Locked On ACC - Daily College Football & Basketball Podcast - Can FSU Make The Most Of Their Amended Complaint? How Many ACC Players Will Be 1st Round NFL Picks?
Episode Date: April 25, 2024Florida State was offered a do-over in their lawsuit against the ACC in Florida. Judge Cooper ordered FSU to amend their complaint, giving them a major opportunity to revise or even expand their argum...ents in their quest to break away from the ACC’s Grant of Rights. Will FSU add points from Clemson’s complaint in their new filing? They will have to submit their amended complaint in Leon County early next week. Or, could the ACC benefit from the case in Florida slowing down. If they get a favorable ruling in North Carolina first, it could force the Florida judge to fall in line. Hosts Alex Donno and Kenton Gibbs discuss FSU’s opportunity. The guys examine the NFL Draft and discuss how many ACC players will be taken in the first round. UNC quarterback Drake Maye, FSU edge rusher Jared Verse, Duke OL Graham Barton and Clemson DB Nate Wiggins. Should Maye be ranked ahead of most of the other first round quarterbacks? So, Kenton, we covered earlier this week, Florida State's latest day in court against the ACC.
That was in Leon County, Florida on Monday, and how the judge ordered Florida State
to amend their complaint, that he didn't like the language in Florida State's complaint.
So in at least temporarily granting the ACC's motion to dismiss, but ordering that complaint to be amended,
like you could have initially interpreted that as a win for the ACC, a small win.
But, you know, the more, the more I think about it and the more that's being written about it by legal experts,
you have to wonder if that could end up being a win for Florida State,
that they have the opportunity to refile that complaint.
Let me read you an ex post here from Rohan Law, who is an attorney.
He's not specifically involved in this case, but he's been covering it as a spectator.
He writes, with the day to digest the proceedings, one thing to keep in mind is that the
FSU legal team has an amazing opportunity now, because they are filing a second amended
complaint.
They're now free to add and include the language from the Clemson complaint, which was filed
after Florida states alleging the unilateral right to leave the conference without regard to the
grant of rights. By starting from scratch, Florida State can now look back over the Clemson
complaint and pull any details they want that include their new Leon County filing. Additionally,
if they have had any other thought since the start of this litigation, they can now reshape their
entire strategy and get what we call in law school a second bite at the apple. In all adversity,
you have to seek the opportunity that is presented as well.
And Kent, it did feel like the Honorable Judge Cooper that he's at the home venue there in Florida,
that he wants to give Florida State every opportunity to put their best foot forward here.
Yeah, anybody who's looking at this is a complete loss or complete win for one side or other,
it reminds me of the phrase, absolutes are for two groups of people, babies and idiots.
This situation leaves a lot of room.
And we talked about this yesterday, but we need to reset it again because I can see from our comments, a lot of people felt like we were saying, oh, the ACC1, it's over now.
No, that's not what we were saying here.
What we, what you and I both agree on in this thing is that this is a hell of an opportunity for Florida State.
This is a massive opportunity for Florida State for the reason that they now like, like Rohan Law said, they're getting a second bite to apple, but not just a second bite.
a second bite after seeing, the first bite was incorrect, right?
Like you're not just getting a, hey, take another shot in the dark at this thing.
They're saying, we've given you the study guide, figure out a way to pass the test.
That's what we're seeing here.
So this is absolutely an opportunity for Florida State, even though this battle was technically
a win for the ACC.
So there is some ground to be gained and lost on both sides here.
What I will say is worrisome about this from the Florida state side a little bit is this.
I hear a lot of people saying, well, the South Carolina filing, the Clemson filing, well, the Clemson filing, how do you know that the judge who sees this case and is hearing this is going to say that that language is sufficient?
I would much rather go based on, okay, what parts were we told were not sufficient and worked from that point than to say, well, we're going to introduce entirely new.
language that was not around the first time that may not be sensical to this judge that may be
cynical to South Carolina's judges, which, by the way, it's been very quiet in South Carolina.
