Starting point is 00:02:20 Now that there's anything wrong with Indigenous people, but I get tired of left-wing political soaps here, Dr. Powers. Welcome back to the show. Always good having you on. Oh, and you're absolutely right, because the fact that whatever it is, the destruction of holiday and of history is one that the present day Marxists, if you will, don't have any hesitation. Yeah, it's interesting. I was talking with a, I don't know if you heard the show about an hour ago, I was talking with Andre Domino, and he's president of the Italian-American One Voice Coalition, and what he has done with. that group has gotten together with the indigenous or Native American groups there and they're fighting for one another because, you know, as Andre was saying, Howard Zinn lied about the Italians and what Christopher Columbus did in his American books, which American history books, which are still you know, in our American schools. And the Native Americans are saying, hey, we want you to protect
Starting point is 00:03:21 our tribal names. We like our tribes in the sports teams. And we'll help you with Christopher For Columbus, he's saying this is BS, you know, what's going on. Very, you know, all this divisiveness, you know, going on in the culture. He's been fighting. Excellent point, Bill, especially when we take a look at, in terms of indigenous people and working together, we call it Thanksgiving, that it turned out that the one party that's trying to take over this country just looks the other way. And you're absolutely right about the Native Americans.
Starting point is 00:03:55 because I've talked to several that there were just people I knew at SOU. I never concerned myself with the subjects that they'd be teaching, and they were coming out with the same type of thing. I'm just tired of this point where you have to be self-flagellating over absolutely everything. Just sort of done with it. I like that term flagellating. I like that. That's a good way of doing it.
Starting point is 00:04:20 That's the problem that we have with a party that was totally taken over. over by the far left. And at this time, you know, the surveys are showing the fact that Americans just want to get back to living our life in the pursuit of life, liberty, and the pursuit of happiness. Indeed. Amen, brother. Let's talk today about some great American history still here in Southern Oregon, still at work. And it's the Talent Irrigation District. And I guess the earliest origins, really, we're talking summer of 1852 with Jacob Wagner of Wagner of Wagner Creek, right? That's absolutely right, almost 175 years ago.
Starting point is 00:05:04 And now today, my friend, we are able to see why you needed the TID because the fact that growing crops is going to be typically spring and summer and our rains are in fall in winter, and you needed a way of preserving that. And then we throw in the orchid boom, which is where the TID really came into being in about 1916. And then what we had here was that you had the first organized area, which I was really interested in, came in, Bill, and it had water from the Little Applegate River tributary and also from Wagner Creek that you were mentioning that was the first irrigation that was started by Jacob Wagner all those years ago. And this was for, it was the talent lateral, but this was also Harry and David.
Starting point is 00:06:06 And I remember Bill some, geez, years ago, when Judy and I first came up here and we were looking at a house to purchase, and I came across homes outside of Ashland that my friend were TIG, G, TID, the district, TID, that had these little concrete siphons that were going around, and the broker said, yeah, that's the talent irrigation district. I said, say what? But in any event, we look at all of the reservoirs bill. We look at all of them, whether it's Hyatt, Howard Prairie, immigrant. They were all put together by TID. And they did it because the fact that for all the crops and the agriculture,
Starting point is 00:07:05 we needed to be able to store water that then would be, then supplied to a lot of laterals, you know, in terms of the spring and summer all year around. Yeah, I mean, honestly, you could really say that had it not been for a talent irrigation district and various others' ways of impounding and getting a beneficial use of water, Southern Oregon would not be what Southern Oregon is today if it had never been done. Yeah, and if I look at the present with Salem and the idiots in charge, which is really what friends of mine who are even Democrats are saying, you know, we would still have just a prairie for Medford. The whole thing is that when we look around and we see all of the, not only the fruit trees bill, but also we see all of the irrigation, we have this district that has a solid contract.
Starting point is 00:08:05 with the Bureau of Reclamation went ahead, and they have over 16,000 acres of land that they're providing irrigation water for. They have also over 3,000 landowners, and then we get a good idea of just what climate change really is in a way a real fraud. I recall, as you do, and others, my friend, in 2021 because of drought conditions, TID cut the water supply off in mid-July.
