And by the way, I had my own classified documents case and I was totally exonerated, totally. It was a case brought by Joe Biden and Kamala. She was involved. They did that in order to interfere with the election and it still goes on different cases, but that was, according to most, the big one. And we were totally exonerated. The case was won a month ago. Very little coverage of the case being won, I must say.
Starting point is 00:01:07 I think that a lot of them. This is Michael Popak, Legal AF. You just heard a rousing and blatant set of lies Donald Trump just told at a press conference in front of what appears to be a bunch of self-selected Trump supporters about what really happened in Mar-a-Lago and the case there related to his mishandling of classified defense information. Let me set the record straight. First of all, Donald Trump is genetically incapable
Starting point is 00:01:32 of pronouncing his opponent's name right. Once and for all, it is Kamala Harris with the emphasis on come, not Kamala. That's one. Secondly, which he just does to be disrespectful of women, of people of color, of people of ethnicity, of people with exotic first names, and the like. Secondly, he was not exonerated in the Mar-a-Lago case. And the ultimate outcome of that case has to do with a certain esoteric issue as to whether
Starting point is 00:02:07 the prosecutor was legitimately appointed by the Department of Justice as an inferior officer under the Attorney General or not. Was that office properly funded to go after Donald Trump or not? No other judge in the history of America, I don't usually come out and say bold statements like that, but I will hear, including starting with the United States Supreme Court in 1974 involving Richard Nixon, has ever declared that a special prosecutor or special counsel is an invalid exercise under the Department of Justice. The Department of Justice has guidelines. Those guidelines and those requirements are set forth
Starting point is 00:02:46 in something called the Code of Federal Regulation. The Code of Federal Regulation is ultimately adopted by Congress. So Congress signs off on those rules and regulations, which establishes the office of the special counsel once appointed. It is an inferior office of the attorney general. It is therefore an appropriate exercise
Starting point is 00:03:09 under Article II of the Constitution. Every court, federal court at the appellate level or trial level, except for Donald Trump's handpicked judge, Judge Alien Cannon in Florida has found that way. US versus Nixon in 1974 established the validity of a special prosecutor or special counsel and even went as far as to enforce that special prosecutor's subpoena. Donald Trump wasn't exonerated. He just pulled on purpose. He filed on purpose in order to get Aileen Cannon, a new judge, federalist society,
Starting point is 00:03:45 beholden federalist society judge up in a backwater of Florida where I practice, up in the northern part of the Southern District in a place called Fort Pierce, where they barely have cases there that are of any type of national import, let alone against a former president. And she made in a 93 page decision we reported on on Legal AF.
Starting point is 00:04:06 She made an entirely mistaken interpretation of law to find not that Donald Trump didn't do the things in the indictment. That's an exoneration. An exoneration is if a jury or a judge had found that the prosecutors had not been put to their proof and had not properly proved beyond a reasonable doubt that Donald Trump stole national defense information, stole national defense information and took it with him to Mar-a-Lago, stole top secret classified documents and the like. No such thing happened. There's no exoneration because you got a judge, you tricked her into committing a basically reversible error
Starting point is 00:04:46 at the trial level that's gonna be reversed at the 11th circuit by her bosses sometime in the fall. That doesn't exonerate you. That just means you're able to trick a weak judge who just been on the bench for a very short time when she was assigned this case and has made a series of major errors in public view ever since.
Starting point is 00:05:06 That just means you did that. That's not exoneration. That's actually goading a judge into committing reversible error. As officers of the court, you're not supposed to do that, lawyers for Donald Trump. You should know better. You're not supposed to invite error
Starting point is 00:05:21 and invite reversible error. That's exactly what you did with your motion practice towards Judge Aileen Cannon. That is not any kind of exoneration I've ever heard of. Exoneration for those that were clapping mindlessly for Donald Trump, because they like the fact that he's mean again, and he's going after Kamala Harris, pronounced properly, and making fun of her race and identity and personal attributes and the like.
Starting point is 00:07:00 They like that. They'll take whatever he's selling. For them, it's like they ring a bell and they start to salivate. It's Pavlov's dogs all over again. And here you have Donald Trump lying again to the American people on the eve of the National Convention for the Democrats, saying that he was somehow exonerated by anybody. That should be a warning and a lesson to the Supreme Court. Because now Donald Trump gets to walk around and says, I was exonerated. First of all, immunity doesn't exonerate you
Starting point is 00:07:32 for the other crimes. It just says you committed the crimes, but you have immunity because six out of the nine on the Supreme Court, most of which you appointed, said you did. That doesn't mean you're exonerated. That means you got immunity at the last minute. In other words, you're in the, what's the word for that?
Starting point is 00:07:49 The electric chair, but the governor calls the last minute and commutes your sentence or gives you a pardon. So once and for all, the takeaway on this hot take has to be that Donald Trump was not exonerated in Mar-a-Lago. We're gonna see the outcome when the 11th Circuit finally gets the case fully briefed by Jack Smith, the special counsel, and makes that decision.
Starting point is 00:08:11 Current judges that are handling cases involving Donald Trump don't believe that alien canon did the right thing, right? Judge Chutkin in the District of Columbia is moving forward with her cases, even though it's the same special prosecutor, special counsel prosecuting the cases. And in fact, Donald Trump hasn't even filed there to argue the same BS he argued with Canning, because he knows it won't work. That issue is going to come up through the 11th Circuit and maybe to the United States Supreme Court,
Starting point is 00:08:37 and it's going to fail. And then what are we going to say? See, Donald Trump wasn't exonerated. We will know in a public trial whether the Department of Justice and Special Counsel meet its burden, meet its burden to prove beyond a reasonable doubt that Donald Trump committed espionage, willfully and criminally retained national defense information documents, and obstructed justice. That day has not yet come because Donald Trump has delayed that day and as I said, has invited error, reversible error by Judge Cannon. That is not any exoneration that I'm aware of. We'll continue to follow Donald Trump's talking out of both sides of his mouth and out of his backside at press conferences like that one.
Starting point is 00:09:20 And we just, what we don't want is a mindless clapping audience, not understanding what sits at the intersection of law and politics. That's why we invented legal AF.
