Starting point is 00:00:55 he'd spend the rest of his life with Alyssa Dayvault in fact Dayvault and her two kids lived with him they lived together for nearly two years and he tells us he never could have expected this. That one day changed my entire life. A life Chris Matician thought would forever involve 30-year-old Alyssa Dayvault. But December 11th, police knocked on the door. One of the detectives pulled him aside. He was just like, just you got to keep your cool, you know. I'm going to tell you some news that's going to be a little shocking. They told him his girlfriend of nearly two years threw her newborn baby in the trash container outside their home. And a year earlier, police say she threw another baby into a Cherry Grove dumpster.
Starting point is 00:01:41 It doesn't make sense, you know. I'm like, what's your evidence you know and then he told me a she confessed and then i found out that there was a baby in that garbage can right there i can't even take it in the man is looking at a garbage can and finding out his baby had been in that garbage can. Take a listen to more of what he, Chris Metician, tells Aaron Edwards. That's when they told me that they found the baby boy on our property in the garbage can. And then the hardest part is thinking about that baby girl that no one knew of. I go over to Cherry Grove Commons every day and I drop a flower right in front of the dumpster it's just so messed up it's so so messed up a Titian knew it was too late to give
Starting point is 00:02:36 a burial for the baby girl born in November 2017 and now my baby girl sitting who knows where I mean in landfill, like next to garbage and trash. It's just the worst feeling in the world. He hoped he would get to give his son a proper burial, but he says Daivolt's family members didn't include him in the memorial they already had. I wasn't invited to it, so that hurts, not being able to see my baby boy and his ashes get spread. Thank goodness. It hurts. You are hearing a heartbroken dad, Chris Matician, father of not one but two children, a boy and a girl, both dead, both thrown away like trash, thrown away in the trash. I'm Nancy Grace.

But the jury had to know the truth and could not be turned away from the evidence, as harsh as it can be sometimes. Why? Because we have to keep our eye on the prize. And that prize is justice. Justice for these two babies who suffered such a horrible death and disposal.

Ashley Wilcott, judge, trial lawyer, anchor at CourtTV at AshleyWilcott.com. Renowned New York psychologist Karen Stark. Joining us from Manhattan, she is at Karen, with a C, KarenStark.com. Starting point is 00:04:46 Joseph Scott Morgan. Levi Page, CrimeOnline.com investigative reporter. First to you, Levi Page, where is this happening? This is in North Myrtle Beach, South Carolina. And isn't it true the mom of the two children now found dead and disposed of, thrown away like trash, she's beautiful. In fact, isn't she a famous makeup artist? Yes, you're correct. And not only that, she's a mother of two children, ages six and eight years old. Two living children in addition to the other two children. Yes. children in addition to the other two children. So she's got a six-year-old little girl, an eight-year-old little girl, and they all live together with the bio dad of the dead children, Chris Matician.
Starting point is 00:05:33 And they've been living together for years. What, he didn't know she was pregnant? He did not know she was pregnant. He said that because he snored a lot, it was very loud that they slept in separate bedrooms. And she was able to conceal her pregnancy as well. Okay, just so you, Levi Page, know, I know you're not married. You don't have any children that I know of. You don't just show you're pregnant when you sleep.
Starting point is 00:06:01 Okay? As a matter of fact, listen to what the boyfriend said. When I first noticed she was gaining a little weight, it was actually, we went on a trip to Asheville, North Carolina, just to see the trees changing color and stuff like that. We went there in fall, so it was November 2017. That's when she had my baby girl, actually, that month. But at the beginning of the month, we went to, like I said, Asheville. I mean, I love Alyssa, so it was like, okay, she's going to put on a few pounds. That's whatever, no big deal.
Starting point is 00:06:35 It's not something you want to say, hey, why are you gaining weight? So I never really did. And as a matter of fact, the longtime lover, Chris Matician, isn't the only one who noticed an unusual weight gain. Listen again. Her mother actually said to her that she asked her if she was pregnant. And then Alyssa came to me and was like, I can't believe my mom just asked me if I was pregnant. And when her mom brought up that, of course, her mom's very blunt, but she brought up to Alyssa that she was gaining weight, and she straight-up asked her while we were on vacation if she was pregnant.
