Michael Popak, Legal AF, the Unholy Alliance of the Heritage Foundation, and Donald Trump are at it again. They're going to try to use the court system with filing a number of lawsuits just like they did to interfere with the peaceful transfer of power. This time, they're going to try to stop Kamala Harris for being on the ballot in all 50 states and for her using the $91.5 million available to her as a war chest in the transfer of funds from the Biden Harris campaign to the Harris campaign, which she's allowed to do. And how is Donald Trump going to do that? Let's expose it here on this hot take.

First of all, the Heritage Foundation months ago prepared an emergency memo, which Donald Trump and MAGA are using as their playbook in case Joe Biden stepped down before the November election. They titled it emergency. They plan to go after certain battleground states, including Wisconsin and Nevada, who had very difficult ballot rules to argue that if he stepped down, if Joe Biden stepped down, he would be forced to stay on the ballot. In other words, there'd be somebody on the ballot that did not want to be president any longer, or they would argue that there was no person on the ballot, no Democrat against the Republican challenger, Donald Trump, in those particular states. In other words, their effort would try to take the four or five battleground states using arcane state law

to deny the Democrats having a representative on the ballot at all. That's their goal. They want to make this 50 states for Donald Trump against 45 states for the Democratic candidate, who is now Kamala Harris, the Vice President. This has been their plan all along. Just as Project 2025 is the blueprint for Donald Trump's first 180 days, Heritage Foundation and its lawyers and its executive director and its general counsel have been advising lawyers from MAGA about how to challenge Kamala Harris substituting for Joe Biden on the ballot.

Now remember, she's already on the ballot as a vice president. The only switch is she's going to go to the top of the ticket in those particular states. Donald Trump's approach is two-pronged, led by the Heritage Foundation memo and strategy. One, file lawsuits and flood the court system with lawsuits. Does this sound familiar? This sounds a lot like what John Eastman and Ken Chesborough and others came up with to cling to power off the 2020 election. File 70 lawsuits, seven zero in various states, you eventually lose all of them,

but it ties up the process and mucks it up. But we're only about a hundred days or so away from the election. And this is not going to work because the chances of them either being right about the laws of the individual states is low, that they're gonna get a federal judge or state judge to deny Kamala Harris being on the ballot is even lower and it won't happen before the actual election.

But they will use it as campaign fodder to try to cast Kamala Harris as being illegitimate, to already cast dispersions against her future presidency and try to undermine it. This is their strategy to try to delegitimize and go after the Democrats before the even election, calling the election unfair and rife with fraud before it's even been run. As part of the strategy, besides the multiple lawsuits that they're preparing to file within the various battleground states, including Nevada and Wisconsin and other places that have some arcane ballot election law rules. They also had the Trump campaign file with the Federal Election Commission, an FEC administrative complaint against the fact that Joe Biden filed papers a few days ago to transfer the Biden-Harris campaign fund chest from Biden to Harris for president

and the $91.5 million that was in there. In other words, giving her the war chest that they together, collectively, Biden and Harris had accumulated. Of course, under the FEC rules, the fact that Kamala Harris's name has always been on those accounts and people are always submitting money on behalf of two people, Biden and Harris, means that there's not going to be a finding of a federal election commission or an FEC violation, an election law violation. It's totally appropriate in the case of a candidate who decides not to run to transfer the money that's been collected from delegates

for a person who's also on the account in Kamala Harris over to Kamala Harris for president. And it's going to take a while for the FEC to make their ruling. And through a doctrine that's called administrative exhaustion, where you have to exhaust your administrative remedies before you go to court, they're going gonna have to wait the Trump campaign 120 days to see if the FEC even moves on this issue before they can file in federal court and argue that the FEC is moving too slow. Now they can try to file improvidently with a court,

try to get some sort of DC circuit court, good luck with that, federal circuit court where they've lost time and time again to rule in their favor and force the FEC to make their ruling. But the chances of that happening between now and the election are approaching zero. Let me make a solid prediction here on this particular hot take. I don't care how many lawsuits that the Republicans led by the Heritage Foundation emergency memo file in battleground

states, they're going to lose at the federal or state level and Kamala Harris is going to be on the ballot. The only state that was potentially in jeopardy was Ohio because its nominating ballot requirement was before the Democratic National Committee convention to confirm now Kamala Harris as the leader of the Democratic Party and as the presidential candidate. There was about a 10-day gap, but Mike DeWine of Ohio, ironically also the home state of J.D. Vance, is promulgating some legislation quickly that will align Ohio with the appropriate date for the Republican confirming convention, which is going to be done virtually anyway. She's going to

get confirmed between delegates and superdelegates. She has more than enough obviously to be the candidate and to get the war chest, the 91 and a half million dollars that was for Biden Harris and to be on the ballots in all 50 states, including Ohio. But we're gonna see a fusillade of lawsuits being filed, all of them dead on arrival, tying up the court system, using the court system, weaponizing the court system, or to turn a phrase that MAGA uses using the law as lawfare in order to try to convince some segment of the American

voting public that Kamala Harris and her candidacy is illegitimate, that she doesn't belong on the ballot. So when they lose in November, they can do what they did on Jan 6th in 2021 and try to cling to power and argue that she is an illegitimate president who came from an illegitimate president who shouldn't have been on the ballots and disenfranchise people. Listen to Donald Trump talking about people in the Democratic Party, the 14 million that voted for Joe Biden being disenfranchised. Suddenly, the savior of disenfranchisement, the savior of making sure that people have the right to vote and their vote is respected. Donald Trump, right? That's like an arsonist becoming the captain of the fire department,

right? Or the fire marshal. And so forget all of that noise. Forget all of these arguments that make no sense and are gaslighting that Donald Trump wants to make sure that your vote is being respected. Joe Biden made his own decision, I'm sure influenced by outside outside advisors, that he would not stand for reelection. Harris, Kamala Harris, vice president, was the natural successor, both constitutionally and from a political standpoint. And she's gonna get the money, she's gonna get on the ballot, she's gonna get the votes,

and all these lawsuits are just gonna waste millions and millions of dollars of Donald Trump's own money and of the Democratic Party's money in defending it and making sure that she stays on the ballot. And woe be any federal judge, like one of these MAGA federal judges who who tries to take her off the ballot, because then we're going to have emergency appeals and expedited appeals that may go all the way up to the United States Supreme Court, who should, based on prior precedent, which they usually

ignore, say that these are political questions, and these people like Kamala Harris have to be on the ballot for the American people to decide, and it's not for the courts to decide who should be on the ballot. I mean, they just did that for Donald Trump, allowing him to be on the ballot, both as an insurrectionist and finding that he had basically immunity and won't be putting himself through a criminal trial again

from now until November. What's good for the goose is good for the gander. Time for them to rule appropriately if need be, if it even gets up to them before November that Kamala Harris belongs on the ballot. There's going to be lawsuits led by the Heritage Foundation and MAGA. They're going to lose. There's going to be attempts to deny her the $91 million. They are going to lose, nor will they be reached by election day. We'll continue to cover it all just like this and analyze it and break it down for you on the
