Doctor, it is great to have you back and welcome to Where Past Me Is Present. We're not even going to do a history today because there's so much Trump news that we probably should deal with that.
Starting point is 00:00:23 Why don't we just deal with that? That's probably going to be plenty to talk about, wouldn't you think? Oh, it sounds like a winner because there's a lot and just lean on Macduff. Yeah, now what do you think about this 90 day, a 90 day relaxation of the Trumpy tariffs and so we're gonna go from a hundred forty five percent in China and we're gonna be down to a to 115% lower, roughly 30%. Now this is 90 days. Markets are loving that, aren't they?
Starting point is 00:00:52 So are we past the crises and the trade war issue? What are you thinking? What's your gut tell you? What's your Spidey sensei, retired professor of business law? Well, this is really quite an issue. Basically, Spidey is saying that this is a temporary suspension for the 90 days. It's one to where Trump is absolutely right, my friend, in terms of that China is very dependent in terms of we import four times as much as China imports from us.
Starting point is 00:01:27 And that this was one of those things where both sides moved their tariffs down about 115%. But I think the devil is going to be in the details when you really get into things like technology, into things such as the drug trade in terms of fentanyl might be easy to go, Bill. On the other hand, the announcement by Trump as to going ahead and changing the tier system for where the US is paying more for drugs than by any time, by any amount, by four to twice as much that EU, China, and the others are. It's interesting you bring this up. I was talking with a guest a little bit earlier from US Diabetes Care. He's like an alternative clinic on diabetes care and we were talking about diabetic drugs like insulin, various other things. And he
Starting point is 00:02:27 says that a challenge that he's looking at here is that even if by executive order President Trump reduces the price of prescription drugs 30 to 80 percent that end users, we customers, would not necessarily see that because of the cabal between insurance, pharmacy benefit managers, hospital systems that will still mark up drugs quite a bit there beyond what the executive order might indicate. Would you agree with that overall or not? Well, that's a good argument. On the other side, the right now negotiations going on in the House and Senate on Trump's big beautiful bill is one where they're really looking at cuts as to what is paid by the
Starting point is 00:03:17 government in terms of, you know, drugs, Medicare, Medicaid types of things that are needed by all of us. And it's something that will come through, but what we're seeing now, right off the bat, is that the announcement is made, what, a half hour ago or an hour ago, the executive order is signed, and already we have the pharmaceuticals and the various medical industries that are lining up to start trying to go ahead and make their arguments so that they can be exempted. Okay, so the political posturing is already beginning, is what you're saying. Yeah.
Starting point is 00:04:02 Now, this could be a tough sell. And the only reason I bring that up is that you just look at the amount of pharmaceutical industry money which has been spread and injected into Congress, both in the House and the Senate, along with people running for president too. You know, it's like everybody gets their little gift, I suppose. In fact, it's one of the... Well, and I even wonder if Cable News will report honestly on this because most of their revenue, if you look at the ads, is coming from pharmaceutical advertisement. That's true. And, you know, as a matter of fact, they mentioned the figure that apparently Trump turned down
Starting point is 00:04:41 a hundred million from the drug and pharmaceutical industry in his re-election run. And you're absolutely right in terms of looking at the way that right now with Congress, it's the best that money can buy. Hmm, all right. I'll tell you what, in just a moment, why don't we delve into habeas corpus, because it is now being talked about openly when it comes to the border issue. You ready for that?

Dr. Dennis Power is with me and he's retired professor of business law at Southern Oregon University and a wonderful legal brain that I get to bend his ear once a week.
