2022 it's about 9 25 in the morning yesterday afternoon former president donald trump
filed a lawsuit in federal court in Miami against Hillary Rodham Clinton and
about 15 others, including James Comey, the former director of the FBI, alleging that they
participated in a racketeering scheme, I got to say this with a straight face,
to make his life miserable, to force him to spend money he shouldn't have had to spend,
and to help him lose the election of 2016. So the allegation is under the Racketeer Influence
Corrupt Organizations Act, commonly known by its acronym of RICO. RICO is a much-abused federal
statute which says that if a plaintiff can show that a defendant committed two or more criminal offenses, whether charged or convicted or not, but two or more criminal offenses in the preceding 10 years.
And the defendant conspired with others to receive benefits from those offenses, and the plaintiff was harmed by
it, the plaintiff can get treble damages. So here's what Trump says. Trump says that Hillary
Clinton and the Democratic National Committee and James Comey and 20 or 25 other people
conspired together to concoct the idea that Trump was open to receiving assistance from
the Russians in the 2016 campaign. And that triggered the Mueller investigation,
and that forced Trump to spend $24 million in legal fees. And therefore, he wants those legal
fees back times three, because this statute says, if you can fit within the requirements of the statute and show that you were harmed by this conspiracy, you can get treble damages from the conspirators.
That's Trump's version.
No one has answered the complaint yet because it was just filed yesterday.
It probably hasn't even been served.
It was prepared by a two-person law firm in Bedminster, New Jersey, not one of the great firms that you'd expect a former president to have, but valid licensed lawyers who wrote a
complaint which, in my opinion, will most likely be dismissed before the defendants even have to answer it.
Trump is basically saying they made my life miserable and I want them to pay for it.
Well, welcome to big league politics, Mr. President. You've made people's lives miserable
for political reasons, which is exactly what all of this is about. Some of the defendants,
in fact, most of the defendants were government officials
at the time. So they are immune from liability for what they did in their governmental roles.
And in fact, they will be defended by the government. Those that are individuals have
the defense that, you know, an FBI investigation conducted by Bob Mueller concluded
that the Trump campaign was receptive and open to receiving aid from the Russians. I don't know
if it did. Nobody was charged with that. Obviously, nobody was convicted of it. But the president,
the former president, will be, if this case goes to trial or to discovery, you know, we exchange evidence and take examinations under oath before trial, will be opening up all these old wounds.
It's almost inconceivable that these defendants could be, many of whom have never even met each other, could be liable for participating in this massive conspiracy to
cause harm to Donald Trump. Now, if you know Donald Trump as I do, this is no surprise.
He's a tough, pugnacious fighter. You strike at him with a fist, he's going to come at you with
a knife. Just an allegory. He's going to hit you harder than you hit him. And this is what he's doing. Statute of limitations here on this statute is 10 years.
These events that he and his lawyers have articulated in this complaint occurred in 2016.
That's six years ago. So we'll see where it goes. Expected to be a headline for a day
and then probably dismissed
without even any oral argument,
just on the basis of documents
submitted to the court.
But who knows?
