It was fun, but it was too much time.
Starting point is 00:00:23 It was. All right. Where past much time. It was, huh? All right. Where the past meets present. Every Monday we like to talk about some history involving Southern Oregon, Northern California. And today we're going to touch on, before we get into all the Supreme Court stuff, and there's plenty to talk about with the Supreme Court from the last few days. That's for sure here, Doc. But the town of Kirby.
Starting point is 00:00:41 We had mentioned Kirby briefly in another profile here a few weeks back, but why don't you just fire into how did we get to where It's a Borough came into existence, right? You know, out there and all sorts of other things. Kirby, tell us about that. It used to be the county seat, right, in Joe County? It was, and that was, we laid the groundwork for that when we discussed Bill Grant's pass last week and when we had all the gold strikes happening in southern Oregon, at least in terms of in Josephine County, we had a number of different towns, if you will, that became county seats. And so, Kirbyville was running at the same time in the 1850s, but importantly though is the fact that Kirbyville then was named by the territorial legislature as a county seat, but what we don't know,
Starting point is 00:01:49 which is kind of cute, was that a year later, now we're talking about the 1850s, it was named as Napoleon. Napoleon? Really? Napoleon. And Bill, that is really funny because as Napoleon, that's because there was an influential landowner who greatly admired at this time Napoleon III, and it lasted for about a year. It's almost like tailholt and some of the other ones that, like if we're going through a rogue river... Yeah, yeah, I love that. Tailholt originally for Rogue River, but great story. tail hold originally for Rogue River, but great story. It is fun and it is funny. And then of course when the railroad came through Grants Pass in the 1880s, that very quickly became the new county seat. But as we know when we're going
Starting point is 00:02:38 down, this was really quite a route. So when I was heading down to Crescent City quite a bit on some books, Judy and I loved to go ahead and to connect with some of the towns that were down on the way on this route, which was a major trade route from the sea into Josephine and then Jackson County. But there's a wonderful museum there, being the Kirbyville Museum, which I would imagine with your interest, you probably have seen it sometime. You know, I've never stopped in. Would I find it interesting?
Starting point is 00:03:11 You know, I've driven past it all these years, just on my way to the coast. Should I give it some time? What do you think? Yeah, and actually what's fun about it, Bill, is that they have an early-day log schoolhouse with the all-important outhouse. And so the museum is very intriguing. But the thing they really always wore in my heart was the fact that damn, how lucky we are, my friend, to be living here now even with the Marxists that are trying to take over things because we got indoor plumbing. Yeah, I know outdoor privy is not all that much fun from what I understand, especially
Starting point is 00:03:50 in the winter. Now, the other thing I would add though, now did the one room schoolhouse have the dancing drag queen story hour like we had in the legislature a couple of weeks ago, or did they pass on that? And you know what was happening when Biden was non-comfirm mentist, run by the Marxists, and with Soros that was in there. So that was that was Biden's fault that we got the dancing drag queens in the state legislature or just just the overall culture? just the overall culture. Absolutely, because you see, without him being in there, you know, where the Marxist really took full advantage of his not even knowing what in the hell was going on, here we're
Starting point is 00:04:36 going ahead, my friend, and here we're fighting in terms of, like in the Supreme Court as to whether or not parents have the ability to take their children away from reading about drag queen Charlie? Yeah, you know, it is all kind of connected. All right, so before we get into that though, okay, we'll set that aside here at the moment. We had James Kirby who founded Kirby, right, and it was the county seat there for a while, and then as a stagecoach stop and all the rest of it, and it went away mostly and then declined after Grants Pass really rose to prominence because of the railroad. Is that what really drove that rather? Yeah, that true and then also the need to go to Crescent
Starting point is 00:05:27 City on delivering products wasn't as great because we had this wonderful railroad. Okay so the trade routes changed somewhat because of that. They did. That's a good point. They really did and you see goods and products could come right in on this radio on these railroads my friend that could go all the way from oh gee Portland which was a big port all the way straight through California all the way straight through to the East Coast it was monumental and it was the big event because it was so capital intensive. So many people tried with dreams and were met by bankruptcy and failure, but without that it would have
Starting point is 00:06:13 been some years before the United States really was able to become the power that it was. Yeah, interesting to think about. Yeah, I would imagine the railroad would have been much more convenient. Well, like we've said, the railroad coming through the valley back in that day would be the equivalent to the internet in those days. What we think of as the internet, the ease of moving because as you have talked before, to move goods from the coastal port and move them over the mountains and then coming into the Rogue Valley. Boy, expensive and must have been incredibly arduous in spots. Had to be. Right.
