Kevin, I just had a listener who was mentioning, you know,
given the fact that you recognize the lack of fight in the opposition party here in Democrat
controlled Oregon. He was raising the issue. Why don't you run for governor? And that way you can bring
your pro-gun status into the ticket, too. I'll ask you. Okay. I'll ask the question for him, okay?
Let me count the reasons. Okay. I mean, first of all, I'm not going to win for governor,
obviously. Second of all, I really don't believe that you can be nearly as effective becoming
part of the machine, all right? This has to be a group effort. I'm not that person, not interested in that job.
I'm an activist. So it's never been in my cards. I don't believe that you have to be a alleged,
look, I mean, this is, you know, I've spoken to many people who are running for office, and many of whom are in office.
And I said, this is what you're going to face when you get there. And they always downplayed it.
No, it's going to be fine. And look what happens.
to James Heath. Look what happened to Mike Neerman. Okay. You know, and so no, I'm not interested in
holding political office and I, you know, wouldn't win anyway for obvious reasons, but thanks for
asking. Okay. Well, that's kind of what I figured you would say, but at least I would pose that there.
The other issue, I think this is also why the former trailblazer candidate who came closer than any
other Republican to winning the governorship, I have a feeling that's why he's been kind of holding
his fire and not moving forward with the candidacy so far. I think he's kind of calculating this too
right now. Yeah, I have no idea what his plans are. Obviously, he's been speaking a lot. It would be
nice to see him get in the race. It would be nice to see a man running for governor, you know,
but, you know, that's going to be up to Chris. All right. Now, one thing I did want to ask you about
before we take off is that there was a law passed in the state legislature last year,
which appeared to put a date of implementation.
in for Measure 114, the massive gun denial business, which is essentially make it very difficult
to purchase firearms here, if not impossible to do so. And I recall something about March or April
was one of the dimension here. And is that happening? And other people were writing me saying,
does it overcome the lawsuits that are going on right now? Could you tell us what is actually
on the deal? I can tell you what it is. And a lot of people have misconduct.
understood that law. And people have to understand there's a very strong possibility that very soon
it will be unlawful for them to purchase a firearm. And as Oregon becomes more and more dangerous,
that should be a consideration. But what the bill did essentially said, according to Fagan,
our pot-dealing former Secretary of State, she was going to start enforcing that law from the
moment she believed it passed. So even though it was not in effect, if you had purchased a
standard capacity magazine, she would hold you accountable and arrest you.
if you bought or sold one. What this measure said was no, those, the restrictions created by
Measure 114, if it's approved by the courts, do not go into effect until March of 2026. I don't know
why they pick that date. I guess they're assuming that they'll have a decision by then, but it's still
dependent on what the court decides. So if lightning were to strike, which it's not going to happen,
and the court says, yes, this unconstitutional measure is unconstitutional, everybody's still safe.
If they say that it is constitutional, that's the date they want to start arresting people for buying or selling magazines.
So if you bought or sold one prior to that, you wouldn't be considered a criminal.
But you're still saying that if you were looking to get a firearm to be able to defend yourself,
it might be better to get it sooner rather than later looking at what he could be staring down the barrel of, no pun intended.
I can't imagine why anyone would see a downside in that. What if we're lucky and common sense prevails,
which is almost out of the question in the Oregon courts? That would be perfect. You haven't lost anything.
But if you continue to wait and what we're anticipating happens, happens. And as Oregon becomes increasingly dangerous,
now you're really in a bad position.
All right. See, that's what I thought of when I'm looking at what's happening with the Iranians right now, is that they've been effectively disarmed by their government for quite some time, and they're fighting back, and they're not fighting back nearly as effectively as let's say Americans could because of not being allowed to own personal firearms. And, of course, they're getting mowed down by government forces right now as we speak.
Exactly. And of course, in Oregon, where our politicians are protecting dangerous gang members, even if we don't have tanks in the street, you are facing a major criminal problem, and the people in charge are determined to make sure that you cannot protect yourself. So something to keep in mind.

