Voters reelected to Republican congressmen in the midterms, Chris Collins of New York and Duncan Hunter of California, who were facing federal indictments, who are facing federal indictments for alleged, alleged insider trading and campaign corruption,
Starting point is 00:14:50 respectively. Quick study. Yeah. Texans re-elected Attorney General Ken Paxton as their top cop, even though he's facing criminal charges for securities fraud. And in Montana, voters re-elected rep Greg Gianforte, despite his conviction of misdemeanor assault

This week in NBC reported that the FBI intends to brief the gang of eight on Mueller's counterintelligence investigation, which makes it sound like it's separate from the regular Mueller investigation. We still don't know.
Starting point is 00:22:44 If you're a book club member, you'll know that McCabe referred the counterintelligence investigation into Trump over to Mueller along with the larger Trump-Russia probe, but we don't know if those things are going to be reported separately, or if it's included in the Mueller report. No briefing has been scheduled, but one of the officials has said they expected briefing to occur behind closed doors in the next 30 to 60 days. Okay. So anyway, that's gang of eight FBI, Karen, intelligence.
Starting point is 00:23:15 All right, let's go to the next question. Jordan, I'm scared. This is a fun segment until you realize we don't know what we're talking about. Fake it to you. All right, Jordan, the Supreme Court of the United States refused to hear an appeal from the mystery company from country A about a Mueller subpoena. As we know, Mueller has completed his investigation. Which US Attorney's Office did he hand this case off to? DC.
Starting point is 00:24:02 Correct. Yay. Yes, according to Politico this week, DC. Correct! Yes! Yes, according to Politico this week, the Supersecret Subpoena Battle involving the secret company from country A has been handed off to the US Attorney in DC. Other cases, Mueller has handed off to the DC-US Attorney, including Rick Gates, which Mueller recently asked to extend for the fifth time his sentencing by 60 days because of his role in several open and ongoing investigations. And the Concord Management case. That's one where the Russians hired American lawyers, Jordan,
Starting point is 00:24:30 you've been reporting on this to try to get all of Mueller's findings through discovery. They even got a hold of some innocuous documents during this discovery process and set up a fake anonymous Twitter account and bragged they hacked Mueller by posting forged and falsified documents and Bragg, they hacked Mueller by posting forged and falsified documents saying they were associated with Mueller's findings. Sounds like InfraWorn. Yeah, yeah. There was a gay frog in... Yeah, find the gay frog.

Starting point is 00:25:48 Back in January, a federal judge extended what by six months? The grand jury, well, we think it's six months. The grand jury for Mueller. Yes, correct. Correct. And we were all sort of wondering what would happen with the grand jury after this weekend when Mueller seemingly prematurely ended his investigation. We put beans on the grand jury continuing its work with the prosecutors Mueller has handed
Starting point is 00:26:14 his investigations off to, and as it turns out, those beans came true. We learned this week that the Mueller grand jury is still in paneled, working full steam ahead, robustly. Revustly. This grand jury expires in June if we're correct about it being extended for six months But this is a great opportunity to get to know the community. It's Ken Starr's report was 445 pages, but that report was conclusive. He drew a lot of conclusions in that report, and I have a feeling Mueller doesn't.
Starting point is 00:34:50 He doesn't strike me as a conclusive fella. And check this out, the Watergate Road Map, the one we've been calling a Jaworsky report, sent to Congress by the Grand Jury. That one, that's the one that made Nixon resign, was 62 pages. Bar says he will release a version of the report to Congress within the coming weeks,
Starting point is 00:35:12 but he will not make the April 2 deadline that was demanded by six Democratic leaders of committees. Now they're saying it might not go to the White House for executive. But Bar said that he said that Trump told him that Trump would defer to him, no big shocker there, and that it would not be going to the White House. Although legally speaking, they could still come back around and say that they want a assert executive privilege, but right now it's going to be redacted and allegedly, I love

Right. Pending Mueller's report, it's gonna be a strategic shift, I imagine, and how they were gonna proceed down that list. Well, they were very careful in terms of not wanting to overlap too much or impede upon what Mueller was doing, and so that's the reason why they were being mindful of it. But now it's a free throw. She's a staff writer for the Atlantic. She's an MSNBC contributor. Her expertise in the Trump-Russia probe is unsurpassed. She's absolutely incredible. Ladies and gentlemen, please welcome Natasha Bertrand. We got you a comfy chair. That was pussy riot, by the way, guys.
Starting point is 00:59:12 Yes, we brought you up to pussy riot. So you know, all right, let's see. I wanted to ask you about, first of all, I wanted to ask you about the Bhutna Bhutna questioning that happened back in January, and how it wasn't about NRA money laundering. How is that? So, I have to be very careful about how I discussed this because it was a weird kind of background off record conversation.