Starting point is 00:08:41 But you see, even if water is delivered, customers still must pay because water usage is not meter. They have to pay for the maintenance of all this. So whether you get water out of it or not is irrelevant to the fact that you got to support that. And you also write in here that in the Great Depression, I guess, like so many other business is it had to be reorganized right bankruptcy farmers and irrigators are going bankrupt even back in those days too and that was a big deal there was a great depression uh and uh with the orchard boom really uh settling out uh in a lot of things you had the situation where a t id uh had to be reorganized because the farmers and irrigators uh couldn't go ahead and and make the money to
Starting point is 00:09:30 pay to TID, and then World War II halted all construction. And so after World War II, you had Howard Prairie, you had a new reservoir there that was constructed. And didn't they also increase the height of the earlier dam, I think? Didn't they do that? Oh, well, when we came to Immigrant Lake, and this is in 1960, they doubled it to 204 feet high. And then you had different laterals, which is the way you get the water from the storage facilities, which are reservoirs, which we've all fished in, picnic by, voted in, enjoyed. Swimming in, too, for that matter.
Starting point is 00:10:13 You know, do you think that, now, do you think that if today, if we were just setting up Southern Oregon today, could you even do the town of irrigation district today if you had to, even if you had the water rights? The environments wouldn't allow it, and that's a problem because it'd say, no, leave the earth the way it is. And we don't want agriculture because the cows give CO2, which, I mean, all these fallacies. But, you know, the other thing, Bill, that we're reminded of is that here, the water supply situation did not improve in 2022, but then over time, with longer, stronger winter rains, in Snowpack this year in September, all the lakes were greater than 70%. And, for example, what you had back in 21, immigrant lake was at 3%. And so you had this change as that it depends. You have El Nino that comes in.
Starting point is 00:11:17 You don't have all these considerations that are coming in by the Socialists. Well, it's a great profile. We'll get that up here today, Doctor. And there's plenty of current news to discover here, too. And we've got to talk about Insurrection Act, what's going on in Portland. Senator Ron Wyden, of course, by the way, did you hear Senator Wyden's ex post over the weekend? Did you hear that? Oh, I didn't. I didn't. Okay, here. He was in his neighborhood. And, of course, you have to laugh when he says his neighborhood. I've got to play it again. Hey, everybody. Ron Wyden here. I've been driving around in my name. neighborhood in southeast Portland. Donald Trump says our city is so scary. Oh, pumpkin. Yep. So he's making fun as he's in a nice little residential area in southeast Portland. No problem over at ICE is what he's implying. And that's exactly what we're seeing in the court decisions as well. Is this the lying that's going on? We've known about Portland for for decades.
Starting point is 00:12:22 Well, let's talk about it here in just a minute. and talk about it, you know, where the lawfare goes here, Doc. All right? Let's do that. Okay. Starting point is 00:12:43 It's the Bill Myers Show on KMED, Southern Oregon's Place to Talk. 829, where Pass meets present, Dr. Dennis Powers is here. Dr. You know, Tom was asking me during the break. He said, Bill, why is it? Could you ask Dr. Powers, what is it in the sociological or socioeconomic or the business side? What is it that is just turning Portland into a communist hellhole? Do you have an idea? It's kind of a big question. You know, if we could all answer that, I'd just say we could probably cure it, but maybe not. I don't know if there's a shot for this or not. What are you thinking? Well, you know, when I go into my Zen meditation legally, Ome, the Portland used to be up to about 20 years ago, because I even would go ahead and have conferences up there, you know, in terms of business attorneys across about four or five states. and it was a beautiful town with trees and places you'd go to. But then slowly but surely, when you had the overall change from Republican conservative, especially with the two far-left senators that we have now,
Starting point is 00:14:07 you could see the changes happening in Portland in terms of more types of of homeless coming in. So, in other words, it was essentially bringing in of a people of an attitude of less discipline, a less discipline to culture, I guess. And no regard, you know, for the rest of us, for, I hate to use the word, but it's true, family values, values that we have, which is not getting for boys to dress up in girls' dresses. The whole key thing here is that I saw this happen. to where, Bill, I have a friend of mine I play bridge with, and he is one of the ones I know
Starting point is 00:14:54 that's never voted for a Republican in his life. So two years ago, he went in, totally naive. I told him, you know, be careful, into Portland. He wanted to have a weekend with his wife. He was driving in from Idaho. And he was at a state. stop like getting out when he was leaving, and out of the corner of the eye, he saw a homeless person ambling over that started beating on his window and trying to open a door to get in. And this is just to get on the freeway to get out of Dodge. It's what we're seeing now is the total lack of values and ethics by the administration in Oregon and by the Senate, and by the senators to where it's more important for them to keep their power, and the concept of power
Starting point is 00:15:51 corrupts absolutely. I would imagine that, you know, at some point, though, the disorder in some ways does, but you see, the disorder in most sensible areas would tend to lead to a throwing out of the current regime, as it were, but it seems that the regime gets thrown out, but the sickness remains. None of getting at here? It's like, what is it there? You know, there's just no possibility of changing that from the looks of it. Well, that's true.