You're still an attorney in private practice today, aren't you, John?
Welcome back.
Sure, sure, Bill.
Yes, I am.
All right, just have to ask you, since you are an attorney,
you're still keeping track of the courts and such.
Did you happen to read anything about that transgender arguments yesterday before
Scotis?
Did anything strike you about that?
He's curious before we move on.
Well, I think basically,
I think the law can be upheld.
Remember, the tie goes to the runner in something like this.
The state legislatures have, in my view, appropriately,
but that's not, I'm not really of concern here to the justices,
but have appropriately said that transgender athletes essentially can't compete in men's,
in women's sports.
And so the real question is, is, I mean,
the petitioners have a burden here of showing that there's something wrong with that.
You know, however you say it, you can call it sex discrimination. There's some weird cases
where one court called that sex discrimination when you're talking about transgender and
people and so forth and so on. But in my view, this is something that is going to be fairly
easy for the majority of the Supreme Court. I think this is a six-three decision at the least.
You do, huh?
And, yeah, yeah, I think the statutes will be upheld,
and the lower court decisions overturning the statutes will be reversed.
This will be interesting because we'll probably see a patchwork of laws
that in Oregon, I would imagine they would do everything possible
to defend dudes and dresses in female locker rooms.
That seems to be something our state legislature loves for whatever reason,
because, well, we have communists in charge, you know, up north.
That's right.
And that's a more difficult case, Bill.
That's a more difficult case.
Let's say Oregon says males to biological males can compete in women's sports.
You know, if I'm a woman, I'm going to say Title IX, this really violates Title IX.
This is really a dude over here in the locker room, you know, and not to get too technical,
but these guys, I think they still have their original equipage who original.
OEM features.
I love that, John.
OEM features.
I'm going to remember that as the original equipment manufacturers.
But the thing is, even if they have the OEM equipment removed, that doesn't change them genetically,
their bones don't shrink.
Everything doesn't change to a female just because a dude says he's a woman.
It just doesn't do that.
It doesn't work that way.
Well, right.
Think about all the Olympic sports where somebody has been disqualified for taking
testosterone because it's considered that that's, oh, that's not fair. Well, if you're a male for 18 years
or for 12 years or 14 years, you've had testosterone more than the female has. And so that's,
that's an issue right there. So I think it has a basis. Now, the issue is, though, when you
have that, I think that's a tougher case. I still think it's probably violated Title IX and or the
equal right protection of the women who are playing to have to play against a male. But that's a
tougher case. If the state comes out with its own state policy, you have this problem with
federal law versus state law and so forth, or at least shouldn't the states have their own
right to do their own things. They're supposed to be laboratories of democracy. That's a tougher
case. And that's the one that I think is the most interesting to me, because I think,
I think, if I were a judge, I would turn down, reject those statutes as being unconstitutional that allowed men to compete against women.
I would agree with you on that, too.
You know, when you talk about laboratories of democracy, I don't think laboratories of democracy include states that essentially want to forbid ICE and get in the way of ICE enforcing federal immigration law.
Would you agree on that?
Because aren't states like Oregon and Minnesota and others essentially in open rebellion in some sorts or another?
I don't know if I –
Well, yeah.
Well, yes, I would say, look, that we have a supremacy clause in the United States Constitution.
Federal law is supreme.
And it is absurd to say that the states can stop the federal government from enforcing federal laws.
I mean, that's sort of what we had in this time of desegregation.
That's why when James Meredith went to the university, Dwight Eisenhower sent troops to protect him.
The whole idea is this is federal law.
This is a federal decision by the Supreme Court that you can't discriminate.
And so we're going to enforce this federally.
And you, the states have no business stopping the enforcement of federal law in that case a constitutional decision.
So there is really, I think, sort of a disease, the idea that if you don't like a law, you can decide to obstruct it.
You can decide to do that.
So now these are the same folks that say, oh, look at that, somebody actually protested on January 6th protest of the election.
That's terrible.
That's terrible.
even trespassed across this line and went into the building. That's terrible. Well, okay. I mean,
I do think it's wrong to trespass. I'm not so sure the government didn't overcharge and overreact
to that. But nonetheless, I'm on board. I'm a conservative person. I'm on board that we need to
obey the laws and these things. But that goes for people who are now trying to stop a legitimate
government function of arresting bad guys? I mean, that's really, I'll tell you this. I mean,
I'm, I prosecuted obstruction of justice statutes as a federal prosecutor. This is obstruction
of justice. You are hindering the enforcement laws, even if you're out there and trying to
put your car in the way of ice or do other things that make their job more difficult. I think
you're obstructing justice. You're certainly.
aiding in the
helping a felon
resist apprehension.
I mean, there are several laws that you can go through here
and you can say, well, I think this is
it's wrong for this reason,
that reason and this reason. There are a lot of laws that apply
whenever you're obstructing a federal officer.
And think about that.
Think about, you know, can you help Al Capone
escape, you know, prosecution for illegal liquor sales.
So you can have all this talk about, like in Minneapolis.
Oh, we're gathering around in the neighborhoods.
We're protecting our residents from these ICE officers.
It doesn't matter.
You are obstructing justice in that process is what you're doing.
Federal law.
Well, that's right.
Federal enforcement, right.
That's right.
You're obstructing justices, and maybe the better when obstructing justice is usually
thought of as lying or preventing evidence. And so to a certain extent, they are preventing the
collection of evidence, but you're also obstructing an arrest. And so that's, you're actually
helping a felon. And there are several statutes on that. But you cannot do that. You cannot,
in any way, harbor or assist the fugitive. I prosecuted those cases back when we had
a terrorist out there, people, and there were people that were looking for, the federal government
was looking for, you'd do anything to help that fugitive from justice, and you can be convicted.
There was one case in Arizona when I was prosecuting cases in California where some poor guy,
a young lawyer on an Indian reservation, met with a fugitive for 10 minutes and gave him some advice.
And that guy was convicted of harboring a fugitive by giving him just.