Starting point is 00:07:11 And then Alyssa came to me and started crying, and she was like, oh, my God, am I gaining that much weight? Since then, I never really brought up the weight factor, but I did notice it. I definitely did notice it. So that's a big no-no, karen start you never should bring up when people have gained weight or have lost a lot of weight well that's true women don't especially women get very upset even if they ask you if it looks like i'm gaining weight you don't want to say yes it looks like you're gaining weight. However, it's very hard, Nancy, for me to imagine, even if they were sleeping in separate rooms, obviously they were creating children. They were having sex. But he didn't begin to notice
Starting point is 00:07:55 that she wasn't just gaining weight, but it was in a particular place and she looked pregnant. So that's striking to me. What do you think about it? Well, on the other hand, though, Karen Stark, remember when I was pregnant with the twins, I managed to hide my pregnancy for, I guess, what was it, Karen? Because you were with me and you knew over four months. Absolutely you did, Nancy. But how about with David?
Starting point is 00:08:24 Well, I mean, he knew the whole time, so I wasn't keeping it a secret from him. On the other hand, remember, she was desperately trying to conceal the pregnancy. So who knows what she was doing to hide it. But how can you go through all that and even a doctor doesn't find out? Take a listen to Dave Mack, CrimeOnline.com. Makeup artist Alyssa Dayvault lives with her boyfriend, Chris Mateachin, and her two daughters from a previous relationship. In December, heavy vaginal bleeding not related to her menstrual cycle has the 32-year-old heading to an emergency room. Dayvault is bleeding so badly that she needs and
Starting point is 00:09:01 receives a blood transfusion. Doctors at the Grand Strand Regional Medical Center in South Carolina trying to diagnose the cause of the bleeding perform an ultrasound and make a stunning discovery. An undelivered placenta in her uterus, but no baby. Whoa! Crime Stories with Nancy Grace. Crime Stories with Nancy Grace. Guys, we're talking about a guy who learns that he has two children he never knew about, that they're dead, and that they've been thrown away like trash. But how did the mom manage to cover up the pregnancies, affect two deaths and dispose of the bodies? How does that happen? We learned she goes to the
Starting point is 00:09:54 hospital with heavy, heavy bleeding. Listen to what the doctors say. Here's Dave Mack, Crime Online. Doctors determined that Alyssa Dayvault's bleeding is a result of a tear caused by labor that has become infected. Under a doctor's care, Dayvault delivers a placenta and umbilical cord consistent with a full-term pregnancy. But there's no child. Dayvault explains it away as being from her other children that she would have known if she was pregnant. Dayvault's boyfriend and mother are asked about her pregnancy and both say they were unaware if Dayvault was pregnant. The hospital contacts police, and Dayvault is discharged from the hospital. Okay, I'm just a JD.
Starting point is 00:10:33 You're the death investigator, Joseph Scott Morgan. What is happening? I mean, how could she have this heavy, heavy bleeding? They say it was caused by a tear that developed during labor, has become infected, and they deliver a placenta and an umbilical cord. Yeah, so we know, you know, if there's infection that has set in, Nancy, we know that there's some time that has elapsed here. And, you know, just to give folks a of a brief run through that have never been present for pregnancy and a delivery, you know, listen, there's literally an incision that is made sometimes to accommodate a baby being delivered. It's called an episiotomy.
Starting point is 00:11:16 And if that's not done, then you can get this ripping effect. And not only that, you know, people think that, well, when a baby is born, the mom is told, okay, honey, push, push, push. And, well, not, you know, following the birth of a child, women also have to continue to push to get the placenta out and the rest of the umbilical cord. And if this doesn't happen, this can lead to onset of septicemia, which is a system-wide shutdown and infection. And she's walking around with this within her, Nancy, and no one is any the wiser. I would have to think if she had this bleeding, she's also going to have maybe some kind of associated fever as well. She would not have been in good shape. But how do you, as a doctor, you examine a woman there's placenta there's umbilical cord but there's no baby
Starting point is 00:12:10 i mean you kind of buried the lead there joe scott morgan where's the baby yeah yeah where where is the baby and that's the big question that the doctors need to be asking at this moment in time and literally in this woman's face at this moment in time. Because what they're looking at, where is this baby that you're not providing care for, that no one is providing care for? You're not going to tell us that this placenta and the umbilical cord is left behind from some pregnancy that occurred years and years ago, because that's what's actually being implied here. That's not going to happen. You'd have horrible necrosis, rotting. She'd be dead by now. That's the problem here, because now we've got an emergency on our hands. It's not just her bleeding. There's a baby out there somewhere. Where the hell is the baby? We've got to provide care for the baby. And why? Why is it the the boyfriend slash, you know, living boyfriend, husband, whatever he is and mama?
