And speaking of Grants Pass, that happens to be the profile today on where pass
meets present Dr. Dennis Powers, retired professor of business law.
Dennis, you're the palate cleanser.
It was you start out here.
It's been a lot of a rant talk this morning and a terrorism talk and all the rest of it.
We'll certainly get back to that. But okay, how many homeless encampments did
Grants Pass had to pay for back in the 1852 era, back when you know Grants Pass
started moving forward? Just kind of kidding. That's a really great
leading question because now we go back back to the founding of cities and
states and values that we had of freedom.
In any event, what's interesting here, Bill, was that when we look at 1851, 1852, and I
know people say, well, that's kind of like a yonder, but on the other hand, so many different towns and gold strikes were happening from the 49ers
in the 1850s. That ended up really driving a lot of the founding of many
of our towns, including Grants Pass, right? Well, what was happening there is it's
really great stories, because what you had was
sailors deserted their ship near Crescent City and this was in 1852. This is when
Jacksonville strikes were going on. We had Coyote Evans and Rogue River, but
bottom line was that they said, the hell with this, we're gonna find gold.
And they just deserted their ship. Yeah, they retired, the hell with this, we're going to find gold, and they just deserted their ship.
Yeah, they retired, they had towed that bar, lifted that bail kind of stuff, and they figured,
what, we're going to go out and make money like all the other people getting off the boat.
Right? That was kind of where they were going.
And they did it. They found rich gold deposits in the Illinois Valley that was known as
Sailor Diggings, 25 miles south of present-day Grants Pass. But then all of a sudden, Sailor Diggings was a population of several thousands.
But then there, what was interesting is that depending on how the gold was being found,
people then would pick up their camps, pick up their storefronts, and wagon them to the
next place.
So that was a place when they left for British Columbia.
You then had Kirbyville. And with Kirbyville, it was James Kirby had settled that. And then
the county seat again moved to Kirbyville. But what's important...
Now, this must have been after, because Josephine County
used to be Jackson County, or part of Jackson County, but it was carved out later, right?
In the 1850s, I think? Yeah, actually one year later, when Kirbyville was set up and became the
new county seat, a year before then was that you had Jackson County that was huge and then Josephine County
was carved out from that portion. It was named for Josephine Rollins, the first
non-native American woman. But what happens is that you had then, at the same
time, you had tiny, tiny, teeny Grants Pass, which was really little more than a stagecoach
stop that was named for Ulysses Grant's victory.
And what was it about it that made it grow though?
What was the part of Grants Pass history that, because it wasn't necessarily gold strikes
there, or was it?
Well that was where we had the railroad that came through, it was gold mining and the railroad
that came through, and that was Christmas Eve in 1883.
But you see, when you have Grants Pass and then you had the apostrophe S there, Grants
Pass, being now a place where you had a railroad depot.
You then had a center because you had river, you had a lot of different things right on
the stagecoach line, right on the railroad track line.
Everything was there.
You had then saw mills that came in.
You had also electricity that came in when they went
ahead and built the dam that was there. And that long story short too is that
not only did they have that but they had the first bridge that's that spanned
Rogue River. So it then had proximity, railroad, gold strikes around it, everything that you needed.
By the 1890s, it had its own opera house, a number of bridges across the road, water
company, light and power, and the dam was just a few hundred feet west of Caveman Bridge.
Yeah, and you would think about it then, so often the railroad, when you look back at
Valley history, Southern Oregon history, ended up being like the equivalent of the internet.
This was the driver.
Wherever the railroad was, that was where the population and where county seats also
tended to be made, wouldn't you say?
And the converse also applied, because if the railroad didn't come through to your town,
ones like Jacksonville just were dying on the vine
for decades.
You had smaller towns in between basically
Gold Hill and Medford that died.
You had a number of ones that went.
On the other hand, you had all these different things that were ingredients that were coming
in.
Then you had actually, in terms of transports, it was for Medford where it sprung up, my
friend, was because it had the first municipal airport.
This is like in the 1920s. And so all over time, you had these places that we look where
past meets present, and you can see why even now these are places that would have to grow
based on all the ones that we've talked about.

few days.

