Hello everyone, Judge Napolitano here with another What's On My Mind sort of pop-up.
Here's what you need to know about the law.
It is Monday, December 13, and the governor of the state of New York has actually signed
it yesterday, an executive order requiring
all private businesses that are open to the public to compel everyone on their property to wear
masks if they do not require proof of vaccination for the people who come on their property.
Here we go again. Here we go again with somebody in the executive branch of the government, the governor, writing a law, even though only the legislature can write a law.
Has the legislature of the state of New York enacted a statute with criminal penalties saying if you own a business and you invite the public onto your business and you don't ensure that everyone there has
been adequately vaccinated, that you force them to wear masks? Of course not. There is no such law.
It's the wish, it's the dictate of Governor Kathy Hochul, just like her predecessor,
former Governor Andrew Cuomo. My friends, in America, we have divided government, executive, which enforces
the law, legislative, which writes the law, judicial, which interprets the law. And the
executive branch, the governor, can't write the laws. And to make this even worse,
the state government, of which she is the head of the executive branch, is not enforcing this.
She has ordered county governments to enforce this.
So at the same time that the counties in the state of New York, which includes the city of New York,
are enforcing vaccine mandates and persuading people to get vaccinated and making sure they are vaccinated before they
go on government property. She has added to their burden the obligation of seeing if people are
wearing masks on public property. Governor Hochul, do you really want the county officials to walk
down the street and stop people who are not wearing masks and ask them if they're
vaccinated? What is this, East Germany? This has to end. The people have to recognize
that we are our own rulers in America, that we have constitutions, and the Constitution of the
state of New York says only the legislature can enact laws.
Why is the governor not asked the legislature to enact this law?
Because it won't.
Be firm.
