Starting point is 00:00:00 Hi, everyone. Judge Andrew Napolitano here for Judging Freedom. Today is Friday, April 14, 2023. It's about 3.15 or so in the afternoon on the east coast of the United States, you know how I like to end these segments with more as we get it. Well, we keep getting more. And so that's why at this hour on Friday in the northeast, it's 86 degrees. It might as well be a Friday in late July. There is more that I want to discuss with you when we start out with a soon-to-be-famous criminal case called the United States of America versus Jack Douglas Teixeira. Teixeira is the enlisted Air Force National Guardsman from Massachusetts. There he is. It looks like he's taking a selfie of himself, although somebody else obviously took that picture. There he is in his full dress Air Force uniform about a year ago.
Starting point is 00:01:11 I don't know where the picture was taken, but that's the one his parents gave to the press and we're all using it. That's Teixeira, who yesterday was arrested. You'll see him looking quite differently in a moment by FBI agents dressed in military garb. Look at them. Look at the way they're dressed going after this 21-year-old kid who's half naked. They politely and without violence removed him from his home. I don't know why they sat him down in that armored personnel carrier, and then they moved him to another vehicle, which took him to the federal courthouse in Boston. Look in the upper left-hand corner, WCVB. It's a CBS television station in Boston.
Starting point is 00:01:56 CBS? Yes, CBS. This is taken from a media helicopter. So why does the FBI notify the media before they make arrests? Hi, ask Roger Stone why CNN was in front of his house at 5.30 in the morning. Two helicopters, 25 armed people, armed to the nines like they were in the military, and a gunboat in a canal behind Stone's house, almost the same here. There were two helicopters above to share his parents' home, military and media. There were 25 or 30 FBI agents, all of whom were dressed in that kind of garb. Okay, the guy had guns. The guy knew how to use
Starting point is 00:02:43 guns. He's in the military. It's almost conceivable that this is going to be violent, but the American government likes to put on a show of force at the time of arrest, even if they're arresting someone who looks like butter wouldn't melt in his mouth. All right, now what's the case against him? The case against him is espionage. Believe it or not, these are the same charges against him that the federal government wants to bring against former President Trump, and that is the failure to safeguard national by bringing them to a non-secure federal facility, his home in Florida, and having people without security clearances move them around and hide them from the federal government. Jack Teixeira is accused of posting them on a small Internet chat room with a bunch of his young buddies, teenage young men and men in their early 20s whom he didn't even know personally, whom he apparently
Starting point is 00:03:55 wanted to impress with these national security secrets. This raises a lot of questions. How does a 21-year-old get this security clearance? This is top secret SCI no foreign. Top secret is the highest level in the federal government. There's confidential secret and top secret. Top secret is defined as if the information is revealed, it will cause grave harm to the national security. Okay, it was revealed. Did it cause grave harm? That remains to be seen. SCI means segregated compartmentalized information, meaning it can only be viewed in a federal skiff, in a federal facility where the internet doesn't work, where you can't bring a mobile phone, you can't even bring a writing instrument with you. You're patted down. Even if you're a U.S. senator, when you go in this skiff, you're patted down when you leave.
Starting point is 00:04:50 You can only read this stuff. You can only remove it from your memory, not from any physical or digital copy. No foreign means no foreign person may be given this under any circumstances. Joe Biden couldn't give it to his new buddy, the president of Ireland, if he wanted to. No foreign, no foreign person. So this is the highest category of national defense information that we have. Unfortunately, unfortunately,
Starting point is 00:05:20 Trump had some of this stuff as well. And it said on a top secret SCI no form. Another issue for another time. I know some of you think I don't like him. I do like him. He's been my friend for 37 years. But when I address the law, I wear my judicial hat, not my I am a friend of Donald Trump hat. Back to Jack Teixeira. How could he have gotten this?