Starting point is 00:59:39 But my understanding is that the NRA money laundering angle that was being investigated by Mueller reportedly at one point was not part of Bhutina's case. And I believe that's the conclusion that they came to because Mueller's team didn't ask her about that in their interview. And yeah, so it is a bit weird, but I think that the one thing that they were really trying to talk to her about was like JD Gordon, and like all of these Trump associates that she was kind of closing up to during the election.
Starting point is 01:00:15 But the NRA thing didn't come up, apparently. And that's weird, right? Because Erickson wasn't, I think, I remember for a long time ago, he was in touch with Dearborn, sent an email with a subject line, Kremlin Connection. Yeah. Don't open this.
Starting point is 01:00:32 Don't open this. Right? So I mean, if you're gonna interview the beauty, you might ask her about the beast. Yeah, that's actually, yeah, Erick the Ericsson sent Rick Dearborn an email. I think it was like May 2016 saying that Putin really wants to have this good relationship with Donald Trump. He's very serious about it.
Starting point is 01:00:56 And Dearborn, I think forwarded that to someone else in the campaign, not really sure what came of it, but of course, Alexander Torshin, who is the Russian bankers, close to Putin, he did end up chatting with junior at the NRA event that summer. So there is a connection there. I guess I just can't figure out why I asked about JD Gordon. I mean, they went to sticks together. Remember that? We played Domoari, goto, Mr. Roboto when that happened, but I mean what are some of the other maybe things that she might know about JD Gordon?
Starting point is 01:01:31 You know, I don't know. I think they like Went on a date, but she denied that it was ever anything romantic. I would too And JD was like an ex-military guy, so he would see him. I mean, even Brutina's lawyer admitted that he would seem like a really good target for a Russian spy, because he's kind of susceptible to flattery by younger women. He's kind of like lost in the sea there. So the idea was that she was targeting him because he was a member
Starting point is 01:02:05 of the campaign and because maybe he knew some secrets, but then her lawyer was like, but nope, that's not what she was doing. So guess we don't have any other explanation for that. But I think it seems pretty clear that she was at least trying to kind of infiltrate the campaign and put in like, it was a pity date. Oh, yeah, I mean, they, I think they went out a few times and she wrote him emails and was like, oh, you look really good on TV today.
Starting point is 01:02:35 You know, your points were great and he would like write to her in Russian. And yeah, it was, so good. The language of Russian. The language of Russian. He is susceptible, isn't he? I don't lie, in cell.
Starting point is 01:02:49 I don't know how he found time out of his busy schedule of feeding his pet tarantula and blocking his fedora to go to sticks with food now. Finally, I wanted to talk about a piece you put out today. Incredible piece you guys, in the Atlantic about whether Congress is going to get the full Mueller report and the full Monty. So maybe you could tell us, first of all, what we know so far about the Bar MMO. Well, now they're, well, the Bar MMO from Sunday or the Bar MMO, the Bar Letter from today. they're a letter, yeah, both because I don't think we talked about the today letter, which is amazing. Yeah, today's letter was like a complete walk back.
Starting point is 01:03:32 But so the memo, obviously from Sunday, was just saying that Mueller had concluded that there was no conspiracy between the campaign in Russia and that their Mueller had kind of not been able to decide whether there was obstruction that was committed. And the Democrats, the House Democrats, were really unhappy with that because they felt like it kind of gave Trump the head start before we even saw the full Mueller report. And as we've seen, he's taken full advantage of that kind of going on this victory tour, which is a bit premature because the report is 400 pages long, and it probably outlines a lot of bad conduct by the Trump and the campaign. But so the Democrats, kind of the senior Democrats in the House held a briefing for reporters yesterday.
Starting point is 01:04:22 And they said, you know, we're going to subpoena for this thing. If we don't get it by April 2nd, they said we want all the grand jury material and they're really pissed off at bar because they don't think bar should be redacting it outright. They think he should go to court with them and get a court order to release it to them.
Starting point is 01:04:38 But the Democrats are really, you know, they're digging in on this. They want to see the classified information as well, which maybe would only go to the gang of eight, but all members of House Intel really want to see it as well, and think they're titled to it, just because of the precedent that was set by House Republicans, right? In the last Congress, when they asked for and they received all of these classified documents on Hillary Clinton, they received all of these classified documents on the Russian investigation. So they're like, okay, well, D.O.J. could handle over that stuff and surely we can get things that are in our oversight capacity in this
Starting point is 01:05:10 probe. So that's kind of the strategy they're using. They're also using the strategy of the Watergate roadmap, which the grand jury material was handed over to Congress and that eventually led to Nixon's impeachment, because it's really important, right? I mean, you're seeing all of the evidence, the witness testimony, and I mean, this is key to understanding the findings. So today, Barr puts out this other letter to Congress, and he says, look, you're gonna get this by, you know, sometime in the next few weeks, mid-Abrall.
