Prosecutors, though,  have revealed that D4vd and Celeste exchanged text messages regarding sex, pr...egnancy, and abortion while he was 18 and she was 13.  The teenager's death certificate was amended to state it is unclear if she was pregnant, as authorities continue to investigate. Starting point is 00:00:00 This is an I-Heart podcast. Guaranteed Human. Crime Stories with Nancy Grace. Bombshell tonight, deep cuts on D4VD, aka David Anthony Burke's lips, caught on camera. We believe those cuts were shortly after Celeste's murder. And tonight, does D4VD unwittingly admit
Starting point is 00:00:32 Celeste was pregnant at the time she was murdered. Good evening. I'm Nancy Grace. This is Crime Stories. I want to thank you for being with us. Celeste Revis is talking to her friend about running away because she's pregnant. Nancy, what I see is a little girl who imagines she has a true relationship with a much older man. April 23rd, that's when investigators say D4VD killed Celeste Revis. This is a 20-year-old man who's not going to let anything stand between him and his career. As we go to air tonight, we uncover deep cuts on D4VD's mouth and lips. We believe just after Celeste is murdered.
Starting point is 00:01:30 Also tonight, was her murder more of a two-man job? Is the state looking at a co-defendant? this as the preliminary hearing set to go down what's going to happen we think we know but first to the cuts on his lips first of all let's look at it control room let's not just talk about it let's show it it's on video okay there you go ow and what what is on his shoe it looks like blood okay right at the get-go straight out to Joseph Scott Morgan, Professor Forensics Jacksonville State University. He is the author of Blood Beneath My Feet. He's the star of a hit podcast, Body Bags with Joe Scott Morgan. But more importantly, he is a death investigator that has investigated over 10,000 death scenes
Starting point is 00:02:29 equaling 10,000 plus dead bodies. The lips are extremely, um, how do you say when you, you talk about having a lot of blood vessels. What do you call that, Joe Scott? Oh, it's, it's very vascular. There's a large concentration. Yes, like your nose, your eyes, your lips. They seem to bleed a lot more than if you cut your arm. And it won't go away. If you keep hitting it, it seems to make it worse. That is right after Celeste was murdered. And And if the two are connected, how badly do you think he wanted that to heal up and go away? Well, if he's demonstrating it, I can't imagine he wanted it to heal up. That's the odd piece to this, because that's fresh, Nancy.
Starting point is 00:03:25 That's not something that has been there for a long, long time. And the problem is that in that image, it is an insult, okay, but we can't tell. What I'd be very interesting to know is what's the nature of the injury itself. Is it shaped like a fingernail? You know how our fingernails are curved? You know where I'm going with this. Like almost someone trying to defend themselves striking at a particular assailant here. Or is it a blunt force tap to the lip?
Starting point is 00:03:54 Or is this just something that maybe he manufactured and put on his lips for the purposes of shock value? Joe Scott, I want to talk to you about something you just said, fingernail marks. Yeah. I'm sure you have, because I have, and I'm sure you have. in a strangulation case. And I believe this, we exhibited it on the slides of Ellen Greenberg's neck. Yes, we did. We often see fingernail marks.
Starting point is 00:04:21 They look like half moons. But with the lip, you can see that because the neck or other body parts, arms, legs, you can see a print better. With the lips, not as much. just like biting into jello. You can't, you can't really get a print as well on the lips. If she, right at him, and that is, in fact, a fingernail mark, a scratch, it's going to be a lot harder to have assessed that on the lip as opposed to on the neck where you and I have seen them routinely in manual strangulation cases. So if you think about the skin as the top of a drum,
Starting point is 00:05:03 okay, a drum has what's called a lot of surface tension. If you think about the skin, over our neck, more surface tension here in the lips, because they're very fatty, right? You don't have as much surface tension. So when you look at that any kind of insult to the lip, it's harder to interpret this than it is to where the skin is more stretched out, okay, where there is surface tension. So that wound for our purposes would have to be cleaned
Starting point is 00:05:32 and then you would have to observe it, but still, if this was generated as a result of a, of a fingernail mark, you could actually take it and what we'll do with an injury is press it close together and you can make out the signature left behind. And again, I ask all of our friends out there watching, look down the long axis of your finger, okay? And if you look at the leading edge of your fingernail,
Starting point is 00:05:56 you'll notice that it's curved. So these things look like half moon shapes almost. Joe Scott, I just said that. Go ahead, steal my thunder. I don't care. You're absolutely right. And I want to follow up on something You said at the get-go, you had mentioned when we were talking about theatrics, like,
Starting point is 00:06:13 what does this mean, if anything, to D4VD? To Dr. Bethany Marshall, that is not Joe Scott Morgan or my bailiwick. That's on you. Dr. Bethany Marshall is joining. She's a renowned psychoanalyst out of the Beverly Hills jurisdiction. But she does not limit her practice to rodeo drive. Rodeo, rodeo drive. Dr. Bethany, we have a prior girlfriend who I believe was also underage at the time she was dating D4VD, aka David Anthony Burke, who says he thought he was above the. law and many other things. I don't think he cared. If Celeste had scratched his face, had made that mark on his lips, I mean, that night, and I'm going to go to Dave Mack in a moment, I'll back up for this, that night after she
Starting point is 00:07:24 was murdered, he's out doing a PR party. He doesn't care. Hey, control room, can you dig up really quickly, him out? That night at a PR party, after he ordered Celeste up like a pizza, got her an Uber, there he is. Do you think he cared about going on camera with his lips still bloody and reopened as a wound? I don't think he cared. Nancy, I think he was happy. I think he glorifies death.
