we're going to get to the bottom of where Rudy Giuliani really lives for the purposes of whether his condo in Palm Beach County is going to be turned over to Ruby Freeman and Shay Moss, those defamed, horribly attacked civil servants who are counting votes down in Fulton County, Georgia in 2020 so they can collect on their $150 million judgment. We're going to find out where he lives. Why does it matter? It matters because if he didn't live in Florida as of the 8th of August when the judgment was recorded on the books and on the docket, he's going to lose the condo. Rudy Giuliani knows that.

So he's not responding to any requests or demands or orders of the court in the Southern District of New York. You know what that means, big sanctions coming. I'm Michael Popock. This is Legal AF on the Midas Touch Network about Rudy Giuliani and a brand new motion that just got filed by Ruby Freeman and Shay Moss. Let me keep it all straight because there's so many motions for contempt out there.

On the 12th of December, we're gonna be in Washington DC because the judge who presided over the underlying case that led to the $150 million judgment wants to know why Rudy Giuliani is continuing to defame Ruby Freeman and Sey Moss on his podcast in violation of a consent order that he agreed to. That's on December the 12th. That's in front of Barrel Howell. Now, let's go to Judge Lyman in New York. There is a deposition that is coming up on the 27th of December in advance of a hearing that's going to be on the 15th of January about whether Rudy Giuliani is going to lose

his Yankee rings and his condo in Palm Beach. Now, here's the question. Does Rudy Giuliani live in New Hampshire or does he live in Florida? And the difference is if he lives in New Hampshire where he has told the bank and banks where that's where he lives, then he doesn't get to claim what's called homestead protection over Florida property. I used to practice in Florida. I used to live in Florida, kind of know a thing or two about homestead law. Homestead Law gives you a protection, gives a debtor protection from all judgments and losing your property if you live in the home up to a certain value. That's why a lot of deadbeats go to Florida to invest all their money in their house. But you have to do it before the judgment is recorded on your house. The recording of the judgment in favor of

Sey Moss and Ruby Freeman was the 8th of August 2024. So was Rudy Giuliani a Florida resident living in that condo with Homestead Protection on that date or not? Problem is just a couple of days before he was telling the world or at least the banks in New Hampshire that he lived and worked in New Hampshire. Now we know about New Hampshire because at one point, I don't know if you remember, during the election he tried to sue Joe Biden and others related to defamation in New Hampshire. So I knew there was like a New Hampshire connectivity there. But he tells the court and he tells the lawyers for Ruby Freeman and Shae Moss that he's got a lot of documents that establish his argument that he lived in that condo before the 8th of August.

He lists them. He says, oh, I've got a registered to vote and I got a deed and I registered my car and I've got a driver's license and, quote, other documents which defendants reserve the right to submit and use it as evidence in this action. But that's not how it works. We don't do trial by sandbag. You have to provide your documents. And the reason the new lawyers or the lawyers for Ruby Freeman and Shea Moss had to file

a motion for sanctions and for contempt is because he hasn't answered a darn thing. He hasn't turned over a one shred, not one page of documents, despite being ordered by the court to do so under penalty of contempt. Not one page, not any of the documents that he claimed that he had in his possession. And they got a deposition coming up on the 27th of December and they want to be able to ask him questions about his documents, about the issue of the homestead and when he decided to live in Florida because dates matter Knock knock who's their federal judge?

Federal judge who federal judge is gonna find you in contempt and what they're asking for in this new filing is extraordinary But it could happen. They want the judge to find adverse Inferences and rule against Rudy right now to declare that he doesn't have any documents effectively because he hasn't turned any over, take an adverse inference under his own advisement as a judge that those documents are against Rudy Giuliani, that they would not establish his Florida residency in time, that he can take that, he can make that assumption because of the misconduct of Rudy Giuliani, which is never accidental. It's always on purpose.

And they remind Judge Lyman in their filing that Rudy's done this before. He did it in the underlying case about the $150 million judgment. That's how he got a default judgment entered against him by Judge Barrell Howell because he refused to turn over any documents. So the judge made adverse inference. The documents you haven't turned over despite court order must be really bad for you. I will assume that they are.

And that's exactly what they want the judge, Judge Lyman, in the Southern District of New York to do right now against Rudy. Assume that all the documents are against him and don't establish Florida residency. And therefore, that is more likely than not that he lives in New Hampshire. Let's be real guys, wearing nice pants sucks.

And I love the fact they go through in the motion all the ways in which Rudy Giuliani has thumbed his nose and flouted the orders of the court. Enough is enough. The judge almost found him in contempt about a week ago when he lashed out in court in front of the judge. And he said, you're making assumptions about my conduct that are not appropriate.

And the judge says, all right, let me recalibrate here. I'm the judge. You're a party. You're not even a lawyer. This is my rendering of the judge because you've lost both of your bar licenses. You have a lawyer next to you. This Joe Camerata or something, an ambulance chasing lawyer from Staten Island. I'm not making that up.

Let him talk for you. In fact, he has to talk for you. You can't talk unless you want to take the stand and I swear you as a witness, and then you can talk under penalty of perjury. But then he went back outside at a press conference with Joe Camerata and talked about, I can't write a check. I don't have any money. Remember that one?

I don't have money. That's why I haven't paid him back. I couldn't even call an Uber. And then he revealed that he does have money! That's why I haven't paid him back. I couldn't even call an Uber." And then he revealed that he does have money. I have some money, you know, with my day job as a podcaster. Oh, God. I got to laugh. He's going to be found in contempt by Judge Lyman. Rudy's new lawyer, Joe Camerata, is not ready for primetime. Let me just put it that way. Former cop, that's not why he's not ready for primetime. I'm not here to malign cops.

He knew Rudy from 9-11 days, decided to bail him out when his fifth lawyer quit him a couple of weeks ago. Didn't even tell Rudy he was quitting. He just filed a paper with the court and said, I'm out. And then Rudy had to find out about it in the newspaper. This guy's just all about being pugnacious and being a pit bull and the nation's mayor shouldn't be treated like this and all this other stuff. He doesn't know his way around federal court. He couldn't

find federal court or federal proper practice or procedure if he tried to find it with both hands. So he's just going to go in there and make a mess. The judge is going to find Rudy Giuliani in contempt and then he's going to decide which contempt. Money's not going to do it. Normally it's contempt like a fine, but Rudy says he has no money so fines aren't going to do it. It's got to be something greater than that. I find that none of the documents that you have in your possession would be helpful to you or you would have turned them over and I'm going to find against you on the condo. Turn the condo over to Ruby Freeman and Shea Moss so they can go live in splendor in Palm Beach, Florida near Mar-a-Lago. They deserve it. Let them drive around your

1980s Mercedes from Lauren Bacall, allegedly, and they can wear your Yankee rings and then they can fly to New York for the summer or for Christmas and stay in the, which they now own in your, what was once your Upper East Side apartment and good and you deserve it. You know, and you're, and he's still defaming Ruby Freeman and Shea Moss on his podcast. It gets my goat.
