Always nice to take a, like to take a look back, rather.
And also what else is going on?
What the, if you want to call it the legal insurrection or the legal lawfare kind of report,
we'll certainly talk about that.
Kerry writes me this morning about MLK Day.
Bill, according to Fox News today, President Trump is calling an end to MLK Day and June 10th.
I think that this is ammunition for the left to strengthen their claim that Trump is a racist and helps black people, just saying.
That's what he was saying.
Well, this is, I ended up looking that up because I had not heard about him wanting to get rid of MLK Day in June 10th.
But what the AP is reporting is that the law.
list of free days at National Parks included Martin Luther King Jr. Day and Juneteenth,
which is June 19th. The new fee admission policy, there's a new fee policy taking effect
the first of the year and one of several changes, which means that Trump's birthday free at
National Parks, MLK and Juneteenth have been cut. So it's not eliminating MLK Day or Juneteenth, but it is
about eliminating them for free day at National Parks. I don't know if that's the same thing
or it's a difference without a distinction. I hope that helps. Okay, so that does appear to be
what's going on. And let me just to make sure that I have this because I'm going off of just
some basic summaries from the AP story. Let's see, yeah. National Park Service will offer free
admission to U.S. residents, rather, on President Donald Trump's birthday next year, which also
happens to be Flag Day, but is eliminating the benefit for Martin Luther King Jr. Day and
Juneteenth. So he's bringing Flag Day in as a free day, which also happens to be his birthday,
but Flag Day is an actual national holiday too, or at least, you know, a commemorative holiday.
But MLK Junior Day, Juneteenth, no, from the freebies. You'll have to pay to go into the national
parks then. So that is the day. That is the day. Of course, the AP will come at it from, this is the
latest example of the Trump administration downplaying America's civil rights history.
Well, I've got to tell you, folks, I've been around here almost 65 years.
I'd never heard of Juneteenth until they made a big deal of it just a couple of two or three
years ago.
I had never heard of Juneteenth.
Now, maybe if I lived in Texas or some other place, I would have heard about it.
And as far as ML Martin Luther King Jr. Day, you got a national holiday.
I don't know.
I guess we don't want to, well, how many free holidays do we want?
I would dare say that Flag Day is more uniting than dealing with Juneteenth and MLK Day.
That's just my own opinion, but maybe we can talk about that, all right.

What are you thinking on that?
Well, there are two problems with it.
The first is that America loses its birthright.
So, in other words, when I was a kid, you could get into national parks for free.
But now, and ever since Reagan, they basically stole America's right to visit it.
own property.
You know, we the people own the national parks, and we should be able to relax in our
national parks for free.
Okay.
Now, why is that?
Because there are costs that have to be washed out of that, too.
It's not free to run it or to have them open.
You understand that part, right?
Oh, I don't disagree.
But the fact of the matter is that the second part of this scam, and you didn't mention it,
not only is he dropping Martin Luther King Day in June 10th, but he's,
adding his own birthday.
No, it's Flag Day, which happens to be his birthday.
Which day?
Flag Day.
Flag Day happens to be President Trump's birthday, but he's not adding his birthday technically, wink, wink, nunch,
look at Fox News, look at ABC News, look at The Chronicle, they're all headlined.

his birthday. Yeah, but it's, but it's, but it's, but they're saying adding flag day. See, that's what
they're not mentioning. No, they don't. They don't say flag day. They say Trump's birthday.
That's what, well, that's what they're saying. That's what I'm getting at here, David. That's what
they're saying. NPR. They all say to add Trump's birthday. Okay. But way is, okay, so does it just
happen to be, does flag day just happen to be Trump's birthday or is Trump's birthday just
happen to be flag day? Which is it? Hmm?
Well, let me click on Fox News. Let's say, is that the one that you love?
No, I don't love any of them, David.
You know what I would say? I don't think there should be any free days at national parks, except for one thing.
Show a copy of your IRS tax form so that you actually demonstrate that you pay taxes, then maybe you get in free.
How about that?
So maybe Trump wouldn't be able to get into the park because he doesn't pay taxes.
Don't you remember when last term, when Trump was supposed to be given away his salary back to America,
turns out he didn't do it.
He'd pocketed it the whole time.
Okay.
You know, the guy is a liar.
He's organized crime, and he's stealing America's birthright because he's pretending that he's such a God that he can
add his birthday.