Starting point is 00:07:41 And let me tell you, the legal industry keeps giving to you, right, Doc? Welcome back. Very true. It's always my pleasure. It's been for 15 years. Now then, we look at this in Article 1, Section 9 of the Constitution. We remember that Constitution. It's been kind of under an administrative state condom for a number of years. Trump trying to remove a little bit of that. But here it is. Isn't it true that in law fair, it's like the Constitution is almost like a Constitution-free zone, administrative courts rather than Article 3 courts, all that? You ever get that feeling sometimes, like the Constitution is sort of hidden away, you put a condom over it, and you just say, there
Starting point is 00:08:20 it is, the administrative courts. Boom. Yeah, that's true and part of it is because the drive-by media goes ahead and reports without giving any real specifics underneath what's going on, such as on habeas corpus that's just been coming out, but also in terms of this quote due process that they're trying to force on every illegal immigrant of the what 15 million that flooded well and probably more what I'm curious about though is that is there a Definition of due process is there like a classic definition that everybody knows Is it actually in black letter law and or you know, I don't see it defined the Constitution. Am I right or wrong about that? No that's correct and when you get
Starting point is 00:09:09 into what due process is there are generalizations and very quickly citizens have more protection on due process than illegal immigrants and it's very very well put into the law. OK. Now, let me then take it to the next step then. Citizens have more protection. Does due process or could due process be something as simple as, all right, you're brought into court and then do you have authorization to be in the United States? And then the person says no, I don't have authorization for this and then the immigration judge would then say fine thank you, you have no authorization, hence you will be deported within a matter of days or whatever the case might
Starting point is 00:09:59 be and off they go. Does that qualify for due process or does due process mean you're going in with juries and trials and then everybody comes in and says, but I want asylum and yada yada? It must not be as simple as my little brain is talking about this morning when it comes to due process. Oh, actually you are correct in terms of that's where the arguments would be coming through. And you have the Associated Communist Legal Union being the ACLU that comes in. And the first thing they do is they say, look, just say you're afraid to return to your country. So it's a factual thing that's coming in.
Starting point is 00:10:41 And right now they're trying to go ahead with these injunctions to stop the motivation, as you know and you've pointed out so well, the motivation of this country to go ahead and proceed and get, starting with the most heinous of people to be thrown out. And the ACLU and the other, you know, communists, really, that's what they really come down to, are fighting this as best they can because they really want to get these quote unquote hearings for everyone. And I don't think they're going to do it, but boy, they're making a massive fight for it.
Starting point is 00:11:19 Well, what happened, this is the part that has been disturbing to some people, it's not as disturbing to me, because I'm looking at Article 1, Section 9, the privilege of the writ of habeas corpus shall not be suspended unless when in cases of rebellion or invasion the public safety may require it. I know that Stephen Miller and others have been now talking about the suspension of habeas corpus openly when it comes to immigration law and immigration hearing. Have you been hearing this and reading this also, I would imagine? Yes, and I can even remember the discussions on habeas corpus going back decades when I was in law school. It's the English common law procedure, but what was put in the Constitution is a limitation. It
Starting point is 00:12:15 just says the only time that Congress can suspend habeas corpus is when there's a rebellion or an invasion. And habeas corpus then was subject to a federal statute that came in. But remember, at least what I had to remember back to, was that the right of habeas corpus is not a right against unlawful arrest. It's a right to be released from imprisonment after the arrest. After the arrest? Oh! After the arrest. And that's why, you know, these, you know, Che Guevara judges are coming in. And first of all, they don't care if they have jurisdiction. But that's why they're concentrating on the arrest, the actual arrest of the illegal immigrant? Yes, and to release them. Because if you release them from imprisonment, they disappear.
Starting point is 00:13:19 Again. Yes. That kind of thing. The 15th time. And this is just such a massive fraud that's being instituted against our country. Alan Dershowitz, who was very, very liberal for years, O.J. Simpson, very, very erudite scholar, Harvard professor, taught it. I remember listening to him when I was able to come over and just listen to him. He has even changed because of the way that the far-left is actually just not only camouflaging what the law is, but actually totally misrepresenting it because these judges are far-left Democrats. Is this, am I to then read here that even civil liberties defenders are coming around to the need to possibly suspend it, or am I reading too much into this?