system, just a modicum of assistance. So certainly blocking the roads around ICE agents and stopping them from doing their job is just as serious, if not more so.
All right, John, hey, I appreciate that. I want to make sure and touch on another piece of news that has been bubbling through the system.
And that has to do with the Federal Reserve Chair, Jerome Powell, under criminal investigation.
It's over the renovation of the Federal Reserve. And, of course, Federal Reserve is the Central Bank of the United States.
Right. And it's interesting how the tongues have been wagging, and my first initial reaction was, oh, okay.
President Trump wants Powell out because Powell is not as money printing happy as President Trump would like.
He would like cheaper interest rates, okay? It's what he's all looking for. And then magically, here comes an investigation.
But what are the actual facts of the matter on the ground here legally?
Yeah, I don't think they're very good. You know, there was some going back and forth. He was sparring
on the stand with Tim Scott
over renovation plans.
Gee, you're doing this like Versailles.
You're having a rooftop garden.
You're going to have a separate elevator.
You're going to have a VIP dining room.
You're going to have a water feature in the gardens,
on the rooftop gardens.
And then so one of the things he's,
so some of that is what he denied
was being in the plans.
And it was very general testimony.
No, no, we're not doing that anymore.
We're going to, we've taken a lot of that out.
It was very, very nonspecific stuff about what was going on with the plans.
And Powell let it be known that they were changing rapidly.
The plans were.
So to try to get him on a criminal charge for that, for his state of mind as to what he was thinking was in those plans and what was going to happen, his way off.
there was one statement when he said that there had been no major renovations of the Federal Reserve Building for a number of years,
and there had been one between 1999 and 2003, and that's one of the ones Representative Luna said, oh, that's a lie.
Well, I mean, first of all, what's major?
When you say major renovation, what's major?
Number one, and number two, he might not even known about it.
Powell might not even known about it.
It's one of those things that a prosecutor is going to look at and say,
no way am I going to get a conviction on this.
But here's my fear.
There's just substantively he's pressuring Powell and so forth and so on.
I would love it if there was some easy way to get good interest rates and cheap mortgages and everything.
The irony of this is, and now I'm going to put on my hat as a world-renowned economist,
it did take one economics class in college.
But I think that if you have cheap money presently, and the overnight rate is down, the real question is, what does that do to the 10-year Fed rate, the 10-year bond rate, on which mortgage rates are pegged?
And actually, if he is too loose, Powell is too loose with present-day interest rates, a smart person that the price of that 10-year bond is going to go up.
there people are going to say oh that's an inflationary move i better protect against inflation
by and that that that bond is now going to be have have a higher rate and so what you what you
think you're going to fix by cheaper money could be hurting in the uh in the longer bond market right
that's what you're getting right that's okay and other that's Biden's mistake Biden didn't want
pal to come in and and you know when Biden was being inflationary all the place of the r a IRA all
these inflationary policies. He also pressured the fund originally, the Fed originally with
Yellen and then with Powell to say, oh, no, this is just transitory inflation. We don't need to
take efforts to keep inflation down. Well, what did that do? That sparked runaway inflation.
So actually, Trump, in a sense, is pushing Powell to make the same mistake, with obviously with a
lesser, less obvious inflationary pressures.
But ultimately, though, you're...
Yeah, but you're looking at this investigation is probably thin gruel overall,
from you're looking at the facts of the case, thin gruel?
Oh, yeah, it's an unstarter.
You're never going to get an indictment out of the Powell thing.
I just think it's even the pressure on him is not necessarily good.
And furthermore, he may pressure Powell, such that Powell, his term as a chairman, is up
very soon, but his term as a governor a last two more years. So just by doing this, Pal may just
dig in his heels and say, okay, normally a chairman resigns his governorship when he resigns
his chairmanship. I'm going to stay on and see how you like it, big boy. Oh, that would be
interesting. That would be interesting. All right. So maybe what the president should concentrate on
is using the DOJ to go after the people obstructing ICE and get some obstruction charges out there. That
they can do, and that's probably going to be a dead bang win, I would think, legally, wouldn't you?
Well, it should be, but remember, then you got these nasty things, people called jurors.
Oh.
It may not like it.
You know, so, so basically the defense is going to be, oh, no, I wasn't obstructing.
I was just trying to document what these folks were doing, and I'm collecting evidence.
Yeah.
And I really wasn't obstructing.
I was trying to help.
Yeah, I wasn't. I was just trying to help. Yeah, yeah, that's the ticket. I'm thinking of that old Saturday Night Live character, the liar, you know, the John Lovitz character, back when I was a kid.
That's exactly it.
Yeah.
All of them are John Lovett.
And, you know, so I think it's going to be tough, but do I think they're committing crimes?
Yes.
Do I think it's wise to prosecute?
Oh, no, it's just going to be another forum for a demonstration.
So these are some pretty nasty folks out there.
And the interesting thing is, is they're all female.
I don't know what that has to do with the price of tea in China, but it seems to be the case.
But it is very nasty.
what's happening, and I wish, my own wish is that Christy Noem and President Trump would talk more
about who it is that they're zeroing in on. And if people understand that they're getting
true felons here, including people who have abused the system, now there's some people out
there that have had removal orders and then they're, you know, then they're out there running
around, well, those people should be apprehended, you know, whereas so much, so much,
many illegal immigrants don't have removal orders. They're here. Many of them have been here for 15 years.
There's no removal order. They haven't committed a crime. Those should be, in my view, at the end of the
pact. Let's get the people that, first of all, have a criminal record. There's no doubt about that.
We've got to get rid of those people. And as long as I think the citizens feel that there's some
sense about this, I'd like to see a guest worker program for the people who are good people,
are working in the fields and so forth and so on, working at hotels and have been good citizens
and paying their taxes.
There should be something like that.
But in the meantime, I think politically, it's going to hurt Trump if it looks like he's indiscriminately
going after anybody that might be here illegally.
And that's not a good look.
And I know what I'm saying here can be controversial in some...
Well, no, you're talking about the optics in the optics matter here.
And so I appreciate your honest and clear-eyed view of the situation, John.

