Crime Stories with Nancy Grace - Naked Exec Eyed in Fashion Designer's Hamptons Yacht Death: Blood, Vomit, No Charges?

Police respond to a 911 call in the high society area of the Hamptons at the Montauk Yacht Club shortly after midnight. Martha Nolan-O'Slattarra, a fashion designer from Ireland, is found unresponsive on a boat named "Ripple." The yacht is reportedly owned by insurance mogul Christopher Durnan, 60, who was present at the scene and allegedly ran down the dock screaming for help. The wealthy yacht owner was once accused of fighting and biting a former New York firefighter during a tribute concert, commemorating 20 years after the 9/11 terror attacks. CPR is attempted by a good Samaritan, but first responders pronounce Martha dead at the scene. Initial autopsy results showed no signs of violence. As rumors swirl of drug overdose, Martha's family strongly denies those claims and rumors of brain cancer by hiring attorney Arthur Aidala to ensure a thorough investigation is performed.  The official cause of death is inconclusive. Crime stores with Nancy Grace. A naked executive tonight eyed in a glamorous young fashion designer's Hampton's Yacht death. She's purple. There's blood all over her head and face. Vomit. You know what's missing? Charges. There are no charges.

I'm Nancy Grace. This is Crime Stories. I want to thank you. for being with us. A beautiful young fashion designer found dead on a Hampton's yacht. Things get swept under the rug. People might be paid off. People might not be, might be scared to speak.

A dead woman on a yacht? Why, I'm Martha, the founder, CEO, crew director, you name us of East by East. We are launching a resort wear line soon. we just got our first round of samples back and I wanted to share some first looks with you and see what you think. We got another crochet. This is floor length.

You can see the beating, the details absolutely stunning on. I tried it on. I think this will be a best of her. That is from Martha Nolan's TikTok account. Imagine that beautiful young woman purple blood all over her face and head, vomit. Now, I'm not quite sure how blood all over your face and head equals no charges, and factor in a, quote, naked executive.

Straight out to Brian Harmon joining us, executive editor, greater long island.com, former daily news. what can you tell me, Brian, about the condition of Martha's body when found on the naked executives yacht? Well, the official word from authorities is that there was no evidence of blunt force trauma, that the death didn't seem to be suspicious, and that there was no signs of blood. There was no blood at the scene. since then there have been reports showing indicating that the EMTs did find blood on the back of her head and chest, blood in her mouth. You know, I'm curious because those are two very different accounts. I'm not saying it's you, Brian Harmon. I know for a fact that you are recounting exactly what has been.

been stated. But I find the dichotomy to be jarring, to say the least, that authorities, wherever that might be, says, well, there's no blood, but the EMTs, and I'm reading directly, find blood on the floor near her body, purpling of the lips, and under her nail beds, blood in her oral mouth, head and chest area. We also find vomit. Her head covered in blood, according to a new report. How is this? How can one official report say there was no bleeding

and another Brian Harmon, coincidentally, from those on the same state, there was blood? That's really not something I can explain. I'm just, I'm basing it off of official reports from the police and then, and then documents that have since come forward from the EMTs that were at the scene and the documents that they filled out. I do can say that I spoke with police yesterday. They did say that the case remains under investigation.

Joining us, in addition to Brian Harmon, joining us from greater long island.com for formerly daily news. Joseph Scott Morgan, Professor Forensics, Jacksonville State University, the author of Blood Beneath My Feet on Amazon. He is the star of a hit series, Bodybacks with Joseph Scott Morgan, and has performed over 10,000 death scene investigations.

How can you have blood on the back of your head and there be no foul play? I don't understand that. The clue rest here, Nancy. in what they're referring to as purpling, which is not a very common term. She is cyanotic, and that's what it sounds to me, and what that means in plain English

is the fact that she's in some type of congestive failure, perhaps. Now, congestive failure, you can arrive there in a couple of different ways. We've already talked about drugs. All right, so that means that your lungs stop functioning, your heart stops functioning. You can have blood that will pool inside of your airway. You can cough it up.

There's another way that psionosis you can appreciate it. And that is through some kind of asphyxial event where the airway is being blocked in some way. You can see it, you know, we talked to, we heard about vomiting in this case. Did she aspirate any kind of vomit into her throat or into her, airway or or did she have some kind of pressure applied to her throat. I find it very interesting as well is that her nail beds were starting to purple up, which many times is that you're seeing that in cases of an oxygen deprivation event. And that means that she's not getting uptake of oxygen, all right?