Starting point is 00:06:51 Excellent. All right. Well, we'll put the post up there on the town of Kirby in Kirbyville. And it's a great little post. There's more to it. We're just kind of glossing on the high points of it there, but it's more than it's a burl. I'm going to check out the museum. Thanks for the suggestion.

Starting point is 00:09:56 This is the Bill Meyers Show on 1063 KMED. Delighted that you are here once again because we have Dr. Dennis Powers, retired professor of business law where past meets present. Hey Doc. I don't think anybody's real, real upset about what happened with Iran's nuclear operations here a couple of weeks ago, but as a constitutional or at least someone that at least I want to think that I look at law and constitution a little bit, there's a part of what the left has argued with that I kind of think they may have a point that has to do with what's happening no matter what you think about what happened with Iran, what they were doing,
Starting point is 00:10:32 that the War Powers Act talks about there being an immediate threat necessary in order to invoke that power and do what you want and then talk to Congress about it. What would you say to that as a retired professor of law? Well, you know, I can remember the War Powers Act in constitutional law a number of times, not only in practice as to it coming out as the sidebar, but the key thing is is that it was enacted in 1973 going all the way back to the Vietnam War. And the whole thing is it's a notification act. It requires the president to notify Congress within 48 hours of introducing US armed forces to hostilities or situations. And then there's time limits on it that the president can only
Starting point is 00:11:25 exchange engage US troops and hostilities for a maximum of 60 days without explicit congressional authorization for continued involvement. So this was about trying to avoid Vietnam type wars. Would that be fair? Absolutely. And the number of presidents that looked at this were the far-left Marxist Democratic Party, which is really all it is right now and a big threat to our country. Seriously, my friend, is the fact that they're throwing this up even though Obama bombed Libya for seven months. Oh, I know. But you see, that's kind of what I was getting at, right? You know, I wasn't happy with Obama doing it. And so I'm always, I tend to look askance at
Starting point is 00:12:10 the War Powers Act. And I, you know, we're getting to this point where, what's the point of Congress having the power to declare war? It never seems to do anything with that or do that. That's true and I on the other hand in terms of looking at it very closely, the constitutional provisions of the US president being the commander in chief is a big check on the War Powers Act and in any event it was the perceived overreach of presidential power in committing troops to conflicts and not air flights, which is why there's another thing. This is just... Ah, okay. Now, see, that's really interesting.
Starting point is 00:12:56 And if we get to the point now where, if we get to the point where instead of sending troops or even air flights, if we send drones, oh gosh, maybe we can send drones wherever we want and kill anybody we want and nobody can say anything, at least according to the War Powers Act. Is that where you're going with that? Well, I think if we look at the way that Trump used this particular power in a one strike on nuclear facilities, I would really with all respect ask people to take a look at Chernobyl. And Judy and I watched that on Netflix, and when you see that about nuclear bombs, it is a horror as to what happens.
