Well, if you had any doubts that Joe Biden did the right thing to take Hunter Biden out of harm's way and give him an unconditional pardon for a 10-year period to cover all of his potential misdeeds and take him out of the line of fire of Trump, his FBI, and his Department of Justice. Look no further than the new order we just got from the judge in California, Judge Scarcy, who was set to sentence him in about 10 days. And when you hear my report about what Judge Scarcy, a Trump appointee, put into his order
Starting point is 00:02:51 in which he's begrudgingly accepting the pardon, but not really, but took the time to chastise Joe Biden and suggest aspects of the pardon are unconstitutional. Now you know why Joe Biden did the right thing to pardon Hunter Biden. I'm Michael Popak. I'm at the intersection of law and politics here on the Midas Touch Network, an Unlegal AF. Let me catch you up. We had two criminal cases against Hunter Biden, one in Delaware related to gun charges, one in California related to tax evasion. The gun charges were going to be settled along with the tax evasion in a plea deal.
Starting point is 00:03:34 The plea deal fell apart mainly because of pressure from MAGA and Hunter Biden was willing to take the plea deal. The whole thing fell apart and he made them have to go to trial. He got convicted on the gun charges, right? He pled guilty ultimately to the tax evasion charges, waiting for sentencing up to 12 years in prison. If anybody thought, well, just leave it in the hands of Judge Scarsey.
Starting point is 00:03:59 He's fair and impartial, isn't he? Not based on what he just wrote. So he gets, you know, Hunter Biden on December 1st gets the pardon. We all reported on the pardon. I used the hyperlink. I downloaded the memo that went along with the pardon from Joe Biden. I read the pardon itself, which is a paragraph long. I understood that as of the moment the pardon was issued, there can be no further criminal proceedings against somebody for the underlying things. That's the power of the pardon. But apparently, literally, Judge Scarcy didn't
Starting point is 00:04:29 get the memo, didn't like that he didn't get the memo, and decided now is the time for him to say that it was improper for the pardon to be given. Now, let me explain something. The pardon power is unassailable. Pardon power is robust. It's the strongest power that a president has. It can't be challenged in the courts, but that doesn't stop kippetsers in favor of Donald Trump from taking potshots at Joe Biden about it. Also, there is no requirement that Joe Biden do a memo. He did a memo to the American people because he wanted to explain why he originally said
Starting point is 00:05:03 he wasn't going to pardon Hunter Biden, but as things developed and he decided not to run for office and Hunter Biden was about to get excoriated by Scarsi, now is the time to step in and give clemency. That's what clemency is for. So he wrote a memo and no good deed goes unpunished. Now Scarsi, the judge, he didn't like the memo. He didn't get the memo the right way. A lot of these judges, Scarcy, the judge, he didn't like the memo. He didn't get the memo the right way.
Starting point is 00:05:25 You know, a lot of these judges, federal judges get what we call black robe disease. Oh, you didn't deliver it on a silver platter with a wax seal at the appropriate hour. And therefore I had to, oh, I had to have one of my clerks hit the click, the hyperlink. Oh, come on, come on, Scarcy, give me a break all right here's what he writes in his order uh which i thought it would be um i thought it would be helpful for everybody to see
Starting point is 00:05:53 here here's the um here's the so he begrudgingly effectively he begrudgingly accepts the whole darn thing. But not without taking, as I said, the pot shots at Hunter Biden. So here we go. Give me one second. So here's his recitation. This is the judge now. On December 1st, 2024, defendant Robert Hunter Biden provided notice that Joseph R. Biden Jr., president of the United States, issued a full and unconditional pardon to Mr. Biden. All right, so they filed a notice of pardon. Now he's got to be all bothered, hot and bothered about how it was delivered to his chambers, as if he's the President of the United States. Rather than providing a true and correct copy of the pardon with the notice, Mr. Biden provided a hyperlink to a White House press release presenting a statement by the president regarding the pardon and the purported text of the pardon. Really? We all have
Starting point is 00:06:50 a copy of it, Judge. Do you think he made it up? Do you think, is that your allegations, Scarsey? Now you see why we can't be sentenced by the guy. He's not fair. He's not impartial. He's a Trump-er. Federalist society since 2017. Had no background in criminal law, by the way, just to call out federal judges. I mean, his entire career before he hit the federal bench, this Judge Garcy was an intellectual property, copyright and trademarks. That's all he did. He's the chairman of the department of a couple of large firms, never tried a criminal case in his life.
