Hello there everyone, Judge Andrew Napolitano here with Judging Freedom.
Today is Friday, February 25th, 2022. It's about 425 in the afternoon on the East Coast. And I just learned that my longtime friend,
very notorious character and well-known public figure,
Roger Stone, is suing the January 6th Committee
for attempting to invade his privacy.
Now, the committee subpoenaed Roger,
and full disclosure, he and I have been friends

college. The committee subpoenaed Roger to have him testify about what he did and what he knows
about January 6th. He quite properly invoked his right to remain silent, protected by the Fifth
Amendment to the United States Constitution. He said that the committee treated him professionally
and actually appeared to respect his right to privacy. Then they served him with a subpoena,
or actually they served AT&T with a subpoena, looking for all of his private communications,
his cell phone calls, his transmissions of fiber optic data, and his texting. Well, that's just
none of the committee's business. I mean, that is so personal and so private that the committee
would need to go to a judge to get that and show probable cause of crime in order to obtain it.
Roger hasn't been accused of any crime. There is no probable cause of crime. There is no basis for this kind of a
subpoena coming from the committee, not because he's my friend and not because I've known him for
all these years, but because he's sticking up for the Bill of Rights and for his own right to privacy.
I strongly commend Roger Stone's lawsuit against the committee, and I predict that he will prevail because the
committee cannot engage in a phishing expedition. It can't just subpoena whoever it wants and
whoever's records it wants. Not all big tech takes the position that when a challenge to the committee has been filed, it will stop complying
with the subpoena. Some big tech complies with the subpoena, and then the challenge occurs.
So even though I've had many disputes with AT&T, not personal disputes, but public disputes because they bowed over like a slave when George W. Bush demanded that the NSA be given access to their computers.
This is back when Bush was in the White House.
Nevertheless, the new and the current management of AT&T takes the position that they will protect the privacy of their clients. And if the government subpoenas client information and
the client files a lawsuit to quash, challenge, or block the subpoena, AT&T will not comply with
the subpoena until the court rules. So AT&T is doing the right thing. Prediction, Roger Stone
