Joining me from the Freedom Foundation, she's the Litigation Council, Rebecca Schulteis.
And I want to talk a little bit about what the Freedom Foundation is first here.
Welcome to the show, Rebecca. Good to have you on.
Thank you so much for having me.
Could you tell us a little bit about the Freedom Foundation and what it's all about? Because
your group is putting a brief together and sending it to the United States Supreme Court. It has to
do with some worker rights. But is worker rights what you mostly focus on? What else is going on
here? Please. Yeah, thanks for asking. Freedom Foundation is a public interest nonprofit organization and we are dedicated to limited
governments, individual freedom, and really importantly, accountable government.
Boy, you must be very lonely.
I'm sorry.
I'm just having fun with you.
No, you know, we stay really busy. A lot of people are concerned about these issues and rightly so.
But yeah, our main focus is on public sector labor unions. So there's a lot of things that
are unique here in Oregon, Washington, state and California that basically, when I say unique, we have unique laws that allow
public sector unions to have immense power in our states.
And this is even after the Janus decision, which supposedly, you know, cut back the ability of a
union to be able to force you to join it, even now that's still happening?
Yes, yes. It is. And one of the things we do, one of the primary things we do
outside of our legal efforts,
is we just let people know that they have the right
to leave their union.
Because surprisingly, well maybe not surprisingly,
public sector unions aren't telling people that.
So if you didn't happen to be paying attention
to the Supreme Court,
you might not realize you don't have to pay anymore.
But the thing that's disturbing
and that actually relates to this particular brief that we're talking about today
is even if you don't have to pay membership dues to a union, you still have to be represented by a labor union.
If you're in a collective bargaining unit that's been defined under Oregon law, which pretty much every public sector employee is at this point.
So even though you're not necessarily paying them money, they still represent you. You still have to go to them for
anything you need with regard to the contract, your labor, you know, labor
rights, the wages hours, working conditions. So even without, even without
paying into the system, so to speak, you're still in the system. And of course,
yeah, you're still owned, you're still owned by the union to an extent, even if you're not paying dues
to them, right?
That's exactly what we try to point out.
And the union still speaks for you, which we argue in this brief is forced association,
it's compelled association.
Now, the case that we're talking about is actually a Bar Association case.
And as an attorney, it's near and dear to my heart.
I'm actually admitted to practice here in Oregon as well as in California.
So let me understand this then.
It's a case that I've not heard of.
It's Crow v. the Oregon State Bar.
So what is the basics of this case and why did you want to get involved with this, with
the Supreme Court?
So I guess what, it's a friend of the court brief?
Is that what you're going to submit?
Correct.
Yes.
We did not bring the initial challenge, Ms. Crowe did.
And so it's a case that's been working its way through the court system and is now on
petition for review at the Supreme Court for certiorari review.
So we're in support of the Supreme Court looking at this because what we have right now is a circuit
split. We have, for instance, the Second Circuit saying it's perfectly fine to force people
to be in mandatory bar associations. And the Fifth Circuit saying, no, you can't force
people into any kind of membership. That's a violation of your freedom of association rights. And then the
the night circuit sort of came down in the middle in this Crow case and said
well you can be forced to be in a membership but if they're going to
engage in speech that you disagree with they have to include a disclaimer to
say that they're not speaking on your behalf. So it's in the middle of the ground.
All right now, I...
Which is good, it's just not good enough.
Yeah, all right.
Yeah, here's the thing.
And we have talked about all sorts of numerous professional organizations that many people
apparently are forced to almost associate with in order to practice.
Like, now, I don't know if you are forced to be a member of the AM with in order to practice. Like, now I don't know if you are forced to be a member
of the AMA in order to practice medicine, maybe not,
but the AMA does tend to determine everything about a doctor,
whether for good and or evil.
And I would dare say the American Bar Association
has an incredibly big thumb on the ideological scale
out there in the United States. Is that a fair assessment and is that why Crowe is challenging this
association, this forced association? That's a really great question. Now,
the American Bar Association is completely voluntary. So, while it is a
huge organization and while it has an oversized impact on all kinds of
policies, you don't
have to be part of it.
So I personally have chosen not to pay money to the organization, not to be part of it.
I don't, you know, there's some really good things about it.
There's some really, but there's things I just can't support that the American Bar Association
does.
And so, you know, that's my choice not to be part of it. Now, you're
right, they do still have a huge impact. And that's probably another issue for another
day. But the issue here in Crow is even if you're not, I mean, even if you're, well,
two things. In Crow, you can be forced to be a member of the bar, and you can be forced
to pay bar dues.
How is that possible?
How is that possible then, Rebecca, if it is a voluntary association, supposedly, or
a voluntary group?
Okay, okay.
Let me distinguish.
Let me distinguish.
Sorry.
The American Bar Association is a national organization.
It's a voluntary.
Yes.
The Oregon Bar Association is just in Oregon and it is in just in Oregon, it has control of the profession.
So basically, the Supreme Court here in Oregon has delegated to the Oregon Bar Association,
as opposed to the larger organization. So they're not related, actually. It's just,
they happen to be called Bar Association. Thank you, because I didn't realize that
there was a difference with the Oregon Bar Association.
So the Oregon Bar Association is not just a subdivision, then, of the national.
No, no.
It's not, in fact, not connected at all.
It's under the control of, at least loosely speaking, the Oregon State
Well, the Supreme Court.
Yeah, the state's Supreme Court that regulates all legal professionals.
Yeah. So, yeah, so there's a distinction there, but a kind of one of the points of our
brief is voluntary associations were great.
There's more than 30 states that do basically what the American Bar Association
does and says, you know, you can be a part of our organization if you want.
You don't have to be, you do have to be licensed to practice law, but that's
something that the state takes care of separate from the bar. And it's voluntary, and you
do it if you support what we do, you don't do it if you don't support it, you have the
freedom to choose. Which is very American, you know?
Yeah, yeah.
The choice is kind of fundamental. And we were scratching our heads as we put these
briefs together, seeing what situations are there where you're forced into an association in an organization where
you don't want to be part of it?
And we've come up with two instances, mandatory bar associations, like in this case Crowe,