Starting point is 00:13:45 And in this case, you know, we have the Marxists and they just jump in their anti-American approach from against Elon Musk on Teslas, jump into against ICE, jump into against pro-Iran. Now this party is so corrupt, but in any event, as to your point on the War Powers Resolution, it's the fact that it had to do really with anti-Vietnam, all the intent, it had to do with the overreach of President Power in terms of troops, and that's why they didn't say anything about when Clinton, my friend, was going ahead and bombing the hell out of Kosovo. Yeah, I remember that too. And I had the same kind of questions in those days, and that's why I wanted to run it by you. Okay, well, and I understand why the Marxists don't want to question their own guy. Okay, I get that. All right. We get very tribal on our, well, yeah, you know, I know he did it. But on the other hand, I get concerned that we are getting into it. Well, he did it so I could do it. Well,
Starting point is 00:14:54 they did it so I could do it. And I still don't know if that's... I don't like Congress being emasculated, I guess is what i'm saying is because i look at uh... at congress as a needed check also and it seems like so much of what congress does these days is uh... offloading its authority onto whether it's the president or offloading authority into uh... administrative agencies tonight i'm not a big fan of that because i don't vote for those people
Starting point is 00:15:22 those administrative agencies you know i really do appreciate uh approach, of course, always, and your arguments, which come right in on different points. But in terms of different things such as upholding the ability to go ahead and continue to allow a private enterprise to determine how much money can be put into quote unquote rural. Yeah, this was the universal fee or access fee tax that's been put on telephones. And there was a lawsuit there, and the suit was claiming that the FCC overstepped, saying that it's up to Congress to be able to decide where tax money goes, not the administrative agency. Yeah, that was part of it. The other part of it, my friend, was the fact that the FCC had delegated its duty to a private corporation to set those amounts as to
Starting point is 00:16:26 what we pay in the telephone bill. But in a 63 decision, Oh Roberts came right through with the chance that he had because the fact they said, oh this is you know a legitimate purpose, there's no problem. We had the three-time losers with Kenji Jackson, who made $2 million off the sale of her book when she was going ahead and criticizing other Supreme Court judges who wrote the opinion. Okay. The Oregon legislative session came to an end late Friday night and Oregon lawmakers failed to pass a transportation package before the end of the session. When it became apparent House Democrats didn't have the votes for a nearly $12 billion package, they tried for a smaller last-minute bill. It would have increased the gas tax three cents a gallon and raised title and registration fees. It also added more hypothetical oversight to ODOT projects. It passed the committee
Starting point is 00:18:15 but never made it to the House floor. Governor Tina Koteck was angry, saying she'll likely call lawmakers back for a special session. A 19-year-old died at a southern Oregon swimming hole. The teen drowned after falling from a cliff into a rock quarry reservoir outside Ashland. Investigators do not believe there was foul play. The Oregon Department of Forestry has declared fire season for the North Cascade District starting July 1st. Probably the biggest one, you'd have to admit, was the nationwide injunction decision, the injunctivitis that we've talked about so often.
Starting point is 00:21:47 Is that completely over now? What does this really mean? And it had to do with the birthright citizenship issue, and I don't think they actually decided that part, right, doctor? You're absolutely right and on that it was a big decision as all the newscasters are going into as you're pointing out. That's where a single federal court could block a law or policy if they are located let's say in New York they can block it in Wyoming. Now let me ask you, was this a power that was created through some kind of rule, or was it something that courts just kind of took? How do you see this as a legal eagle here, huh?