But since he called him the N-word, then, you know, it becomes, well, get out of jail free card.

Interesting times, huh?
Sure, is, and Bill, I'm glad you took those two phone calls
because, you know, one was obviously a voter for Biden,
and then the other one was a little more independent.
But the interesting thing, though, is on the June 19th,
is that still, even here in Ashland, people are shaking their heads
and were saying, what the hell is June 19th?
It was something that Biden just came up with.
But you're right.
We've got a pallet cleanser coming up.
Oh, yeah, absolutely.
And before we do that, though, I just wanted to touch on that.
Like I said, I've been almost 65 years old.
I had never, ever in all my schooling, all my cultural experiences had ever heard of Juneteenth.
Now, I know it was a big deal down in Texas and some areas that were subject to this.
But I always thought it was kind of a nonsense, nonsensical thing to have.
that is a national holiday. Of course, the state has recognized that as a holiday, too,
here in the United States, because it's a sop to the civil rights rackets, in my view.
But, that could be me.
Actually, you know, you're right because the fact that I can remember, and I'm not that old,
when we would celebrate Lincoln's birthday, who was a Republican, and George Washington's birthday,
and then to have them all go out, and then they have a president's day,
and then also to have June 19th and some of these other ones,
it's just too bad, you know, with the way that the far left has chipped away.
You know, I remember when my kids were going through school,
and they would have questions.
We'd talk about it, and it wasn't like we had the sixth graders that were talked about,
you know, yes, actually on Friday, Bill,
about where you could have a teacher saying,
if you have a feeling that you are a different gender,
then you should go ahead and talk to me.
Yeah, nothing like being groomed by your government school teacher, right?
Well, also the fact is that these are sixth graders, you idiots.
I know.
I know.
And people think that I'm weird for wanting to dismantle the public school system and start again.
Oh, I agree with you because it's just not there.
I've been on very quickly on some of the book tours I've been on, and I fly into these countries from, yeah, they are countries from Detroit, you name it, to Atlanta, and I'm coming in there, and then I get to talk to people, and I'm saying, this is a strange place.
Got to love it here, Dr. Dennis Powers. By the way, on changing the National Park Freedom to Flag Day, or Free Day to Flag Day.
Yeah, it is Flag Day because you couldn't do it on an individual's birthday.
You can't do it on an individual's birthday.
Okay, all right, that's what I thought.
I mean, they showed that with, except the problem is you can do it with...
Well, what about MLK Day?
Because they did have freebies on MLK Day.
That was an individual, wasn't it?
Yeah, but you know, the thing I was going to mention about freebies is that that's a very creative argument
is why you want to keep MLK in there and keep June 19.
in there, but basically you can get a card to all the national systems, and then you can get
into their website and see when you don't have to pay.

Now then, is President Trump going to have his horse appointed to the Senate, though?
That'll be the next question coming from the left, I'm sure.

Andy Marr, football star, coach from a tiny town.
Rip it up this morning, Doctor.
Who is he and why should we love him?
Oh, you know, he really does stand out when I came across him is the fact that Andy Maurer was born in tiny towns and he even played high school football in prospect, which is only, you know, we've gone through that.
I've gone through it to try to pick up some of the trails to go into the Rogue River, but he played football, and this would be in the late 1960s.
four prospect on an eight-man football team.
But he was, you know, very athletic, six foot four, two hundred twenty pounds, got to a scholarship
at the University of Oregon, and was drafted in the NFL draft in the third round.
He played eight seasons for this guy from tiny prospect in southern Oregon, and he set then
records for a four-seasoned consecutive game played streak as an offensive lineman from 1970 to
1973. But you know where he really stands out, Bill? Where's that? He comes back to Medford,
not only as a successful businessman, athlete. I'd love to see some of these athletes we have now
in NFL football, comes back here, successful businessman, and he coaches at Cascade Christian High School
starting in 1992.
They didn't even have a field then.
Yeah, they didn't, no field at that time is what you write here.
Wow.
And so the thing that stood out to me was not only NFL, but also, my friend, it was the fact
that he reached the state playoff six times and won the class 2A crown.
And, you know, Cascade Christian is only about 300 students now.
But he looked at it, as Danny Miles did, and deserves the kudos with his family, was that he didn't believe he was training football players.
And this is like a number of the coaches that I got to know personally over at SOU in wrestling track and field, because in this case, Andy Mowerbilt felt he was training fathers, future business owners, and that it was an important investment in the life.
lives of the players he coached.
Yeah, it was more than just the football game, wasn't it?
It was more than a game, but also was the fact that here he was always having to set goals
and about the thing that you always try to set goals.
And there's no need as you grow older to say what you couldn't do and then look around
to blame others.
It's more in terms of saying, okay, what can I do positively every day?
and Andy Maurer really epitomizes that, and he really deserved to be brought to you, to us, and to your listeners' attention.