Starting point is 00:07:58 He began to feel sort of elated and like all the responsibility of this underage girl is away. They probably may have had some kind of bite. Something was going on with her where she had more needs as girls and women do. And I don't see a fingernail mark. I see a bite mark. Now, I'm not Joe Scott Morgan. I'm not a death scene investigator. But I am as a psychoanalyst.
Starting point is 00:08:26 I think that he, death, sex, eroticism, all of those things were fused together in his mind. So it could be that they were having sex. He was making out. She bit him. Okay, yeah, I see where you're going with that, Bethany. But to you, Dave Mack, joining me, Crime Stories, the investigative reporter. Let's get our timeline straight here. He ordered her up like a pizza on Uber Eats.
Starting point is 00:08:52 He paid for her to come to his home the night she was murdered. There is plenty of evidence supporting this. That is the night she was murdered. She was threatening to expose their relationship in a few moments. You know what? Let's don't wait. Let's show the screen grab now where D450D seemingly admits that Celeste was pregnant. Okay?
Starting point is 00:09:20 Can we pull that up? So what I'm saying is I don't think the injury, the deep cut to his lip was from a makeout session. There you go. I'll join the group chat with Wifee and give you all the story. time. What should I name my kid, guys? Okay, there you go from D4VD. So what I'm saying, Dave Mac is I don't think that was a love bite. Immediately he's on making the videos, putting out Insta, putting out TikTok with a bloody injury to his lip right after Celeste is killed. Just like he went
Starting point is 00:10:01 to the party. Just like he was pushing his tour. He did not care. What's so hard for anybody to understand about that? We can't relate to it. But the timeline proves it. If in fact, our information is correct. That's not a love bite. That's an injury. Give me the times. Give me the dates. Okay. All right, Nancy, April 23rd is the key date here. That's where, as you mentioned, you know, he orders Celeste up like a pizza. He orders her from her home with her parents to his house, a 70-minute drive, a long drive by Uber. Then he allegedly kills her. And it's important to note, Nancy, that while he allegedly killed her right after she arrived at his house just after 10 p.m. on the night of April 23rd, D4VD sent text messages to her phone, acting like
Starting point is 00:10:54 she hadn't arrived yet, to kind of create an alibi right off the bat. Then, after He allegedly kills her in his home. He then takes a late-night drive out to Santa Barbara County, the first of many. And this is where he allegedly disposes of some evidence. This early morning late-night ride was reported early on by investigators, if you remember. And it all came to fruition when we saw this timeline getting built around April 23rd. This is the week. His album is coming out, his first full studio album going out, Withard.
Starting point is 00:11:33 The Withard World Tour was beginning right then. And by the way, Celeste Revis was threatening. See, he had broken up with her. He had cast her aside. And she was threatening to go public that week to blow up his entire career that he had been involved with an underage girl for years. And that's what happened on April 23rd, Nancy. Okay, and it's not just that, Dave Mack.
Starting point is 00:12:01 You're right. She was jealous and she was angry. And in her little girl mind, she's 13, they started their relationship when she was 11 still wearing Hello Kitty apparel. It's not just her saying it. Other people, other girlfriends, many of them allegedly underage. And I want to reiterate, D4VD, David Anthony Burke, is innocent tonight. He is presumed innocent. This is for you, Troy Slate, and I'm throwing you a bone.