We are now back into the present side of things, Doc.
And out of the court decisions that happened last week, well I know there was an interesting one out of the Ninth Circuit and then ended up helping out
the the two Grants Pass educators and you'd always been talking about
Alliance Defending Freedom, they're gonna be able to get their trial in
Medford Court, which I find really interesting and there was some kind of
some question about whether that would happen for a while. Overall take on that?
Absolutely and that's the reason why after years
of trying to find out an alternative to the ACLU,
I found it in the Alliance Defending Freedom.
And they have been really centering
in different areas of the United States
national organization, including Grants Path.
And the latest one on Grants Pass is the I Resolve
Campaign. And the basic thing there is that you had the Ninth Circuit Court of Appeals
that came in and stated that the two educators in Grants Pass that were fired over their I Resolve campaign, which was that there
was an alternative to this idea of transgender, gender dysphoria type of problems, and they
had been fired.
One was this former assistant principal, the other one was a teacher.
You of course had the lower court, the lower
district court bill that was going the way of the Marxists.
Yeah, it ruled against them. Were you surprised though that you saw that reversal from the
Ninth Circuit of all places? Ninth Circuit doesn't have a reputation of
being that respectful of such views.
Underneath Trump, it became more balanced.
And what's interesting there is that if you're seeing votes that are happening in terms of
the Ninth Circuit Court of Appeals, including the one that's the National Guard issue, who
controls the National Guard, that was 3-0 in favor of Trump, including a Biden
appointee that went ahead and applied for that one.
Yeah, what happens next in that particular case, by the way?
You know, my main question.
Well, you know, that's one to where what we're seeing is, and this is true, the Democratic
Party has been taken totally over to Marxism and socialism by Soros, Obama, and Clinton.
And so what you're having is this lawfare that's happening in so many different ways.
A key thing is this lawfare that has to do with the National Guard that Trump brought
in to Los Angeles to protect federal buildings because there's no question
that Newsom would go ahead and allow the federal buildings to be attacked like you had in the
George Floyd.
Well, and also in Portland, we had those buildings attacked and defaced.
Same sort of thing.
Absolutely.
Local authorities were not going to protect it.
And so the president seemed reasonable in his order there, I thought.
That's right and what it shows is how far left the Democratic Party quote-unquote
with the K has lurched because this control issue in the Ninth Circuit
that was three to zero Bill, you know, said that Newsom does not have control, Trump has control,
and it's strictly constitution.
The problem, my friend, is the fact that people who are uneducated, like the ones demonstrating anti-ice anti Tesla all anti which is just anti-american
That these people will do anything to keep their power, you know, if it's in the streets
All the way along the Constitution everything I've known for six decades
My friend has been the fact that the commander-in-chief really has
been the fact that the commander-in-chief really has strong powers that were even used by Obama and never questioned because now we have the far
left Democratic with the K Party that's going ahead all throughout the courts in
a last gasp effort to keep control and it's basically anti-American. You think
that Trump ultimately wins this totally because I know we're on to more hearings in this case, correct?
With seeing what's happening, absolutely. Because this is like
bottom-line first-year law school law. Unless you're one that is coming through
with the latest Oregon Bar Association
where you don't even have to pass the bar to become an attorney just through
some Mickey Mouse 650 hours that you do when you're studying underneath some
other attorney. What could go wrong with such a system?
Oh, I'll tell you right now what goes through. You get uneducated
attorneys that just knee-jerk in terms of the court,
and so you're going to have...it's too easy to sue, and the problem is that they
won't know the difference, and yet the people who are sued are going to be
saying, damn attorneys, not knowing the fact that we live in a socialist state
government. All right, back to some of the lawsuit decisions that have come here.
Not only was there a Ninth Circuit reversal that is good
news for the former Grants Pass educators, also involving the
transgender issue. The transgender issue in Tennessee also ended up... I think we
may... I don't know if we talked about that last week or not. I think it may have
happened after that. But yeah, that was a solid one. Tennessee is allowed to enforce their no transgender surgery for minors.
And there was a genuine, what do they call it, compelling state interest, I think, is what the justice has said.
One of the issues had to do with, in constitutional areas, what is the test that you use, compelling or neutral, but that was a
very small part of this decision. It was a very narrow decision. And it didn't, it
was about that it didn't require stricter scrutiny, is that what I
understand it, if I understand it correctly? Well, that was in the dictum.
Yes. The two major points, Bill, on this to to be honest on it, is the fact that one was the
fact it was looking at the law, and in the law, they really stated that there was no
equal protection unconstitutionality of that provision.
The second thing was they said it really is something that should be done with the states because there's a lot of factual dispute there.
But it was so narrow because it just had to do with you can do
puberty blockers and hormonal therapy to treat gender dysphoria, if the person is over 18, gender dysphoria has a very
narrow definition, and it said that you could even do it for gender dysphoria,
only that is prohibited, but anything else is okay. It was a very narrow
decision, as we saw with the Ninth Circuit, which has to do with the free speech area, and then
in terms of, my friend, can men still dress in women's bathrooms?
That's another issue that's going to be going up.
And so it's very narrow all the way through, so the legal fight continues on.
Alliance Defending Freedom is one that people should really closely look at because they have taken an interest and I think it's because of
those in our area who have been donating to the Alliance Defending Freedom. It
helps. It's been a positive approach. I mean a good defense is an
offense in this particular case. Alright, Doc, I wanted to ask you here before we
take off here, what major decisions are we looking for coming out of the Supreme Court? Because they're not all
out yet, and I guess it's going to be pretty much a fire hose these last few days of the
term.
Yeah, that's true because it's really interesting. You can see where our Chief Justice is really working to get quorums, if you will, five to four, six to three.
And the reason is, is the fact that forum shopping is still there.
Another one is the way that these far left Marxist fundraisers who were appointed by
Biden are able to put on the national injunctions for something that only applies to two people
that are living in that state. So we're going to know by the end of this
term whether the so-called injunctivitis, right, national injunctivitis, is going
to be reigned in. And do you believe that it will be reigned in or are they going
to kind of step sidestep this this time? I think it's going to be one to where
they'll handle a couple of ones because this is such
a waste of court resources all the way through the appellate courts with the way that these
far left, Marxist-appointed judges are really trashing constitutional law because of the
fact they don't want to have the far left marching in front of their house.
And the bottom line is that if we
get a decision, but I would think it would be one that would be narrow like the ones
we've seen before that can be opened up in the next term, which will be in October.

