Jack Smith and the Department of Justice, are they going to accept Judge Cannon's remaining three-day block through Sunday about the release to the public of the DC election interference special counsel report? No. They've informed Judge Cannon based on direction from the 11th Circuit Court of Appeals that they are appealing that particular order of hers,

which kept in place until Sunday, the block of the release by the Department of Justice of the statutorily required report to the American people. They're not even going to wait 72 hours. The 11th Circuit, when it issued its ruling, gave this opportunity to the Department of Justice and they are taking it. Let me explain it to you and break it down. It's a little bit complicated,

but it won't be when I'm done with this hot tick. I'm Michael Popak. You're on the Midas Touch Network and Legal AF. Let's back up a few days. On Tuesday, just this Tuesday, Judge Cannon, because Donald Trump asked her to, issued an order blocking temporarily until the 11th Circuit Court of Appeals

dealt with its own emergency application on the same subject, blocked the release by the Department of Justice of volume one and volume two of Jack Smith's final report. Volume one is on DC election interference. She never presided over that case. Volume two is about Mara Lago. She no longer has jurisdiction over that case

because the issue about whether she properly dismissed the special counsel as being unconstitutionally appointed is still up on appellate jurisdiction with the appellate court. But she felt without jurisdiction and without having any involvement in another case, she could issue that block, which she said was temporary for, until the time the 11th Circuit rules plus three days.

Well, the 11th Circuit is ruled against Eileen Cannon. On their own emergency application filed with them, they denied the emergency application, I presume, because Merrick Garland has already declared he's not releasing the Mar-a-Lago Volume 2 report anytime soon. He's only releasing Volume 1, which has nothing to do with Mar-a-Lago or the 11th Circuit.

And so 11th Circuit said, yeah, emergency motion filed by Donald Trump through, well Trump through his co-conspirators denied. Now they didn't address it that moment. I thought it was a little bit weird. I practice in those courts. I thought it was a little bit weird that when they filed their papers, the Department of Justice didn't also ask

to have the stay vacated that had been put in place by Judge Cannon. They just focused on opposing the emergency application to the 11th Circuit. The 11th Circuit, of course, caught that procedural glitch and said, by the way, when they issued their order, if you want to challenge Judge Cannon's decision to block from now till Sunday, file another notice of appeal, basically directed the Department of Justice to do it procedurally properly. And I also said in that gap, there is time now, whether it was planned or not, for Donald Trump to try yet another Hail Mary

over to the United States Supreme Court. I'll break, let's break those two, those two tracks apart and let me explain it. Now, Jack Smith, well, through the US Attorney's Office in Miami, who's really taken over the case, has informed Judge Cannon and the 11th Circuit that she is being appealed. They're not gonna sit around and wait till Sunday.

They want the 11th Circuit to vacate, reverse, Judge Cannon's 72-hour stay. And so there's gonna be briefing at the 11th circuit, gonna go fast and furious here. And then from there, it's going to go, I'm sure, sometime maybe later today or tomorrow, they're gonna lift that stay. Donald Trump is gonna then have to try to file

an emergency application again with the United States Supreme Court, having just come off a major loss five to four, where they refused to block his sentencing, which of course is going on in New York and he's getting reamed and chastised there. You'll see a lot of reporting on the Midas Dutch Network about the sentencing.

So he could try again to see if he can get five votes that for the Supreme Court to deny the release of the report, but I don't see that happening. So you've got the 11th Circuit Appeal going on with a new filing by Jack Smith to get rid of the 72-hour block by Judge Cannon, while Donald Trump, I'm sure, his lawyers are working around the clock

to try to file a 30 or 40-page brief with the United States Supreme Court. So this is gonna be a fast-moving story. Tune back into Legal AF and the Midas Touch Network for updates. to the 11th Circuit is going to trigger a very quick briefing schedule that the 11th Circuit is going to order, like in hours, where they're gonna try to resolve this because Sunday is fast approaching. So I think it's gonna be fully briefed by Saturday and they're gonna to try to resolve this because Sunday is fast approaching. So I think it's going to be fully briefed by Saturday, and they're going to make a ruling on Saturday that some people might be wondering, what's all the commotion? Why not just wait till Sunday? Because you have to challenge improper procedural decisions. You can't let them lie.

You can't create bad law behind it for future cases. And every day, every day justice is delayed as justice denied. It's time for the American people to hurry up and get that report in their hands. It's obvious that Jack Smith and Merrick Garland knew that they were never gonna be able to release the Mar-a-Lago report.

That was the sacrificial lamb. That was the faint. That was the fake in order for them to throw the long ball and get the DC election interference report into the hands of the American people. Because the Mar-a-Lago report is tied to an existing case

that's still going on that will be dismissed after Donald Trump becomes the president and Pam Bondi becomes the attorney general. We'll never see that report.