Starting point is 00:07:19 And now he's taking Biden to task. Why not? Guy's on his way out, going out of business sale. Let's kick him on the way out. Kick him in the backside of the way out. Here we go. And then he cites the links. The court previously noted its disproval of this practice. I don't know what he's disproving. It's hard to tell in that sentence. Is he disproving of the practice of being provided a hyperlink instead of a hard copy? Or he's disproving of the memo that Joe Biden wrote
Starting point is 00:07:45 to go along with the pardon? I don't know. But the president's statement illustrates the reasons for the court's disapproval. So now it looks like the judge is criticizing the memo that Joe Biden didn't have to write at all to go along with his pardon. The Constitution Article II powers of the pardon
Starting point is 00:08:03 don't say you gotta write a memo. You gotta write a book report of the pardon don't say you got to write a memo, you got to write a book report before the pardon is going to be effective. So the judge goes on. For example, the president asserts that Mr. Biden was treated differently from others who were late paying their taxes because of serious addictions, implying that Mr. Biden was among those individuals who in timely pay taxes due to addiction. So now this is the judge just being snarky. It's like, oh, well now you're taking potshots at me and how I administered the case. So I don't like that. So let me, let me criticize. All right. So he's basically saying, no, that's not the reason he didn't pay his taxes. He had money to pay his taxes, even though he was addicted, which I'm not sure is actually accurate for the record. Mr. Biden admitted that he paid tuition
Starting point is 00:08:46 and different luxury items. Apparently, Scarsi didn't like all that. He used a lot of his money to support his lifestyle. According to the president, this is now Judge Scarsi again, the guy that was going to sentence in about a week under Biden, no reasonable person who looks at the facts of Mr. Biden's case can reach any other conclusion that Mr. Biden was singled out only because he's the president's son. So then the judge says, well, there's been two federal judges who have looked at this issue and have refused
Starting point is 00:09:14 to dismiss the case on selective prosecution. All right, we understand that. Starting point is 00:12:01 dot com slash legal AF. I mean Scarcee's been a pain in the ass in this case from the beginning. I'm sure the lawyers representing Hunter Biden told Joe Biden that they're having a lot of difficulty with Judge Scarsee and that it looks like he wants to throw the book at Hunter Biden to make an example out of him. And that's exactly why a father slash president of the United States with one remaining superpower should exercise the pardon. And the judge goes on, I mean, cause he's gotta be the most important person in the room on this issue.
