The New Hampshire Supreme Court has overturned the murder conviction of Adam Montgomery, previously found guilty of brutally beating his 5-year-old daughter Harmony to death in 2019 and then hiding her remains, which have tragically never been found.
Starting point is 00:00:25 Montgomery's conviction on the second-degree murder charge now vacated due to a legal technicality, the Supreme Court said, resulted in an unfair trial. The High Court ruled that prosecutors should not have tried Montgomery's second-degree murder charge alongside an earlier separate second-degree assault charge from months prior. The justices argued that hearing evidence of the first beating improperly led the jury to assume he must have committed the fatal December assault, creating an impermissible inference. The ruling read that the state produced much stronger evidence that Montgomery committed the first July 2019 beating with four witnesses who claimed they noticed Harmony with a black eye. Several of those witnesses also testified when confronted about that bruise, Montgomery admitted
Starting point is 00:01:10 to striking the little girl. The evidence in the allegedly fatal December beating was weaker. Only Kayla Montgomery, Adam's wife at the time, who was offered a deal in exchange for her testimony, witnessed the assault. She said that Montgomery beat Harmony in the head for soiling her bed in her sleep, saying immediately afterward of the attack, I think I really heard her this time. The defense attacked Kayla Montgomery's credibility and argued she was truly responsible for Harmony's death. The backlash of the vacated conviction was immediate.
Starting point is 00:01:41 The adoptive parents of Harmony's younger brother released a searing statement saying, We are absolutely disgusted. The reality is, more protection is in place for this monster than Harmony ever received. But before there's panic, Montgomery is not walking first. The court upheld all of his other convictions, including abuse of a corpse and tampering with evidence.
Starting point is 00:02:03 His 43-5-year sentence for those charges stands completely unaffected. Furthermore, the New Hampshire Attorney General's office has already confirmed they are absolutely pursuing a retrial for the murder charge, stating they remain entirely confident in the facts of the case. Next, we move south to Massachusetts where Boston police are currently hunting for two suspects who pulled off an armed robbery. The target? A Neighborhood Children's Lemonade Stand. On Wednesday afternoon in South Boston, a pair of sibling entrepreneurs were approached by two young males who asked at the stand accepted Apple Pay. But before the kids could even answer, one of the suspects snatched the cash box containing about $50. When the kids looked up, they spotted a black firearm tucked into
Starting point is 00:02:49 the suspect's waistband right before the duo took off running. The description of the suspects makes this even more jarring. Police say they appear to be kids themselves, one around 14 years old, the other just 11 years old, both wearing full-faced Nike masks typically meant to go under a football helmet. Boston City Councilor Ed Flynn took to Facebook to voice the neighborhood's collective outrage, writing, there is little I can think of more disturbing than the innocence of a children's lemonade stand being violated by an armed robbery. Local street cameras unfortunately missed the incident, but the South Boston community isn't letting the bad guys win. Starting point is 00:04:14 emotional and contentious sentencing hearing. In Derritter, Louisiana, the city's former mayor, 43-year-old Misty Roberts, has been sentenced to 90 days behind bars. This sentence follows her high-profile conviction in March on charges of carnal knowledge of a juvenile, an indecent behavior with a juvenile. The charges stem from a July 24 incident where Roberts engaged in sexual activity with her teenage son's 16-year-old friend during an alcohol-fueled birthday party hosted at her own residence. The courtroom dynamic on Tuesday was explosive. Prosecutor Charles Robinson fiercely argued for the maximum allowable penalty of 17 years
Starting point is 00:04:52 in prison. Robinson emphasized that Roberts is a highly intelligent individual who managed an entire municipal budget, yet completely failed to accept accountability for her predatory actions. The victim's mother took the stand to deliver a blistering victim impact statement, explicitly branding the disgraced politician a predator who hides behind hair extensions, high heels, Botox, and cosmetic augmentations, warning the court that danger does not always look like danger. Despite the state's push for a lengthy prison sentence, Judge Kent Savoy opted for a 90-day jail term combined with two suspended five-year sentences. Judge Savoy additionally mandated that Roberts undergo mandatory therapy
Starting point is 00:05:34 officially register as a sex offender and submit to regular ongoing drug and alcohol testing. The family fabric completely unraveled on the witness stand. Roberts' own daughter testified graphically that she personally witnessed her mother and the teenage victim on top of each other on the night at the party. Furthermore, Roberts' ex-husband, Duncan Clinton, testified that Roberts explicitly confessed sexual encounter to him, admitting that their own children had caught them in the act. While addressing the court during her sentencing, Roberts expressed deep shame, calling herself an embarrassment to the city of Derritter. She confessed that she had desperately begged others
Starting point is 00:06:11 to lie on her behalf following the incident because she feared her ex-husband would sever her access to her children. Roberts wept as she asked the court for grace and mercy, stating she simply wanted the opportunity to do what the Lord asked her to do, which was to be a mother.