Like, you and I have both been searching for information about those cases, and it seems like
there's complete radio silence there. So I'm not sure if copying Clemson is the route to go,
but this is absolutely an opportunity for Florida State to regather its bearings and figure out
a winning strategy,
you know.
I look over,
the Clemson complaint
was so bold.
I almost wonder if it's too bold
because like their interpretation
of the grant of rights was
the second we leave,
it's not valid.
Like it's valid because we're in the conference,
but the second the makeup of the conference changes,
we have no fiduciary duty to the ACC
basically means you don't have to pay
for your own media rights.
And, you know,
there's some mumbo job.
jumbo in there about how it's really only based on the 8 ESPN agreement, which is like
their right to broadcast past games, but it doesn't have anything to do with present and future
games.
So I, again, you can interpret the same agreement probably 50 different ways.
And that's why, you know, that's why appeals are such a popular thing in this country.
And that's why judges can look at the same information and interpret it differently.
but it does seem like a bold claim that you can basically invalidate the grant of rights by saying,
well, it only applies while we're in the conference, not while we're out of it.
Yeah, and that's, I'm going to tell you this, if that's the loophole that gets them out of this,
I need everybody's lawyers to admit that they're not smart.
I need everybody's lawyers to get together, come to the front of room and say,
hey, guys, we are not smart.
Because we, although none of us have been able to see the grant of rights,
All of us have assumed that it's fairly ironclad.
Why?
Because nobody could get out.
And if the out is, oh, these contracts don't talk about the future at all.
This is literally just past them.
This is them saying that they got the rights to show our old games.
I need all the lawyers to step to the front of room.
Every lawyer that was involved, step to the front, come on in the room and say, hey, law school is easier than you think.
Never give up on your dreams, kids.
because we get paid a lot of money to kind of sit around and play patty cake because we
obviously did not read the documents as they were given to us because we missed a huge loophole
because that's not a tiny little thing there to say like, oh, this contract doesn't concern
itself with the future at all.
That's a massive point.
That's a massive point.
So I'm interested to see how that shakes out.
And again, it seems like we're getting radio silence out of South Carolina.
So I'm excited for when that picks up.
and when we start getting updates on how those legal battles go.
Because, again, these are things that while we want to talk about what's happening
on the basketball court and on the football field,
the reality is these cases are going to have a lot to do with that.
These cases are going to have very, very strong implications for whether or not
this conference exists as it has been, for whether or not there's a restructuring of
the playoff deal to where it seems to be a power three deal where it's like,
well, Big 12 is little brother, but at least they're in the power three.
The ACC, y'all are kind of group of five-ish.
You're not quite there, but you're not quite powerful.
So I'm very interested to see what happened to.
Now here, and somebody pointed this out, actually, in the comments to Rohan Law,
and I was thinking about this as well.
Like overall, I think the opportunity to amend their complaint again,
I think that's definitely an advantage for Florida State.
the only potential disadvantage, though, could come from the idea that with all this extra time that's going to go into an amended complaint and then a new court date that is yet to be determined, is this going to now allow the lawsuit in North Carolina?
Because remember, there are parallel suits happening here.
ACCC is suing Florida State in North Carolina.
Florida State is suing the ACC in Florida.
And if one of those courts, Kenton, reaches a ruling before the other one, then that's going to provide a.
pretty powerful precedent for the other court to potentially abide by. So if things get bogged down in
Florida and things may be moved faster in North Carolina and they reach a ruling that, let's say,
favors the ACC over Florida State, then Florida State could get hurt by this delay in Florida.