And so your body is like screaming, screaming, screaming. And all of these things play a part in leading to the terminal event, Nancy. Blood on the back of her head. Blood on the back of her head. I heard everything you just said. I did not hear an explanation for blood on the back of her head. Okay. Sure.

So if you're coughing up blood, perhaps, and you're in a supine, which means on your back position, you're turning your head from side to side, you can spit up blood and it will gravitate to the back. That's really the only explanation I would have at this moment in time. That medical exam is off. How about getting hit on the back of the head? Oh, you know what? I get it. It's the victim's fault. She, messy girl, vomited blood. And the, rubbed her head in it. Okay, to Jeff Gentry, joining us out of Fresno, forensic certified bloodstain pattern analyst, senior crime analyst and death investigator, former toxicology lab, analyst author of forensic science applications to death

and crime scene investigations. Jeff, please tell me something different because I don't think she vomited up blood and then rubbed the back of her head in it. Okay, so when I'm going into a scene, If I see blood, I have to first of all figure out where did this blood come from. And that should have been on everybody's mind right from the get-go. I mean, not only are they trying to save this person's life, but they're trying to figure out where this came from.

In the medical examiners report, there were no indications of any external injuries. Could they have possibly missed an injury on the head if they're not correctly documenting blood at the scene? Yeah, that's possible. So I'd be really curious to see exactly what those medical examiners put in their reports. but let's just assume that they're correct and that there were no obvious external injuries then where did that blood come from and it had to be from the nose or mouth

and which other guests said about there possibly being some traumatic asphyxial event that could definitely cause blood from the nose or mouth for sure it is not really common nose and mouth Jeff Gentry what you're singing along with Joe Scott Morgan's choir she naughty girl

vomits that blood then rubs the back of her head in it. Okay. Brian Harmon joining me, executive editor, greater long island.com. Isn't it true, Brian, that the naked executive told EMTs he was in bed with Martha and called 911 when he could not wake her up? That has been reported in a number of places and we've reported that as well. that he was he was you know they were definitely on the boat they had been on the boat for hours together they were there apparently they were there for some type of business meeting um in bed him naked and her quote in bed the business meeting in bed originally it was it was officially it was reported as a business meeting and then there has since been reports that

have indicated that he has said that they were in bed together Brian Harmon, you know, Harmon, I've read your work and I'm a fan. Hold on. Let me understand this. This is a yes, no. I have now declared to you a hostile witness and I'm cross-examining you. Isn't it true? The naked exec says, according to reports, he wakes up in bed and she's dead in the bed beside him. Is that correct? That is no, that is not what I, what I know is that they were on the boat together. First of all, I know nothing directly from him over the last year. You know, we have tried to reach out to him, reach out to people representing him, and we have not heard back from them.

But what I do know is what you've discussed before is that he did go screaming naked down the dock and multiple. other boaters reported that. And then, you know, EMTs and other responders came to the scene and found her in that state and did try to resuscitate her. Okay. I believe I said reportedly. And you just said that according to reports, he stated two EMTs that he had been in bed with her and woke up and could not wake her up. That remains reportedly, yeah.

So then the answer, after all that, is yes. That's what he reportedly said. Correct? Okay, reminder to Brian Harmon. I only have a JD, not a DDS. I don't know how to pull teeth, but I can certainly try. Straight out to Dan Murphy, joining me, former NYP Detective Sargent,

formerly on the Joint Terrorism Task Force, former Chief Security Officer at U.S. Bank Corps, and star of Gold Shields podcast, author of Workplace Safety. Dan, he's running around naked, screaming. If he'll do that in front of the other boatgoers, what will he do in private? I'm just having a hard time getting my head around the fact that he says to EMTs, reportedly, Brian Harmon,

reportedly, if you don't want to believe the EMTs, I guess that's on you, that he says he woke up in bed with Martha, who has a boyfriend and told him she was on her way home, he was unable to wake her and that he called 911. Help me, Dan. He himself makes statements about where she was, but why, again, why didn't he call 911 himself? And ultimately, the medical examiner of the EMTs when they came find her cold to the touch. There's a million reasons why a person can be cold to the touch, and Dr. Morgan can answer them far better and professionally than I, but have been at many scenes. The human body is 98.6 at an average temperature. If she's dead, it starts to go down around two degrees or so an hour.