Starting point is 00:14:17 No, I think you're right, except it's only been used four times that I was able to find, which is in the Civil War with the KKK in South Carolina. It had to do with Hawaii after Pearl Harbor. In any event, it's going to be tough because Congress has to allow it. And that's going to make it a political fight. Plus the fact that these courts are so out of control with John Roberts being a CS, a chicken sheist. Well, couldn't John Roberts just provide guidance to tell these judges, hey, knock this off. Knock this off with the district decision covering everybody and you getting involved
Starting point is 00:15:10 in these foreign policy issues, which essentially is what they're doing. He could, along with our Notre Dame professor, which could go five to four against what the administration and the country wants. And part of the problem is that what I'm seeing with Roberts going along on a 5-4 to allow on the executive order to discharge trans people from the military. And, you know, my god. Well they all agreed on that one though six to three for the most part that was a that's right no problem there. Yeah but part of the reason is is that that's almost like a slam dunk I mean because you know they're on the battlefield and they're
Starting point is 00:15:58 saying oh I need to get my fix I mean and this is military this is security the United States, but what Roberts did when they switched along, that was an easy one to do, my friend, because of the fact that that makes just total common sense, and it's only a thousand. But when we come into these other ones, you know, that was one where they released the nation wanted junction, but they are waiting, being Roberts, at the Supreme Court to have others come in and this waiting game is just what the far left wants. The game is to delay then. If you delay, you end up just essentially ending the deportation? It's to go ahead and to make it so difficult
Starting point is 00:16:47 that their boat carriers will be able to stay in here, but I'm still very optimistic because that's why the far left is arguing so strenuously about Medicare and Medicaid Social Security continuously about Medicare and Medicaid Social Security because we have, even here, it was admitted in little downtown Oregon in Salem that we have illegal immigrants on everything from unemployment insurance all the way to getting in, and that's how they're getting into the hospitals. It's an emergency. Yeah, you can't say that it's a cost-free policy here in Oregon.
Starting point is 00:17:24 Right. It's for sure. Hey, before we take off here, Doc, what about Judge Janine Pirro being named interim US attorney? And this is interesting. Didn't he get a chance to listen to her show yesterday? I don't know if she was on it yesterday or had somebody filling in for her, but this all happened because of Ed Martin. Ed Martin, who of course was well known for defending J-6ers, and there were,
Starting point is 00:17:50 shall we say, Republican squishes that didn't want to get involved. You didn't have the Republican support to be able to get the votes, to get confirmed. Yeah, and she is on. I mean, this just shows the brilliance of Trump. I started laughing because, yes, she was on in terms of Sunday. And the other thing, Bill, was that to nominate her for interim US attorney for DC is that this is where, like Ed Martin, as you point out so well, could not be confirmed within the 120 days, then also the district court in DC will go ahead and appoint their person. And we've just seen what happens when the far left
Starting point is 00:18:37 goes ahead and appoints and gets people in like Letitia James. Yeah, now could you technically run the DC court or the US attorney in DC in which, okay, you appoint Judge Jeanine Pirro and then 110 days from now you appoint someone else and then you appoint someone else, etc. Could you run it that way or is it better to find someone you can just permanently put in there? Well, on that question, the Judge Jeanine was a very highly respected judge in Westchester County, in New York. She was a rising star in terms of the Republican Party until she made the mistake of trying to run against Hillary Clinton, who is probably as deadly as Che Guevara is, who then really nailed Janine then in terms
Starting point is 00:19:35 of coming up with, I think it was some $12,000, only $12,000 that came from mafia-associated people to her campaign. And then also she got caught in a disastrous divorce. But then for 14 years she comes in into Fox News and yes, they can go ahead and she's perfect because she just, I wonder the extent to which she's even going to try to go ahead and do that. She's making much more money than she is with Fox. Oh yeah, it would definitely be a pay cut to be the US attorney, no doubt about that. But on the other hand, it's great for the resume, I suppose. But still, I mean, so she's not going to be the permanent, you don't think?
