Hi everyone, Judge Andrew Napolitano here for Judging Freedom. Today is Tuesday, May 9, 2023.
It's about 3.30 in the afternoon here on the east coast of the United States. As we expected,
the jury in the E. Jean Carroll versus Donald Trump
case has returned a verdict and it is not good news for the former president. The jury found
that Donald Trump sexually abused Ms. Carroll in the ladies' dressing room of a Bergdorf Goodman
department store sometime in the early 90s, and that 30 years later,
while president of the United States and in the driveway outside the White House defamed her,
and it awarded her $5 million, both for the sexual abuse and for the defamation.
Now, there's a difference between sexual abuse and rape. The jury found that Donald Trump did not rape her.
Without getting too graphic, rape requires a full entry into the body.
So the jury finds that Donald Trump did not enter her body, but that he touched her private parts and attempted to enter her body.
That would be the definition of sexual battery. Battery is an
unconsented to touching. Sexual battery is an unconsented to touching of the sexual parts
without full penetration. Rape, of course, is full penetration. More details as we get it, more of a breakdown as we get it.
We don't even have the breakdown of the numbers,
although it appears that it's $3 million for the sexual battery
and $2 million for the defamation for a total of $5 million.
The jury found that Donald Trump acted with malice with an intent to harm her
when he made his statements while President of the United States. The courts have already
ruled that those statements are not protected as presidential statements ordinarily are
from liability and damages because they were not part of his job. So to repeat, Donald Trump found
liable for sexual battery and defamation, found not liable for rape, essentially that the rape
did not occur, but that he touched her private parts inside her clothing, actually touched them,
his hands touching her private parts, his private parts touching her private parts,