and mandatory unions for public sector employees.
So you're looking for a decision then from the Supreme Court that is very much like the Janus decision with public with you with
unions. It's like the next step of the Janus decision. Got it. Okay. Very
interesting. You know, I wanted to tickle your your legal pituitary gland, you know,
if you don't mind here. I don't know if you have one or not, but the legal
pituitary, yeah, the growth hormone here.
Why not, has there been any discussion about expanding
even this concept of forced association
when it comes to people's property?
And the reason I bring this up is that, you know,
for about 40, 50, 60 years now,
we have this kind of legal created out of whole cloth idea that if you allow people
into your property, you are now turned into a public accommodation.
And then there is so much control of the state by this in that you must force, it was almost
like a forced association when it comes to control of your private property under the guise then it's always under the guise of
Federal civil rights laws anything that ever gets talked about in your circles. Just curious
I know it may it's it's far afield from what you're talking about here, but I've always wondered this
That's a great question. It's not something I personally have considered at all. But yeah, it's interesting as you start thinking
about situations in which we allow basically so much government control that it becomes
basically an association, right? Some of the old case law dealt with, you know, like, you
know, a sheriff would get elected in one county and you had to be a member of his party to
continue to work for the sheriff's department, right?
So, you know, if you didn't want to change your political party, you were going to get
fired.
Right.
The Supreme Court thankfully said you can't require someone to be part of your political
party to work for you, even in a job like sheriff, you know.
Yes, you got to be able to trust your people, but no, that's a step too far.
And yeah, in so many situations like that, I think what we need is a drawing back and
saying, look, if you're forcing someone to be associated, to be a member, to basically
stand in the circle with these people, and the message of the other people in the circle,
they don't agree with.
Don't force them to be in the circle, they don't agree with.
Don't force them to be in the circle. Let them out. But you see, this is very common
if you have a building or a business, let's say, and you know, trying to control
your clientele and you don't want to associate with some people. Now I know
that may hurt some people's feelings, but it's either your property or it is it.
It can't be both the government's and yours. And that seems to be something which has been lost, I think.
Not that I'm advocating bigotry, it's not what I'm saying, but you know, when we are now in a
world now which the government almost has total control of you under forced association, and yet
there are so many other forced associations that are not, that no one would even think of that.
Think of that sort of forcing.
It's a great question.
It's one I think we're going to have to face and really dig down and analyze.
But I have to say, I haven't done that at this point.
It's a big question, especially with personal property, private property rights.
It's an important question. Yeah. But yeah, our clients, you know, what I do nine to five is representing public sector
employees and one of our most recent lawsuits is against the United Teachers of Los Angeles,
who are forcing Jewish teachers to basically be in a bargaining unit, be represented by
a union that...
Hates them?
Hates them is very anti-Semitic.
It's putting forth all kinds of information and curricula even in their classrooms that
is diametrically opposed to their deeply held religious beliefs.
Yeah.
And so we're pointing out, you know, this is a situation where, yes, it's freedom of speech,
but it's also freedom of religion and freedom of conscience that's affected here. Because no
matter what these individual teachers say, they're still associated with this union.
And the union's got a very loud voice. It's out there saying, free Palestine, you know,
from the river to the sea, Israel should not have a right to exist. And some of the stuff that they publicly said in our complaint, it's outrageous.
So anyway, we need to stand up for these rights of both public officials.
And it must be wise to maybe cool the political tempers going on in some of the, or temperatures,
I think, in some of the or temperatures I think in some of these
organizations. What if they just step back and said we're only going to deal
with things that are actually relevant to wages hours and working conditions?
What a concept. That'd be a great step in the right direction.
And that's part of the analysis, right? If you're if you're only dealing with things that are
truly germane to your job as an overseeing association.
Well, that's one thing.
But I have yet to find a labor union or a bar association, a state bar association that
does that.
Well, as an example, I would bring up once again the American Bar Association.
Now, I have a very different point of view and in a
way when it comes to science revolving involving rather climate change. Well the
American Bar Association's absolute one of reasons to exist is that they push
this as a matter of their deal. Now what does this have to do with the law in
being the best attorney and or judge
and various other things in the world?
You have involved yourself in political arguments
and decisions rather than getting involved
in promoting the profession, I guess,
is what I'm getting at.
And I can see why people say,
why should I be forced to have to join this group?
Right? That kind of thing.
Well, absolutely.
And there's a very fine line between,
the organization's right to take a position on climate change or some other controversial topic, and then
for them to turn around and say, well, if you don't agree with us on this topic, you're
not allowed into the profession. That's the next step.
Yeah, exactly. And that's why-
We're really fighting about that, even though that's not technically an issue
in any of these cases.
I think that's the bigger question.
And one that we're gonna have to face.
I mean, you're in Southern Oregon, right?
I mean, what if there was a, you know,
you can't own a gun unless you belong
to the American Gun Association,
and they take positions, you know, on all of these things.
You know, and you have to pay money to them. I mean, it
would be...we wouldn't do that, right? I don't think we should do it to lawyers or to
teachers or to any other profession either. Yeah. Well, the states
tried to make sure we don't have any of those anyway, but that's another
conversation for another time. But wouldn't that be a clever way to do it?
Oh, of course, of course. Yeah yeah you have to belong to the American Safety Association or whatever you might want to call it.
Whatever you want to call it. The American Anti-Suicide Association.
So anyway, Rebecca, I appreciate learning more about the Freedom
Foundation. So it's freedomfoundation.com and is it mostly then
working with government unions and associations that you work with,
or do you ever take on private sector concerns too?
We mostly work on government because our focus and our mission is to improve and bring a
little bit of accountability to our government, which can't happen without reforming public
sector unions.
So that's our focus, but if someone's in a private sector union and needs help, we will definitely talk to you and never going to turn
someone away if there's anything we can do to help. Rebecca Schulteis once again,