Starting point is 00:16:24 And what happens is that, especially in this state, which has been californicated, you know, in terms of where do you go to have some sanity and some decisions made for all of us who live in southern oregon for example and what happens is that they leave they board up and they leave businesses have left uh and then you have this this shell game that's gone on by our leaders which i have uh you know uh you know people i keep up with like you bill uh over uh in new jersey in new york in different places where i'd gone to school and they'll say what the hell is going on with portland and i'd say you'll see you'll see what's going to happen if Mombani gets elected in New York City.
Starting point is 00:17:16 Yeah, you'll get more of it. It happens in Portland. Yeah, all right. So just form, I guess form is lagging function in this particular case. The function. Good point. Okay. Let us, before we get to the phone calls, people do want to ask a question or two about some
Starting point is 00:17:32 things here. Where are we when it comes to the battle to bring Portland and its disorder to heal? And that is obviously what President Trump has been working. on through the various issues. Now there's conversations about using the Insurrection Act. And I would dare say that maybe, you know, when people say the Insurrection Act, you're thinking, okay, the people are rebelling and they're trying to overthrow the government. It's just not it.
Starting point is 00:17:56 But I would dare say insurrection could almost be defined when you have local law enforcement that does nothing to enforce law and peace and order, you know, around federal property. Maybe that's where they're going with something like that. And that's kind of the real insurrection. Any thoughts? And that is where the issues are centering, because the Insurrection Act goes back to 1807. And this empowers the president to nationally deploy the U.S. military and to federalize the National Guard units of individual states.
Starting point is 00:18:33 But it's for the suppression of civil disorder, insurrection, armed rebellion. But as you're pointing out so well, it's not only. a statutory exception to posse comitatis that limits the president's ability to deploy the U.S. military to enforce either civil or criminal law. It's one to where it allows district court judges, federal district court judges, that are fearful of having different far-left groups protesting in front of their house like they saw with what was allowed underneath Biden and Garland with Supreme Court justices. They are concerned and fearful of Antifa. And so what happens is as they censors, you're pointing out so well, on what do you mean? What do you mean by civil
Starting point is 00:19:33 disorder. What does that mean? How do you apply the facts to the legal concept of suppressing civil disorder? And that's where it is. And so in my Zen meditation over some hours, I decided to read through a number of the district court judges with their opinions, especially with where they would put in temporary restraining orders, which are not supposed to be. to do with the deployment of protecting ice facilities. But what it comes down to is two things that are practical. And if I was practicing law, I'd have to be a little more tiptoeing on this one. But I'm retired. One is the fact that judges are human and judges who were appointed by Democrats or in immigrants situation, she was very liberal on the way back in terms of
Starting point is 00:20:38 Well, she was appointed by President Trump, but essentially appointed by Wyden and Merkley because they give approval on these kind of things, right, on who they would prefer? Well, that's where Grassley is making a horrid mistake, and maybe Grassley, who's head of that Judiciary Committee, will stop deferring. to what different senators in far-left states want. Yeah, I would hope so. What's the point of having presidents choosing federal judges or approving and nominating federal judges
Starting point is 00:21:14 if all they are are applying for the commie team? Yeah, I don't make sense. That makes sense. Being on the list of what the FBI was centering on when they were covering Republican senators to find out whom they had talked to, what was about where were they, where were them, maybe he will. But the first thing is, is that on Democratic and even immigrant, there is this fear,
Starting point is 00:21:40 especially if you're dealing with Portland, that Antifa is going to show up at your house. So they are ruling, in your opinion, to keep Antifa from going after them. Ultimately, you're thinking that's what's driving a lot of the TROs? this is this is where it's not just a TROs it's where they're going ahead and ruling against the Trump administration and the other thing bill is not only that the other rule is that judges want to be promoted and I knew this going back to you know all my times in the law and talking to judges who are running for office and I'd say okay after this one where do you want to go and the only way you're going to
