Judge Andrew Napolitano here on Judging Freedom, another one of my pop-ups where I just pop up in front of the camera, as I did in my Fox days, to explain to you a legal issue that is current or news-breaking. Today is Monday, December 20th. The news today is that
early this morning, or perhaps late last night, former President Donald Trump filed a lawsuit in
federal court in Albany, New York, in an effort to get a federal judge to stop the Attorney General
of New York from investigating the Trump Organization. So the question is, when the
state is investigating you or a company you own or with which you are affiliated for committing
crimes, can you go to court and get the court to stop the state from conducting that investigation?
The answer is a very clear one. No. It would be nice if you could do that. I mean, the state violates the rights of citizens, of persons, of criminal defendants and of potential criminal defendants all the time.
The former president argues that the attorney general of New York, Letitia James, has publicly stated her personal animosity toward him. He states correctly that when she ran for attorney general,
she attacked him, even though he obviously wasn't the person running against her.
And from that, he concludes that her investigation is driven by her personal animosity toward him,
towards his politics, towards his personality, towards his wealth.
That may all be true,
but the defendant, the potential defendant, because he hasn't been charged with anything,
is not in a position under our system to challenge the investigation until the investigation comes
to fruition and it does something. But the mere gathering of documents and the gathering of evidence against a potential defendant, even a former president of the United States, is a decision for the prosecutors and the prosecutors alone.
The former president's lawyers should know that their effort to stop Attorney General James, as much as I wish this weren't going on, they should know that these efforts are frivolous
for president it's going to end up being fined for filing frivolous litigation in a federal court