It was actually less than the average, so I guess the ratings must have been going down by that time.
But 9 o'clock p.m., May 6, 2000, heard by the last time, 51 million people ended up tuning in for the final original episode.
And throughout that entire run, it's six stars maintained a pretty unified front.
They're making sure that none of them emerged as a dominating force. In fact, in the spring of 2000 they signed a two-year 40 million dollar contract. Each
of them got a million bucks per episode. I would have done that for that. Would
you have worked for a million bucks an episode back in those days, Logan? No, you
would have been a kid at the time. I don't know. It's kind of tough to sell out.
I don't know. Well, everyone has a price. A million dollars for an episode. What do you think?

I believe there are certain men that will just stick to their integrity versus selling out, but to each their own.

From the KMED News Center, here's what's going on. GrantsPass representative Duane
Younger is under investigation in the Oregon House under House Rule 27. It prohibits harassment,
discrimination and retaliation. At issue, Younger was giving a speech in opposition
to Senate Bill 1098, which aims to restrict book bans in schools. His crime was reading a scene from the 2016 book, The Haters, which was challenged in
the Three Rivers School District but ultimately remains on school shelves.
In essence, he read from a book which is considered appropriate for middle schoolers but is too
lascivious to be heard by adults in the legislature.
A bill headed to Governor Tina Koteck aims to make it easier for Oregon nonprofits
and local governments to preserve open space.
Supporters say it'll protect land from development.
Oregon is joining a lawsuit against the Trump administration
over cuts to the US Department of Health and Human Services.
The suit argues Trump's actions violated federal statutes
and regulations.

