Judge the Politano here with a special edition of Judging Freedom this Friday afternoon where craziness continues in the state of Michigan. A young man, a 15-year-old Ethan Crumbly, is accused of murdering four students in a high school and severely injuring eight others using a gun that was bought for him as a Christmas gift by his father. The prosecutor has determined that the parents so recklessly dealt with the gun in
Starting point is 00:01:12 their house, they didn't know where the gun was, didn't know that their son had the gun in school, knew that their son had some mental issues, and let him take the gun anyway. So while the 15-year-old is to be charged as an adult with first-degree murder, the prosecutor announces that she will ask her grand jury to indict the parents for criminally negligent homicide. Now there's two definitions to that in Michigan. One of the definitions is providing the means by which another person kills. The other definition, the standard one, is recklessness with regard to a dangerous instrumentality, recklessness so severe that somebody dies. Either of these definitions will fit the charges

They won't get bail, and they'll be in jail, not the same facility as their son, and they'll be charged with criminally negligent homicide. This is a tragedy that doesn't seem to end. The charges against the boy are serious, and the evidence is overwhelming.
Starting point is 00:02:52 The charges against the parents are serious, and the evidence is overwhelming. All of this will fall into the hands of the Oakland County Prosecutor, which is the county outside of Detroit, where the killing occurred and where the parents and the boy lived. One would think that these cases will result in guilty pleas rather than jury trials. It is unusual for these mass killings to end in jury trials simply because the pain of the victims is so severe. The state doesn't want to put them through reliving that pain by forcing them to come into a courtroom and testify about it. As to the parents, it's a head scratcher. I mean, if the police are looking for you, even if you feel the charge is unjust and you're absolutely guilty, you ought to show up because leaving, fleeing,