Starting point is 00:22:39 Well, the far left just grabbed it for the Democratic Party because all of these quote-unquote universal injunctions, they had more against Trump this year than all other presidents before then. And it was a continuation of the Marxist lawfare, which is really what it is. And which is really what it is. And as to where they came from, it just ran afoul of every single thing that legal scholars had learned over centuries. All right. Now, it's interesting how this is being reported. I'll give you an example. You know, Le Monde, the French newspaper, right? They ended up putting out a statement about this, saying, the Supreme Court's decision weakens the few checks and balances capable of restraining Trump. Well, that tells you the way the French are looking at this, I
Starting point is 00:23:32 understand. They're looking at it from a biased point of view. But I would look at this as checks and balances against any president. Would that be fair? Well, that's quite fair, but you see what it is is that, we'll look at it, is that this was an overreach by the judicial branch against the executive branch. In other words, they were worried about, so many of these judges, these federal judges were worried about an imperial presidency, and so they replaced it with an imperial judiciary? Is that what happened? Yeah, and if you look at Kenji Jackson, who is a card-carrying Marxist, when you read her biography and why she is where she is... And she was one of the three on the losing side of that decision last week. And she wrote a total an opinion that was in
Starting point is 00:24:28 certain ways as bad as what Roberts did to try to go ahead and to justify Obamacare because judges just go especially you, we had the Chief Justice with the wins. But Barrett did a really good research by her legal assistants because she just said basically the very famous line, Jackson decries an imperial executive while totally supporting and embracing an imperial judiciary. Well, that's the mic drop then, isn't it? That's the mic drop moment. You wouldn't have an executive branch because they checked every single thing Trump was doing.
Starting point is 00:25:16 Yeah, and I just couldn't see the judicial heft behind anybody, like some district judge someplace or federal district judge judge being able to say that that the executive can't do what's under the purview of the executive whether you agree or disagree with it it is for a higher authority than i would have thought a district federal judge agreed it but you see i didn't know this until it came in from Pan-Bondi, which was the fact there is a total of 40 district regions for district court, this is federal now, that for 40 of those, only five were the ones that had 95% of all its decisions. And so the Republicans were asleep at the switch again,
Starting point is 00:26:07 in terms of when judges coming through, and no one ever decided that they were taking over and court-packing individual judges in just five Democratic with a K judicial districts. And so this is, and then you would then shop the, what do you call it, venue shopping you would then shop the, what do you call it, venue shopping, that sort of thing, or judge shopping, and try to find the appropriate one to get the judge to do the nationwide universal
Starting point is 00:26:33 injunction, right? Yeah, that's a good point because it's done all the time and it was totally done here because that's why Boasberg, who is totally out of lunch, would go ahead and continue to have decisions involving Trump instead of a neutral judge. Now let me ask you Dr. Powers. A constitutional crisis. Yeah, okay, now that the Supreme Court has smacked down the universal injunctivitis disease, which has been going on. What happens next? When is it that a judge in the federal district court might have something going on to the point where they can stop a presidential action, or is this just completely gone now because of the Supreme Court decision?
Starting point is 00:27:19 That is the issue, and most important that I was waiting for some of these commentators to tell us about, the reaction first of all, there's no question that class-action lawsuits are an exception to this decision. And the reason is, is it goes way back, because I read the entire decision and all 111 pages of it, but it goes back to old English law. That's how far they went. That's how far the communists are doing to a bill of peace, and that is what became the basic class-action lawsuit. Class-action lawsuit is an exception to this, and so voila! The day after this decision was announced, we had the ACLU, and that's why I keep mentioning please look at the Alliance Defending Freedom. They have won a lot of suits involving Oregon, and for some reason people here have been
Starting point is 00:28:22 donating there, and so they have been helping grants passed in the two major decisions already. But the thing Bill is that immediately the ACLU with four states brought a class-action lawsuit on birthright citizenship. Oh okay so they ended up changing tactics with the Supreme Court decision is what you're saying. So before we're just going to stop the president, now we're going to have class action status for illegal immigrants now. Isn't that great? Wow. Well, they're going to try to do that and so this was in Kavanaugh's dissent. And these judges and justices really showed how important this decision was as to what they were really and in their
Starting point is 00:29:07 concurrent decisions. The reason being is that Kavanaugh went ahead and said that basically you're going to have, which is happening now, two different court systems with two different appellate courts who will come up with two different decisions and what do you do with the district court that comes in with the class action lawsuit because that is a built-in injunction. Okay. That's a built-in injunction? Yes.
Starting point is 00:29:41 Okay. Because the way that you do it with a class action is you say, this has to do with, you know, you have to set up a class. It's a very complicated procedure. I kind of observed it one time. And what happens is that it's a lot of money for the attorneys and it doesn't work that well for the people that are being on the other side of it. And so this is what's happening. This is law fear. This is a constitutional crisis. It is continuing.