We have somebody who is Republican, but she's very progressive, very enthusiastic about

She's been on the board for about a year now.
So, she's also supported by the Democrats and Indivisible.
Ah, well, I guess that sometimes the Republican label doesn't always help. It's a bit
of that kind of like in Salem where we hear about senators and Republican House members that
my job is to reach across the aisle so that we can pass Democrat bills. Yay!
Yeah, well yeah, kind of rhino-like. So anyway, but Jenny is a wonderful candidate. Everybody who
knows her is just so excited.
She's an educator. We need people in there maybe with education degrees because she wants kids to learn how to read.
We're having problems. She teaches in the public school and she sees what's going on.
And maybe the library can fill in the gap somewhere with reading and all that.
I hope you're right about that. I appreciate that, Charlene, because I know that you have been passionate in your support of having a great library system and reforming what's going on there.
As far as the reading, how do they teach children to read now? Do you know? I'm still trying to get
to the bottom of this. I learned to read the phonics in my mother back when I was a little
boy and it worked really well for me. I'm not saying it works for everybody, but I think they
got away from it and now they're kind of
tiptoeing back I think. But could you tell me what's going on? Well from what
I've seen and heard they have a kind of a combination phonics and sight reading
or something. I'm not real sure but it might be confusing the kids. But you
know what are we 49th in the nation for reading levels in the school?
Oh, who's counting?
Yeah, who's counting? It might be 50, I don't know. But yeah, I have talked to people in the
schools and they tell me, and I think they're trying to get back to phonics, but, and the
library, of course, is going to give reading lessons. But, you know, there are things they
could do more than they're doing now. They have a lot of kids programs and things like that, reading
to you know babies and wobblers and all this kind of stuff and that's kind of
early, but to keep kids more interested in reading and excited to read and more
you know just anyway but there's just a lot of issues that the library can use a
good conservative voice. I agree.

all the pornography and all in schools. Yes, that is... it was State Representative

of trouble, but they're now claiming that he created a hostile working environment for reading from the school books or
from the books that are in the school library. It's so bad, it's so
great for the kids but so bad for adults to hear it that they were cowering,
cowering in fear, I guess.
The problem is, well, that's nothing compared to where they're taking us.

I really highly recommend you get this woman, Jennifer Billicon, because this goes back
to the beginnings of the Catholic Church and the whole transhumanism, transgender, transsexual
plan and commoditize even sexual reproduction.
But literally also to be able to use robots,
they're already using them to pick carrots
and they look like humans out there
because they've got them looking like humans.
I mean, it's amazing what they're doing,
but where we're going,
there's not gonna be male and female.
You're gonna be maybe a part,
but they can change it out.
A guy that was
homosexual read her book and realized now, because she also goes into how dangerous it is to change
sex and start doing this hormone stuff. But we know the food is also causing a lot of people to
not have the normal libido. Well, I've wondered though about the endocrine disruptors, which is
why I also focused quite a bit yesterday on the PFAS, the forever chemicals thing, which I do believe is a real thing.
I don't think this is the environmental left going hissy-fitty on it.
I think there's honestly some issues involved with some of this.
This woman has been on quite a few shows and movies.

Gender Transformation, 2023, The Gender Delusion. These are different movies she's been, but it's
also she's been on The Megyn Kelly Show, Stephen Bannon's War Room, James Patrick's Big Picture.
She's really amazing in her knowledge and to literally take it back all the way to the beginning with this Catholic.

with the trucking company guy the other day.
I've been in the trucking industry for 49 years and I'm currently semi-retired.
I believe that those foreign drivers are getting their training from disreputable schools.
I wouldn't be surprised if some of the schools are run by foreigners
that also recruit these drivers back in the home country.
I know that a lot of these schools can give a driving proficiency test,
but they don't know how they can go to the DMV
and get the written test and have no English skills.
The driving test has been a problem for new drivers
if they didn't go to a truck driving school.
How do you find a truck to take a test in?
I believe the DMV doesn't even do
the CDL driving test anymore.
When I go in to renew my license,
I've never seen an option to take the test
in other languages.
Besides the language issue,
most of these drivers are poorly trained
and are a danger to other drivers.
As far as the self-driving trucks go, John writes,
very little trucking could use this option.
Everyday trucking has so many variables,
weather, accidents, detours, et cetera.

which is done to a limited extent already by UPS and others.
Where I have worked, we used the railroad at times to move our trailers.
The big problem is the railroads not operating in a timely manner.
