This is ABC 11 eyewitness news. Here we go at 5 a.m. Good morning, Carolina. Welcome on this Monday. It is August 3rd. I'm Joel Brown. And I'm Anna Rivera. Thanks so much for joining us today. This morning on eyewitness news, hundreds waking up without power in Wake County. We'll show you what's causing the outage and how long before the lights are back on. water restrictions being lifted today in Raleigh, but another triangle city keeping its water conservation measures right where they are. And the man accused of killing UNC student faith Hedgepeth. What hearing is happening today and what it could mean for the upcoming trial?

All right. Let's get underway here at 5 o'clock. Time for a first check of weather. We'll do traffic as well. We'll do it all together. There's meteorologist Kualin Murphy. Look, here we go. First full week of August and if August can give as much as July give, that would be great. Well, we'll see. We're going to have rain and storms each day this week. We'll call it unsettled. Some days the rain potential will be better than others. Today, I think we back off on the coverage a little bit more. So I do expect a lot of dry time throughout the day today, but you will have some isolated to scattered showers and storms at times. You can see most of us are dry right now. There are some exiting showers around Roanoke Rapids. Another batch of rainfall here south in Robinson County. I think some of those could track into Cumberland County soon. But here's the bigger picture. We have a stationary boundary near the mountains. And that's That's going to help kick up more showers and storms pretty much through the week until that boundary starts to dissipate. So today the coverage again, you're going to see limited activity early. I think some of us will see some sunshine today. That could help hike our temperatures up closer to 90 in a few spots where we do see the sun.

Aside from that, we're going to be in the 80s for a good part of the day with some rain possible into early evening as well. Temperatures right now in the mid-70s around RDU. We do have 70s all around at this point. Clinton's 74, 73 Burlington. and it's very muggy too. So you'll notice the feel to the air. Winds from the southwest, a little breeze here around the triangle

with 10 to 15 mile per hour winds sustained right now. So upper 70s through 11 at noon today, we're at 81 degrees. And again, I think we'll have a lot of dry time through lunchtime today. Temperatures mid 80s by afternoon. 87 in Raleigh today, 88 in Fayetteville, Roxburgh up to 86 degrees.

We'll be back to the 70s by 9 tonight. And I'm still going to hold on to some scattered rain and maybe a few storms. later this evening through midweek. We're going to have a level one of four risk for some flash flooding. So downpours could lead to some ponding on the roads and maybe some minor issues around creeks and streams. We're going to see rain chances dropping off later this week and temperatures will respond in kind heading back up. We'll talk more about that in my full forecast. Right now our first check of weather and traffic together. Anna back to you. Quailan, lots of green on the map, which is good news to start your Monday morning because that means traffic is moving nicely. No crashes on the map either. Let's take a live look. outside on my way in when I was hopping on from 540 to 40. I did pass a crash. It looks like that has cleared and traffic is moving nicely. New this morning, hundreds waking up in the dark in Southern Way County, and here's why a large tree came down on the power lines near Graham Newton Road. Duke Energy says crews are working to have the lights back on by 8 this morning. And with a chance for storm and rain every day this week, now's a good time to download the ABC 11 mobile app.

All that rain we've had lately, including Sunday's storms, is paying off. Raleigh is lifting its stage one water restrictions today. But that's not the case everywhere. Durham's restrictor rules are still in effect. And Sean, joining us live now from Dix Park.

So, Sean, what does this actually mean for people at home? Yeah, good morning, Anna Angel. Well, in short, those personal stricter water restrictions that Raleigh homeowners have been forced to follow here for several weeks now are no longer in place. They can water as they like here on their lawns and their gardens here in Raleigh. But over in the Bull City,

they say that they are still in wait and seeing. mode. And while Falls Lake here, which is the primary drinking source for the city of Raleigh, is back to about 84% capacity with more rain in the forecast this week over in the Bull City, the rain has not been enough for leadership to lift their tougher stage two restrictions. And Mayor Leo Williams says for now, he's not taking any chances with that. We'd rather be safe than sorry. So it happens to do not change overnight. I was really surprised that so many people follow our protocols in the initial request by reducing the 12%. But we're going to have to continue our conservation practices while also just hoping to get more rain

and more water that we can put into our reserves. Mayor Leo says he does expect to get an update on drought conditions in Durham today, but he does not expect at this point those stricter measures to be lifted just yet, though. It is something that they will be watching over the course of the coming days and weeks here, as we do expect more rain. Those lifted restrictions here in Raleigh, those, though, those are in effect starting today. So as you wake up today as a Raleigh homeowner, you are able to, again, garden and water at Willguise. Sean, thank you for that update. And happening today, a judge could make several major decisions that shape the upcoming trial of the man accused of killing UNC student, Faith Hedgepeth. Tim or Scott explains what could be decided in this case. Good morning. Hey, good morning, Anna. Yeah, later today, a judge is expected to hear several motions that, could shape what evidence jurors will ultimately hear when the trial starts next month. So Miguel Enrique Salgarra Alvarez is charged with first degree murder, rape, sexual offense, and burglary in Hedgepath's 2012 death.