It cools slowly. To find someone cold to the touch, also the extremities cool quicker than the core body. and reportedly, Brian Harmon, that was for you. he claims he's naked running up and down the dot. He says he stripped because Martha vomited on him. So he went naked. But there were no signs of vomit at the scene or in the autopsy. There was no soiled clothes at the scene. Nancy, there is no indication of vomit being anywhere.

But what there is an indication of is that Martha was, cold and turning purple, but there was no active bleeding. The blood was dried blood on her head, chest, and around her mouth, not vomit, but dried blood. Says that she went limp between 1030 and 11, but he goes screaming down the dock, you know, naked, looking for help and doesn't call 911. It is someone else a bystander that calls 911 around midnight. We've got at least one hour of time where we don't know what was going on. We just know that he was covered in vomit is not backed up by any evidence.

As of tonight, no one has been charged. No one is being considered a person of interest. No one has been detained or arrested at all. Why? According to the executive's lawyer, his client was naked because his clothing was soaked in the victim's vomit. Her heartbroken family is not convinced that she died allegedly of an OD. And we had some unique pieces for the store in Montauk that we had last summer, such as like silk dresses, everything, just follow through with the journey. You know, it's a roller coaster of challenges and triumphs and I want to share it with all you beautiful people. Hey guys, I am driving back from location sketching in Newarkup. I was just putting my phone up, so 10 to 3. I met the team and they're all beautiful, beautiful gorgeous people. And yeah, we went location scouting.

Well, I went location scouting. I went and had a look at the locations that we're going to shoot in tomorrow. Yeah, we'll be shooting about with 80 logs. You should know that. This young woman came from a rural, extremely rural area in Ireland, comes here to make a better life for herself and starts her own fashion design business with stars in her eyes. the executive was an alleged investor and wanted to meet up with Martha on his yacht according to him to discuss her swimwear fashion company then she ends up dead beside him in bed and him naked his lawyer says he was naked

because his clothing was, quote, soaked in the victim's vomit. No soiled clothing was found on the boat. But I'd like to point out that in the EMT, emergency medical technician report, there was blood on the floor. Dr. Chloe Carmichael, joining us, clinical psychologist,

author of Nervous Energy, harness the power of your anxiety. You can find her at Dr. Chloe.com. Dr. Chloe, she obviously thought she was going to an investor meeting. So how did he end up buck naked? She's clothed, blood on the back of her head, and cold to the touch. Yeah, Nancy, what I know from the facts, apparently, is that at the very least, he was running around, throwing sunscreen battles and all these things. What I might infer from that is it appears that he was making a big display of asking for help.

Yet, as you pointed out, he apparently did not do the most obvious thing, which would be to call 911, and it appears from the temperature of the body and other medical details that he may have not moved as fast as he could. Even if we believe his ridiculous, I think, story of having taken off his clothes because they were soaked with vomit, even if that were true, it would only suggest that he further delayed going to get her medical care. If I were with somebody that I cared about who was vomiting to the point of needing medical attention, I wouldn't say, oh, excuse me, you're going to have to wait while I clean myself up a moment, and then I'll go get you the medical help. So none of this makes sense.

You know, another concern to Brian Harmon, according to Martha's family, law enforcement told the family the scene had been cleaned up before first responders arrived? This is what is part of the basis of the wrongful death lawsuit that she's filed last week. And she met that she filed it, her family filed it. and it was basically, it was filed almost to the day one year from when she died. And it's, it's really like you're obviously pointing out that it's a family that's waited for a year for some answers for someone to explain what happened to their luck one. To Joanna Nievis joining us, we're now a criminal defense attorney, founder of the Nieves law firm joining us out of the California jurisdiction. Joanna, you have handled criminal cases, you handle civil cases. The family is accusing him, the naked exec, of causing Martha's death through assault and negligence.

I'm guessing the negligence would be waiting so long to call 911. And the assault, I assume, is derived from the blood on her body. I agree with you. That's what we can assume. We don't have enough information or a detailed complaint to really understand what their allegations are. We know from the first autopsy that there was this conclusion that there was no violence. And then the second autopsy undercuts this theory of an overdose. But there were trace amounts of cocaine in there.