Starting point is 00:20:21 Or do you think she could end up being the permanent? I would be surprised if she was because the old wounds that were there that Hillary put on her is why for the last 14 years... Yeah, that would be brought up again. They'd bring that back. Okay. Yeah. All right. So, political, getting all the votes wouldn't be enough. Okay, well, I just thought I'd ask anyway, but still I'll tell you the heads explode when he does stuff like this. I just got to chuckle. I thought it was as funny as when you brought up Alcatraz last Monday. Oh yeah, Alcatraz. And of course, don't forget my favorite Christmas carol right
Starting point is 00:20:59 now is Trumpy Claus is coming to town. He's making a list and checking it twice and going to find out who's not helping ICE. Oh, I love that. Yeah, we love that. You know, long, different ones that come up. You know, some of his lines being, oh, yeah. Oh, do you have some Trump lines? I'd love to hear them before we take off. Go ahead. Yeah, this is going to be fun because the Democratic Party said we needed more legislation. All we needed was a new president. Yep, that's one line I remember I was saying that. Sure, sure. Fake news, more like mis-facts, trumpify it. Oh, another one. I mean, you and your listeners
Starting point is 00:21:41 will have tons of them. The name Trump is synonymous with excellence. Ask my kids. Oh, and Bill Bush was funny because he was like a golden retriever. Oh man. I mean, no one is as good as Trump is when it comes to this. And also the fact that he is funny because when he throws these things out, he has the mainstream drive by idiocracy racing in taking him serious,
Starting point is 00:22:15 whether it's Alcatraz or you name it, all these different places. Well, the reaction is always the same. No matter what it is, it's like... Every time. Every time. Starting point is 00:23:51 Now today, with the stock market just zooming up a thousand points, maybe about 900 last time I checked, it gave back a couple percent. But no, it didn't go diving. Yeah, maybe some people rotating out of precious metals, they're looking at the lack of trust in the system, even if the markets are looking okay for the time being. That's what gold is all about. This is why central banks have been buying it. This is why big money has been buying gold right now. And if you wanted to buy gold and or sell it, well,

Starting point is 00:25:19 The recognized experts at Jay Austin. Police arrested a man after finding half a pound of fentanyl at his parents' property outside of Grants Pass. Multiple agencies, including the Rogue Area Drug Enforcement Team, seized fentanyl and firearms. Christopher Smith was taken to the Josephine County Jail on charges of delivery and possession of a controlled substance and federal firearms charges. Besides the weight of the snow, an engineering firm says the cause of the North Medford High School gym roof collapse was wooden beams that
Starting point is 00:25:48 were glued together in the 60s came apart or delaminated and that when the roof was built during the mid 60s its load capacity was overestimated. The Medford School District says now it's commissioned a comprehensive engineering assessment for all of the large buildings across the district. Oregon has joined 14 other states in challenging President Trump's energy emergency declared earlier this year. Attorney General Dan Rayfield says the emergency allowed the president to bypass rules for the Clean Water Act, Endangered Species Act and the Historic National Preservation Act.

Then they went through some money issues, closed it up and at that time I, I tried to get it going at that time, but couldn't find a good editor. And so now you found a good editor. And so, Warren, we appreciate your editing, editing on this one. But what is this all about? Rhone Valley vibe? Because I see a lot of history in here and I see a lot of fun places too. Do you want to take that? Oh, yeah. You know,

Oh yeah, you know, it was kind of a product of, I used to work at the Mail Tribune and when the Mail Tribune went out of business, I asked Mike, I'm like, hey, is there any way we can kind of fill in some of the value that was lost when they went down? Is this kind of, or some of the, I can kind of fill in some of the value that was lost when they went down. Is this kind of where some of the, I can think of some of the print material that was at the Mail Tribune at the very end. My wife actually, Linda Mounce used to work for editing at some of those. I want to say like Home Life and various other things. Is this kind of a take off on that kind of deal? They were beautiful magazines. Well, it was, you know, we, at first we were kind of debating like, oh, should we do a,
Starting point is 00:31:10 you know, another newspaper or something? But we wanted to just bring like a different type of content. Mike came up with the idea of doing a magazine and I was like, I was like, oh, heck yeah, I can do that. Sure. And so this one's like a little, you know, it's a little different. It's, you know, it's about Well, it's about history. We want to really focus on history in the Rogue Valley. We want to make sure that people recognize the rich history that the Rogue Valley has. Like one of the stories is Kind of like what Dennis and I talk about all the time. Right, right. And he's a great asset. So yeah, so Rogue Valley vibe, we, I read some stuff about how the Rogue River and Rogue Valley got their name. And I guess, you know, I'm gonna do some
Starting point is 00:31:56 more research and we put something together. And, you know, it tells people how the Rogue River and Rogue Valley got their name. And I think that's really important. I mean, I never knew until I came across it one day. All right. Where do you get it? Or how do you get this, this magazine? Starting point is 00:32:46 And so, discover how the Rogue River and Valley became Rogue. And then you also explore the first commercial pear orchard. And then, ah, and see, this is kind of like some outdoor fun. Yeah. Is what you bring in there too. Exploring the South Umpqua Falls, Mill Creek Falls, Avenue of Boulders, et cetera. Yeah. Pretty cool stuff then. So are you looking for contributors and people to- Yeah, absolutely. I mean, yeah, we're looking for, you know, anybody that can contribute, you know, the type of value that we wanna have in here.