Starting point is 00:13:10 Why don't they know the status of this? You know, it leaves me scratching my head. Well, hold on. I think I need a shrink for that. But have you learned in your practice, Ashley Wilcott, judge, trial lawyer, court TV anchor? People see what they want to see and they don't see what they don't want to see. I mean, you know, let's just break it down to something less disturbing, something we can wrap our head around. For instance, women think the husband or vice versa is having an affair, but they don't want to know that. So they don't investigate. I don't mean hire a private eye. I mean, for Pete's sake, look at the cell phone, do something. You don't want to know. So you don't investigate. I don't mean hire private eye. I mean, for Pete's sake, look at the cell phone.
Starting point is 00:13:45 Do something. You don't want to know, so you don't look. You're blind. You've got on blinders. What about that, S.U. Wilcott? They didn't want to know that. It's like you read my mind because that's exactly what I was thinking of in all the situations where women don't want to believe their husband's cheating or vice versa. And it's denial, and they just don't want to think about it.
Starting point is 00:14:03 And so I do think there had to be some of that here now remember a couple of things number one um i'm going to assume that this woman is exceedingly convincing oh wait a minute i've got to tell you something ashley wilcott yeah you know traditionally i have the skeleton life size on top of the car on Halloween season. Yeah, I love it. So the other day, David said he was going to have wings and a salad with one of his friends he used to work with when he was a CPA. And he said it at the last minute. So I was picking up the twins late from school because he had some kind of sports event. And I thought, you know what?
Starting point is 00:14:42 David never does anything wrong, much to my chagrin. Knock on fake wood. But I was thinking, actually, you know, I would tell any other woman, you've got blinders on. Investigate. So I'm like, okay, you know what? I'm going to go investigate. Sure enough, there I am with the beat up minivan with a skeleton on top. I drive through the restaurant where he's supposed to be sitting outside having wings. And guess what?
Starting point is 00:15:11 I caught him being good again. There he was having wings with the guy he used to work with. And they see me driving by with the twins in the car with the skeleton on top with the minivan. And it was one of those parking lots you have to kind of like stop before you can yeah anyway i'm not living with blinders on but i can tell you it always doesn't turn out the way you think it will okay back to this case you know i love that david and that's why listen but the reality is you know unfortunately for this man not all all men not all people but really not all men are comfortable talking about women's reproductive systems and bleeding and all of the things that come along with it. So I think some of them exceedingly manipulative, convincing, use whatever words you want, that she was able to convince not only him, but her own mother,
Starting point is 00:16:10 her own family and doctors that she hadn't been pregnant or wasn't pregnant. There is a lot more going on here with what's wrong with her. You're absolutely right. I mean, we hear about scams every day, and we think, why didn't they figure it out? What are they, crazy, stupid? They're not. They're people just like us that can't see what's right in front of them. Take a listen to more of Chris Matician. I definitely did notice she was wearing baggier clothes. She would wear my clothes, my shirt, you know, like walking around the house,
Starting point is 00:16:44 where she would never really do that. You know, she would just wear her own stuff. But, yeah, the last—and you've got to figure, I was dating her for 24 months, and she was pregnant out of those 18 months. So it's like her a little bigger was kind of the normal, you know. And it's like, again, I didn't—I don't care. I didn't care about that, you know. I loved her. I loved the whole situation we were we were in guys we're talking about this woman being pregnant not once but twice resulting in two babies thrown away like trash which is a whole
Starting point is 00:17:16 nother can of worms in itself to figure out the disposal of these children why you would treat them like trash. There's got to be an ulterior motive to that disposal, a meaning to treating these little babies like trash. But listen to Taggart Hout at WPDE. Dayvault went to the hospital just over a week ago for bleeding. Doctors found a placenta and umbilical cord, but no baby. A police report states she denied the hospital with her baby was found dead in the hospital. The woman was hospitalized for a week over a week ago for bleeding. Doctors found a placenta and umbilical
Starting point is 00:17:50 cord. But no baby. A police report states she denied to hospital staff that she was pregnant. But later confessed to police that she's had the baby at home. It was breathing and she disposed of it. Nothing good about anything
Starting point is 00:18:04 that like that happening anywhere close to home. Eric Herron lived near Dayvault last November. Report says she did the same thing in this apartment building. I feel like it's a very family-oriented community and to hear something like that happening in my neighborhood in our neighborhood is really sad. The disposal of the babies is an emotional decision that a trial lawyer like myself, I need help figuring that out. Crime Stories with Nancy Grace. We're talking about a beautiful young woman, a fairly famous makeup artist. If you go on YouTube, you find tons of her videos where she does one beautiful job after the next trillion artist. How does someone in the prime of their life with a wonderful, loving partner, and that would have been Chris Matician, two beautiful little girls turn into a murder monster?