Starting point is 00:22:24 get a promotion to, let's say, in federal, the Court of Appeals, or the odds are against you, the Supreme Court, you follow the party line. Plus, the fact is, if you are a great fundraiser and really are connected with the Democratic Party, which is, you know, lurched to the left, you're going to go ahead and vote with them. Yeah. Do you thought, I'm just asking, though, for, I know we're speculating at this point, one of the challenges that we've had is that, is that Oregon, and especially Portland, is wishing to ignore federal law in jurisdiction, okay? That's pretty much where they are, sanctuary, whether it's sanctuary or not. I think they really wish to ignore this. Could you see the time coming sooner rather than later in which President Trump just
Starting point is 00:23:19 ignores the court. Could you see, okay, if you're going to ignore it, I'm going to ignore it too, hey, have a nice day, and I'll tell you what, you go ahead and bring your army against mine. I mean, I'm not advocating that, but could you see something like that happening? Only if and when the Supreme Court rules against Trump. Well, you know what I'm getting at because, you know, there is precedent or there's a history in which which, yes, Mr. Marshall has given his order, now have him enforce it. You know, that kind of thing back in the day.
Starting point is 00:23:55 Yeah, I don't see that. What I see, though, is this. First of all, once it gets up there, you know, where the red herrings are thrown out, is with the decisions that are coming out that the drive-by-media jumps on, oh, the Insurrection Act doesn't apply, oh, posse comatist does apply. all these different things, and, you know, it would never happen. I really hope that there would be for journalists a licensing, but we never could do that because of the First Amendment,
Starting point is 00:24:31 because some of them are, they're just pulled in so many directions. They cannot come up with the right thing. But the key thing is when we look at really where it's coming down, it's the second amendment, which has to do with the executive powers. And in there, you have all these good arguments. Yeah, well, what you're really seeing, well, I think what you're really looking at right now here, doctor, is you have an executive that is wishing to run the executive. And the executive, of course, has been taken over by the administrative state, really more and more in which you can't fire people, you can't do this, you can't do it. I think President Trump's going to stretch that and stretch it back to maybe what it once was, you know, in the day.
Starting point is 00:25:16 But I'm running short on time, so I don't want to run out of our daylight here at the moment. I think you're right. Yeah. But I can see this. Let me ask you this as a point of law, rather than using the military, rather than using the military or the National Guard, could President Trump expand greatly the federal protective services? You know, the police services that you'll see the FPS trucks going around here? In other words, put a hundred security guards around ICE and just have them hire to do, to take care of security and issues, or would that not be effective? I'm just raising a possibility where you're not using the military.
Starting point is 00:26:03 Bill, I think he's already doing that in a different way. Yes. Because where he's also doing things, such as he's holding off on the National Guard going in. into Portland because he wants to get the appellate court to go ahead and rule two to one saying that he is allowed to do that. He's been putting in more ICE officers into Portland who are coming out to go ahead and defend. And you're absolutely right with our governor going ahead and telling the police, you know,
Starting point is 00:26:38 whispering, don't support them, but never coves with the rest of it. I want to get to Washington. Yeah. But the key thing, you know, the key thing is the fact that I am looking forward to these arguments coming in after the election. And Bill, as we're thinking about this, I would love to see after the 2026 House and Senate elections before the national election for president two years later, Bill, I would love to see them come in with a RICO against one of these states, because with their ordering and proving
Starting point is 00:27:24 it for the police not to go ahead, which is your point, the police in there to protect federal, and that's the supremacy clause, and also... Yeah, yeah, you know, if you're not going to, you know, if you're not going to protect the federal officers, you can't stop the federal from protecting the federal officers, too. It's like, you know, okay, it's right, all right, you don't want to help, you don't want to do anything about this, but you're going to say that we can't do anything. I don't know if that works. I really don't think that works. And finding out who is funding all this and then going after them, because that is really starting to bring results.