He will face a judge this morning. When today's hearing comes after more than a dozen motions were filed last month, prosecutors are asking the judge to keep certain evidence out of trial, including references to polygraph tests and faith hedgepats blood alcohol level. And a witness statement, they argue, was unreliable. The defense is pushing back on parts of the state's forensic evidence, including several DNA tests, they say produced inconclusive results. They're also asking for additional crime lab records and for answers about a blood sample that police record reports say that was collected, but later could not be located in the evidence system. Now, while the judge may not rule on every motion today, these decisions could help determine what evidence will be shown to jurors when the trial begins on September 28. And we will be inside the courtroom today.

We'll bring you all the latest details as they come. Back to you. Tamara, thank you. We are working to learn if human remains found in Cumberland County last week have been identified. The remains were discovered Thursday afternoon behind a home on Deep Creek Road near the intersection with Cade Hill Avenue.

Right now it's unclear if there's any connection between the home and the discovery of human remains. The case remains under investigation. The sheriff's office now asking anyone with related information called the crime stoppers tip line. In downtown Raleigh, It will now cost you more to park. Hourly parking rates going up over the weekend.

The impacts all city-owned, this impacts all city-owned parking locations from parking decks to street parking. It's the first increase in more than seven years. This morning, a major U.S. strike on Iran called off at the last minute. President Trump says he had a plan ready but pulled back after Gulf leaders from Saudi Arabia, Qatar, and the UAE urged him to give diplomacy more time. Trump says Saudi Prince Crown Prince Mohammed bin Salman made the case himself pushing for a deal, not more strikes. Now Trump says they've reached, quote, the perimeters of a deal, one that would reopen the Strait of Hormuz and address Iran's nuclear program. Talks are expected to pick back up soon.

We are counting down to the first day of school. Most traditional calendar schools start on Monday, August 24th. That's just 20 days away. And nonprofit Operation Homefront is helping military families in Fayetteville get prepared for the. first day of school. The organization handed out 400 backpacks filled with school supplies this weekend. It's part of the annual Back to School Brigade. And eyewitness news is your back to school headquarters. If you have an early tea time, I think you'll be okay today. Later today, chance for showers and storm.

I think we'll see some rain and storms later today at times. Tracking some light-to-modern rainfall around area south of Fayetteville. Right now there's a stationary boundary that keeps the rain in the forecast through the week. Today where there could be some locally heavy rainfall that could lead to some ponding on the roads. So maybe some minor street flooding, but I do think today in general, there will be a lot of dry time.

Temperatures at 8 o'clock, still around the 70s, mid-70s. And then by lunchtime today, we're into those low 80s with highs, mid-to-upper 80s, close to 90 potentially for spots that see a little bit more sunshine by the afternoon. Still low 80s at 8 o'clock this evening. Muggy conditions are here to stay. We'll be back to the 70s at 9 tonight. Statewide today, a chance for showers and storms. So no matter if you're heading to the mountains or to the coast, expect 80s. on temperatures with showers and storms and pretty much the same deal tomorrow.

One of the cooler locations will be around boom with temps in the 70s. Up and down the eastern seaboard tracking that chance for some flash flooding concerns and some stronger storms too. There could be some severe storms around the New York City area and the northeast. Also out in the plain states as well. Big fire danger concerns persist for areas around the Rockies and back to the west. 86 in Tampa today with showers and storms. Miami near 90, 84 in Atlanta, New York City.

to 84, Pittsburgh 80 with dry conditions. Dallas and Oklahoma City still tracking triple digit highs today around 100 degrees. Same for Denver, San Antonio, 99 degrees. You can see the week looks rather wet in terms of daily shower and storm chances, but some days will be wetter than others. We'll talk more about that, my 70 forecast.

Quay, Lindsay, you soon now to those devastating wildfires that have destroyed hundreds of homes and businesses in Spokane, Washington forcing more than 60,000 people from their homes. New video from the fire zone shows what's left piles of ash and debris where homes once stood. Authorities call it the worst natural disaster the region's ever seen, more than 7,000 acres burning. Crews are pouring in from across the country and as far away as Australia.

Now to the Bahamas where a seaplane full of American tourists crashed into a dock. You can see here the plane's nose nearly submerged as passengers carefully climbed out and helped onto a rescue boat. Authorities say the small sea plane with eight passengers and two crew members went down in the waters near a resort in North Bimini. The pilot was attempting to take off but diverted to avoid other boat traffic causing it to crash into the dock. All of the people on the boat were rescued. 514 is the time on your Monday and new details on that deadly shooting rampage at an in-and-out restaurant in Idaho. What we're learning about the man being hailed as a hero for opening fire on the suspect. And a bitter family feud spilling out on kids.

Capitol Hill days before a crucial election deadline. We are local news. ABC 11 eyewitness news continues now. Time now 517 and we're learning more about the deadly shooting at an in-and-out burger in Twin Falls, Idaho. Police now crediting a bystander for confronting the gunman. Video shows 35-year-old Jordan Salinas returning fire during the rampage. An off-duty state trooper also opened fire. The shooter, 24-year-old Chad Williams, killed three. injured seven and then turned the gun on himself. A motive is still unknown.

