Starting point is 00:00:00 All right, how are you got? Good, good. Good. Yeah, thank you. I need that good wall. Landale, please. All right, nice to meet you. A married plastic surgeon accused of stalking a former flame using tech and hidden cameras.
Starting point is 00:00:14 So here's a deal, Mark. I'm going to make this real little key, real easy for you. But you are going to be on arrest for invasion and privacy and stalking at this point. I'm going through the case. I'm me and Jeanette Levy. And this is crime thing. Mark Blake seems to have it all. He's a plastic surgeon.
Starting point is 00:00:37 he has a family and lives in a really nice part of Milwaukee County in Wisconsin. But recently, Dr. Blake ran into some trouble, legal trouble, when a co-worker, he used to date, accused him of spying on her. It was May 20, 26, when Glendale Police Detectives paid Dr. Mark Blake a visit at the medical spa where he worked. The detectives had received a report from a woman who worked at the clinic. She'd discovered an Apple Air tag in her car, and when she tried to figure out who put it there, she said she tracked it back to a coworker that she had once dated, Dr. Mark Blake. A criminal complaint states, the woman reported that she used the Apple Find My App to obtain information about the tag and observed that the owner of the tag linked to a phone number ending in 3336.
Starting point is 00:01:25 She informed Officer Ramos that the defendant's phone number ended in 3336. the woman stated that she then confronted the defendant via text message. The defendant initially denied placing the tag, but when the woman confronted him with the phone number information, he stated he was sorry and was worried about her life decisions. The woman reported that she did not initially report this because she believed the defendant's behavior would stop. But the woman told detectives, she discovered more concerning things, and police would later discover photos on Dr. Blake's phone that had been taken. with a hidden camera inside a locker room at the medical spa. The criminal complaint continued. The woman provided a written timeline to law enforcement.
Starting point is 00:02:11 She reported that she and the defendant had been engaged in a relationship, but that it ended and became strictly professional prior to March 20th, 2024. The timestamp noted in one of the above images. The woman indicated the relationship was over by that point. The woman indicated that after comments began in May and April of 26, she felt the defense, knew too many specific details that he should not have known, making her believe he was stalking her. She reported that on May 19, 26, the defendant approached her at work and said they needed to talk, and this was urgent. He texted her that he had heard a police investigation began. The woman's claims
Starting point is 00:02:50 were concerning to say the very least, so detectives arranged to meet up with Dr. Blake. Oh, how are you going? How are you got? Good, good. Thank you. I need second wall Wondale, please. Hi, nice to meet you. Thank you. How are you doing? All right.
Starting point is 00:03:05 All right. Hope we're not turn your day too much. Yeah. But I want to talk to you about an instant that was reported to us involving one of your nurses.
Starting point is 00:03:15 Okay. Is that you're going about it? Yep. Okay. You aware of this at all? Uh, or why we're here somewhere? Okay.
Starting point is 00:03:24 So, let me backtrack. I understand there's two sides to every story. There is, some allegations made to us about some potential stopping or appropriate behavior. Ward is trying to get to the bottom of it. So what can you tell you about what's going on?
Starting point is 00:03:41 So the biggest question I would have is do one do I need to have one in turn. That's okay. You're not under arrest right now, right? Right now we're in the stage of an incident was reported to us and we're kind of fact gathering. Right? So we've talked to her obviously already and now we want to talk to you. Yeah. That's where we're at.
Starting point is 00:04:02 I still don't get anything to have on the front of you, but I talk to about anything. Okay, okay. So you don't want it. It's okay. So you're just somehow putting words in your mouth. You'd rather have an attorney before you talk to us. I think if somebody is alleging things about me,
Starting point is 00:04:21 that I should make sure that I am, taking care of myself with that's quite possible. You know, I don't, I don't know whether it would be right for me to discuss or not discuss. Dr. Blake is concerned. He's not so sure he should be talking to police without a lawyer. Smart move. But the detectives want Dr. Blake's phone. Well, I'm not going to force that out of you.