What do you say?
Starting point is 00:28:51 Well, two things that the president's doing that are interesting. One is trying to get mail-in voting canceled, where you have to vote in person with ID. The other is cleaning the voter rolls. Right. I was wondering how Dr. Powers thinks that might be going. Any thoughts on that, Dennis, about the cleaning the voter rolls? I know that there's just been an executive order done at this point, and Harvey Dillon has taken the lead on that particular issue from the sounds of it. Yeah, and these are good points. First of all, on cleaning up the voter rolls, there's litigation going over it, but we haven't had one that has been made yet.
Starting point is 00:29:39 although in Oregon, as I understand, they have, they being our governor, had said that they will allow the list of on the voter role as to what can, of course, they got caught, you know, with the fact that you had illegal immigrants that were voting. Yeah, and of course they're claiming that, well, we can't give you this information to federal government because there can be social security numbers on them. I'm thinking to myself, I'm laughing. It's so stupid because, yeah, the federal government issued those Social Security numbers, you morons, in Salem. But, you know what I'm getting at, right? That's excellent, and that's exactly, exactly right. And what was that first point? I guess what he was trying to find out is if you think that they're going to be effective, voting in person for federal election and cleaning the roles is what he was going.
Starting point is 00:30:37 Yeah, there are states that have, because they have a more balanced approach that we have here in Oregon, that have gone ahead and have been using, you know, voter ID, primarily they had a couple of lawsuits down in the south that upheld it. Yeah, well, you know, there is talk, though, that what they're trying to do is get rid of the, you know, election week. like how Oregon allows, you know, vote by mail, the votes can just dribble in, you know, for the next week or so after the election? See, our state has been Californicated. Oh, yeah, no, and I agree with you, but I'm saying, but when it comes to a federal election, the feds could actually make that change, couldn't they? And they could say, no, you can't have, you know, election day is election day,
Starting point is 00:31:30 and the stuff has to be in if you're going to do vote by mail, couldn't they? Well, I like that argument, but on the other hand, one of the issues that has come up is state sovereignty and state laws as to federal sovereignty and the supremacy clause. And it gets to be complicated conflict of law because it has to do with who has preempted it. So it's one of the place where the California cated judges will actually rule against it. And what they do is they rule against, you know, this is racial profiling. And we should have more...
Starting point is 00:32:11 Oh, okay. So it's racism to ask for ID. Great, got it. Okay, I'll remember that next time. And next time I asked for ID. And it's totally, it's totally BS. But you see, we are in a civil war. And if we connect all the dots, there's no other conclusion.
Starting point is 00:32:27 So you're not thinking that there's any real chance of them forcing that issue, next election cycle? I think we have to wait past the elections coming up in 20. 26. All right. We'll take that then. A, doctor, I want to make sure I get everybody squeezed in here. Brad, water wars. You wanted to go back, I guess, on the Talent Irrigation District Talk. Go ahead. Let's hear it. Yes. Dr. Powers, I'm so happy to hear you talk about how important it is to pay attention to water policy. And, doctor, I want to remind you, Pat Basme's present, back in 2000s when we saw the largest incursion of federal interference into the farming community and history, the United States, the lawsuits that got the water turned off to the Klamath
Starting point is 00:33:13 irrigation system, beginning in April of 2000, turned the water off to 1,800 farm families that already had their crops in the ground and turned off irrigation water to over 200,000 acres of ground that had already been planted. Good point. Yeah, and I am very sympathetic on that argument. argument, because when we look at the farmers and the way that liberal administrations federally have gone ahead and looked the other way to go ahead and get the fundraising from Native Americans to a certain extent.
