These text messages were gross and repulsive.
These messages ignite a visceral urge to condemn the defendant.
Judgment Day for a woman accused of molesting a young girl with a boyfriend.
The woman already admitted to sex with dogs.
And now her reality star boyfriend is on trial.
I was complicit, man. I do.
But were you involved in it or just you knew about it?
I've never touched.

Okay, I'm gonna be this.
I'm Ann Jeanette Levy, and this is crime fix.
Erica Grove is a military veteran.
She was a nurse anesthetist, and she's a woman who was accused of horrific sex crimes.
Grove was taken into custody earlier this year after she'd been charged with her boyfriend,
Tony McAllister, with having sex with dogs.
McCollister had appeared briefly on an incredibly short-lived reality show about swingers in the burbs.
neighbors with benefits, but the charges Grove faced were more serious than the vile acts with the
dogs. A grand jury indicted her on four counts of rape involving a young child, along with five
counts of gross sexual imposition and charges that she drugged the child in order to rape her
with McAllister along with charges of child endangering. Erica Groh opted for a trial by a judge
rather than a jury, she claimed that Tony McAllister was abusive to her and she was trying to
please him and she was under duress. Judge Robert Peeler heard days of testimony about Erica Grove and
Tony McAllister, including sickening text messages about things they plan to do with the young girl.
But Groves' attorneys say it was all a fantasy that these text messages were simply fantasy.
Judge Peeler took several weeks to deliberate before writing out his verdict, and
announcing it in court. To prove the four counts of rape, the state was required to prove beyond a
reasonable doubt that the defendant engaged in sexual conduct with a minor child. To establish these
counts, the state relied exclusively upon the text messages between the defendant and her co-defendant.
These text messages were gross and repulsive. These messages ignite a visceral urge to condemn the defendant,
for the perverse conversations in which she engaged.
But it's fundamental that a civilized society does not punish for thoughts alone.
Thus, the state bore the burden of corroborating the text messages with additional evidence
to establish the defendant's guilt for rape.
To establish in some manner the sexual conduct involving the child took place.
To do so, the state offered the Child Advocacy Center interview of,
the child, wherein she makes no reference to any conduct that could be considered rape.
The state elected not to call the child as a witness to further explore any prohibited acts at trial.
The state elected not to call the co-defendant at trial.
Now you can probably see where this is going as far as the rape counts are concerned.
After careful consideration of the evidence presented and certainly the lack of corroborating
evidence presented, the court cannot say the state's
proved beyond a reasonable doubt that the defendant engaged in sexual conduct with the child
to warrant a conviction for rape. Accordingly, the court finds Erica Grove not guilty of rape
under counts one through four. So Erica Grove was acquitted of rape, the most serious charges
involving that little girl. Then it was time for the verdict on the counts of gross sexual imposition.
Erica Grove was accused of drawing on the little girl with marker in a bathtub.
and vice versa, and also having the child touch her body.
To prove the five counts of gross sexual imposition,
the state was required to prove beyond a reasonable doubt
that the defendant engaged in sexual contact
with a child under the age of 13.
The law defines sexual contact as the touching
of an erogenous zone such as thigh, genitals,
buttock, pubic regions, or breasts
for the purpose of sexually arousing or gratifying either person.
To establish these counts, the state again relied heavily on text messages between the defendant
and her co-defendant.
Unlike the rape count, however, the state was able to corroborate gross sexual imposition
through the child advocacy center interview of the child.
During that interview, the child stated she on each other's bodies, in reference to her.
to wear on each other's bodies, the child referenced her upper and lower torso and her
thighs.
The text messages about these interactions include statements from the defendant that she was sexually
aroused and or gratified by performing these drawing sessions with her drawing.
A photograph of the defendant's body depicting the drawing was introduced into evidence.
the artwork of the defendant's body introduced by the state is in fact a drawing done by
the child, the testimony of the child in connection with the text messages shows the defendant
drew on her and had her daughter draw on her for the purpose of sexual arousal.
Accordingly, the court finds the state proved beyond a reasonable doubt that Erica Grove
engaged in sexual contact with the child and is guilty of gross sexual sexual
imposition under count five.
Further, the court finds the text messages alone establish the crime of gross sexual imposition
where defendant's fantasy theory is outweighed by her own confessionary statements.
For count seven, the defendant is accused at forcing the child to touch the defendant's breast
while lying in bed together.
While the defendant contends this was all a farce to appease her co-defendant,
The court finds that theory wholly lacking where the defendant repeatedly texts her co-defendant
that she feels incredibly aroused but terrible and worried about C.B. the child who was laying
there frozen. The court finds that the state proved beyond a reasonable doubt that Erica Grove
engaged in sexual contact with the child and is guilty of gross sexual imposition under
count seven. The state did not prove beyond a reasonable doubt the remaining counts of
growth sexual imposition and Erica Grove is found not guilty of count six, eight, and nine.

