Hi, everyone. Judge Andrew Napolitano here for Judging Freedom. Today is Wednesday, August 3rd,
2022. It's about 140 in the afternoon. If you are joining us live to listen to my interview with the great Phil Giraldi, the former senior CIA official, who when he told George W. Bush
that there were no weapons of mass destruction in Saddam Hussein's Iraq, Bush asked him to leave
the Oval Office and of course course, started the war anyway.
We had some technical difficulties with communicating with Phil Giraldi, so he's not
going to be on with us today. Technical difficulties. These things happen. We'll
resolve them and we'll get Phil on as soon as we can. Instead, I'm going to talk to you about a
couple of different topics, the first of which is
Gretchen Whitmer, the governor of Michigan, who successfully sought and thus obtained
an injunction against the enforcement of Michigan's abortion law. Okay, so what happened?
Well, Michigan's abortion law was very, very liberal
and permitted abortions almost up to the moment of birth until the Supreme Court decision
on Roe versus Wade came down. And then it turned out that the abortion law was no longer valid,
but there was a 1931 abortion statute in Michigan, which was still valid, which made it a crime for physicians or
anyone to perform an abortion. The courts have interpreted that as the valid law in Michigan.
The governor has sought an injunction against enforcing it, and the court bifurcated its
injunction and cut it in half. So this is a little unusual. So in Michigan, if you have an abortion other than for rape or incest or to save the life of the mother,
the doctor can be disciplined and the abortion facility can be disciplined. Excuse me, I said
that wrong. The doctor cannot be disciplined and the abortion facility cannot
be disciplined, but the doctor can be prosecuted. So because of a quirk in Michigan law,
this injunction against enforcing the 1931 law does not apply to county prosecutors. They can prosecute physicians or anyone in Michigan who performs an abortion where the conception did not come about by incest or rape or where the development of the baby in the womb is not likely to cause the death of the mother.
This is a very, very, very odd situation.

in the country. I would imagine the Supreme Court of Michigan will resolve this soon. The governor,
who is a liberal Democrat and pro-abortion, has been crowing about this, but she cannot stop the