Starting point is 00:04:51 If you don't want to talk, that's okay. Obviously, that's why you hear you side of the story. Where I can take up too much of your time, then, I'll give you my business. card before we leave here so you know who I am and you can talk to attorney about that at some point we would like to talk to you about this do you have an attorney you do not you okay not to get one yeah okay before I leave though I'm gonna ask you one question okay where's your cell phone right now it's in your pocket is in my pocket yeah so here's what's gonna happen I'm not
Starting point is 00:05:25 searching it but I am going to seize your cell phone okay focus So what we're going to do is we're going to get a search warrant, or we're going to apply for a search warrant, assuming that search warrant will be granted, then we would be searching your cell phone. We are going to take it now, though, okay, and that's something we're going to do without an attorney. Okay. Okay. Okay. Do I need a warrant for that? No.
Starting point is 00:05:46 Not to take it. To search it, we work. Yes. And that's what we're running up doing anyway. So you can contact your attorney and let them know that you don't mind not playing with it. I want to play with it, but I do. Well, how about this? I'm assuming you need phone numbers and stuff out of your phone.
Starting point is 00:06:03 Okay. I'm not here to be a complete jerk. I get the situation, right? Unfortunately, we have a job we have to do. So if you want, I have to follow my rules, right the same way you would. I'm sure it did after. We can get some numbers and stuff out of your phone if you want, so you have someone to call in the meantime.
Starting point is 00:06:23 I can promise you that I'll try to get everything done quick, so I'm not inconveniencing you more than I have to. have to. Does that make sense? So if you want, you have your own pen and maybe my pen, I'm going to watch to make sure you're not doing anything sneaky. I'm not suspecting you would. But I have to do my job a certain way, right? So if you want, we can grab some numbers and some other stuff, but then I am going to take your phone, okay? I'm not messing with it now. I'm just turning it off. You send you. Okay? What kind of phone is this? I can also know what's an iPhone? You know which one or no? Huh?
Starting point is 00:06:59 Oh, I think he said blue. Okay. So the next step here is, if you have any questions, I'm more than happy to explain them. So I know this is probably all very new to you. But we are going to apply for a search warrant, right? That goes in from a judge. The judge has the opportunity to say yes and sign or say no, I'm not sign it, right? I'm not going to tell you he's going to do one thing or the other.
Starting point is 00:07:51 I'm just going to tell you what I'm going to do, right? Here's my card on the back is the case number for everything, so everything follows that number. Your attorney will want that, okay? Assuming the judge would sign off and say yes, the next step will be we're going to search your phone. Once that's done, then I can get it back to you. Okay. So today is Wednesday. Let's say the search warrant gets done and everything's done with that by right up tonight and tomorrow.
Starting point is 00:08:24 if you signed Monday, let's say, probably have your phone back to Tuesday or Wednesday, assuming everything's good at the latest, okay? What number can I call you at? Alternative number. That I don't have a hold over. No one? Okay. Is it doing a call here?
Starting point is 00:08:43 Do I mean to show up here? I'm trying to make it. I know none of this is easy, so I'm trying to make this as less, least impact as I can. I guess I would call here. Obviously, I don't answer any questions if you don't want to. I'm not being tricky right here. The allegations are that, you know, there's some stalking type behavior going on, right? Now as cops, we have to investigate them.
Starting point is 00:09:12 We have to look into it. Part of looking into it is talking to everyone involved. That means the person reporting it, any victims, and anyone else involved, which in this case, unfortunately, your name was brought off, right? So that's what we're looking at. Now, just because somebody said something happened doesn't mean that it did or that we're going to assume one person's right in the other's line, right? We're going to look at everything. But that means we're going to be looking at everything, right?