Oregon members of Congress reacted strongly to the U.S. bombing of military sites in Iran over the weekend.
Republican Congressman Cliff Benz says he supports the president's decision calling Iran hostile

push the administration for answers on what plan if any it has to prevent an

And I ended up getting a text message from Dwayne Younger over the weekend.
He says, hey, I'm out of here.
There's no point in staying here and allowing, just voting no with the Democrats moving forward.
But we find ourselves in a dangerous time, don't we, when it comes to the gun bills that
are up for grabs right now?
Yeah, I don't think most people recognize how bad this is.
You know, hopefully I'm wrong, but between the two bills that are being considered and,
you know, we expect that beyond the floor soon, I do not see how the average gun store
can survive the regulations that will be imposed on it, in addition to which now the Department
of Justice under this bill gets a list of every single gun that's purchased by every single person which they can do anything
they want with and keep forever. Now currently, Oregon law says that those
lists that are keeping being kept by the state police have to be deleted in five
years. Now nobody believes they do it, but at least theoretically there is that
rule there. There's no such rule with the Department of Justice. And this would end up being a big database then of firearms owners.
A enormous database in the hands of an organization that hates gun owners.
But the other problem is, and there are many, is that most of the regulations that will
be imposed on these dealers haven't even been written yet.
And so we don't know what they are.
They'll be written by the Department of Justice, which is a bunch of lawyers who hate gun owners.
So there's that problem.
Plus, it takes away your ability to protect yourself, and a massive collection of government
buildings goes away in spite of the fact that those buildings are not protected by anybody
else.
And then, of course, 3076, the gun store shutdown bill has
so many regulations that you know 24-hour video surveillance and all these
other rules that would apply to gun shows. And they would also have to keep
the videos for what years? Two years I think, two or three years. Yeah. Plus all
you how do you do that how do you move that operation to a gun show? So between
243 and 3076, we're talking about a fairly catastrophic situation where, you
know, the record-keeping of the Department of Justice assumes that you could buy a
gun to begin with. And I do not know of a gun store that can comply with these
regulations. And especially a small gun store. I'm thinking of the Good Guys, the well-burns of the world, you know, that kind of thing.
Absolutely.
You know, the unannounced inspections by Department of Justice looking for what?
And of course, you know, the proponents of this bill, I mean, give you a perfect example
of how demented all of this is.
James Manning, Democrat, I'm sorry, I'm sorry, Lou Frederick, a Democrat, a black Democrat from Portland, specifically said in the hearings on
these bills that the problem, the reason he's voting to impose these regulations
on gun stores is because the problem is the people in his neighborhood, okay?
So what do the people in his neighborhood have to do with gun stores?
Well, nothing at all.
I'm tired of going to funerals.
I'm not worried about someone carrying a rifle in Burns, but if someone's carrying a rifle
in my neighborhood, they're hunting people.
Well, dude, maybe you should address the people in your neighborhood.
The guns that are being used in crimes are not the fault of the gun dealers who are obeying
the rules.
And they say, well, all of these guns come from Portland
or Oregon gun stores and wind up in crimes,
but they don't say how they got in the hands
of the criminals.
So I believe this is speculation,
but I believe there are still members of both chambers
that wanna kill these things.
And of course, most members are only interested
in what's good for them.
And so we have a last-minute push here because of the process and the steps these bills have
to go through.
I believe even a day of a walkout could kill these things because there's still these steps
that have to take place.
And we have to keep in mind, and I know that you'll hear all this talk, that walking out,
we can't do anything
because if you walk out now, you know, they'll just have a special session, etc.
Well, and you know what? If they don't walk out, they'll still do it. So, if they
walk out and stop them, there'll be bills next year. If they don't walk out and
don't stop them, there will be bills next year. And in fact, this is the
absurdity of it. Well, the main thing to keep in mind here, Kevin, is that for firearms owners and along
with anybody else trying, even just the transportation bill, this 14 point something billion dollar
monstrous tax increase that is here, the Republicans could deny quorum right now and block this