Starting point is 01:05:39 It's gonna be seen by the public too, but oh, we're also redacting these four pockets of information, which is a grand jury material, classified information sources and methods. Any material that may be damaging for someone's reputation, that might be a third party, which is a really interesting bucket that I imagine is going to spark a lot of controversy. And the last one is the last one is ongoing investigations. But yeah, but that but that one that he mentioned about you know some some information possibly being derogatory about people who weren't charged is something the Democrats already kind of foaming at the mouth over because they're like well like who do you consider a peripheral figure like you know I don't consider Trump Jr. a Jared Kushner to be peripheral figures in this.
Starting point is 01:06:25 If you met with Russia and you're probably not a peripheral figure. So, so they're a little bit cautious on that. But overall, Bar said also that he, this was not, the memo he put out on Sunday was not a summary of Mueller's findings. It was just the top line conclusions and that he doesn't want anyone to think that it was comprehensive.
Starting point is 01:06:44 Don't worry, bro, we don't. And then I believe he went on to blame the media for mischaracterizing what he put out as a summary. Why do you think he amended that? Do you think it was his own conscience? Or... My understanding is that he was not anticipating the blowback. That's my understanding of it.
Starting point is 01:07:16 And, you know, a f**k you motherfucker. And this is something that actually, you know, experts who've studied this thing for this special council and independent councils for years have said like, look, public pressure is really what's going to make, it's really going to make the difference here. Because ultimately, the special council has different obligations, the special council reports to the AG, independent council like Ken Star report its Congress. So yeah, it really is going to be and I think the blowback that he faced really did, it made the difference here. Yeah. Yes. That's you guys. That's you guys. That's you guys. Good job blowing back.
Starting point is 01:08:02 James Faire, do you um, are you with me? I think it feels like for the destruction piece. Um, do you think Mueller not drawing a conclusion on obstruction was more procedural? Not just that he didn't, he couldn't figure it out on his own? That was my initial instinct. I was like, OK, maybe he figured he can indict a sitting president anyway, that it's against COJ policy.
Starting point is 01:08:24 And so he was kind of like, well, I guess this is an unanswered question. We're not even going to try because he didn't even really try to subpoena the president for an interview. So if he was cautious in that respect, then why would he kind of try to go down the road of upending DOJ policy, which is not binding, but upending it just for the purposes of this? I mean, I imagine he'll lay out the evidence in the report, which again, is nearly four on her pages long. I mean, what is he feeling that space with? If not, like, evidence of this stuff. But yeah, I mean, Bar's decision to kind
Starting point is 01:08:56 of co-opt that while not necessarily wrong, because again, Mueller reports directly to the AG and the AG as the final say on this stuff because it's the regs And it was an over correction from the star era It's still seen as inappropriate because bar could have taken that and given it to the house So so yeah, I think I think most people I'd speak to think it was a procedural thing Yeah, I'm speaking to the regs you you quote Neil cuttell in your piece He helped draft the special counsel regs in 1999. He said, the regulations set a floor, not a ceiling on the amount of transparency.
Starting point is 01:09:30 And I thought that that was just a really, really good point to make. Yeah, again, a Neil wrote them. And like he, it's really all at the bar. And, you know, Congress can issue a subpoena, but like, you know, the Marshalls are gonna go and like, you know, enforce the subpoena, the DOJ. It's not going to happen, so it's going to go to the courts.
Starting point is 01:09:50 And it's going to be this whole long-protected battle when Barr ultimately has the final authority of discretion to give to Congress what it wants. And the grand jury material by law, he has to redact. But again, there's a process he can go through with Congress to get that to lawmakers so yeah I mean I think it's just interesting how history plays out like this was an over correction again from the staria and now we're kind of facing the consequences of having a political pointe determined what the public is going to see from the findings of someone who's supposed to be completely independent of politics.
Starting point is 01:10:27 So it's just it's an irony. So but the dumbest field there's really nothing stopping bar from giving them the grand jury material. I mean, we've got the precedent, right, and we've seen it. And so and we've known for a while now that the White House hired like 17 lawyers and they were all just going to do executive privilege. Like that was their whole that was was gonna be their whole game plan. And, and so it just seems like that's really the only obstacle to releasing the full report is what Barr and the president decide to take out of it. Right. And actually something else that was really interesting about Barr's
Starting point is 01:10:55 letter today is that he, he's not going to actually give the report to the White House. Well, he said he has no plans to give the report to the White House. But I'll do it spontaneously. Exactly to privilege, right. But, you know, the president, and he said, like, I'm relying on public statements from the president where he said that he, I have, you know, he has full confidence in me, basically, to do what I think is right. And bars like, okay, well, that being said, I guess I'll just go ahead and give this to Congress and the public without taking it to the White House first for executive privilege review.