Starting point is 00:09:38 Both on this side of it and on like the Internet side of it with, you know, companies like Apple and cell phone towers and stuff like that. So that's what we're going to be doing over the next week or two. And that's probably very nerve-wracking for you. if you didn't do anything at the end of the day that'll be a good thing because it'll show that what your version of events is
Starting point is 00:10:00 is right? You know what I mean? Right? But if you didn't do things like you know we'll put a tracking device or something like that in someone's car we will see it
Starting point is 00:10:10 and we will know it. Right? So two people set you free one way or the other call your attorney you can more than welcome to give them my card and I'm always open you know, calling you need to tell me anything
Starting point is 00:10:25 remember anything or you think of anything. All right? Have any other questions? I know this is probably whirlwind. I get that. I'm not, I'm not blind to that fact. Yeah. Yeah. Yeah. Days later, detectives go to Dr. Blake's home this time with a warrant for his arrest. A detective wrote in a criminal complaint that he found photos of the victim that were taken using a hidden camera. Mr. Blake? He's coming. Oh. Yeah. Hey, Mark. Hey. Hey.
Starting point is 00:11:02 Shoes aren't. Um, come on here for a second. I'm gonna talk to you. You want to keep your, I don't have your, the poor thing to run away. Sit. You remember me from the clinic? Yeah.
Starting point is 00:11:20 Okay. We'll step over here, okay? So here's a deal, Mark. I'm gonna make this real little key, real easy for you, but you are gonna be on arrest for invasion and privacy and stalking at this point, okay? So I have you turn around, put your hands on your back. Can I tell my kid? In a second, okay?
Starting point is 00:11:32 Trying to avoid doing this in front of your kids. You get what I'm saying? Right? My kid is here alone. Okay. I'm going to get you some shoes. We're going to get the kid thing. We're going to figure all that out next.
Starting point is 00:11:42 Okay. And I get your kids here alone, but trying to do your favor and not do this in front of your kid and wants to have to. Okay. Which one of your kids is here? What is your son? Your son? How old is he? 14.
Starting point is 00:11:58 Okay. Like I said, you are under arrest for stalking and invasion of privacy. Not too tight? No. Not pinching you? Okay. I'm going to quick search you. I'm going to explain the next steps.
Starting point is 00:12:12 Okay, so what we're going to do is we're going to step down here. Is there anything on you that's going to poke me, sick me or hurt me? No. I'm going to search you. No razor blades, no needles, nothing from, no? No. Let me turn it out. One, seven, very much.
Starting point is 00:12:26 Bring your arms away from the back. One seven, yeah. Is it just your son? Is it just your son? Is everybody else? Step over my son. Step over here. Glendale squads, you can come up to the front door.
Starting point is 00:12:42 To get him to school. We have a search warrant for your house, okay? So what we're going to do now is my partner's going to go in. We're going to make sure there's no one else in the house. It's a safety thing, okay. We'll make sure your son and your dog are okay. Once that's done, we're going to have you transported back to our police department where you can figure this out later while we here finish the search point here at your house.
Starting point is 00:13:02 Okay? I'm going to have a copy for you. You can give it to your attorney. Okay? Is your wife and daughter gone already for the day? Detectives read him the warrant. And right inside is Dr. Blake's 14-year-old son getting ready for school. What I have here, this is a search warrant, okay?
Starting point is 00:13:17 And it's for a search of your house. I am going to read it verbatim. The residents located at the village of Whitefish Bay, County of Milwaukee, state of Wisconsin. It's a search to include all storage areas accessible to said residents and all persons and vehicles. Present on premises, computer storage media and their digital content to include, but not limited to floppy disks, hard drives, both HDD and SSD tapes, DVDs, CERMs, SD cards, flashed, and any and all of their magnetic optical or mechanical storage, which can be accessed by computers to store or retrieve data, image, just and or videos of other sexually explicit material, items containing or displaying
Starting point is 00:13:54 passwords, access codes, usernames, or other identifiers necessary to examine or operate the recovered electronic items, cellular telephone, computers, tablets, cameras, and other electronic communication devices, and their associated storage media, cameras both hidden or exposed, along with their related hardware and software. Which things were using the commissioner may constitute evidence of the crime to wit, both Stocking and invasion of privacy. Inside the house, detectives document every room and notice something significant. One can you do some inventory, you know, especially because you know where to lie and stuff.