Starting point is 00:33:59 And you've got to go into the different tribes, but Native Americans, you know, vote conservative as well as they do liberal. You have this pandering that happens in terms of 2000, and you're right. It's terrible. I appreciate the call here, Brad. The other thing I was going to ask you, before we get to the next call, I forgot to ask you about this here. Oh, Clinton was the president. Yeah, I know.
Starting point is 00:34:24 Yeah, that certainly helped, I'm sure. What I was wondering about is how successful do you think the president will be in reducing the bureaucracy, the bureaucratic hiring and the actual body count here? Now that we're still in more than two weeks of partial shutdown time. Well, I love that because of the fact that they are already going ahead and furlowing tens of thousands of federal workers, and then they'll be up to them once they get this thing settled as to whether they're permanent or if they'll pay them for back pay, which will go into the Supreme Court again. But the key thing here is, as you're pointing out so well, is that the shift and lurch of Schumer and the rest by AOC and by the far left like Antifa has created these problems.
Starting point is 00:35:25 I see this as being a longer than shorter shutdown, unfortunately, because this is more than politics. this is by the fact that the Democratic Party, which is now the Socialist Progressive Party of the United States, has, it looks at this as their power survival. Yeah, well, I would say that reduction of enforced there actually reduces Democrat power base in D.C. So that doesn't particularly bother me at the moment. But hello, Deplorable Patrick, you're with Dr. Powers. You had a question. I don't know if we can answer this one, but about the Jace case.

Starting point is 00:36:15 Well, I appreciate the subjects I've been hearing, but I want to ask on another area about something that's kind of a bit of a technicality, but it's interesting to me. At least on the Sean Hannity show, they advertise this thing called a Jace case where you can have a supply on hand in case of emergency or supply chain issues or whatever. Medicines just have there on the shelf in case you're on your own and all that. And so suppose, so go, you get on the phone and they talk a little and they send you this case
Starting point is 00:37:03 and then it's you got it at your house. Now, if my daughter has a sore toe and I say, oh, let's get you some oreal mycin for that, then that makes me the one prescribing, doesn't it? Oh, okay. You know, I've wondered about the same thing as I watch that, and we've even gone ahead and purchased one of those kits. key thing is that I think there's more of a liability that would then go against those that are selling it
Starting point is 00:37:41 and those that are manufacturing it in case something really goes wrong. Yeah, I would imagine, though, from what I understand, though, they do consult with you and prescribe them to the family members that they consult. I think that's how they may get around that. I'm not sure about that, though, DP, all right? Oh, and you know, that's a good point, Bill. I agree with you. The only thing I'm wondering about outside is that for product liability,
Starting point is 00:38:06 there's a lot of things that could happen. And in looking over the medications, I didn't find anything that would be something you really needed a prescription for, but your point's valid. All right. Starting point is 00:38:22 Yes, Dr. Powers. I was wondering. I've heard some buzzing around about after, you know, if we don't. get through a lot of this craziness, that Oregon may succeed. What exactly is meant by that? Succeed. Oh, could you, I couldn't quite hear you. Did you say Succeed?
Starting point is 00:38:37 Is that what you said? Oh, oh, okay, secede. You know, it's nice to think about including the eastern half of Oregon going into with Idaho. But the problem is that on any succeeding, and of course it's interesting, because we have more of a problem of seceding by these far-left Illinois in California, especially given the fact that they had already done that and caused the Civil War over slavery. But your points well taken, I think the key thing that's coming in is that you need to have eventually the positive support of the House of Representatives. In other words, you need a federal, you know, legal approval to any of those succession,
Starting point is 00:39:35 which would be going ahead and joining up with another state. Yeah, I mean, technically possible, but that's the issue I have with Greater Idaho. Love to do it. I think I can see whether you want to do it, but you'd have to get the state to agree. So it's like you have to beg your tyrants to, you know, to let you go, and they haven't wanted to do that. Doc, I agree, Bill. Yeah, I'm just out of time.