Starting point is 00:05:43 How could a 20-year-old have this level of security clearance? What's wrong with the Defense Department that he could have gotten his hands on this? Depending upon when you're watching this, if you've seen Tony Schaefer, who had this very level of security, top secret, no foreign SCI, it took him years to get this. The background investigation is so intense. When I became a judge in the state of New Jersey and when I was nominated for the federal bench by Ronald Reagan, the scrutiny took months of every document that I had written, every bank account that I had at the time and that I could find that I formerly had, they walked up and down the streets of where I lived and where I worked with photos of me and asked people about me. This type of scrutiny is very, very intense. I don't know how Jack Teixeira at age 21 could have gotten it. Moreover, these documents were revealed in January. It's now the middle of April. In January. Why is it the DOD didn't know that its so-called secret documents were out there
Starting point is 00:06:52 for four months? Moreover, the DOD learned about this in late March before the Secretary of Defense testified before the Senate Armed Services Committee that he expected Ukraine to do well this spring and well next winter, even though the documents paint a very bleak picture of the Ukrainian armed forces vis-a-vis the Russian armed forces. They paint an unmistakable picture that in the opinion of the American government, Ukraine is in very bad shape militarily. And by early May, excuse me, late May, a month and a half from now, almost to the day, Ukraine's air defenses will be so degraded they'll be down to zero. So I don't know what's going to become of Tasharov, the punishment for this. I mean, he didn't sell them like the Rosenbergs. I don't even know if he posted them in a public place or if one of these 18-year-olds who was in his gamer
Starting point is 00:07:50 group posted them. That, of course, will affect the exact charges against him, and that will affect the penalty as well. He may not very well have been the human being that put these on open sources. He may have kept them within his group. It's still a crime, but it's not as severe a crime. It doesn't call for as severe a penalty as if he had posted it directly on the Internet itself. So there are missing pieces here. How did he get it? Is there a gap between the preparer of these documents and him?
Starting point is 00:08:22 Were others involved? Who prepared the documents? It appears that they were prepared for the Joint Chiefs of Staff, the highest military command in the United States government. And it appears that they were approved by the staff of the Joint Chiefs of Staff, the best military minds, almost all graduates of the military academies that the United States government has working in the Pentagon. Secure, secret, brilliant, gifted, loyal, patriotic, working for the bosses. And a 21-year-old got his hands on it. Well, eventually this will come out. I'm disturbed
Starting point is 00:08:59 by a number of things. Not that Jack got these. I have said before, before I knew who he was, I'll say it right here and now, he's an American hero. He is an American hero for telling the American public that the government has been lying to it and people are dying as a result of a lying and American dollars are being wasted as a result of a lying. The same day that this came out, Cy Hirsch, he of My Lai Massacre, Watergate, Nord Stream Pipeline Destruction fame, he's the person who revealed all three of those things, revealed that the Ukrainian military and political senior leadership has skimmed over 400 million. You heard
Starting point is 00:09:47 me right, 400 million American dollars. President Zelensky knows about it because he's the scammer in chief. The head of the CIA knows about it because he flew to Kiev to say, what the hell's going on here? President Zelensky fired 10 of the 35 generals whose names are on the list. He obviously didn't resign himself. He's still there and still able to scam. What happened to that 400 million? Gone. Shouldn't the American public know about this?
Starting point is 00:10:15 Of course we should. Why are we aiding a military cause that our own government believes is doomed to failure? Why are American officials lying to the United States Congress, to the media, and to the American public? Jack Douglas Teixeira, not the 400 million, but everything else, exposed all of this. Here's somebody who agrees with me. I don't agree with Congressman Marjorie Taylor Greene on a lot of things. I would not have voted for Kevin McCarthy to be Speaker of the House of Representatives. I would have voted for Andy Biggs. I would have voted for a member of Congress who truly understands that the Constitution means what it says. But Congresswoman Marjorie Taylor Greene said this
Starting point is 00:11:00 about Jack DeShera. She misspoke about his name. It's Jack, not Jake. Jack DeShera is white male Christian and anti-war. She could have said Catholic and she could have said libertarian, but she said what she said. That makes him an enemy to the Biden regime. He told the truth about the troops being on the ground in Ukraine and a lot more. Correct. Ask yourself, who is the real enemy? A low-level National Guardsman or the administration that is waging war in Ukraine, a non-NATO nation against nuclear Russia without war powers? Gary, keep it up. I want to repeat the most important part of Congresswoman Marjorie Taylor Greene's tweet. Ask yourself, who is the real enemy, a low-level National Guardsman or the administration that is waging
Starting point is 00:11:57 war in Ukraine, a non-NATO nation against nuclear Russia without war powers. Well, she's right. Ukraine is not in NATO. We have no treaty with Ukraine. Russia is a nuclear power. We all know that. We have no obligation to fight this war, and Congress has not authorized this war. Are we fighting a war?