Starting point is 00:14:27 Hold it out once. Perfect. Take that. Anything else for me for me? Yeah. There's a box of air tags in the center console of this truck. I'm going to come there for that. That's the big thing.
Starting point is 00:14:44 Yeah. Especially if there's three out of the four. That would be ideal. Let's go look at these air tags, hey? That's what I'm looking. You're here as a puppy. Search the rest of that in the meantime. Look to, is there a receipt for these air tags
Starting point is 00:15:17 to line up with the date they were bought, you know? Yeah. They know when they were bought? One's missing. You guys got a bag by chance? One missing. Is that your one right back? I'll have to check.
Starting point is 00:15:39 I'm not going to pull them out now. Those air tags are kind of what I was looking for. I stand up there. Serial number in order. That would be nice? Three out of four air tags found. And remember, the woman at the clinic found an air tag in her car, one she said traced back to Dr. Blake. While police searched the house,
Starting point is 00:16:05 a detective picks up the phone and calls Dr. Blake's wife, she was away at a college visit with their daughter. Hello, Detective Fred. Yes. My understanding is you are in Indiana right now? All right, so One second, okay? Aponte, can you give me my binder
Starting point is 00:16:28 or that little black padfolio? Where's that? Right here. Have you talked to your son yet? Okay, we are at your house right now. Everybody's okay. Get that out there right away. Everyone's fine.
Starting point is 00:16:46 You're Mark Blake's wife, though, correct? Okay, he was arrested this morning for not only stalking but invasion of privacy. It looks like there were some hidden cameras placed. So both at the clinic and at your house. Some of them do appear to depict you. Were you aware that you would ever have been recorded in either a shower or in your beds, like your master bedroom?
Starting point is 00:17:15 No. So. Well, we're searching. in your house right now, what I can say is there were videos on your husband's cell phone that looked to be from a hidden camera and they would capture you either showering by yourself or not, sorry to be intimate and say this, but or maybe you and your husband having looks like your bed. You weren't aware of that.
Starting point is 00:17:44 From my perspective, what I'm looking at is you may be a potential victim. Dr. Blake's wife had no idea. And when the call ended, the detective told other officers what she'd said. told her about the hidden cameras in the bathroom, catching what I believe to be her showering. And then she said she didn't know those were being taken. She seemed generally surprised and like, no, no one has a, like, what do you mean there's a camera in my bathroom? I would touch base with her tomorrow to set a time up where, like, I can sit down with her and actually, like, go over it and see if, you know, is she a victim or is just the clinic? Mark Blake was booked into the Milwaukee County Jail on charges of stalking and three counts of capturing an intimate representation.
Starting point is 00:18:26 He later pleaded not guilty to the charges. All right. So to really break this down, I want to bring in Eric Fattis. He is a defense attorney based in Colorado. Eric, welcome back to Crime Fix. Thanks for coming on. This case is really interesting to me. I'm wondering what your thoughts are.
Starting point is 00:18:49 We have a physician, a plastic surgeon, basically accused of stalking his ex, who is also his coworker. Yeah, yikes. I mean, there are so many issues at play here. One is, you know, this person is a physician that a lot of people hold them in high regard. People give them trust, including their coworkers. And for him to allegedly betray that, especially in like a creepy way like this, you know, is very problematic. There are also, of course, workplace dynamics that could play a role too. So a lot of issues circulating in these alarming reports. Yeah. I mean, that's what I'm thinking. You know, This is a doctor. I mean, he's a physician. You go to school for a long time. It costs a lot of money to get through medical school. And he's working at this, you know, what I think of as a med spa.
Starting point is 00:19:39 And he was dating this woman at one time. It appears from everything the criminal complaint says. And then the relationship ends. And can you imagine you're going out to your car one day and you find an air tag? And I'm thinking to myself, wow. She immediately figures out how it could be, like who it could belong to. And she does like her own detective work. So, you know, we have somebody who's, you know, held in high regard.