Andy Mauer, what an amazing guy.
First of all, you have to understand how huge this guy is.
I mean, you try to hug the guy.
It's like trying to hug an oak tree.
He's just, he's gigantic.
But not only, I mean, seriously, he's huge.
But the thing is, is what a heart of service.
When he was a coach in Cascade Christian, they were over at what they called the Biggham
Noel campus now, you know, the old building there in Jacksonville.
And for those of us that were parents that had kids there,
we kept that thing running with duct tape and bailing wire every way.

mowing the lawn so they could
practice, do the football
practice? Let me guess it was Andy.
It was Andy. So Andy was out there doing
that. Okay. He was the guy.
He was the guy out there, and he
wasn't. He was grooming these young men to be
successful. He was, he was
coaching them football as a means
of teaching them how to be successful
young men. And
the other thing that I know that Dr.
Powers knows is, not only
was he coaching young men, he was also
coaching older men because he provided financial counseling and business counseling to people
all the time at in many times he didn't even charge him very cool great story and thanks for sharing

in just a moment but i was checking price of gold always have to do that 42 do you see the price of
silver lately have you seen that amazing what is that is that a short squeeze going on
on? What's going on?
Yes. That certainly is part of the thing that's going on.
And gold and silver have become, as you're pointing out, momentum plays at this time
heading to the end of the year.
Now, I know the rumors had always been that big banks, a lot of big banks had short
or were betting that silver was going to go down in price and at a short squeeze.
What does a short squeeze mean when that happens?
because are they having to buy physical and they didn't think they were going to have to buy a physical as part of their bet?
Is that the deal?
Yeah, it's a little different, as you're pointing out, because the fact that with gold and silver,
you really are dealing with future contracts, and that is going to be having to do with physical amounts.
So if it turns out that things are not going the way a hedge fund have figured out,
they've got to go into the market on the futures and pick up those contracts, which operates the same way.
In other words, okay, we were betting, okay, I'm J.P. Morgan, let's say, for example, all right,
J.P. Morgan Chase, let's say, and I'm betting that silver is going down.
The whole idea we're going to keep that cheap, right?
So I'm going to buy, I'm going to try to force that price down.
The market says, no, we're not going to sell, and then they have to buy at the higher rate,
it has to get at higher rates or someone is persuaded to sell is essentially happening.
Isn't that what's going on?
Right?
Yeah, and Bill, if we take a look at the amazing increase, if we go back to April, it was at $30 for
silver per ounce, and it's now almost 60.
Actually, right now the quote is 58.405.
Yeah, 58.4.
It's an incredible jump because it's used in integrated circuits.
Yeah, and solar cells too.
And so this may be what we're looking at.
Is it going to go up higher?
I don't know.
Some are talking 200.