And Grove was also accused of drugging the girl.
To prove the charge of corrupting another with drugs, the state was required to prove beyond a reasonable doubt that the defendant knowingly by any means furnished or administered a controlled substance to a juvenile.
To establish this count, the state relied exclusively upon the text messages between defendant and her co-defendant.
The only corroborating evidence as to this count was the testimony of Dr. Samuel Kleinman,
who testified that a hair follicle test revealed no indication of illicit substances within a sample of the child's hair.
Upon careful examination of the evidence, the court finds the state failed to meet its burden of proof
that Erica Grove, therefore, is not guilty of corrupting another with drugs under counts.
So the state's case is not faring all that well so far with the verdict.
The state was required to prove beyond a reasonable doubt that the defendant abused a minor child.
To prove the charge of endangering children under 2919.22A, the state was required to prove beyond a reasonable doubt that the defendant, as opposed to a minor child, created a substantial risk to the health or safety.

The child suffered abuse at the hands when she was engaged in gross sexual imposition with the child.
Likewise, the court finds the defendant, as the child's crime created a substantial risk
to the health and safety of the child by violating her duties to care and protect.

Thus, Erica Grove is guilty of these counts of child endangering.
Both charges can be elevated to felonies of the second and third degree if the violations
resulted in serious physical harm to the minor.
The definition of serious physical harm includes several categories of physical harm, as well
as any mental illness or condition of such gravity.
as would normally require hospitalization or prolonged psychiatric treatment.
The state called no witnesses to testify that future medical treatment was necessary,
specifically prolonged psychiatric care.
Although the child was taken to a counselor, there was no evidence presented
that prolonged psychiatric care was necessary in the future.
The state further failed to demonstrate any other form of physical harm suffered
by the child at the hands of her
Accordingly, the court finds Erica Grove guilty of both counts of child endangering,
both misdemeanors of the first degree, as the court does not find that the state met its burden
in proving that prolonged psychiatric treatment in the future would be necessary.

To summarize, the defendant Erica Grove is found guilty on counts five and seven for gross
sexual imposition and counts 19 and 20 for endangering children.
The remaining unresolved charges were not corroborated with any evidence.
Defendant Erica Grove is found not guilty on counts one through four for rape, counts
six, eight, and nine for gross sexual imposition. He counts 18 for corrupting another with drugs.
Counts 10 through 17 were previously dismissed by the state prior to trial.
Erica Grove was found guilty of misdemeanor counts of child endangering and two counts of
gross sexual imposition. Plus, she had already pleaded guilty to having sex with the dogs.
The question is, how much time will she actually do?
We would ask that the defendant be remanded at this time.
She's out on bond.
She's now been convicted of two felonies of the third degree, as well as multiple misdemeanors.
She faces the possibility of up to 120 months in prison on those counts.
We believe that would be appropriate to take her into custody at this time pending sentencing.