stuff and there would be no penalty against Measure 113, the one could deny quorum right now and block this stuff, and there
would be no penalty against Measure 113, the one that says that you can't have 10 unexcused
absences because the law says that their session has to end Sunday.
We don't have 10 days left in this session.
And there's still not...
No, they have the ability to do this.
And the fact is, I mean, when I listen to Fred Gerard saying, these bills will absolutely
be coming back.
And then Christine Dresden saying, well, there's no point in our leaving because if we leave,
the bills will come back.
So you can't have it both ways.
But if they come back next year, you fight them next year, but you can kill them this
year. If they come back next year you fight them next year, but you can kill them this year You know the Democrats are on a jihad these bills especially you look at both of these bills, okay?
So now people who own what these these accessories rapid-fire actuators will become felons if they try to do any
They can't own them if they try to get rid of them. That's a felony
Yeah, the gun stores will be going out of business. The
magnitude of how catastrophic this is cannot really be understated. And for Republicans
not to understand that, say, okay, we stopped them now, they come back in special session,
we stopped them again, you do what you have to do. But you certainly don't give up now
because you're saying, well, you know, what's going to happen next year? right? This is the problem right now. We have arterial bleeding at the moment.
So we're not going to worry about your hangnail that's coming down the road. And you know, I,
I still think there's time. I still think it can be done. I think that people have to, you know,
we will, we will expose anyone who sells out people of this state. But the tax bills, all of these bills
that they've already passed, the demented stuff that's gone on with no support from
the people. Look, Shelley Beaux-Arts Davis, right before getting slapped around by Chris
Gorsuch very publicly, made the point that the tax bill is opposed two to one.
Yeah. And then Gorsuch smacked her around there.
It was humiliating.
It was embarrassing.
And she took it.
The thing is she took it.
Not only did she take it, Bill, not only did she take it, but every Republican on that
committee took it.
Nobody stood up and just said, hey, wait a minute, you can't impugn the...
What did Gorsuch say?
You're impugning the members.
Yeah.
I mean, he...
And it's like you stand up and you say, damn right we're impugning them.
Okay.
And she wasn't.
She was just repeating what a Democrat said.
But the fact is, is that this stuff is coming down the road.
It's very close to being passed.
The Republicans have the ability to stop it.
And they don't have to do much.
They really don't.
And so I'm still encouraging people.
I think it's still possible.
I think the outcome can be beyond
what people believe is possible.
But as I was saying,
Bozart-Davis in that meeting said,
look, the opposition against
this bill is two to one.
How come they didn't say that when Manning's bill came up and the opposition was 100%?
100%, yeah.
And this is, and by the way, this is the way, this is the reasoning here.
And your latest alert says, and at this point you call Christine Drazin and Senate Republican
leader Dan Bonham,
right? These are the points you want to drive home this morning, right?
Yeah, they're the leaders of the caucuses. This is their job to either get these people
to go along with what's best for the people of the state or to make damn sure they never
get elected again. You know, and I mean, certainly Bonham has nothing to lose because he can't
come back. Several other legislators have nothing to lose because he can't come back. Several other legislators have nothing to lose because
they can't come back anyway. But at this point none of them have anything to lose
because they can't get 10 unexcused absences. House Republican leader
Christine Drazen's number by the way. Both of these start with 503-986.
503-986-1451. Get on the horn with Republican leader Christine Drazin, Republican leader
Dan Bonham, 503-986-1726. So it's 1451 and 1726 after the 503-986. I'm going to post
this up and get this on social media too, Kevin. And you know, you think of this as
Hail Mary, they can do something, but they have to want too, Kevin. And you know, you think of this as Hail Mary,
they can do something,
but they have to want to do something.
And so we have to make them want to do something.
I do believe that some of them do want to do something.
I really do.
But the problem is going to be the ones
who are more interested in self-preservation,
whatever deals they're cutting,
whatever money is going to come into their districts
or into their pockets, you know,
because they have ways of doing this.
And that kind of selfishness is what is leading the state straight down the toilet.
All right, Kevin, I appreciate the update and we'll get it out there again, okay?