What were there reasons for being so offended by that idea?
I don't know.
It's like, why do some people like, what are those shoes?

Here's my feelings on it, Bill.
You know, your listeners, your hardcore true blue listeners, you know, we're kind of a community of similarly thinking people, not identical,
but similar.
And we have, some of us have very similar lifestyles.
We like similar things in terms of vehicles and tools and things like that, you know.
And I think it would really be nice to be able to connect with each other on these things.
Like, you know, somebody might have just the perfect thing that another one of us has been
wishing we could find for years.

Give me your elevator pitch.
Someone says, what do you do, Danny?
You're one stop for all your excavation, rock needs, septic systems.

Can you do this?
And how many years you've been doing it?
I've been in it since about 2004.
We started left coast underground about nine years ago.
What made you want to get into it?
Just curious.
I loved it from the day we started, the day I started, the day I
I learned how the project went about, fell in love with it, never looked back.
Yeah.
Did you play with Tonka trucks and digging things when you were kids?
I sure did.
I had a feeling you did.
I sure did. I loved it, too.
Almost every boy that I knew that did that kind of stuff grew up and ended up being in the
trades, the construction trades in one way or the other.
Well, I think what's really important about what you do is that to everything there is a season, right?
And I did not realize until getting notes about what you do at left coast underground LLC is that there is a season for repairing and replacing or upgrading septic systems.
And that is what time of year?
Well, generally, it's kind of a double-edged sword.
Generally, your septic systems are going to fail in your wet months.
You know, holidays, people coming over.
Yeah.
Your septics are getting overloaded.
Your soils are wet.
But when we start the process, generally it's June 1st to October 1st is our window of putting in the new septic systems.
Okay.
And so right now, this is the time to get things analyzed.
And if you think you have a problem, this is the time to sort of get on your calendar, wouldn't you say?
Right.
Absolutely.
Yes.
You're going to start seeing signs of it.
You're going to give us a call.
I'm going to come out there and start inspecting.
It may be just a simple plug, maybe a failed tank.
There's numerous things that it could be.
It's not always a complete septic system.
We do specialize in the Norweco green septic systems.
We are the Southern Oregon distributor for those.
When you say Norweco green, is that just because it's the color of the tank or something else?
It's green.
So what it does is it's a whole lot different than anything that we're used to.
It air rates, has airation chambers and filter chambers.
So a lot of people talk about like your gray water that comes out of your travel trailer or your camp trailer.
This is very similar to that that's coming out of your septic system into the ground now.
And the idea of aerating it is that it's more effective or a better septic tank, better septic system than what you may have installed or they may have installed 40, 50 years ago.
Correct.
Correct.
You're introducing air in there and you're just helping things grow.
the more bacteria and microns and all of those things that are in your septic system growing,
the more we can feed them, the more that they're going to exist,
and that's going to help your septic system dispose of all of your disposal.
Okay, all right.
Well, the whole idea is to do this and have it work.
And you really want to stay off the DEQ radar, too.
Isn't that part of it about making sure your septic system's working really well?
Absolutely.
Yep.
Once you're on the radar, you're on it until we're done.

