Starting point is 00:03:00 Letitia James racist slurs like jigaboo and having his proxies recently call her a fat ass that belongs in jail. Now he needs something from her. He wants, no, he's demanding that she immediately dismiss, vacate, walk away from a $450 million civil fraud judgment that she obtained after proving under oath with sworn testimony and a mountain of evidence that filled a courtroom, she proved to a New York State Supreme Court judge that Donald Trump had been operating a fraudulent,
Starting point is 00:03:30 persistently fraudulent business called the Trump Organization for the last 10 years along with his family. But in their writing, in their demand on the letterhead of John Sauer, soon to be your and my Solicitor General of the United States, the temp Supreme Court Justice, because of George Washington's farewell address and Abraham Lincoln's Thanksgiving Day proclamation, for the good of the country and for healing to begin, the people of the state of New York should walk away
Starting point is 00:04:03 from a $450 million judgment that's up on appeal. Do you hear that sound? That's the sound of Letitia James' response. I'm going to cover it all. You're on the Midas Touch Network. I'm Michael Popak. I sit at the intersection of law and politics on a show called Legal AF, on a YouTube channel called Legal AF, and I'm here for it.
Starting point is 00:04:23 And so are you, and I appreciate it. Let's dive right into it. We got a letter from John Sauer. I'm gonna read to you from parts of it. He was the private criminal lawyer for Donald Trump, reasonably successful appellate advocate, got a couple of those key Supreme Court decisions to go in Donald Trump's way.
Starting point is 00:04:40 Now he's their appellate lawyer, du jour, and he's demanding, not because there was anything, and he's demanding not because there was anything wrong with the evidence, not because there's anything wrong with the liability, because he, a lawyer who doesn't practice in New York, is telling the attorney general of New York and a judge who is sworn in in New York that they don't understand New York law. I'll tell you who doesn't understand New York law, John Sauer. I've been practicing New York law for 34 years. I know the persistent fraud statute that's on the books to allow attorney generals like Latisha James
Starting point is 00:05:11 to shut down fraud shops. And that's what she did, right? Under 63-12 of the executive law, which she's allowed to do, but not to the lawyers around Donald Trump who don't understand that statute and still don't. Let me read to you, you're gonna have to sit down for this one. Let me read to you from the George Washington
Starting point is 00:05:32 and Abraham Lincoln moments in this. People love comparing Donald Trump to those things. So here we go, let me just read to you from the relevant portions. This is on John Sowers' letterhead, or actually, he doesn't even actually have his own law firm. He's working at a place called the James Otis Law Group. That's a MAGA law firm out in St. Louis, Missouri, where he's on the letterhead.
Starting point is 00:05:56 Dear Attorney General James, in furtherance of our conversation with your office, we write to request that you completely dismiss the case against President Donald J. Trump, his family and businesses, and stipulate to vacate the judgment against his family. In the aftermath of his historic election victory, President Trump has called for our nation's partisan strife to end. The partisan strife that he's been causing. And for contending factions to join forces for the greater good of the country. Alright, let's stop right there. What does this have to do with Donald Trump's fraud conduct
Starting point is 00:06:30 before he was even president? But of course, he's got to also remind Letitia James that he will one day be the Solicitor General. He said, this case, like so many others against President Trump, is a flashpoint of our national partisan division. As counsel for President Trump on this appeal, and now his nominee for Solicitor General of the United States, I've had the opportunity to
Starting point is 00:06:50 experience this partisan division personally, and I strongly believe that it's necessary for the health of our republic for the strife and lawfare to end. So which are you, John? Are you the Solicitor General? Are you the people's Solicitor? Or are you Donald Trump's private lawyer? He seems to be all bottled up and tangled up in conflict and ethical conflict, don't you believe? So they then go on, he then does a summary of all the other Jack Smith cases that have now been dismissed.
Starting point is 00:07:17 He then does a cursory pass through the law and he's got it completely wrong. This case is already up on appeal on the amount of the judgment of $450 million. The first department appellate division in New York where I practice is going to cut down that $450 million. I could tell from the oral argument that I listened to about four or five months ago, they're going to probably lower it into the $200 million range, but it's still going to be $200 million and there's still going to be findings of fraud against Donald Trump and his businesses. And they've kept in place, despite multiple attempts, they've the appellate court has kept in place the monitor, the court appointed monitor, a former
Starting point is 00:08:04 federal judge who's been watching all of Trump Organization for the last two and a half years and all the money flows, that's still in place and other court-ordered officers remain in place. So he then goes on, this is my favorite part, after he gets all of the testimony wrong and all of the, this is a victimless crime. It's not. Just to remind people what happened here, Donald Trump lied about his personal financial statement. He boosted the number, he cooked the books. He then had his people take those inflated numbers
Starting point is 00:10:30 and go borrow more money than he was entitled to because he didn't have enough collateral, so to speak, enough value of his collateral. He was able to get better terms, better interest rates. He was able to do it without having to sign a personal guarantee, and he got properties insured based on these false statements. That's the case. There's no other way around it. And the value, the delta between what the true value of the property was and what
Starting point is 00:10:54 he claimed it was, the inflated number, the two, three or four times inflated to make himself a three or four billionaire, that is the damage amount. That's the discouragement amount. That's the amount that has to be removed from the equation and. That's the discouragement amount. That's the amount that has to be removed from the equation and turned over to the people of the state of New York, including all of the beneficial bank loans that he got and the deltas related to that. That's the case. John Sauer didn't try the case at all. It was tried by Chris Kis and Alina Habba. And now John S Sowers trying to come in here, of course, as the appellate lawyer, trying to change the history of what happened. But then they go on to say, here's my favorite part, after quoting the Supremacy Clause, in his farewell address,
Starting point is 00:11:36 President George Washington warned, this is on page four, President George Washington warned against the alternate domination of one faction over another sharpened by the spirit of revenge natural to party dissension, which in different ages and countries have perpetrated the most horrid enormities. I mean, the only spirit of revenge that we've ever heard about during the election cycle was coming out of the mouth of Donald Trump and everybody around him, including those that he swept into power. He then quotes John F. Kennedy, I guess he figured he'd throw a Democrat in there, as a modern statesman, an icon of the Democratic Party, John F. Kennedy stated, the time has come for intellectuals and politicians alike to put aside those horrible
Starting point is 00:12:21 weapons of modern, internecine warfare, the barbed thrust, the acid pen, and the most sinister of all, the rhetorical blast. Let us not emphasize all on which we differ, but all we have in common. I'm sorry, this is John F. Kennedy saying that if you are found to be a fraudster and owe the people $450 million, we should put down our acid pen and rhetorical blast. I think the judgment, John, goes well beyond a rhetorical blast. And then, of course, he's got to throw in Abraham Lincoln. I don't know why exactly, maybe because Letitia James is black and we're coming up on Thanksgiving.
