Starting point is 00:00:00 Hello there everyone, Judge Andrew Napolitano here on Judging Freedom. Today is Monday, February 14, 2022. It's about 2.15 in the afternoon on the east coast of the United States. As many of you will recall, shortly before leaving office, former Attorney General of the United States, Bill Barr, appointed a special counsel to investigate the origins of the Russiagate expose involving Donald Trump. Starting point is 00:01:06 the United States. Did anybody break any laws at the time? Well, this, this federal prosecutor, his name is John Durham, indicted two people. He indicted a, an FBI lawyer for lying to the court. That lawyer got a slap on the wrist, but he'll probably lose his license to practice law. And then he indicted another lawyer, one of Hillary Clinton's former campaign lawyers, for lying to the FBI when he was speaking to the FBI general counsel. Now, I have a problem with this statute. How can it be a crime to lie to an FBI agent when the FBI agent is allowed to lie to you?
Starting point is 00:01:41 Nevertheless, that's the law. So be careful when you talk to the FBI. They can legally lie to you, but you cannot legally lie to you. Nevertheless, that's the law. If a lawyer is indicted for lying, of course, the consequences are drastic because even if acquitted, he can lose his license to practice law. Another story for another time is how you can lose your license to practice law if you've been found not guilty. In the process of filing documents with the court about this case, John Durham, the prosecutor, filed a six or seven page document last Friday, which has a lot of people scratching their heads. Scratching their heads because of what it shows
Starting point is 00:02:25 and scratching their heads because of the little amount of publicity it's getting. It shows that the federal government is prepared to prove that Hillary Clinton engaged lawyers and IT technicians to invade the servers of Donald Trump at Trump Tower in the summer and the fall of 2016 when he was Mr. Trump and when he was a candidate for the president, and that the Clinton campaign used federal assets, FBI officials and CIA officials officials to bring this about. Now, some of us argued that the Obama administration was spying on the Trump campaign, and it was using foreign assets, British agents, to do so. This brings the case much closer to home. If John Durham, the prosecutor, can prove in this case in which he's accused a lawyer of lying to the FBI what he said he can prove in the document he filed on Friday, we have another Watergate on our hands. state using campaign funds to invade the private servers, computer servers of her adversary,
Starting point is 00:03:48 and doing this in conjunction with federal assets as well. Of course, a lot of people are saying they should be indicted. Well, fortunately or unfortunately, depending upon which side of the aisle you're on, it's too late to indict. These crimes have a five-year statute of limitations. And if everything occurred as John Durham says it occurred, when he says it occurred, it took place in 2016. It's now 2022. Do the math. That was more than five years ago.
