This is Michael Popak, Legal AF.
The irony is not lost on me and shouldn't be on you
that Donald Trump's lawyers are using the excuse
of a hurricane to delay having to file more papers
in their DC election interference case before the election.
We just got a new filing, it's right here in my hands,
motion to continue filing deadlines using as an excuse
what happened with Hurricane Milton,
the devastation that went through those various states,
including Florida, and claiming that the Florida Council,
who by the way does very little in the way of writing
in this case, and rarely signs any brief directly,
using the Florida Council's location in Florida
to use as an excuse to delay not providing
the American people with any more
information or content about why Donald Trump is not guilty of the crimes that he's been charged
with in the DC election interference case and anything to support his argument that Judge
Cannon in the Mar-a-Lago Florida case was right about dismissing the indictment because Jack
Smith was improperly appointed and funded as a special counsel. He doesn't want the American people to see the actual legal reasoning that he
has, the actual case law that would support it, or any type of analysis, because there is none.
Because Donald Trump just wants to stand on a stage or a rally like this neo-Nazi rally in
New York and just talk about, oh, you know, the Jack Smiths is an animal and
he's inappropriately appointed and everybody believes that all the
constitutional scholars, if it's that cut-and-dry Mr. Trump, why don't you have
your lawyers file your papers on time? Why are you back again on bended knee or
whatever it is, asking Judge Chutkin to bail you out. Now look, I'm not here to suggest that John Loro
at his law firm down in Florida,
where is he these days?
John Loro and Greg Singer in Tampa,
that his office wasn't somehow knocked out by
or for a couple of days because of hurricanes.
I practiced law in Florida during hurricanes.
I know the impact on law firms.
We were once,
many, many years ago, a firm I was with was knocked offline for over a week, which led us
to do things for disaster recovery, like all the partners had satellite phones, and we made sure
our servers were put in co-location locations outside of Florida, stuff like that. So I get it
that maybe for a few days they were knocked out,
but the irony of Donald Trump trying to benefit
on the back of Hurricane Milton
after he spent a considerable amount of time
and effort and money scaring the crap out of people
and scaring Americans against FEMA's help
and claiming falsely, including at this recent rally
in New York,
that the Biden administration and FEMA didn't have money
in their budget for the hurricane response
because they were busy flying illegal aliens
on private jets and jets, that's a lie.
And I think he's, there is no low beneath
which Donald Trump will not stoop, I get that.
But when I saw this I said they need
three weeks because of Hurricane Milton and then I always know something's up because there's two
observations here. One in the footnote they say that if the court wants more information about our
hardship in Florida and our law firm and how we were knocked offline we're happy to provide it.
This is what it says, at the court's request, defense counsel will provide specific descriptions
of the nature and extent of the hardships imposed by the hurricane.
And to the extent that the court requests such detail, counsel respectfully requests
that it be permitted to do a sealed filing in light of the extraordinary press coverage
of this case and the irrelevance of counsel's personal details to the merits.
That just shows you that they got nothing. They want to seal it, which she's never going to do.
She's never going to allow the public to be denied,
whatever it is that John Lauro thinks is the rationale and reason why he had to roll up his
suit pants in order to wade into his office. He couldn't work from home since COVID.
He doesn't have a setup at home with an ability to,
or maybe Starlink for Elon Musk could have been used.
That could have flown a satellite over his offices
or his house and he could have used Starlink, why not?
So I already know that they have no good reason
and if anything an embarrassing reason,
they want to hide from the public because of the footnote.
And then they go on, the thing they miss is what is the work share relationship and workload
relationship between the lead lawyers in the DC election interference case, which are not
named John Loro and Mr. Singer, but are named Todd Blanch and Emile Beauvais, who were Donald
Trump's lawyers
in New York when they lost the 34th felony count conviction in New York, were Donald
Trump's lawyers in Mar-a-Lago and up on appeal about the Mar-a-Lago dismissal.
They sign all the papers under our rules requiring someone to sign.
I haven't seen a John Loro or Greg Singer
signed filing in this case, DC election interference case, in a long long time.
Except this one. If you go to the signature line, they have flipped the
signature blocks. These are the lines that lawyers use to sign. They have to
sign their pleadings, sign their motions. And here, this usually, this box here that I circled, is usually Blanche and Beauvais,
and Loro's on the other side. Now they flipped it because they want to make,
oh, our Florida Council's underwater. I'm surprised they didn't drop a footnote.