Starting point is 00:19:16 I don't get it. And then we learn there's a suggestion of another dead baby. Take a listen to WPDE ABC 15. A police report says they learned of the 2017 baby when they secured her medical records. They say those records show she had an ER visit in her third trimester in 2017 and that she admitted she gave birth to a live baby girl and disposed of the child. Dayvold's Facebook page shows a smiling mom with two children. Police say they're six and eight years old. We reached out to her family and her boyfriend, but have not heard back.
Starting point is 00:19:54 Her boyfriend, Chris, did post this message on his Facebook page, saying, quote, I beg for your prayers, prayers for my son and daughter, who were not given the chance to live on this planet, who were selfishly hidden from me and thrown away like trash as he is turning it over and over in his mind like a Rubik's Cube he can't figure out take a listen to what we learned Chris Matician had to say he claims he's the father of both babies and had no idea she was pregnant. Did I notice her gaining weight early 2017? Of course, yeah. I mean, but how do you bring that up to your girlfriend, you know?
Starting point is 00:20:39 And again in 2018, he noticed the same thing. She was even complaining about her back hurting and stuff. And I'd be like, well, let's go. I mean, we live right next to a park. Let's go walk the park. Let's go do something like that. You know, she would just be like, oh, you just want me to lose weight. He says he thought he knew day vault. I was ready to spend the rest of my life with her. And then it's like in one day everything is different. He hopes her other Children know he still cares. I just hope they don't think I abandoned them, you know. Trying to figure out what happened. Starting point is 00:21:18 In my mind, there's really no way she can claim insanity because she plotted to keep the pregnancies a secret by wearing the bigger clothes by basically going on the offense when it was brought up to her that she was gaining weight by saying or offered to go for a walk she goes you just want me to lose weight and turning it back on the boyfriend so he wouldn't bring it up again. And the elaborate lies that she constructed for nine months, not once, but twice, that rules out the possibility, in my mind, of any insanity. Not insane. Not at all, Nancy. I mean, you can be a psychopath, and it has nothing to do with being insane. You know the difference between right and wrong, but you don't care.
Starting point is 00:22:06 Here's the thing. When someone is a psychopath or antisocial personality, the way this woman seems to me that she is, there's really no anxiety, regret, or regard for the suffering of others. So killing a baby, it doesn't mean anything to her. It's a doll. She can do whatever she wants, but she knows she's doing it. There's no doubt about it. I got another question to Ashley Wilcott. Ashley, do you think pretty people get away with more than untraditional beauties? Yes, yes, yes, yes, yes, yes. I do too.
Starting point is 00:22:46 I see it from the bench. I do see it from the bench. Should it be that way? Absolutely not, a thousand percent. But they seem to not just be the pretty people, but they seem to have more confidence and more belief in themselves sometimes, right? But for whatever reason,
Starting point is 00:23:01 I absolutely see that those with beauty looks do get away with more. They do, even with their own family. I think it's harder for juries because they look at this person. They go, wow, they've got everything. This woman is gorgeous. She's got a great figure. She's got a beautiful family. This guy's head over heels in love with her.
Starting point is 00:23:27 He's even helping raise her two little girls. She's got these two girls to live for. It's really hard to believe that she would throw all that away. As a matter of fact, if she had not developed that infection from the tear she received during childbirth, she could be very well pregnant right now and getting rid of another baby. Yeah, she could. Out to Levi Page, CrimeOnline.com investigative reporter. What do we know about the COD cause of deaths on the babies?
