Who has bailed out Rudy Giuliani and given him a big sack of money in order to resolve the Ruby Freeman and Shea Moss $150 million case? That's on everybody's mind with some new reporting that in order to avoid yet another hearing about whether he was going to lose his Florida condo in addition to his New York condo, the bulk of his assets, in lieu of

that, it looks like the parties, Rudy Giuliani on one side and Ruby Freeman and Shea Moss, those Georgia, Fulton County, Georgia election workers holding the $150 million defamation and punitive damage case in the other, who are fresh off of a series of wins against Rudy Giuliani for contempt just last week. Why did they reach a settlement and why is the settlement going to allow Rudy to keep his two apartments worth millions of dollars, the bulk of his estate, in return for some sort of payment? And how large is this payment and who's making it on his behalf?

I'm Michael Popock, you're on the Midas Touch Network and Legal AF. Fast moving story. This morning, if you caught some headlines, you probably thought Rudy blew off a federal judge, Judge Lyman, who's a federal judge appointed by Donald Trump in New York, who's presiding over the enforcement of the judgment,

the creditor's rights rights if you will, against Rudy. Last week he got found in contempt by this same judge for his failure to properly turn over documents and the judge was just about to on the precipice of forcing the turnover of the Mar-a-Lago adjacent Palm Beach County Florida condo worth three to five million dollars to Ruby Freeman and Jay Moss. So why the settlement? So that was the headline in the morning. Rudy didn't show.

Where's Rudy? Nobody knows where Rudy is. Well, the judge is even on the bench. Well, now we know why. Apparently over the last 72 hours, settlement talks broke out. And I'm sure as a lawyer does a lot of settlements and practices law regularly, I've settled cases on a courthouse step

in the judge's chambers in a lunch room. I've settled a case in the bathroom, to be honest with you. For justice, I'll settle a case wherever it's required. So they were working on a settlement. I call that a suggestion of settlement. So they picked up the phone, I'm sure now, and they called the judge's chambers. And they said to Judge Lyman's chambers,

we're working on a settlement. Can we postpone this morning's hearing a bit? And they were granted that time. First piece of paper that came out that you might have seen the headlines on was an announcement of a possible settlement. I got that letter, a joint letter signed by all three lawyers representing the two parties.

And I was like, this is interesting. A settlement with conditions, it's not done yet. Please judge, give us more time. It's that tone of the letter. Keep the hearings, but postpone them until February. As we say, it's always better to bargain in the shadow of the law than just take pressure off. Keep everybody honest.

I mean, Rudy Giuliani honest. And so that happened. And I was about to do a report about that. Like, all right, there's a settlement. I was gonna speculate, given my vast experience settling hundreds and hundreds, maybe thousands of cases in my 32 year career. I was gonna like speculate about maybe

they were gonna liquidate one of the assets, give Rudy a little taste, maybe three or 400,000, turn the rest over to Ruby Freeman and Shane Moss. Because the goal of a lawyer in this settlement posture is to connect his client with money as quickly as possible. Time value of money matters. A dollar today is worth more than a dollar three years from now. And if they could just get Rudy, who they already made prone and drove him to the ground on his knees, if they could just get him to start turning over some cash and stop F-ing around, that would be better for Ruby Freeman

and Shane Moss. Not for the lawyers though, lawyers are doing it for free. The lawyers at Wilkie Farr and Gallagher, tips of the hat to you, chef's kiss to you, they're doing God's work, doing free work, which lawyers do, call pro bono work, I do it of course. And so to maximize the recovery for their clients. Now we've got new reporting coming out of the New York Times that says that maybe you've

seen the settlement or talked to the lawyers and there's going to be a large payment made by Rudy and he gets to keep all of his assets including the two pieces of property. Well that's worth, I've already estimated based on my understanding of real estate in both Florida and in New York, that's like $10 million. So in order to settle the case, it's gotta be a millions payment now. Maybe he gets a discount, maybe because of selling it. Maybe it's 5 million, 8 million, 7 million,

some millions of dollars. Where's he getting it from? His podcast doesn't make any money. His GoFundMe page isn't large enough. So is it coming from Mago World? Is Mago World through Donald Trump, did Donald Trump whisper in somebody's ears and say, you know what would be nice,

to bail Rudy out of this problem. And can we get him a little nest egg that he can use to spend his way out of this problem? So the next level of reporting is gonna be where did the money come from? Because Rudy looked the bankruptcy judge in the eye and said he had no assets other than what was disclosed. I mean, he was chastised for being a bad faith filing.

He looked the judge lineman in the eye and said he had no other money, no other assets. This stupid book that he wrote, I think Harper Collins or somebody was gonna publish it about the Biden crime family. I mean, who's Harper Collins or somebody was gonna publish it about the Biden crime family. I mean, who's gonna, no one's gonna publish that really and how much advanced did he possibly get? But he's 80 something years old,

he's barely making a living. Who bailed him out? Not a hundred Biden had a patron, some millionaire former lawyer that paid for a lot of his expenses and living expenses and paid some money for him and got him out of his tax problem. Maybe Rudy has a shining night,

a white night that's come forward at Donald Trump's best. Is that an appropriate thing for an incoming president to do, to broker a major payment? Or is it, can we see it another way? Is it an admission by Donald Trump? Is the money really coming through Donald Trump so Sey Moss and Ruby Freeman can not only declare victory over Rudy, but through MAGA as well.

Now I know Rudy's taken a social media I won. Oh, I what did you win? What you got $150 million judgment against you by a jury of your peers in Washington 90. You had a file bankruptcy, you lost both of your law licenses. You're indicted in Georgia still.

You're indicted in Arizona. You were an unindicted co-conspirator in the DC election interference case. Your life's in shambles. Nobody's hiring you to do legal work. The front page of the New York Times attacked you about a year ago for being an alcoholic and doing a lot of drunk dialing around client matters.

So if that's victory, somebody show me defeat. That's kind of how I see it. So I'm gonna continue to follow and kind of dig deeper, kind of talk to some of the lawyers here and figure out what the settlement proposal really is. And what are the chances that Rudy's actually gonna come up with the money? He's violated court orders, agreements endorsed

by the court, he's been found in contempt twice. He's got an allergy to compliance, right? He's allergic to compliance. He's a recidivist. And what happens if he doesn't pay? Is he then is part of the settlement, which is what I would negotiate. He automatically puts the deeds and the stock shares

for the New York co-op into a trust or into an escrow held by the plaintiff's lawyers. And if he violates again, they don't have to go through a court proceeding. They automatically get that judgment and automatically get title transferred to them. That's the only way. And I wanna compare what I'm telling you now

about how I would handle the settlement to what the settlement's actual terms are. Cause that's the only way I would settle with somebody like Rudy Giuliani, with me holding the title. And if he violates, doesn't pay, we own the title. If he pays, we turn over the title out of escrow. That's the way I would do it.