We do have these suspicious behaviors that were going on, namely him being naked, the time gap that's unexplained, the things that we see around the scene that are being described, like the blood on her body. that's dried. We just at this point I don't think there's enough for that causal connection. You know, that blood could belong to somebody else. Somebody could have fallen or cut themselves earlier. Who? Who would fall and cut themselves and she rubs her head in it? Do you do hear yourself, right? Yeah, absolutely. Here's the thing. I don't know that she rubbed her head in it. I do know that there was blood that was found around her on dried on her body. I do think I do, of course, believe that there is blood that would be derived from her, that came from her mouth.

But other blood on the scene could have been, could have happened during, uh, attempts to save her. Maybe somebody, maybe. It says the blood is around her body. Yeah. Somebody else could have harmed themselves in, in the, uh, attempts to save her. And we, I'm not sure whether or not it's been concluded that they were the only two people on. Because, uh, they didn't need a warrant to get this. got a stripped down to see if he had injuries or had cut himself.

He says he was alone with her on the boat. So we've seen his whole body on natural. And there are not any cuts on it. So who is the mysterious, spontaneous bleeder you're talking about? That we know of thus far, right? Just like we see that there was this lack of kind of consideration and reporting regarding the blood earlier on, even though the EMT documented it, there. it is the possibility that there's a lack of documentation concerning any injury to him as well.

As far as him being on loan on the boat, I don't know if he was captaining the boat, the yacht, excuse me, himself. What are you saying, woman? He says he was alone with her on the boat. What are you talking about? A captain. He is the captain. It's his boat. Really, some people do not consider the people that are assisting them, what you might consider help, as people. and in his language please please please Joanna I know you in a lot of cases but right now I think you need to go lay down

I think you've had a head injury because there was nobody else on the boat nobody else cut themselves nobody was a hemophiliac and bleeding on the floor and she got into the blood that didn't happen she was covered in blood she and his lawyer states

and back to Brian Harmon his lawyer states that she Martha goes limp as early as 1030. He thought she was having a heart attack? That is not something that has been officially reported or officially said by law enforcement authorities. So I cannot really speak to that. I ask you, did the lawyer say that?

Dave Mack, do you know about that? He is the executive's lawyer, Holdman, states that Martha goes limp at 10. 30, between 1030 and 11. Do you see that, you know what? Joe Scott, help me out here. She's limp. At least 1030. She's cold to the touch when EMTs get there. He's naked. She's got blood all over her head. Does nobody see a problem with this? Am I the only one that has a problem? No, there is a problem, particularly when you're talking about the body being cool to the touch. As Dan had mentioned just a few moments ago, the idea that she would be called to the touch. Now, we don't have a degree reading here like you would have with a medical legal death

investigator, at least to this point where they can measure this. They can give you the body temp. This is troubling to me from the sense that, as Dan had mentioned, you're going to lose that first hour that Nancy, you're going to lose about two degrees of temp. If we're at 98.6, you're going to be down to 96.6. And then for every hour after that, you're going to lose about a degree to a degree and a half of body temp under ideal conditions. The other thing I'd be very curious about Nancy is, was her body rigid in any way? Did she have any rigidity in her jaw, in her fingertips, any of those peripheral areas where we look in the smaller muscle groups?

And also, we've talked about the back of her head where you've got this kind of matted area of blood or whatever this is, that they're kind of, vaguely describing here. I want to know if she's got any kind of distribution of blood that has settled on her back and to what degree. Now, this is where it goes from the EMTs doing their initial assessment to an actual death investigation where this thing is locked down and the scene is thoroughly worked through. And one big thing here, Nancy, that I'm really concerned about is that to this point, we've only heard snatches that she had trace elements of cocaine in her system. To me, what that says is that there's probably what's called cocaine metabolite, which is as the cocaine is metabolizing through the system, it's leaving back little remnants. We generally get this out of the urine most of the time.

if there's not enough there to kill her, we have to look somewhere else. Why hasn't the official toxicology report actually been released with all, all of the qualified and quantified amounts that were in her body? I've never heard of a cocaine overdose when the tox report shows trace amounts. That doesn't even mean it was that night. No, the only time. that that could have happened, okay, is if there is some kind of peripheral thing

that she's got some kind of heart ailment, okay? And I'm not buying that, because we would have heard that from the doctor. Oh, my stars. A congenital heart ailment? Okay, I'm putting you in the corner with the evidence. There's no evidence at all of a heart ailment. She's a healthy young woman,

having a stupid meeting with an alleged investment. on his yacht. And I guarantee you, he ain't naked when she gets on that yacht. To you, Dave Matt, wasn't she perfectly coherent when she called her boyfriend and said, I want to get out of this. I'm on my way home. Just give me a minute. Yep. She was, there was no sign of anything going south when she talked to her boyfriend. It is, it's, everybody's trying to avoid the obvious here. You've got a 60-year-old rich guy with a beautiful young woman on his yacht to talk about business. You know, Nancy, this is not a dumb woman.