Starting point is 00:23:54 And how do you think, Levi Page, she managed to pull it off? Was she working? I mean, did she go to work? I mean, how did she pull off not one but two pregnancies? So, Nancy, that's why I mentioned her boyfriend said that they slept in separate rooms because he snored. He didn't even know that she gave birth. He said because they slept in separate rooms and police obtained medical records when she went to the doctor in 2018 and delivered an umbilical cord. They found an umbilical cord and she refused to say she was
Starting point is 00:24:27 pregnant. They tested her urine. It had traces of marijuana, THC in it. And in addition to that, they called the police and the police started investigating and looked at her medical files. And they discovered that in 2017 2017 she had actually gone to the doctor and for being pregnant she knew she was pregnant in 2017 so they questioned her and presented her with all the evidence that she finally broke down and admitted yes I was pregnant in 2017 gave birth to a little girl disposed of the body in the public trash area that apartment complexes have. And that body has never to this day been recovered.
Starting point is 00:25:11 So the dad has no idea, no idea what has happened to the baby girl. Right now, all we know about is the baby boy who was thrown away in a garbage can and the boyfriend the bio dad has to look at that garbage can goes that that's where they found my baby Crime Stories with Nancy Grace. We are talking about a beautiful young 30-year-old young woman, a makeup star on YouTube. Her name, Alyssa. Take a listen to our friends at WMBF. When police interviewed Dayvold, they say she confessed to delivering a male child here at her home on South Oak Drive on December 2nd. She told police the child was alive and took multiple gasping breaths, but she failed to seek medical
Starting point is 00:26:17 treatment and didn't try to save the child's life. The warrant says Dayvold then put the child's body in the trash at her home without notifying police. Knowing you carried it for nine months and to dispose them in the trash and live day by day, there's no way I can do it. Warrants also say a similar incident happened November 2017, where Dayvault disposed of a baby girl in the dumpster at her apartment complex. I just pray for her family and definitely her children to grow up possibly without a mother because of the mistakes that she did. Those who knew Dayvolt say they had no idea she was pregnant, but they did notice she was wearing sweatshirts and baggy clothes on hot days in the summer this past few months. She says, and this is the critical part of what Dayvolt says, that she gave birth to a little boy December 2.
Starting point is 00:27:05 He was born alive and took multiple gasping breaths. She says she failed to seek medical help and did not try to save the child's life, then put the child in the trash at her home. How can we tell, Joe Scott Morgan, did the baby die on its own or did she suffocate the baby? Well, one of the things that you're going to look for, obviously, Nancy, are going to be, you know, things that we've talked about in the past, like external trauma to the face. These babies are very, very fragile. It wouldn't really take a lot, but certainly petechial hemorrhages to see if there's any kind of burst blood vessels that would give us an indication of asphyxiation. But here's, you know, I just want to take you
Starting point is 00:27:51 back very quickly. This is the key. She says that this child just kind of dwindled, just kind of, you know, diminished and died. That's one of the things I want to know about. First off, you have to prove that the child was alive. And one of the things that we've done in the past, and you and I have talked about it, is this float test, where you see if the lungs had actually been extended to the point where they breathed air, to see if the lungs float in a bucket of water.
Starting point is 00:28:21 And that's one of the tests that we do. And once you establish that, then you can move forward with this idea the child was not stillborn. The child was alive and that she neglected this child to the point of death or did she actually suffocate the child? To Levi Page, CrimeOnline.com investigative reporter, did she stick with that story or did she change her story about what happened when she gave birth? When they discovered that she had been pregnant in 2017, she initially told police that she gave that child up for adoption. And then she later admitted, yes,
Starting point is 00:28:57 I disposed of the body in the trash can. And she did change her stories in 2018, too, after giving birth to a baby boy. She at first denied that she was pregnant. And then given evidence that she was, she couldn't refute it. She finally admitted that she disposed of them in the trash can of their home. And the pathologist could not determine exactly how the baby boy died. So we're kind of stuck with her story. Take a listen to Josh Holford. We don't have enough evidence to prove that the defendant intentionally killed her babies. We're not saying that she intentionally suffocated the babies or murdered them.