Starting point is 00:12:32 He's presumed innocent unless and until the state pierces that presumption with evidence sufficient to prove him guilty beyond a reasonable doubt. Now, that said, I want you to hear what another girlfriend, aka victim, of D4VD, had to say about his stable of underage girls. David's third victim has officially come out anonymously in this Reddit post. Stating, this is Victim 3. For those saying I didn't go to authorities, that's the first thing I did. Like, are you guys serious? I went to authorities I'm involved in this. Your comments are insensitive and rude.
Starting point is 00:13:08 I went through so much that you guys need to calm down and realize the victims went through so much. I know there are other girls out there like me. Does that mean that David had more than three victims? It makes sense because she first-hand saw how many girls David was grooming. And it could be backed up by the fact that David had his whole phone full of CP. So it's about to happen that there's even more than just three victims. That's GOD Carmen on Insta, talking about him reacting to an alleged victim three in this case, angry, commenting on the number of underage girls. And, you know, back to you, Dr. Bethany Marshall, how was this little girl Celeste supposed to respond?
Starting point is 00:13:50 She had told her bestie she was pregnant. you see D4VD is putting it out there posting that he's going to have a child. Now, I know Troy Slate is doing a backflip because we can't prove the origin of this, even though that is his official posting. That said, what's going through the mind of a little girl 13 that started her relationship with a much older boy when she was 11 years old? he's a man now. He is a grown man. What is she supposed to think when she sees all these other little girls lined up? It's going to be so confusing for her. You know, when Tiger Woods, all these
Starting point is 00:14:33 women came out with Tiger Woods, they were adult women, and each one thought they would be the only one and the special one. That was why they hung in there with Tiger Woods. So you think of a 12-year-old, her mind's not fully formed. That's going to be a very much a part of the picture. How can a 12-year-old even cope or process something like this, especially if she's away from her parents, our parents help us process reality when we're little. And she didn't have her parents to do that for her because she was out of the familial home. She probably thought she was going to be like a princess and the only one. And that as he, his career grew, that she was going to be the wife of this huge star and all the other girls around, she probably felt so jealous and distrable.
Starting point is 00:15:21 destroyed and awful. And I imagine that her reality, she probably couldn't even put the pieces together, Nancy. She hopefully had little friends to talk to, but probably not, because he probably told her this is a secret. Don't tell anybody. Don't tell your parents. So she was left with a mass of undigestable feelings, which is really awful, Nancy, for a little girl to go through. Pride Months, Toronto. Please, there are no coincidences in criminal law. She's killed, murdered, dismembered. This video is shortly after a According to reports, of course they're connected.
Starting point is 00:17:22 And I'm not surprised at all that he did not delay the video. He didn't delay the party, the night of her murder. He went out and partied for PR, for marketing, and lived it up. Probably got a couple of little girls' phone numbers that night. He didn't care that Celeste was dead at his hands, according to police. So why not shoot a video with your lips still dripping blood? Absolutely right. It's a trophy to him. And how many how many homicides have we seen that the perpetrators have trophies of their victims? And this is just one of them. It's a promotional scheme to put it out there more, to act like a tough guy, to look at what I did. But inside, it is a trophy. And he's keeping that as something prideful, which is sickening. But that's the reason he's doing it. And he wasn't going to stop. If you if you look at all the things that had been going, on with these videos, each of them have something else to do with this crime.
Starting point is 00:18:22 And that's what investigators need to do as far as a timeline goes, start picking these videos out and putting them into the timeline of when they came out, when injuries took place or look like they took place, and then just take it up from there and get all the people involved in these videos as well to get interviewed about what was going on behind the scenes. Okay, I want Troy Slate and Dr. Bethany Marshall to brace themselves. I agree with Tom Smith, by the way. I've had so many defendants just flaunt the law. I had one drug trafficker.