Starting point is 00:33:14 Yeah, we're really looking for sponsors. And we mentioned that throughout the magazine. We want everyone, all readers to know that it is because of the sponsors that this magazine is actually being published and delivered right to their home. All right. So you have sponsors in there right now, but you need more naturally. Of course, yes.
Starting point is 00:33:35 Did you, you know, what are the challenges here of actually doing something in print? And because, you know, we're told these days, oh, you know, you got to do everything online. Something's missing, I think. There are some things that work online or a lot of things that do work online, but I don't know. There's something about the tangible, especially when you have a lot of great photography and beautiful scenery, it just doesn't work online,
Starting point is 00:33:58 in my view, but what is your take? Well, from research, print actually will help people remember much, much better than digital. When it comes down to ads, advertisers get a much bigger return on investment. Really? Yeah, via print over digital. The newspapers kind of went away just because, you know, they just kept getting
Starting point is 00:34:30 smaller and smaller, I think, and the price had to go up. You know, and we're delivering this for free, right? So we're not asking for anything from anybody except for sponsors. You're asking for readership and sponsors is what you're looking for. Okay, very good. Well, how can people find out more about this and get, you know, are you going to deliver this or put this in any stores at all? Or is this mostly just online or I'm sorry, being delivered only at this point? There are some hand delivery. When we go and talk to potential sponsors, especially when we're inside like doctors offices, we want to make sure that we can try to get some inside their waiting rooms. And so I've been doing that throughout the past few weeks.
Starting point is 00:35:09 Well, I gotta tell you, I'll take this over a lot of the other stuff you'll normally see in a dentist or doctor's office. You know, the, you know, the old National Geographic from 15 years ago, you know, thank you. But no, good, good, good stuff. I'm glad to see somebody doing this because I think there's readership for this. And I think the fact that you have great photography and you have it on nice paper and everything else. I think you're going to do okay with this. I really do. And do
Starting point is 00:35:35 you have a website too where people can contribute or find out more? It's roguevalleyvibe.com. All right. Rogue Valley Vibe. How often are you going to be putting this out? What do you say, Warren? Well, right now we're just putting this one out. It's going out to East Medford. We're going to have, well, we're going to come out with two this year. The next one is going to probably come out in the fall, fall time. Yeah, for kind of giving people things to do in the winter and, you know, promoting businesses around that time. What type of stories are you looking for? That'll be the final question,
Starting point is 00:36:10 if people wanted to contribute. Great places to go, you know, some hidden gems that they may not, many people don't know about. Of course, history. If they have some history stories that they think other people would be interested in. Yes, those kind of things will be really, really great.
Starting point is 00:36:28 Hiking, outdoor activities, all that stuff. I'll get your information up here. And of course, nothing happens without the sponsors. OK, right. That's the way. It's that way for me too. Yeah. You know, even doing a talk radio show, it's like first things first.

Starting point is 00:40:22 Hey, another quick email of the day. Dr. Steve Nelson, Central Point Family Dentistry. Dale writes me, we were talking about diabetes and money, saying, Bill concerning diabetes and the money made by pharmaceuticals, I was diagnosed as a diabetic in the fall of 2002 and at that time threshold was 140 on the blood scale. About six months after I was diagnosed, the threshold lowered to 120 and brought a great many more under the diabetic diagnosis. They really don't seem to have worked on the cure or reason for diabetes, but boy, they sure have worked to provide high-price drugs.
Starting point is 00:40:53 It's been since that time my suspicion that diabetes is one of the major sources of money to the pharmaceutical companies who control it. As to obtaining prescriptions for anything anymore, the patient is pretty much left out of the loop and the doctors seem to be complaining more and more about the system.