Starting point is 00:29:43 This case is about the left. It's about extreme indifference to human love. It's a small miracle that the trash didn't get wheeled out to the street in that time, because investigators find that baby diseased in a trash bag, in the trash can beside her house. That's how we know. That's how we found out what she did.
Starting point is 00:30:10 During the course of this interview, she breaks down. Yes, the baby gas in 2018, gas program. The foreign law had placed it in a trash bag in trash bag. That's neglect. That is extreme indifference for human life. And that is a theory of murder. It's called an abandoned and malignant heart, extreme indifference to human life. For instance, as I like to explain to juries, when you drive your SUV at 90 mph through a street fair and you end up mowing down three or four people dead. You didn't even know those people. You didn't intend to kill that person.
Starting point is 00:30:56 But your extreme indifference to human life, your malignant abandonment, uh, to all things reasonably cautious equals murder. It's called an abandoned and malignant heart. She says the baby was born alive and then she put it in the trash. And you know, what a stroke of, uh, really luck and good copying because the cops race over. The baby is still in the trash. Do I have that right, Levi, because the trash just so happened did not get wheeled out to the street? You are absolutely correct, and that is horrifying. I mean, how could she continue on knowing the baby's in the trash can? I don't get how you can even do that.
Starting point is 00:31:51 But in response to what we're learning in court, take a listen to what doctors say. Here's WPDE ABC 15. Two doctors also testified. Both said all of the clues indicated she had been pregnant. But the defense focused on the fact that none of those doctors or law enforcement officials were there when the Children were born or could say if they've been born alive. They charge my client with two counts of homicide by child based on their theory of what occurred. But it's just that it's a theory. Dayvault told police she'd passed out after giving birth in 2018,
Starting point is 00:32:26 and when she woke up, the baby was unresponsive. However, she'd also told them the babies were gasping for air after delivery. Okay, now wait a minute. Right there, that's an inconsistent statement. To ask you, Wilcott, trial lawyer, judge, anchor, court TV, and while you can't bring hearsay into court unless it falls into one of the many hearsay exceptions, when a defendant says something that can be brought into court, especially when it's an inconsistent statement. So she tells cops that babies were gasping for air after delivery, and she simply did not take them to the hospital that she that's that's obviously what happened then she
Starting point is 00:33:06 changes her story to she passes out and doesn't know what happened to the babies they just both of them end up dead another story she gave was that she gave the baby girl up for adoption so she's told so many stories these inconsistent statements are coming into evidence, Ashley. Yeah, they're definitely coming into evidence. And here's the advantage to the prosecution that they're coming into evidence. She did something to these children. She can't keep her story straight. She can't tell you exactly what she did. But there's no doubt when somebody tells this many different versions of a story, all of which, by the way, results in the death, all of which results in the death, then clearly it's easier, in my opinion, to convince the jury that she did it
Starting point is 00:33:49 because she can't even keep her story straight. Take a listen to Nia Watson, WMBF. Among today's witnesses were doctors who examined Alyssa Dayvault during and after her pregnancies, as well as detectives who investigated the case. The first day of trial finished with testimony from the doctor who discovered Dayvault was pregnant in November of 2017. Another doctor who treated Dayvault after she gave birth in 2018 also took the stand. The doctor says she was shocked when she pulled out a full-term placenta, but there was no baby. The jury also heard from two detectives who interviewed Dayvault in 2018
Starting point is 00:34:25 and watched part of their interviews with her. Now in the initial interview captured on a body camera, you can hear Dayvault at first deny having a baby. After further questioning, Dayvault admits to giving birth twice and dumping both babies in the trash, one in a trash can beside her house. In the interviews, Davault also says the father of the babies did not know about them or that she threw them in the trash. During cross-examination, the defense pointed out at one point, Davault said she passed out after giving birth and claimed the baby was blue, limp, and unresponsive. You know, I've noticed over the course of years working in courts that so often when the victim is an infant or a child, the perp, the killer, gets a lighter sentence. They get voluntary manslaughter or even involuntary manslaughter.
Starting point is 00:35:15 I don't know why. In this case, Levi Page, what happened? So, Nancy, the trial started and she did not show up for the trial. So a bench warrant was issued for arrest, but they continued on with the trial. She was found guilty and ultimately caught, brought to court, and she was sentenced to 40 years in prison.