Starting point is 00:20:08 I know for a fact he lives in a pretty nice, swanky area of Milwaukee County because I used to work up there in Wisconsin. And he's accused of doing really creepy stuff, not only the stalking with the air tag, but then when you really did. to the details of the criminal complaint, Eric, they found, the cops say, they found images on his cell phone from the download of this woman, and it appears there was a hidden camera in the women's locker room at this med spa. I mean, I just can't even imagine. This appears to be something that was orchestrated over time that a person had to put a lot of thought into and take a number of steps over the course of years, according to the complaint, in order to accomplish this sort of campaign of invading people's privacy, allegedly.
Starting point is 00:21:03 And so it's not like a one-off. It's not something, you know, where someone took a photo of someone skirt at a mall one time or something. They had to plant a camera in this locale. They had to purchase the air tag. There were just so many conscious steps that were a to have been taken according to this complaint against this defense. No doubt, no doubt. There's another concerning aspect about this. You know, the fact that he's telling this woman, I mean, he essentially makes an admission after she finds the air tag.
Starting point is 00:21:37 He says he's concerned about the decisions that she's making. And essentially it's that she's dating somebody else. That's his concern. I mean, that's what it appears from the criminal complaint. That's the picture that the police are painting and the prosecutor in this complaint. So these things can sometimes escalate. I mean, this isn't just a harmless thing. Oh, Angelette, totally. When I was a former felony prosecutor, including in the special victims unit, one thing they always told us about potential domestic situations is if you see
Starting point is 00:22:10 stalking, that is a potential lethality factor. That is a red flag. That escalates the risk that serious bodily injury or death could occur. Stalking. is just associated with folks who are willing to take it there. They're willing to go way beyond the lines and possibly do something very dangerous. And so, you know, this isn't your garden variety harassment or something like that. These stocking allegations can constitute lethality factors within the domestic violence context. And so if these events did occur, it's good that they detected them at this time because who knows what could happen next. And looking at it from the prosecution standpoint.
Starting point is 00:22:51 I mean, the fact that he's capturing images of her, and he seems almost skilled at this, just from the allegations we're reading in the complaint, it makes you wonder, my God, has he done this before? Oh, well, sir. I mean, according to the complaint, there are photos of, there are multiple photos on his phone of this. And, you know, snooking isn't something a person who has zero history of control and manipulation just decides to do one day. It's not something that just, you know, a light switch
Starting point is 00:23:23 happens and they automatically become a stalker. It's usually something that is developed over time. And the person often gets, you know, a gratification from, you know, observing somebody without their knowledge, having that informational power, having that control over that person, knowing their whereabouts, knowing what they're doing. It's a very scary scenario. Now let's turn to the defense perspective on this. You know, it appears at least from everything that we saw in the complaint and from what we see on body camera footage, you know, he basically tells the cops when they say, yeah, can we talk to you about this? He's like, well, maybe I should talk to a lawyer first. So he probably, you know, he did the right thing there. But then he hands over his phone,
Starting point is 00:24:09 allows them to download his phone. So that's where they say they find these images of the alleged victim in the locker room of the med spa, which is just really creepy. However, how do you defend this case, Eric, because it sounds like from everything we're reading in the complaint that they've got the goods on him? Antoinette, this sounds very problematic for the defendant. When you look at the complaint, it sort of lays out all of their pieces of evidence in a compelling way. If I'm defense, I'm looking at this, and I bet that their defense attorney is going to explore the nature and dynamic of this relationship between the defendant
Starting point is 00:24:51 and the alleged victim. Was there something more to the story? Was there kind of an ongoing amorous connection that may have been downplayed by the alleged victim? I have no evidence of that, but the defense is going to look into because one of the elements here, Antoinette, is that the defendant knew or should have known that these actions he were taking would cause serious emotional distress. And I guess if he's looking at this and saying, hey, this is actually like kind of my quasi girlfriend, even longer than she wanted to admit. And I didn't think she'd be bothered that I was interested in her life. You know, as distorted as it seems, these avenues are going to have to be explored by defense. Yeah. I think when you're a defense attorney, you have to explore every angle and
Starting point is 00:25:34 look at every possibility. However, you know, I'm wondering, do you try to get, do you try to get the consent search thrown out because, you know, maybe they, you'd say, oh, well, he let them look at the phone. He's a smart guy. He, he might through medical school. I mean, you're not going to be able to say, like, oh, they duped him. It's all on body camera footage. He hands over his phone. The guy even says, am I going to need a warrant for that?