Starting point is 00:30:10 These are Marxists that are not giving up. So you're telling me though that even though the Supreme Court has smacked down many of the Marxist takes then with President Trump, they're just regrouping and the strategy is going in a different way with creating... Yes, because they're going for the remedy now, rather than what they're able to do, which is to gut the juggler. All right. What do you think will end up happening, or where will the decision ultimately be made
Starting point is 00:30:37 in your opinion on birthright citizenship, which of course generated one of these Supreme Court decisions? Where do you think it goes now? Supreme Court, because already the far left three spent most of their dissent having to do with birthright citizenship and arguing why that cannot be overturned by anyone, although it's going to be an interesting 50-50 decision once it gets up there. But the point that you had made also, my friend, is that take a look at all the decisions we had to go through, such as parental opt-out from LGBTQ
Starting point is 00:31:15 school lessons. Now see, that was a huge win, and I'm going to find that really interesting here in the state of Oregon, because the state of Oregon has decided that, you know, LGBTQ and climate change is the are the two one number one and number two faith I think that must be that must be pushed through public school do you think that is going to make it a little tougher for the public school system? They don't care. Oregon is so far left. Well I know that. Yeah, but you see it's it's shown in terms of what they're going to do and what they have done. So that will mean
Starting point is 00:31:50 though that Supreme Court decision on the LGBTQ teachers and things, that then gives parents total backing then to off their kids out of the garbage. Is that it? Well, you know, part of the problem, my friend, is that when you look at the law for all these years, you find that it depends on judges and it's not as much the law. Because here we're talking about parent opt-out from LGBTQ school essence. That was never on any bar exam that I took, and I passed three, no matter where it was. And so what we're seeing is this total lurch to the left, and our state is showing what would have happened if the chameleon had won. Are you then implying that the battles have really just begun even though we had these
Starting point is 00:32:38 great decisions from the Supreme Court for the most part. Yes, I am. And that's just, I wish I could tell you in all honesty, Bill, something differently, but the war has just begun. They are not giving up, and that's why they're not giving into one different thing, whether it's boys dressing in girls' bathrooms, whether it's LGBTQ having drag queen contests here in Salem in an elementary school, even after this decision was announced, it is a civil war.
Starting point is 00:33:15 And you think Republicans are taking it seriously as a civil war though? No, because they think that's the problem. Oh, okay. They laugh at it. They have forgotten that the whole thrust of the Democratic Party, no matter where you are, K, with a K, is to go ahead. There's only, depending on who's doing, a 50-50 split. Yeah, in other words, the revolution is always the issue, no matter what is being brought
Starting point is 00:33:46 up there, whether it's the LGBTQ and trans agenda in the school, it's always the revolution. That's it. It's not the particular issue that you might focus on as the Republicans, and we still have Republicans even in the state legislature that, you know, if we just get together with them and show them the error of the way and what good people that they are, they'll change their mind, right? I agree with you. I've been listening, and of course, like all your listeners, you are really a standing beacon on this. And unfortunately, what happens is that when push comes to shove and the courageous need to stand up, most people will go ahead for what gives them the least amount of problems.
Starting point is 00:34:29 Yeah. Well, Alliance Defending Freedom, I've spoken with their attorneys a couple of times over the last few weeks here, and they've been doing great work. Boy, that will help save lives, won't it? He continually states how many people die in that war weekly and how tragic it is. And it is tragic. What I wish he would do is tell Zelensky
Starting point is 00:40:32 in no uncertain terms end the war. All right, Jerry Dale writes me this morning, Bill, I see the article on KOBI about Ashland Peace House demonstrating and marching to Bence's office here in Medford. Someone should invite them to tend to their own business in Ashland and leave Medford alone. I have had strong recallings for the last five days of the first Thessalonians 5.3 about when people start saying peace and safety and indicates the start of the day of the Lord.