Starting point is 00:18:59 He appeared in court in the same bright red full leather outfit, leather head to wrist to toe, red leather, that he was wearing in his book and photo. Really? that the witnesses described he was wearing the night he was apprehended the night that he was caught with the dope. The whole thing
Starting point is 00:19:22 he was so arrogant. Same thing here. I don't think that there would be any problem in D4VD's mind shooting a video with his lip dripping blood from a wound delivered by Celeste in some way
Starting point is 00:19:38 during her murder. Okay. Brace yourself, Troy Slayton and Dr. Bethany Marshall. Listen to Celeste. You heard Dr. Bethany Marshall talking about what was going through this little girl's mind. Was she pregnant at the time? Did she get an abortion? Because we know there was a lot of talk between them. It's documented in the state's supporting brief, which, by the way, the defense tried to suppress so nobody can read it, but we got it and we read it. And it talks about the Plan B abortion pill. It talks about her getting abortions. Is that why she went to London? Is that
Starting point is 00:20:11 why her passport was discarded out in the middle of nowhere, but it was found? Did he not want us to know he took her to there, to Vegas, to Texas out of state? Why? That said, listen to this little girl's response. I know that you probably don't want to talk to me right now, and I respect that. I really do, but I really need to hear your voice right now. Like, I just need to know that you're okay. I need to know that we're okay.
Starting point is 00:20:41 I sound so stupid right now, but like I've been so selfish and I can't stop thinking about you and what I did and how it's affecting like everything. Starting point is 00:21:18 Troy, did you hear the little 13-year-old girl saying she's sorry for what she did to D4VD? Okay. According to his posting and what she tells her bestie, she was pregnant. And her feelings were hurt when she sees all the other girls lined up. to be with D4VD and him taking advantage of that. And in her little girl mind, she is apologizing. It makes me sick. Sick.
Starting point is 00:21:53 I wonder if they can play that in court. But I want to hear your response to it. Well, number one, if that is really her, it seems to me like that was a surreptitious recording of a private communication, meaning you're not allowed to record a communication where the people who are involved in the communication have a reasonable expectation of privacy. It's not like they recorded that somewhere at a McDonald's. This was a message sent to one person intended to be private.
Starting point is 00:22:31 So that's one issue. That's one legal issue. There's no consent framework that exists. for that to be publicly used for any commercial purpose. But certainly if that was her voice, she's unavailable and the prosecutors can absolutely use it in a criminal trial for what it's worth. But as far as everything else that you've said today, it seems like...
Starting point is 00:23:01 Pause. Let's just take one issue at the time. So you're saying that the problem you have with a 13-year-old allegedly pregnant little girl who's watching her love object sleep with other girls and it's hurting her feelings. She's 13. Your problem is that it may have been recorded improperly. Are you going to sue me?
Starting point is 00:23:30 You're going to sue me because I played it? Bring it on, Slayton. Come on. I can't wait. The other thing is, what if Celeste recorded it? that makes it consent. What if she recorded herself? What if it was taken from a police recording? You don't know that. It seems like it seems like it was a voice memo that was sent or like a voice mail sent through a text message, something like that. That's what it appears like to me.
Starting point is 00:24:03 Just because she recorded her voice herself doesn't mean that she's given consent. for it to be played for anybody. She meant it to be for one person. That's not what consent is about. Consent, one and two-party consent, and I've used it in court many times. It's not about whether it's going to be played publicly, like tonight on crime stories.
Starting point is 00:24:24 It's about consent to tape. Can it be tape? That's the consent we're talking about, not consent to air it on crime stories. So let's get the context legally accurate. It's whether one of the two parties consented to the taping. If I record a conversation, if I record my voice and send it to a person, send it to somebody that I don't intend it to be used in any other forum, then it's not allowed to be used regardless of me having taped it myself. It may not violate federal wiretapping laws.
Starting point is 00:25:07 Oh, there you go. He finally admits it does not violate the consent rules. But there's California privacy rules that would not allow its publication. We're not, that's not in criminal law. That's not in criminal court. This is a murder case. That's civil. What do you think I just fell off the turnip truck?
Starting point is 00:25:31 Go to the corner, go to the corner, and think about what you just said. Wait a minute. Don't go to the corner yet because you were about to jump on all the other issues. What other issues? Well, let's take a 30,000 foot view at this, Nancy. What you don't realize is that a young celebrity like this has dozens of people around him. There's an entourage. There are multiple people here and what the defense is going to be starting, is going to be proving. It appears from the very beginning and they're setting this up right now is an alternative explanation
Starting point is 00:26:11 for her death other than the person who's been arrested, D4VD, David. And they are going to allege that there... Why say it in one sentence when you could have said in 50 sentences? There's some other dude defense. Is that what you're saying? Somewhere in all of that. Absolutely.
