon and evenings. But it's not going to be all day and not every community is. going to get us. So for now we'll keep it in the chance category. The highest likelihood is when the front comes in on Thursday that we get rain. Meantime, here's a live look into North Hills, 96 degrees. Dewpoint is falling down. It mixed out a bit down to 61 so really no heat index out there and that southwest breeze is
Starting point is 00:17:03 actually welcome. Makes to feel a little bit better. Takes the edge off. 93 into Irwin, 92 into Fayetteville and Burlington and Southern Pines and Goldsboro, it's a popular number and 91 up in Oxford at this hour. Evening out if you're dining outside a little breezy, but the numbers come down mid-80s by 8 p.m. By the time we get to around 10 o'clock, we fall down to the 70s under clear skies. And once you get just past sunset, don't wait too long because you'll see the moon's going to go below the horizon. Little Crescent moon, you'll see Venus in the sky. And also just above that, you'll see Jupiter pretty easily in the night sky. Here comes the front. Now again, we're hot as we go into Wednesday, sea breeze showers.
Starting point is 00:17:40 We'll stay off to our south and east. Front's going to settle in. That'll help trigger some scattered showers some thunderstorms around and a lot of moisture in the mid levels of the atmosphere. That's all going to be pushed our way over the coming day. So that should likely keep us unsettled all the way through the holiday weekend. Now you look at the mountains. If you're heading up there this weekend, not a washout, even though it looks like it. There'll be hit or miss scattered showers and thunderstorms, decent probabilities every day. The beaches, those chances are going to be lower.
Starting point is 00:18:10 Again, if you're heading out there, don't cancel any plans. You might have, you know, 11 hours of gorgeous weather than an hour or two. A thunderstorm comes in, you have to head inside. But overall, these are 30, 40 percent chances at the beaches if you're heading out there for the holiday weekend. We're going to be in the 60s tonight. It is going to be a mild overnight, to say the least. And then tomorrow, we'll do it again. We're going to be in those mid-90s again flirting with records out at RDU.
Starting point is 00:18:35 First floor, seven-day, then, 94 on Wednesday, rinse and repeat, some late-day clouds. There could be a shower overnight. I've got storms developing on Thursday. Cains, that's your first game. There could be tailgating issues with that. And then isolated storms that a bit unsettled Saturday and Sunday. And temperatures staying in the 80s and likely the same as we go into our Memorial Day. Barbara?
Starting point is 00:18:57 All right. Thank you, Steve. Well, the iconic image of President's boarding Marine 1 from the White House South Vaughn might soon change. Just ahead, President Trump's next White House project. And a teen allegedly murdered by her stepbrother on a carnival cruise honored at her high school graduation. He is accused of sexually assaulting and killing Kepner during a family vacation. Her father recently took his daughter's place at graduation walking across the sage to accept her high school diploma. We waited for her name to be called. And I walked up and grabbed the diploma. My wife set up the senior table and it was great. A court hearing next week will determine whether Anna's stepbrother will be jailed while he awaits trial in September. The Supreme Court rejects a series of appeals from several of the nation's biggest drug makers who are looking to block Medicare negotiated price cuts.
Starting point is 00:20:29 The High Court denied the appeals without explanation. The pharmaceutical companies include AstraZeneca and Janssen. They've argued the program forces them to give their drugs to Medicare without just compensation. Lower courts have rejected that argument. Moving companies are noting companies are free to pull their products from government health programs. The program was enacted during the Biden administration. as part of the 2022 Inflation Reduction Act. More renovations are on the way for the White House.
Starting point is 00:20:55 According to the Washington Post, President Trump plans to add a helicopter landing pad on the South lawn in an effort to stop the new Marine One helicopters from scorching the grass. The Post is reporting it could happen as early as this summer. But people familiar with the project told the Washington Post, the plans could still change ahead of a formal announcement. The new helicopters known as the VH-92A Patriot have exhaust vents that direct heat towards the ground,
Starting point is 00:21:20 damage to the lawn likely. Trump's other renovations include a new ballroom, painting the reflecting pool, and a 250-foot-tall arch that's twice the size of the Lincoln Memorial. Starting point is 00:22:05 New here at 430. We're just hours away now from a public hearing in Cumberland County on a proposed moratorium on a massive data center. Canelope Lopez is in Hope Mills talking with some concerned residents ahead of the meeting. Local organizations across the county are mobilizing in favor of a moratorium. Their biggest concern, the impact on the environment. This is such a new industry that we don't really know what the long-term effects are. Lysit Rodriguez, founder of Community Advocacy Group Fayetteville Freedom for All, says leaders should think about how data centers could affect the community. Our rural communities are also being heavily impacted by the data centers.
Starting point is 00:22:45 If they do get that public input and the people say, no, we want very stringent, guard. to make it nearly impossible for them to come in. That's what we would like to see. Since PFAS contamination is already present in the county's water, she worries about the potential impact of the data center on the water supply. Who's going to pay to clean that up? And now we're going to introduce another industry that will potentially have a big impact. County board members will hear public feedback and decide whether to impose the moratorium
Starting point is 00:23:18 and for how long communities across the state, including wake, Chatham, Orange, and Harnet counties have imposed temporary data center bans while they conduct research. That's what some organizations are proposing could happen in Cumberland County as well. Residents like Carol Ollinger, who is on dialysis says she plans to use her voice to advocate for safeguards. We're in the position where let's get stuff up front. If they're going to come anyways, let's get the things that we need. And Lissetting Carols say they come prepared with a list of requirements, demands if a data center is a approved. Now coming up in the next hour, we'll hear more of Carol's story and her efforts.
Starting point is 00:23:57 Reporting in Cumberland County on Penelope Lopez, ABC 11. Eyewitness News. Now to a herring rescue in the North Carolina Mountains. Look at this. Prosecutors have charged Parker with eight counts of felony child abuse and disregard for life. One count for each bullet the child used. They say she ignored warning signs that could have helped prevent that attack. Parker has pleaded not guilty to all charges, and she faces 40 years in prison if convicted.