Now to the congressional campaign in Ohio rocked by domestic abuse allegations. Republican Representative Max Miller is facing growing calls to end his reelection campaign. His former father-in-law, Senator Bernie Moreno, says he's not fit for office. Here's ABC's Alex Preciay. A bitter family feud spilling out on Capitol Hill

just days before a crucial election deadline. Sorry about the technical difficulties, everyone. It's our first time doing a live stream. Ohio Republican Max Miller, facing mounting pressure to drop his congressional re-election campaign, is fiercely defending himself from domestic abuse allegations in a bitter custody battle with his ex-wife, Emily Moreno, the daughter of Republican Senator from Ohio, Bernie Moreno. In police reports obtained by ABC News, Miller's ex-wife accused him of throwing her against a wall, holding a gun to her head, and scalding her with hot water.

Miller denies all allegations. My former wife is engaging in a pattern of reporting incredible, serious, and destructive allegations with absolutely no evidence. Senator Moreno posting, if there are any basic standards of character required to hold elected office, Max Miller fails them. I believe Max Miller needs to seek professional help. Miller firing back, you know this isn't true and the only reason you are speaking out now is to hide from your own media circus.

The congressman who was endorsed by President Trump says he will remain in the race for re-election before a Wednesday deadline to replace him. The key word there is allegation. We have a process here. The House Ethics Committee works on those things. If allegations are made, they work through a process. That was ABC's Alex Preciay reporting. The timing of this war of words is setting off a debate for Republicans. Democrats are eyeing Miller's seat as a possible target. He won that district two years ago with just over 51 percent of the vote. All right, back here at home, we are talking about the weather and we are getting August underway in a lot better position than we were a month ago. Yeah.

We've got some good chances for more rain this week. Some good chances for rain, some rain locally heavy. Just a matter of where you pick up the rainfall, where that rain falls, that will be beneficial for those localized areas. This morning, most of us are dry. There are some rain and storms over Robinson County this morning. Locally heavy, I checked out some of those totals, generally around one half of an inch or less. So there's slow movers. Once they move to the north and east, I think they work into Cumberland County, probably in here in the next 45 minutes or so. We'll keep eyeing that this morning. Temperatures will be certainly down below average for a good part of the week because of the rain and storm potential. Today we're topping out in the lower to middle 80s. Tomorrow a little bit cooler because we're going to have more showers and storms around. But by the end of the week, we get back to 90 degrees. That'll take us pretty much through the weekend. There will be a chance for locally heavy rain today and tomorrow Wednesday starting to be. back off a little bit more as the upper level support sort of wanes at that point.

So we'll be tracking that through the start of the week. Here's a live look downtown. Low clouds temps in the 70s. It's really warm muggy too. We do have some fog out there. It's mainly west of the triangle right now. So those mid 70s through 9, 81 at noon, and I'll hold on to an isolated shower or storm chance through early afternoon.

But overall, a lot of dry time through lunchtime. Scattered storm chances up around 3, 4 o'clock through the early commute. And then I think rather dry for most of us through. the overnight hour. So here is all the moisture being pulled in from the Gulf South and the Atlantic stationary boundary to our west right around the mountains. So that will help trigger some showers and storms. There's some upper level support around too. This is noon today, temps in the mid to upper 80s. By then, some spots get close to 90 if we see a bit more sunshine with those drier conditions. Overnight, I think we'll see maybe a spotty shower, mainly triangle north. Tomorrow morning starts

dry with a few showers to the south. But notice how late morning, early afternoon, coverage starts to increase. So I think Tuesday is going to be one of our wetter days this week. And as I mentioned, as a result, temperatures, 70s and 80s. Wednesday, we're tracking just some spotty rain in the morning and maybe a few pop-up showers in the afternoon. But overall, we're trending drier later in the week. Your weekend, not completely dry, but the ring chances down to around 30 to 40% by then. Through the next five days, rain totals about one half up to an inch and a half possible. And the tropics, all good here in next seven days, no development expected. So 87 today, Variably cloudy. A few showers in storm, 73 degrees tonight.

Here's your first alert. 70 forecast powered by ACU weather. Cooler tomorrow with more showers and storms. They're rinse and repeat on Wednesday. Thursday we're climbing closer to 90 degrees, 90 Friday and Saturday with a stray storm possible into the weekend. Weather and traffic together, Anna, back to you. not political retaliation. Here's ABC's Hannah Battah with this morning's 10. In today's Techbytes, Capital One says it closed Trump organization accounts over money laundering concerns. The revelation came as the bank asked a judge to dismiss a lawsuit from the company over those 2021 closures. Capital One is not publicly accused the Trump Organization of illegal money laundering. Next, President Trump's social media company is selling early access to his, quote, most market moving posts. Firms can pay up to $100,000 a month to see them before everybody else. Democrats want the SEC to investigate, either that's legal.

Google has pulled a new AI tool from Google Earth. Just one day after launching it, it lets users generate realistic fake satellite images of any place on Earth.