Dr. Dennis Powers, where past meets present.
Now we're back to the present.
Supreme Court case, I think it's being argued today in which Trump fees slaughter.
And this is an interesting one.
This could really be determining the future of presidential executive power.
When you say, Doctor, isn't this a big one?
How far you can go?
I mean, who gets to actually hire and fire in the administrative state?
Yes, it does. And the reason for why this is is the fact that this is Rebecca Slaughter, who Trump originally nominated in 2018, and then of course Biden comes along and says, well, I liked what she really is doing because they hadn't really done a good check in terms of what were the political feelings, I mean feelings of this Rebecca Slaughter.
Biden goes ahead and puts her for another term.
But the key thing is, is that in the, and this is for the Federal Trade Commission,
on the FTC, there is a statute in there that states only certain grounds for being able to fire someone,
you know, such as willful neglect of duties.
but Trump came in and fired her when he finally
well he figured out that he had made a mistake in terms of nominating her in the first place
and the district court that said no you can't there's a statute here of the agency
that says that these are the only grounds
and the administration bill is arguing that yeah but this is at will
and allows us to go ahead and to fire without having to have a good cause.
Is there anything, when they talk about statute, is it statute or rules?
I guess that's, you know, there's a big difference, and a lot of people make the mistake that rules are the same as a law passed by Congress.
Do you know what's in play here?
Yeah, and you see, this was a statute that was in there.
Okay.
And so you have, and the part of the thing is there's a different test when they called a rule versus a statute.
You're really getting into a lot of these legal nuances.
So the Trump administration, just to cut to the chase here, Doctor, the Trump administration is more or less likely challenging the constitutionality of this statute because it's like Congress saying that the president can't do something, but yet it's within his purview, the running of the executive in the administrative agencies. Is that fair? What's going on here?
That's right.
Okay.
But part of the problem that he's running into, Bill, is that this concept of at-will employment, they say, oh, Oregon's at-will.
baloney, because the reason it is is that it's at-will provided you cannot fire for discriminatory
reasons, race, gender, age, religion, disability, you cannot retaliate against reporting
harassment, such as union, for union activity, fulfilling legal duties, and it really is
meaningless because when you read, oh, it's at will, that just means the reporter has not done
their job again, because the exceptions have eaten up the rule, and this is what I think is
going to run against the administration in this particular one.
So you're thinking the Trump administration will likely lose on this one?
I do.
You do.
But this is just, you know, my bet, because of the fact that, you know, this Supreme Court,
with what it has been having to do with total misreadies.
by far left district court judges.
Yeah, but are they misreading in this particular case?
Or are you just...
Oh, we lost doctor.