Starting point is 00:26:30 There were so many other people that had access to this person and so many other people that stand to lose, that stand to be hurt. if for somehow she exposed an illegal relationship and the gravy train, which was his stardom, were to come to an end. Starting point is 00:27:25 Is Canada the liftoff! Available on IHeart Radio. Prosecutors say that Celeste was murdered on April 23rd. The person who potentially committed this heinous crime feels like they can get away with it and no one else knows what happened. He pays it to have Celeste brought to him like she's a pizza. Joe Scott, what actually was done to Celeste? What did she endure? Let's go back in time just for a second, Nancy.
Starting point is 00:28:00 Do you remember the kiddie pool that was mentioned extensively as one of the purchases? What was some verbiage that came out relative to that? And I've always been curious about the source of this information. And that was it was used and that she, we watched her or he watched her bleed out. Do you think that David made that statement? Probably not. Therefore, there's someone making that statement about her bleeding out. You want to know about injuries?
Starting point is 00:28:35 I've got evidence for this. And let me explain it to you. We're talking about, and I've identified as the coroner medical examiner did in L.A., There are two specific sharp force injuries that she endured, Nancy. One is if you'll go to the top of your head and measure about 15 inches down on the left hand side. Okay, that's how they're orienting this in the autopsy report. She is actually stabbed through her ribs in the intercostal space in the left chest. This wound actually goes nowhere.
Starting point is 00:29:08 Okay, it doesn't impact the lung. It does clip the edge of the bone, okay? but here, here's the one that is the fatal shot. So if you go to the top of your head and measure down 25 inches from the top of her head on the right hand side, Nancy, there's a penetrating sharp force injury right there. And you know where it goes? It goes into her liver. You know why this is important? Because liver trauma is horrible.
Starting point is 00:29:37 It's horrible in the sense that it is a slow bleed, okay? you do not die immediately. She would have languished. I've made comments on this before. This is not something that would have been quick like this. She would have laid there and bled out, Nancy. This would have been painful. She would have eventually slipped into unconsciousness as a result of what we refer to as exanguination or bleeding out internally. If they had gotten to her body sooner, prior to, to dismemberment. When you open her abdomen, her abdomen would have been floating in blood, all right, just so you understand. And the liver is a very vascular organ. There's all kinds of vessels that run through it. And all it takes is to clip a few of those. I've worked cases involving
Starting point is 00:30:30 gunshot wounds, stab wounds, and motor vehicle accidents with blunt force trauma to the liver. It is a slow languishing death. Troy Slayton, is there going to be another co-defendant? That's the thing that I had said earlier, and you just brought it up right now and they're discussing it with everybody. This is a person who was never alone. This was a person who had an entourage around him all the time. Even when he's playing a video game, even when he is engaging with a screen, he had multiple people there that are watching, that are commenting, that he's commenting with. there are people all around him all the time, which is a very good defense for him having committed this murder. I'm about to make my bloody shirt uniform for a tour.
Starting point is 00:31:23 Excuse me. Go ahead and take your hand. Put some blood on that hand. Take that hand and put it on that shirt. And I'm going to do this 25 more times and I'll come back to you when it's finished. Here's the bloody shirt. And you see my hands are completely decimated. But we came out with a good uniform and we're going to go on stage.
Starting point is 00:31:45 Oh, yeah, he would totally do a video with a bloody lip from Celeste. I mean, I'm just a trial lawyer. But when you don't know a horse, look at his track record. That's from At the Face magazine on TikTok. Now, I want you to compare that in stark juxtaposition to this. We arrive on this earth with nothing. We spend our years chasing everything, and then we're going to die with nothing. So just make sure your spiritual hands are full before you leave this earth.
Starting point is 00:32:20 Read that Bible, stay in that word, stay inspired, stay prayed up. Oh, I will. I will. But what I'm praying for, D4VD may not be the same thing that you're praying for. That was from at D4VD prayers on TikTok. Right now, a preliminary hearing is set down. The defense is furious gnashing their teeth and switching their tails because this brief has been released to the public. They fought tooth and nail to keep it a secret, keep it sealed.
Starting point is 00:32:56 The judge refused. That's how we know as much as we know. We wait as God willing justice unfolds for Celestius. Revas and last but not least, David Anthony Burke tonight is innocent under the law. All of this unless and until the state pierces the presumption of innocence with evidence sufficient to prove Burke guilty beyond a reasonable doubt if you know or think you know anything regarding Celeste Rivas death.
