Hello there everyone, Judge Andrew Napolitano here for Judging Freedom.
Today is Tuesday, March 22, 2022.
It's about 3 o'clock in the afternoon on the east coast of the United States.
In the you can't make that up category, President Donald Trump has finally, finally won some litigation
against those who
have been pursuing him for a long time. This is Stormy Daniels. You may recall that she alleged
that she had an intimate relationship with Donald Trump when he was Mr. Trump, and she alleges that
she was paid $120,000 by Trump's lawyer, Michael Cohen, to remain silent. She and
Trump then got into a dispute. He said some things about her, and he called her a liar,
and she sued him for defamation, and the case was dismissed. In the action dismissing the case,
Trump's lawyers asked for legal fees, which no one thought he would get, but he did.
So Donald Trump won a judgment for $300,000 in legal fees to his lawyer, Michael Cohen, who was convicted of defrauding the government, went to jail, and then was released from jail because of
COVID. The lawyer representing Stormy Daniels was Michael Avenatti. She charged that she earned
$300,000 from the sale of a book, and Avenatti stole it from her, and he was convicted of
stealing the $300,000, but he can't really say where it went. Two lawyers involved in the case, Trump's lawyer
and Stormy Daniels' lawyer, both went to jail. They're both out of jail, though I believe that
Michael Avenatti is about to go back in because of the conviction for stealing the 300,000 for
Stormy Daniels. So she says she doesn't have the $300,000 to pay President Trump.
She filed an appeal. This is unheard of what happened here. She filed an appeal of the trial
court ruling ordering her to fork over $300,000 to President Trump. She lost because she filed it too late. Oh, if done by a lawyer,
that's malpractice and that lawyer could be on the hook, whoever it is, for 300,000. If she did
it on her own, then it's her own fault for not following the rules. You have 30 days to file an
appeal in the federal system, 30 days to file an appeal in almost every state. If you file it
on the 31st day, the appellate court doesn't even have the jurisdiction to hear it. That's what
happened last night when the Ninth Circuit Court of Appeals, the very, very liberal Ninth Circuit
Court of Appeals on the left side of the United States, it's California, but it's the 15 western
most states of the United States, said we don't have the authority to hear it.
And therefore, it's too late for any appeal.
So Stormy Daniels owes Donald Trump 300,000 bucks.
Mr. President, good luck trying to collect it.