I believe there's a pre-sentence interview tomorrow.
with her with an officer on the animal counts already scheduled she's been out on
on bond now for nine months with absolutely no issues whatsoever I believe
it was a significantly high bond I do with the court permission intend to
call at least a witness or two and obviously I would prefer to create a sentencing
memorandum for your honor okay that that's reasonable she
She has this hearing scheduled for tomorrow
because she had already pled guilty to those four charges.
I don't necessarily need a pre-sentence investigation.
I feel I've heard enough and seen enough
to make a good decision or a proper decision in this case.
However, I agree with both sides of the state
has an opportunity to have the victim
or the victim's representative be heard.
and give both sides a chance to prepare for addressing sentencing.
I agree she's been totally fine on supervision.
However, I have different concerns when a person now stands convicted,
and therefore she's remanded to the custody of the Warren County Sheriff ending sentencing.

Erica Grove was taken into custody and she's been in the Warren County Jail ever since awaiting sentencing.
She may actually do some prison time here.
And now her boyfriend, Tony McAllister, he's on trial, pleading insanity in his case.
McCallister appeared for his trial in a suit and tie despite this being a bench trial.
And McCollister remaining in custody.
He pleaded guilty before the trial started to 13 counts of pandering sexually oriented material involving a
minor and several misdemeanor counts of having sex with an animal.

So Tony McAllister pleaded guilty to charges
involving videos of
prepubescent children engaging
in sex acts. He will have to register as a sex offender when he's released from prison. Then came
his trial on the remaining charges accusing McCallister of sexually abusing the little girl.
You can only make suggestion is if there's any way this can be closed court or somehow so that
my kids don't have to suffer anymore. That's, I'll go do my time. I'll do what I have to do.
I don't want them to suffer for. I think that would be a reason to request. And the thing is that I
would never do it on my own. So as far as said, I think the message will show she is the gatekeeper.
So Tony McAllister is blaming his ex-girlfriend Erica Grove, who blamed him at her trial.
And I was more of a daddy role, so I wasn't really ever directly involved, really at all.
I want to be clear, because, again, I want to be honest. I was encouraging her to explore this fantasy.
And it will say in there many times I'm like this is your thing like my thing is you know
boys like and they get me not being with a boy but like mothers and sisters are using their sons or their brothers
from there it was bath time. In bath time for my memory it was mostly, it was
Erica would be in there with her and Erica.
And this happened after coloring sometimes
because it'd be an excuse to be in there.
But it was usually, it was always an angle where
couldn't see.
Do you know what I mean?
But I was complicit. I knew.
But were you involved in it or just you knew about it?
I've never touched.
Okay.
But, okay, I'm gonna be a .
McCallister also painted Erica Grove as a bad woman.
What I do know is she gaslighted in a
just like she did me.
I know that for a fact.
Talking to both of them and they both admitted now.
And Erica has admitted.
And you could probably check the text between her
because she goes under there.
She starts admitting a lot of the shit on.
Because after we got caught, that was my thing.
It's like, because I would have told her when first together,
like, I have to remind myself I'm a cheater so I don't cheat.
Like, you need to complete.
You need to do all these things.
But I know she cheated on him.
It's in the text.
She cheated on him.
And then she would justify it by you cheated on me first.
And then she would do that thing where everybody knows what she did to me.
Like, they all know.
And if she would have fucking.
I hadn't had evidence.
I had evidence to present them.
If I hadn't had evidence, I already saw her deleting me, deleting the evidence.
and saw her start to talk to people and manipulate them,
she was going to make me be the bad guy.
She was going to turn to somebody, and I know she's going to be Jesse.
And I'm not saying even she, I don't know.
I don't know what he did or didn't do, but I know right now.
She didn't own shit.
She lied.
She hit things and she manipulated, and then she turned everybody against that man.
Because I was the first man, whoever said,
I'm not going to look bad on him.
I'm going to give him everything chance he has in the world to be a good dad.
Like, I'm going to stand by him.
And then...
McCullister's trial is continuing, and we'll let you know what happens.
