Starting point is 00:00:00 Hello there, everyone. Judge Andrew Napolitano here for Judging Freedom. Today is Friday, April 8, 2022. It's about 2.15 in the afternoon. Two stories involving surgeries to change people's gender and identities. The state of Alabama has prohibited these surgeries and characterized them as a penalty punishable by imprisonment of up to 10 years. It has also prohibited doctors from prescribing any medication in preparation for the surgeries. As you may know, when these surgeries occur, there are weeks and months and even years of preparatory time, not just psychological, but biological, medical efforts to block the puberty development, the natural development of the child or of the young person who's about to become an opposite gender. At the same time, the state of New Jersey, this is a mandate by the governor, who's a bit of a tyrant. I live in New Jersey.
Starting point is 00:01:13 This is the same governor that sent the state police to shut down Roman Catholic churches during the beginning of the pandemic about two years ago, Phil Murphy, this is the same governor who told my then Fox colleague, Tucker Carlson, when Carlson asked him about the Bill of Rights, because he was prohibiting worship. Governor Murphy said, the Bill of Rights, that's above my pay grade. I guess he forgot that he took an oath to uphold the Bill of Rights anyway. New Jersey is mandating that in the second grade, so you're talking about children age six and seven, they be informed about gender choices. This is bad. Both of these are extreme. In the Alabama case, the Supreme Court has ruled that you own your own body. If you're a child, your parents own that body. It is not the state's business what you do to
Starting point is 00:02:13 your body, what you put in your body, what you cover your body. I've made this argument many times. Against the mask mandates, you own your own face. The government can no more make you wear a mask than it can make you shave or wear makeup. In terms of vaccines, you own your body and the government cannot compel you to take a vaccine, particularly an experimental one like all these COVID-19 vaccines are. In fact, they're not even vaccines. A vaccine is a small dosage of the disease that builds up antibodies within you so that it will fight off the disease if you come in contact with it. These don't do that. These lessen the effect of the disease if you get it. You can still get it. You can transmit it. You can transmit it without even having it. So these are not traditional vaccines.
Starting point is 00:03:03 They're unproven experiments. Yes, they pass certain tests, but they haven't passed the test of time. Anyway, I have used this argument that the Supreme Court has ruled, and of all places, Roe versus Wade. The part of Roe versus Wade that allows abortion, I condemn. The part of Roe versus Wade that says you own your own body and you and your physician make decisions about your body, not the body of the baby within my view, as are these gender-changing surgeries. You can do what you want to your own body. To deny you the medical help you need to do that is the government interfering with your personal rights. We switch to New Jersey now, which is the other extreme. Why in the name of God the Father would the state compel second grade students to tell boys they don't need a penis or girls they don't need a vagina?
Starting point is 00:04:16 This is just outrageous. This is an interference in parental rights. Supreme Court has also ruled in a famous Wisconsin case, Wisconsin against Yoder. The parents have an absolute right to raise their child. The only time the state comes in is when the parents are doing something to harm the child. Not telling the child about his or her opportunity to change his or her gender is hardly harm. The parents can decide when, how, and under what circumstances children can learn about these barbaric procedures, which they have the right to employ with their parents' permission. It is not the business of the government to be discussing this any more than it's the business of the government to be telling a Jew that the Jew could become Catholic or a Catholic that the Catholic could become Protestant. There are certain areas of development
Starting point is 00:05:16 for children that are none of the government's business and that are insulated from government involvement because they belong to the parents. My friends, we're in such a divisive age. Alabama, one extreme, New Jersey, the other extreme. I happen to live in New Jersey. Believe it or not, I spend a lot of time in Alabama. I'm on the board of the Mises Institute, the foremost libertarian, free market, anti-war, natural rights think tank in the United States of America today. I love both states. I condemn what each has done for the reasons I have articulated. I was giving a talk on an appellate court allowing the president to compel all 2 million federal civilian employees to be vaccinated.
Starting point is 00:06:17 And a regular viewer, who's also a regular emailer, said, what about my body, my choice? I guess that's gone. Unfortunately, what he's saying in some respects is true. This Sixth Circuit Court of Appeals opinion, which reinstated President Biden's executive order, which compelled all federal civilian employees to receive these experimental so-called vaccines violate the principle of my body, my choice, just like Alabama is doing, just like New Jersey is trying to remind babies that their body is their choice.