This is the only thing I'll give them credit for.
They didn't drop a footnote to say that the Democrats or Jews caused the hurricane, that
Joe Biden purposely denied FEMA aid to his section of Florida so he couldn't write his briefs.
I mean, they're pretty close.
They're dangerously close to making that argument.
It's sort of implicit,
but they didn't actually drop the footnote.
Believe me, if Donald Trump wasn't so busy
recreating Adolf Hitler in Madison Square Garden,
he had seen this, he would have said,
where's the footnote about the Joe Biden weaponization
of the weather pattern to try to deny John from writing?
Here's how you get a proper thing filed.
You say what went wrong, you say what your workload is.
Like, all right, the Florida firm was working
on these three briefs and the Washington firm and New York firm was working on these three briefs and the Washington firm and
New York firm was working on these two briefs and we lost a week or two. And why wait so long?
Hurricane Milton was like two and a half weeks ago. So what they're asking for in particular is
an extension. They want to push it out now until instead of November 7th, a couple of days after
the election, they want to push it out to November 21st, which on papers, it's a file bunch of things.
They want to file, they're still arguing about whether they're allowed to file a motion to
dismiss the indictment because Jack Smith's appointment and funding was unconstitutional
because Judge Cannon told him it was down in Florida. And a couple of other discovery motions in papers they have to file to clean it up.
Now, call me cynical, but maybe one of the reasons they want to push it off to November 21st
is because they're going to be busy on the 6th and the 7th trying to call the election
a fraud and drag their feet and stop the peaceful transfer of power and file lawsuits that they'll
all be involved with to try to deny Kamala Harris the presidency,
maybe they'll be busy trying to overthrow democracy again.
Is that it?
I mean, I've already heard Chris LaSavita, who's the campaign manager for Donald Trump,
say that his end date is not even the 6th of January for certification of the election.
It's the 20th of January, Inauguration Day.
They're going to keep fighting until then.
Before voting, they claim fraud.
During early voting, they're claiming fraud.
After early voting, at the day of election, fraud, fraud, fraud, fraud, fraud.
They can't identify one part of it.
Most of what you're seeing, by the way, on social media about fraud is trolling, AI-generated
trolling from either Russia, Iran, China, or MAGA, who's picked it up, like the ripped
up ballots in Pennsylvania, phony.
The burning ballots wherever, phony.
There is no outcome-determinative fraud that impacts the outcome of our elections.
Any fraud, any people misvoting, voting in the wrong place, voting when they shouldn't,
voting if they're not citizens is 0.0002%.
That's it.
That doesn't determine the outcome of an election when hundreds of millions of people vote.
Only in Donald Trump's mind.
And so when you hear voter integrity, think it's voter suppression ripping up your right
to vote.
That's all they're doing.
Right?
And so here, you know, the cynic in me says, is it that you need a couple of extra days
to do your filings because you're going to be busy running around in courts filing meritless
cases again, putting lots of lawyers licenses, law licenses at risk.
So the government didn't oppose this.
The government didn't oppose the extension of time,
but said the court should determine
if she's going to give the extension of time.
I really don't see the good grounds to extend the time.
And if I'm the judge, I wouldn't,
even though generally judges will give extensions of time,
I've been denied extensions of time in federal cases.
I've asked for five days, no, two days.
I've asked for three days, no, six hours.
Judges are imperial people.
They are federal judges.
We joke sometimes that they are infected with the black robe disease, you know, we used to we joke sometimes that they they are infected with the black robe disease
You know, and I'm not sure Chuck is gonna say yeah 21st who cares 721st. It's all the same
She might say no the quick I want to get this case moving
I don't see good grounds or good cause to do it will continue to follow it. She moves pretty quickly
By the time this goes up, we might already have a ruling on it
And I'll report I'll come back and report on it if that's the case.
So in the meantime, I'm Michael Popock reporting on Donald Trump's latest effort to try to
benefit from Hurricane Milton.
While he busily made people afraid of FEMA so they couldn't get the aid they needed,
now he needs aid, he needs assistance off the hurricane, and he's asking a federal judge
who he taxed regularly