So you specialize in septic systems, repairing and diagnosing all that sort of good stuff.
But you do all types of excavation.
What sort of dirt movement do you do?
We've got the dump trucks and the bulldozers and the big excavators and all the talk of toys that you were referring to earlier.
They're just a little bit more expensive these days.

Well, but I was talking with Danny about this because I have an old, I mean, this has been an old splash swimming pool, small swimming pool.
It's been on my property now for ever since we moved in.
and it's just been bugging me because it leaked from the moment we moved into the house,
so I stopped using it.
So I wanted to get that filled in, so you could fill in.
You could do that kind of work, right?
Absolutely.
Yeah, we've done quite a few of those.
You'll buy a new house and have an in-ground pool,
and the cost of fixing it, maintaining it.
It's just more than you can handle.
So a lot of times we'll turn that into a greenhouse or something along those lines.
Okay.
Now, this is something I just got an email from this morning.
an email from the DEQ.
I think it was the DEQ, or it was maybe the locating service, the 811 people.
And they said that the locating rules have changed, and that they've only reduced those from 45 to 30 days.
And how does that affect a business like yours now?
I guess when you make a call and say, okay, don't dig here because the fiber optic cable for Hunter.
Right, right.
Or something like that.
Well, typically when we're bidding these jobs, we'll call.
the 8-1-1, just like a typical homeowner, we'll call the 8-1-1, and we have two full business days
for them to locate all of your underground utilities, and then it's our job to get the job done,
and those stay in the ground when we're done. Okay. Yeah, you don't want to be that guy, right? Nobody wants
to be that guy. Nobody wants to be that guy. Now, it happens from time to time. That's for sure.
When you're standing on the ground, you never know what's under you until you open it up.
All right. Now, back onto the septic tank deal, since that is your specialty, and once again,
it's Norweco.

So you were the authorized dealer around here of the green here.
Replacing a septic field is expensive work.
I mean, that is big work.
Is there a way you help them out on, whether it's financing or some way to make that
sensibly?
Yes, sir.
So what we've done is we've partnered up with a company called Craft 3, and what Craft 3
will do is they will work a private loan with the homeowner.
Nine times out of 10, these homeowners don't have the funds to cover a big job like this.
So they'll get with Norweco.
Norweco will pay us direct.
We will install the system, and then the homeowner will pay back very small payments to craft three.
So they can get the system in, and the huge tax breaks at the end of the year are amazing.
Oh, you can get a tax break on that?
Absolutely.
Going green, yes.

And once again, you want to call them at 541-6-2-50-20 because you may not need the
entire septic field replaced. Maybe it's just some pipe, some broken piping, maybe something needs to be
done in the drain field. Right. It could be something. Could be something very small. We went out on a job
just last week, and they had a bid for thousands of dollar repair. And in a matter of about 15 minutes,
we had it solved. And within the hour, it was repaired. They were back going, and I think it was
under $500. So we just need to get out there and assess the situation. And a lot of times,
It could be a very, very easy fix.

What is the best tip you would give someone that actually has a septic system to keep it from, well, going bad sooner?
Don't be dump any of your over-the-counter cleaners that kill everything, kill all the bacteria,
kill all your organisms that are growing in your septic system.
You would think that sounds great, but really you want those things in there.
the best thing that you could dump in your septic system is yeast to help those grow.
Really?
Yes, sir.
For the digesting of the solids and all the unmentionals that we don't want to see.
Absolutely, yes, sir.
We don't want to see those.