She has a bachelor's degree, a master's degree in digital marketing. She built her product line east by east from the ground up. She even, she actually created pop-up stores on Montauk. We launched about two years ago and we had our first retail location pop-up in Montau in the Montau Beach House. And yeah, we'll be going back there this summer. So you will see us there. We'll be doing some brand activations, some brand partnerships, some, like, wellness stuff.

And we'll also, of course, throw some parties, some pool parties with really cool DJs. So, yeah, stay tuned for that. Within hours of her death, you could walk right up to it. You could board it. I mean, it wouldn't be legal to board it, but you could see in it. You could, and that's where the reports of the white powdery substance come from that was on a cushion. You know, that was visible. So you could see right into the yacht.

There was no signs of trauma or blood. Of course, I could not see into the bedroom. But the boat remained docked there for days. There was no police tape around it. And this is within hours of the, of her death. Jeff Gentry, forensic certified bloodstain pattern analyst and author, Way In. Nancy, I am completely on board with you on this case. It is not a natural death.

She's young, healthy, no evidence of any congenital issues or heart issues, anything that people have been throwing out there. It's not an accidental overdose. The drug levels were too low. And then it's not a suicide. And you have a young lady alone on a boat with one person. and if it's not an overdose, what is it? I think the family has a great claim that there was not only evidence of possibly violence,

but then also the neglect element. And like the other investigators have suggested, you have to look at the body temperature, you have to look at the condition of the body, you have to look at the blood, was it dry, was it wet, was there evidence of cleanup? I hope that they did actually take the time to use, like, luminal or Blue Star, to see if there was evidence of cleanup? Was there rags? where there wet towels, all of that has to be documented and definitely plays a factor in this death investigation.

I think the biggest element here that I want to try to understand is going to be the toxicology results and how this factors into any kind of lifestyle decisions that the owner of this yacht may have been making at this particular time. Does this come into play? We've heard a lot of snatches of information about this. I'd like to know where the status of that investigation goes relative to any kind of drug involvement. That would be very curious. I'd like to know why. At this point in time, after all these months, the police are holding the results of said toxicology report so close to the vest.

I'd like to know more about that as we move forward with this case. So I think what we need to keep in mind is that right now there's a civil lawsuit where the burden of proof is much low. lower than a criminal action. So in order to get to a preponderance of the evidence for this wrongful death claim, they can rely on the totality of this circumstantial evidence, the blood that was found, him being with her, running around naked, trace evidence of cocaine

and how all of that plays together. But to get to a conclusion that this was a homicide and he was the person that inflicted an injury on her and caused the death of this young woman, It's going to take a bit more investigation than the spattering of information that we currently have. As with always, in any sort of a case of a death investigation is the medical examiner's report is being sat on by the Suffolk County ME. They're doing that because they kicked it back to the Suffolk County detectives and said, we need to know more, which I find unusual because typically in a homicide, you will have evidence of homicide findable by the MEs themselves. But in this case, they need to know a lot more, which means to me they're taking it seriously.

And it's frustrating to not have the reports to look at or comment on, but I'd be very curious to see those reports exactly what her cause and manner of death were because they're holding it tight to the best. It's a terrible tragedy, of course, that this beautiful young woman with so much in front of her should pass away under such strange and mysterious circumstances. And I think it's really frustrating that we haven't been able to get all of the reports that we would all like to see. So I certainly hope that that comes through soon because uncertainty in these types of situations always increase our frustration and our anxiety. Nancy, there was a time here where he was a major investor, actually the only outside investor in East by East. And he was talking to Martha and her partner about the possibility of investing more money. So there's legitimate reasons for them to meet, to discuss business, and beyond that. So I think there's a lot more to this story from a, you know, the investigation, what we're hearing civilly is way different than what we're hearing from law enforcement, which law enforcement is playing this very close to the vest.