Friday I don't know what day it was there's a 1 30 in the afternoon and they
even at that hour the traffic was so wadded up where they removed one lane
but it's it's just an outrage and I think we ought to figure out some way to
do something about it. Okay one more more time about one lane you said?
I'm sorry, go ahead. Where they're on Highway 62 coming into town where it's so jammed up every
day. Oh, okay, yeah, yeah, yeah, all right. Now I understand where they have the
sidewalk going in, right? Yes, and even there wasn't even the rush hour
as 1.30 in the afternoon. It was horrible. Yeah, it was quite a mess here.
Now what they've done is that you have three lanes of Highway 62 and then as
soon as you get by Red Lobster now because of the Swidewalk, I guess, you're
shrunk down to two lanes. Now, technically there are then turn lanes
to go into the Red Lobster target area, right?
And then another light that goes in there.
But they ended up grabbing space
from what it looks like from the right lane
so they could put in more bicycle lanes
and also more or another wider bicycle lane
and also a wider sidewalk.
So they have taken away,
it appears that they've taken away space then
for, they call it the multimodal plan, you know, that kind of thing.
It's so bad that it wads up clear back to like daisies or where you come off of the expressway.
You're already jamming up. So it's making me flail about here a little bit and
So it's making me flail about here a little bit and thinking about contract law. And I've read in the law, I'm not a lawyer, but I'm a truck driver who can read.
And in every contract, there is the implied covenant of good faith and fair dealing, meaning
that no party to the contract can go about to deprive the other
parties of the benefits under the contract. What contract? The contract we have when we
pay these people to plan and do the roads for us, and what they're doing is they're
going about to undermine us and to restrict us. And I'm just wondering if they're in breach
of the implied covenant of good faith and
fair dealing.
You know, in effect they are, but as a matter of law, I don't know.
Because once again, we're always at war with the administrative state.
It is a state of administrators, you know, people who are not elected, people who are hired,
and we are traffic planners, or we are urban planners.
In this particular case, Highway 62 is managed by the Oregon Department of Transportation,
which is also filled with the same sort of group that is all in on sustainable development,
as you well know, right? They're all part, they all drink from the development, as you well know.

Medford did, I believe, had to sign off on this, perhaps a past city councilor,
council, as part of this. I don't think it was a complete lack of representation
that goes here, but on the other, they never really come out there and say, oh, by the way, you know, there's never a public hearing,
and I mean like a public hearing that has a big public meeting with real public testimony
and real public input. It's always you have to be in on a planning commission meeting,
or you have to be in on the streets meeting. You know what I'm getting at here? It's always you have to be in on a planning commission meeting or you have to be in on
the streets meeting.
You know what I'm getting at here?
It's like it's always kind of a hidden thing.
And there are so many attacks and undue influences brought to bear, it's difficult for the typical
person to keep up with it.
It's even difficult, I think, for us to figure out, no, where did this come from?
Right?
This came from a decision from a number of years ago, really.
Yeah, and they engineer it to be carefully calculated to be difficult for you, and they
obviously masquerade as your servants, but they're in fact your opponents.
It does feel that way, does it not? I appreciate the call and thanks for making it. I don't know where it goes at this point because you know

Our Achilles heel is the power grid. It is completely unsecured. We've allowed our manufacturing sector to be shipped offshore.

One week without electricity will result
in Americans killing each other.
July 4th this year could be the beginning of the end.
While America is in celebration mode,
terrorists could target key segments of the grid, shutting down communications and the supply chain. Within weeks we will