Starting point is 00:12:32 You know, I've seen many judges accept pardons, especially the ones given by Donald Trump. I mean, Judge Scarcy, if you got a Donald, when you get inevitably a Donald Trump pardon, are you going to criticize and excoriate Donald Trump for exercising his power of the pardon as the President of the United States? I defy you to do that. Do it. I doubt you will. When Donald Trump signs off on 2,000 pardons for everyone related to Jan 6, everyone in MAGA Congress, everybody in his inner circle, incoming
Starting point is 00:13:04 cabinet members and people in his administration or around his administration are all going to be given blanket pardons, unconditional pardons. Are you going to write a letter to the editor and complain about that use when he doesn't write a memo? I'd like to see that. Let's continue. In short, this is the judge now, a press release is not a pardon. See, he's still hung up on he didn't get his his backside kissed properly in his
Starting point is 00:13:32 own mind, making up his own rules about how the pardon could be delivered. Is there any doubt, Judge Scarcy, is there any doubt that the pardon was issued? Is there any doubt of the language of the pardon? Is that what you're doubting? It's not a matter of public record for which you could take judicial notice? Come on. But he's still going on on page three. In short, a press release is not a pardon. The Constitution provides the president with broad authority to grant reprieves. Yeah, no crap. But nowhere does the Constitution give the president the authority to rewrite history? Oh boo hoo on you. Why don't you be honest with the American people as long as you're talking to them? Why don't
Starting point is 00:14:11 you be honest with MAGA and tell them what you were going to do to Hunter Biden and that if you had children, I don't know if you do or you don't, but if you had children and you were the president of the United States, you would save them from a judge like you who's about to sentence him. Why don't you be honest? No, we don't blow smoke or sunshine here on the Midas Touch Network or Legal AF. You shouldn't either.
Starting point is 00:14:33 I know you have a lifetime appointment, but although Mr. Biden attached a purported copy of the pardon, oh, we're back on the purport, seriously, he is like a broken record. It's like a dog with a bone. A purported copy of the pardon to a subsequent filing, the copy is not substantiated by an authenticating declaration.
Starting point is 00:14:51 Mr. Biden's declares that he accepted the pardon. And on that basis, he asserts the court must have missed the indictment against Mr. Biden. And then he goes on to suggest that perhaps it's unconstitutional because part of the pardon, which was through December 1st, included about five or eight hours of additional time to wrap up December 1st that hadn't yet happened and you can't really give future pardons, which I'm not sure that's true under the way the Constitution is written either, Judge Carsey. This shows you why I'm proud of the Democrats and Joe Biden
Starting point is 00:15:28 for doing to the Republicans and to MAGA and to the Federalist Society exactly what they would have done to us. It's time, if you're gonna be in a gunfight, you bring a gun, not a knife. It's time to have sharper elbows, Democrats. It's time to use every appropriate rule and trick in the book in favor of democracy
Starting point is 00:15:49 to constitution republic. This is why the Democrats get flat-footed and outmatched every time, because the Republicans are willing to go to any length, extreme lengths, criminal lengths, to accomplish their goals. And the Democrats sit and wring their hands and go, oh, it'll look bad if he gives the pardon.
Starting point is 00:16:09 Not the pardon, that'll give license to Donald Trump to do his 2,000 pardons. Really? You don't think Donald Trump was doing the 2,000 pardons anyway? Oh, don't do the pardon for Hunter, you said you wouldn't. Haven't things changed since then? Haven't we seen the cabinet picks that Donald Trump is making? If not, go on the
Starting point is 00:16:28 Midas Touch Network and legal AF the YouTube channel. Look at our hot takes. Look at the Attorney General selections. Look at the FBI selection. Donald Trump is going to destroy the independence of the Department of Justice and the FBI that's been in place for over 50 years. He's going to collapse it into one unitary president because that's what the Federalist Society wants and that's what the Supreme Court wanted and that's how they ruled in favor of Donald Trump on the immunity decision. Wake up. They are sharpening their knives to go after Democrats, the media, enemies of the people,
Starting point is 00:17:03 judges and prosecutors. Of course Joe Biden's a step in. If he didn't, we'd be wringing our hands about that. Oh, why didn't Joe protect everybody? Why didn't he pardon Michael Cohen, which he should, by the way? Why didn't he pardon Hunter Biden? Well, that's cruel. If only we were more like the Republicans.
Starting point is 00:17:22 Well, now we're more like the Republicans using what we have at our disposal. And I'll take the criticism from Judge Scarcy. Let him go back to wrap it up. I don't know what he's got left on the clock for his federal judgeship before he goes to senior status. Wrap it up, Scarcy. You should be focusing on intellectual property cases and civil cases more than criminal cases. You've been a rock in the shoe of democracy for a long time