Starting point is 00:12:21 Yes. Are American special forces on the ground? Yes. That was revealed in the documents that Jack Teixeira caused to be revealed. Are British special forces on the ground? Yes. Are American special forces using computers to aim weaponry at Russian troops? Yes. Are American special forces pulling the trigger on those troops? Yes. Are American boys using American military gear in Ukraine firing American ammunition at Russian boys? Answer, yes. Is the American CIA spying on the Russian military? Yes. Is it handing the results of that spying over to the Ukraine
Starting point is 00:13:06 military? Yes. Is Russia at war with Ukraine? Yes. Connect all these dots. Is the United States at war with Russia? Yes. Has Congress authorized the war? Absolutely not. Congress has authorized the Biden administration to spend $113 billion with a B dollars. It has spent about $60 billion of it already, about $4 billion with a B in cash, the rest in military equipment. But some of the military equipment is so sophisticated that only American troops can operate it. Those troops are engaged in wartime activity against Russia. Where does this end? Where is the off-ramp? Larry Johnson, one of the former CIA folks that comes on to judging freedom regularly, Colonel McGregor agrees with this as well. Tony Schaefer agrees with this as well,
Starting point is 00:14:06 believes the whole thing is a fraud, that Jack Teixeira is a dupe, that the CIA wants this information out there because the Biden administration needs a soft landing for the crash landing that is coming. What am I talking about? It has no off-ramp. It has no way to get out of this deep, multi-billion dollar, fatal, deadly commitment it has made in Ukraine. And has no way to get out of it politically. And when Ukraine falls, what is Biden going to do but scratch his head? Congresswoman Liz Cheney, her father, no friend of mine, but I have admired her courage from time to time. On this, I profoundly disagreed with her. Ripped into
Starting point is 00:14:45 her former colleague, Congresswoman Marjorie Taylor Greene. Here's what Liz Cheney said. Marjorie Taylor Greene makes clear yet again that she cannot be trusted with America's national security information and should not have a security clearance of any kind. That statement on the bottom is actually Marjorie Taylor Greene's at the beginning of the other email. When it comes to Ukraine, the Biden administration has lied to us Committee. But just because Marjorie Taylor Greene is in favor of the truth and applauds what Jack Douglas Teixeira is accused of having been done doesn't mean she doesn't think it's a crime, doesn't mean she doesn't think he should be punished, and doesn't mean that she would do the same. but it does mean that Liz Cheney will take every opportunity to take a pot shot at her. All right, switching gears. Ron DeSantis, the governor of Florida, has not yet announced that he will seek the Republican nomination for president,
Starting point is 00:15:58 but it appears he's doing so. His numbers have been sinking since Trump was indicted. Trump's numbers have been rising. Ron DeSantis, Catholic and pro-life for as long as I've known him to be. Today, he signed the strictest abortion law in the country. Florida, as of today, prohibits all abortions after six weeks, six weeks of pregnancy, except in the case of rape, incest, or when two doctors testify that if the fetus is carried further, either to term or further than at the time of their examination, the mother in all probability will die as a result of that pregnancy, like an ectopic pregnancy. Those pregnancies rarely happen today, thanks be to God, because of sophisticated diagnostic techniques. Nevertheless, Ron DeSantis signed the strictest abortion regulation in the nation. And of course,
Starting point is 00:17:01 the pro-abortion crowd is up in arms. They want to call this the Forced Pregnancy Act rather than the Right to Life Act. People cannot get through their heads that the baby in the womb is a person. And the 14th Amendment requires equal protection for all persons, for the life, the liberty, and the property of all persons, of which babies in the womb are the weakest and the most in need of protection. That's what this Florida statute does. This, of course, will drive all the pro-abortion forces against Ron DeSantis. I don't know if any Republicans seeking the nomination are pro-abortion. Trump is not. Nikki Haley is not. The former governor of Arkansas, Asa Hutchinson, is not. There's another fellow, a very successful young entrepreneur, name escaping me. It's an Indian American name. I don't know if he's pro-life or not, but the Republican Party has been pro-life. They're going to pay at the polls, but if they really believe that the baby in the womb is a person as I do, if they applaud
Starting point is 00:18:11 the demise of Roe v. Wade as I do, then they're just going to have to deal with this. They're going to have to make the argument that we're going to give the baby in the womb the benefit of the doubt, as Ron DeSantis and the legislature of the state of Florida have done. It has been a whirlwind two weeks from the indictment of Donald Trump, whatever you think of it, and all the excitement it produced and all the analysis I have given to the release of these classified documents and the arrest of Jack Douglas to sheriff.