Starting point is 00:26:00 And he gives him the phone. So is there any avenue to explore there? Well, certainly defense would want to exclude the digital evidence from the phone. I mean, that is damning clearly. And there are sometimes grounds to get that excluded. One is that if the consent was somehow involuntary, the body can suggest that perhaps it was not involuntary. But on top of that, you got to look at how the government executed the search of the felon. Sometimes they can do this in an overly broad fashion that gets a lot of evidence to which they might not be entitled, that might not be relevant. Did they review some evidence
Starting point is 00:26:37 that could be privileged or confidential in some fashion, could that give rise to some kind of sanction regarding the improper download of the phone? Again, I have no evidence that they improperly downloaded it, but that is a recurring theme in the legal world when it comes to these digital downloads. Okay. Interesting. Interesting. You know, the defense waived the preliminary hearing. So what does that tell you? Because it signals to me that they believe probable cause would be readily met, they were like, we just don't need to go forward with this hearing. Is there any other reason that the defense would waive the preliminary hearing in a case such as this one? There very much is. So oftentimes, before preliminary hearing, the prosecutor will send defense a plea offer.
Starting point is 00:27:23 Or they'll say, hey, if you want to have a chance at a plea offer down the road, you've got to waive this preliminary hearing. Don't make us go to this hearing, bring in our officers, possibly bring in the alleged victim, and have them go through the song and dance when the prosecutor is going to win anyway. If you waive that, that will preserve your ability to continue plea negotiations with the government. So that could signal that the defense is considering what kind of resolution they might be able to broker here in terms of a plea possibly to a lesser offense, possibly to something that limits potential incarceration. Yeah, I was wondering about that because it seems like they've got him dead to rights. And I'm thinking to myself, too, what happens to this guy's medical
Starting point is 00:28:06 license because if he's convicted of stocking and it involves a co-worker who also was in a subordinate of sorts at a workplace, this raises a whole host of issues. You know, it does. And most medical boards, including Colorado where I practice, they take any criminal allegation very seriously, even something like a DUI. Well, here, we are worlds beyond that. We are in the world of alleged stalking and allegedly capturing images invading someone's privacy. And so, my gosh, if those allegations are substantiated, his medical license absolutely could be in jeopardy that entire medspa.
Starting point is 00:28:49 And its viability could be in jeopardy. And so it's going to be – he's going to have to deal with this on multiple fronts, not only on the criminal side, but also on the administrative side and the licensing side, his career as a physician could be over. That's what I'm thinking. That's where my head goes. Because I'm telling you, if this guy hangs a shingle out, any woman who wants to go in there for a plastic surgery type procedure, you know, you're thinking to yourself, am I going to go in there? And maybe this guy is going to take a liking to me and it's going to start putting air tags in my car, allegedly. That's kind of what I think. And, you know, I don't know how he goes back.
Starting point is 00:29:30 Oh, gosh, I know. I mean, these allegations are going to stay with him. I can't envision some kind of med spa bringing him on because if anyone were to simply Google his name. This stuff would come up. Potential clients would look at that and say, whoa, you know, I don't want to be in a locker room with someone secretly peering in through a device and watching me in a vulnerable state. And so, yeah, he's going to have to, you know, start driving trucks or something, man. He's not going to be able to do this anymore. Yeah, plastic surgeon from Whitefish Bay driving trucks.