Starting point is 00:40:58 All right, Dale, I appreciate your writing. Let's see. This is what I wanted to get to. I wanted to share some of these thoughts about retesting drivers, right? I brought that up last Wednesday and was kind of getting people agreeing with me and a lot disagreeing with me too. Bill, Sam says, I agree with you on this retesting. I drive all day every day and the stuff people do is incredible. Most of the time when I see really dumb stuff or extremely slow driving, it's old people. I'm your age, I agree. Also, driving is not taught in schools. I had my kid go through RCC. I'm not sure most are taught the rights
Starting point is 00:41:35 and wrongs of driving on this road. Thanks a lot. I have Debbie, no, Greg, pardon me, writing, Bill, how are these people allowed to have a driver's license when they can't even operate a shopping cart? Speeding in the oncoming lane, illegal turns, random sudden stops, and not parking your cart when you're done with it for the love of decency. Greg, that made me laugh, I had to admit. Dave writes me about what it's like in renewal, the DMV license renewal in California. If you're under 70, renewal online. If tickets or accidents in fractions, you must make an appearance. Over 70, mandatory visit and eye exam. If any
Starting point is 00:42:15 infractions, you must also take a written test or enroll in an online driving school and pass. And a new update picture is required every three renewals? Rural offices became easier with the city offices becoming overcrowded and now it's a long way to book an appointment. People would drive to the rural office an hour each way and have a reason to visit a local Indian casino. Butch writes, I agree Bill, even though I'm 76 I feel folks should have to prove they can drive.
Starting point is 00:42:46 What really irks me though is that to drive a big truck I need a commercial driver's license. For 22 years I drove 2.5 ton and 5 ton trucks in the military but I'm not good enough to drive a similar truck. Meanwhile, any old codger with enough money can buy a 40 foot motor home and drive it everywhere. The scariest part is that they pass me and forget they're towing a vehicle. Oh, I've seen that butch, right? And they end up moving over a little too quickly and
Starting point is 00:43:12 then yeah, I've seen of that. Darren says, Bill, I agree with retesting at specific ages. Seems like 40 and 60 would make sense as those ages seem to go along with health issues and eyesight issues than every 10 years after that. That would definitely make the elderly parent, should you still be driving issue, much easier. If this were to take place through the DMV though, it would need overhaul to make it efficient. Yeah, that's a big one, Darren, isn't it? Big one. Doobie says, Bill, I'm with that other guy. There's no chance that the DMV has the staffing to be able to administer these tests in a timely fashion.
Starting point is 00:43:49 And now you've just given the legislators another way to screw us and get us out of our cars. These rules will be adopted. The DMV won't be able to meet the need. Our licenses will expire before the tests can be scheduled, and now you can't drive. If you drive while expired and you wipe somebody out, you'll be hosed.
Starting point is 00:44:04 If you have assets, they will hammer you. I hadn't thought about that, Doobie, but that's the reason why I ended up bringing up that particular story. Francine says, hey Bill, how about basing it on one's driving record and performance? Something like if you're over 55 or 60 and get two or three moving violations in two years, you'd be called in for a retest. Or if you're involved in two accidents where you're at fault within a two-year period. Not saying that these are the right timelines, but rather a universal requirement,
Starting point is 00:44:33 have it be based on one's driving performance if there appears to be a possible issue. And Grady says, Bill, make the test voluntary, and then the scores end up lowering car insurance. And then Mark says, how about pulling licenses or vehicles from a-hole tailgaters? When you're doing five over the limit they can easily pass or the boom-boom vehicles and you can feel a quarter of a mile away before you see them just allowing more room for grandma and grandpa. Okay Mark, I'm having fun with
Starting point is 00:45:03 that one. I did talk about in my benevolent dictatorship wishing a boom seeking missile, you know, with a shoulder fire on it, you know, just say boom, boom, boom, and then yeah, that probably wouldn't pass muster, but a febulcan dream, right?