happened. All right. Anyway, um, we were talking there, uh, so you think that Trump's going
to lose on this one. And what I'm kind of wondering, though, is you sure there's no
constitutional challenge proper because any rule affecting the executive,
To me, if it's an executive agency, the executive should be able to hire and fire at will.
And this is a Democrat, too.
I mean, I don't care who the president is.
Because otherwise, how do the people ever get any real change if the lifers can't be fired for whatever reason?
Yeah, and you see the argument on the other side, unfortunately, Bill, is that you have a statute in the creation of the FTC,
which states what the rules are, and there is an idea that to a certain extent
agents and agencies should have some type of balanced protection, because here they said
you can go ahead and fire if you have poor performance and legitimate reasons for termination.
Okay. I was surprised you couldn't just create a, or fabricate a reason for termination.
I don't know.
Oh, and you see, what I'm going on is just applying, let's say, what the law is in almost every single state,
and it's been a bar question for three different bar exams that I've taken and passed.
But the key thing, Bill, is that they've got to give something, if we take in being the Supreme Court,
because, again, we have the lobbying by the far left in this civil war that's going against
the administration, and that means all the times that they go ahead and demonstrate...
Yeah, yeah, we get this.
Yeah, we get that, but...
Okay, so you think he'll lose, should he lose, though, legally with your reading of the law?
That is just my bet.
Okay.
And my bet is only as good as you...
I'm sure you'll get other attorneys that come in.
All right, all right.
Fair enough.
I don't want to, you know, get you off on the side there too much.
All right.
Something else going on, which I also think is interesting.
And it's a statement from the Oregon Attorney General Dan Rayfield.
Have you kept track of what he's been talking about lately?
Because his real job, I think, is suing the Trump administration.
That seems to be the only reason he was put into office, at least from my reading of things.
and he is really out against the administration's demand that they want to know the so-called sensitive information about SNAP benefits.
In other words, people are on Oregon Health, not Oregon Health Plan, Oregon Trail Card, rather.
So they're on the Oregon Trail card and getting their food stamp benefits on the card.
Federal law says that you're not supposed to have any illegal immigrants there,
except that we well know that there are a lot of illegal immigrants in Oregon.
on this. And Dan Rayfield says that it is unlawful for him to give their sensitive information
to the federal government. And do you think that he stands on good solid legal ground? Because I can't
imagine, you know, how can you demand the federal government pay for SNAP benefits for people
who aren't supposed to be on these benefits or even here in the first place? Do you have a take on that
on that issue there?
Oh, I'd be shocked if he went ahead and did anything that was different than the mantra
from Salem, our governor, who's running for re-election, and the fact that this state,
actually this state is one that I don't even defend because it is laughed at so much
by the Eastern establishment.
Okay.
Well, I'm going to take the – well, let me take this one part of it, Dennis.
Here's a quote, those demands are both, in other words, those demands, those demands from the administration that we want to know your immigration status and your sensitive information about this.
Those demands are both unlawful and heartless, and it's not only wrong, but it is also politically motivated and illegal.
When the AG says that President Trump's demand for the immigration status to get SNAP benefits on the Oregon Trail card is illegal, is he referencing federal law, you think, or is it the state's sanctuary service?
city law and sanctuary state. What would you engage in here if you wanted to take a bet?
Well, he's going to use federal law, and the state sanctuary law just shows the philosophy
of screw the taxpayer and give it to the illegal immigrant for our next election.
Are you aware of any statute that precludes the Trump administration from demanding
finding out if someone is illegally on the SNAP benefits as part of auditing?
I, in taking look what's happening, no. But on the other hand,
we never can underestimate the way the far left in this Civil War will go ahead and enerce
something that we're saying, what? But you see, this is no different. Oregon is no different
than California, no different than New York, and all the other far-left bastions, because
these arguments are all thrown together in different amicus Kerrides, being front of the court
when it's going up to the Supreme Court. My bottom line of says,
on this is the fact that Oregon is no different than these others, and that the legal thing is really irrelevant.
Okay, but if this were to move to the Supreme Court, because it sounds like this is the only reason that the Dan Refield exists.
Do you think that the Supreme Court would look at this request for immigration status to be on SNAP benefits, the Oregon Trail Card?
Do you think they would look at that is unlawful and improper, do you think?
Or how would you get in their mind?
Well, that is very difficult to assess Bill, and the reason is you've got nine.
You have six to three, depending on how John goes, the Chief Justice.
It really comes down to five to four decisions, these close ones.
And all you need is one like Kavanaugh, who's gone both ways, to have a go in a different,
this is more bets in Las Vegas.
All right.
But if I had to, you know, go ahead and come right into it, I would say in this particular case,
you might get one to where they hold that the Trump administration can do it,
but then when you read the decision, you find out they really aren't.
Yeah, but it still seems to me that, you know, I know we have statute that says that
people who are illegally here are not eligible for benefits.
They're not eligible for welfare benefits.
We have that in statute, and yet they're acting as if, you know, then,
well, I need to find out if you have any illegal aliens,
then all of a sudden, you Dan Rayfield once again,
going, oh, we can't do this.
This is illegal, heartless.
Well, I don't care if it's heartless.
It doesn't matter.
They're not supposed to be there.

And, you know, I agree with your political assessment.
But when you go to the legal assessment, which is going to be federal law on this,
it is really one of where I could go into some other stories.
But the bottom line bill is that judges are.
are no different than the attorneys arguing for them, except that Obama and Biden were
able to get two-thirds of the district courts through, and these were primarily very good
fundraisers. You can read some of their decisions. So very good politics played the part
in the current Trump administration challenges. All right. Well, tell you what, next week,
as we wrap up here, Dennis, next week, though, we'll certainly probably have more news on what's
happening with Josephine County Commission. One quit.
Andres Black ended up quitting on Friday, and now I guess who's going to be appointed is going to be the next question, now?
That's what we're going to be looking at.

Well, my take on it would be that, let's just not pay attention to any news and go and hide until the new year.