Starting point is 00:12:57 So this is the one that established Thanksgiving as the holiday. I never thought I'd see this in a legal document, but here we are. President Lincoln called for the American people to set aside their bitter division so that the blessings of liberty could be solemnly reverently and gratefully acknowledged as with one heart and one voice by the whole American people. He said he wanted to restore it as soon as may be consistent with the divine purposes to the fulfillment of peace, harmony, and tranquility and union. Invoking the same spirit of unity, we request that you stipulate to the vacueter of the judgment and dismissal of this case with prejudice." Let me put this in perspective as a practicing lawyer, as somebody
Starting point is 00:13:42 who has judged moot court competitions, as somebody who has sat in on moot trials, somebody who's tried over 30 cases. If John Sauer turned that into me as his legal memo in a legal writing class, I would fail him. I mean, for him to make the rhetorical leap, tethered to nothing, of the calls for unity in John F. Kennedy Jr.'s speech at Harvard, the proclamation establishing Thanksgiving, and George Washington's farewell address as a justification for why a court-ordered, adjudged $450 million civil fraud judgment should be walked away from and vacated, I would fail him in my class. But that's where we're at. It's just, you know, I'm sure that Donald Trump took giddy delight in taking all of
Starting point is 00:14:36 his criminal defense lawyers like John Sauer and giving them these highfalutin people's lawyer titles like in the Department of Justice, Todd Blanch being the Deputy Attorney General, a criminal defense lawyer for Donald Trump, his assistant, a criminal defense lawyer for Donald Trump, John Sauer, a criminal defense lawyer for Donald Trump, now the Solicitor General, the White House counsel. All the lawyers are coming out of the... this isn't doing the people's business. This is a private law firm, criminal defense firm for Donald Trump that just got kicked upstairs to be the people's lawyers.
Starting point is 00:15:14 And you can see the conflict of interest they already have. If I were John Sauer, a member of whatever Bari is a member of, I couldn't even bring myself to write that letter. It's so wrapped up and suffused with ethical conflict and dilemmas. Well, need I remind you that I'm going to be the Solicitor General? Well, that's not the Attorney General of New York's boss. That's the advocate for the position of the United States of America before the United States Supreme Court. Look, Letitia James, then they know it, is going to be serving a valuable
Starting point is 00:15:45 role for democracy because she, along with about five or eight other attorney generals around the country from blue states, are going to be frequently litigants against Donald Trump and his wacko policies and executive orders starting on day one. You think the six or seven hundred lawsuits that were filed in the first Trump term was a lot, you're going to see a thousand now. And they're going to see Letitia James again. So I guess they figured, well, it's just the cost of the ink and the paper. Let's send a letter to her, right? When we're not calling her fat ass. let me just run this clip from just two weeks ago. It was right before the election where Mike Davis, who was rumored to be a potential pick
Starting point is 00:16:33 for attorney general or solicitor general or one day on the United States Supreme Court for Donald Trump, had this to say in an interview about this same Letitia James that they just wrote a letter to on behalf of Donald Trump. Let's run the clip. Let me just say this to Big Tish James, the New York Attorney General. I dare you, I dare you to try to continue your lawfare against President Trump in his second term, because listen here sweetheart, we're not messing around this time, and we will put your fat ass in prison for conspiracy against rights, and I promise you that. So think long and hard before you wanna violate
Starting point is 00:17:12 President Trump's constitutional rights or any other Americans constitutional rights. It's not gonna happen again. We've been warning people on the show, Mike, this isn't the same Trump administration. Stop messing around, don't rig elections, don't illegally vote. Don't try the funny business because we know the team this time and they are not effing around. Now, does that sound like let's unify and unite and let's have a bomb that solves and is a salve and our great national wound and dismiss the judgment
Starting point is 00:17:46 but or does that sound like a vindictive group of grim reapers who want to bring retribution against those that they just vanquished? Is that what you be the judge.