Starting point is 01:11:26 Whether or not that actually happens, I think people should be aware of that, but because he did say he has no plans to do it, but it's interesting that the White House isn't aggressively coming in and asserting those privileges. That, because that was something that Democrats were really afraid of, that the White House was pretty much
Starting point is 01:11:43 gonna scrub it before it went to the public. And he seems to be alleviating those fears of pitnails. Let's say he does. Let's say at some point Trump does assert his executive privilege. How, if we think that it's inappropriate, like if he redacts a bunch of stuff and we that it's inappropriate, like if he redacts a bunch of stuff and we think it's inappropriate, is there a way, is there any recourse for that?
Starting point is 01:12:10 Is there any way to litigate it? Would the Congress know that what he's taken out is not executive privilege? Like how do you even challenge that with bar as the HadoDOJ? I don't, that might be a question for Katie. I don't know. How that would be litigated. So I thought it would be litigated.
Starting point is 01:12:25 So the privilege issue can be litigated. It's just, it's problematic because there is a lot of discretion given in that privilege. I mean, there's a, it's a very broadly applied privilege. And so it's a little bit problematic. But executive privilege has been tested in courts previously with Clinton, with Nixon, with other people. And so it can go little bit problematic, but executive privilege has been tested in courts previously with Clinton, with Nixon, with other people. And so it can go and be litigated.
Starting point is 01:12:49 I think the fact that you're not going to see the assertion of executive privilege right now is, as you said, very telling. But it doesn't prevent him from doing it. But I think ultimately it'll end up having to be litigated if that's what they end up doing. Is it subject to the crime fraud protection? All privileges are subject to crime fraud exceptions. Yes. All right, so if somebody knows what he redacts is crimes, crime-ing.
Starting point is 01:13:17 Cri-me-a-river. Then, fraud-ing, fraud-ing, and crime-ing, and fraud-ing. Cri-me-ing and fraud-ing and frothing. Criming and frothing. Criming and frothing. I I suppose that that could be litigated then. Okay. All right. So there seems to be some sort of protection against that.

I think I just wanted to say really quick that I think that we found out today 75% now it was 56% said that they didn't think that the bar thing meant that there was no collusion. Now it's 75% want to see the Mueller report. They aren't happy with Barr's memo. That number is just going to keep going up as they realize they've been fleeced, I think. But another 86% said that the outcome of this bar memo is not going to affect the way that they vote.
Starting point is 01:17:42 And that's outstanding because we don't want it to, because from here on out, it can only get worse for the president. It can't get better for him. So I'm really happy about this. So what we need to do is we need to focus on 2020, focus on the issues, find a candidate, back on with everything you got, and we'll do it out.

Starting point is 01:18:58 From a legal perspective, the reason why it's so important to vote, Donald Trump is stacking the federal courts right now. And he's doing it in a pretty stealth mode. And ultimately the decisions that are made as high as scotus are made as a result of who's in office. And so that's the reason why the vote is so important. It transcends just what happens down the street. It's ultimately, he ends up being the judge because as we know, if the subpoena had been served to pull Trump in to testify, it would have gone to the Supreme Court the subpoena have been served to pull Trump in to testify it would have gone to the Supreme Court and it would have been decided by those justices to
Starting point is 01:19:30 of whom have been appointed by Donald Trump. And so it's really important to go out and vote so that you can actually get the kind of person that looks like you and I on the bench. And even on that Mitch McConnell today tried to do a nuclear option about trying to put the, sorry, tried to like, fast track, even faster the judges I heard today that he wanted to get rid of the rules. So there is no blue slip anymore, so it used to be that you had to have the top senators from each state agree into what was happening in terms of the appointments and it's not happening anymore that way because of the nuclear option that was invoked. And so that ends up just being a straight majority vote now in terms of who ends up getting
Starting point is 01:20:12 appointments. Scary. Hi. Hi. Is that Melissa? Natasha, like I'm a big fan of like an Andreate Lupa and I'm sorry, yeah, and gas, that nation and they said that you've been targeted in their last podcast that that you feel targeted as someone that's continuously reporting on what's going on. I don't know who's looking into it right now. And I think the problem is, to your point, the plethora of bullshit. There's so much to investigate Important one. Yes, it's a big one, but it's like where do you prioritize it on the list of Russia stole democracy and
Starting point is 01:35:14 You know, it's it's a hard call to make, but it has to be made prioritizing resources I think we talk about that and or what McCabe does in his book that he wrote I'm all we talk about that in, or what McCabe does in his book that he wrote.