Yeah, and let me say this. I am, as much as we've heard all the updates on the little things and
every little moment in the Florida case, it feels like the North Carolina case is functioning a lot more like
an actual lawsuit than the Florida case. The Florida case felt a little bit like reality TV,
felt a little WWE-ish, if you get what I'm saying. Like it felt very, we're going to get you,
brother, as opposed to like an actual legal proceeding. The one in North Carolina feels a lot more
like that. So I doubt that there's going to be a very quick decision, but this absolutely does
put that North Carolina case if they are to move on similar timelines in a situation where that's likely
going to end first. Well, tonight.
is draft night. And if we rewind to last year, the ACC had four players drafted in the first round.
I think history is going to repeat itself tonight. Who are these four players going to be?
Should anyone else be sneaking in? Because there are definitely some other players in the Atlantic
Coast Conference that are like right on the borderline of potentially being first round picks.
Where are they going to end up? You want to keep it locked right here. We're going to talk some
draft night when we come back on this brand new episode of Locked on ACC.
But first, my friends, we've all been in this position before.

So, Kenton, this is a quarterback heavy draft.
Now, I know you, but yeah, because you and I have your opinions on.
And listen, these days, every draft is a quarterback heavy draft because teams just get so enamored.
Most quarterbacks don't pan out as quote unquote franchise guys.
So everyone wants to go all in to find their franchise quarterback the following year.
We've even had sometimes teams will back to back years use the first overall pick on a quarterback.
Arizona did it a while back.
Now, you can definitely argue that Drake May should be considered one of the top two quarterbacks in this draft.
Some might say maybe even number one.
And you could definitely see him if he doesn't land in Chicago with the first overall pick,
which is probably going to be Caleb Williams, despite, you know, him being kind of a weird, different guy.
He'll probably end up being the first overall pick.
I could definitely see Drake May from North Carolina and for good reason probably be in the number
two overall pick tonight.
I mean this
with everything in my heart. And
you know that I mean this, Donald, because
being nice to Tar Hills is not my strong suit.
Okay. Those of you who don't
know, I've been dealing with some eye struggles lately
and it got so bad the other day
I had to drop something off to an office in Durham.
I couldn't drive. Somebody else had to drive me.
And the first thing I saw
when I looked up was literally their little dirty
foot emblem on somebody's car. It was like
the foot with the dark blue part
in the middle of it was gross.
and that was one of the first things I saw.
So I hope y'all know I'm not saying this likely.
This is the quarterback tier as I see it.
There is Caleb Williams in that top tier.
There is Drake May slightly above him.
And then there's a massive gap below.
He's slightly below.
I think he's slightly below Caleb Williams.
And then there's a massive gap before you get to the third quarterback,
whoever your third quarterback is.
I am telling you all, and I've taken my lashes or locked on ACC in the past for criticizing ACC quarterbacks.
Did I not warn y'all about Kenny Pickett?
Y'all called me everything but a child of God.
And lo and behold, he's no longer on the Steelers, just saying.
Now, I am telling you right now, I don't understand what the fear about Drake May is.
It might just be that there have been some North Carolina quarterbacks in the last day.
decade who have not panned out.
Sure, but there have been Ohio State quarterbacks who haven't panned out.
And look at C.J. Strong.
It's, to me, it is, it is tomfoolery to even consider taking another one of those
quarterbacks over Drake May, unless you have the number one pick.
Because then I get the argument for Caleb over Drake.
I get it.
I understand it.
I would take, I would take Caleb over drink.
But if I am quarterback hungry, if I am a quarterback away,
I'm taking Drake May.
There's not a thought in my mind because the things that you say,
well, he needs to clean up and he needs to get better at,
he'll do it with time.
He can do those things with time.
He doesn't have issues that go beyond like little mechanical concerns.
You can clean up little mechanical in the NFL.
You can't clean up a history of three knee surgeries.
You can't clean up.
You couldn't ball against Maryland's defense.
You can't clean up.
You're basically 24 already and you take way too many big hits.
You can't clean up.
He is one of the most efficient quarterbacks.
Or I'm sorry, he's the second most efficient quarterback in this draft
when throwing to his second or deeper read.
Do you know what that means, Donald?
Yeah.
That means, you know, yeah.
When the play goes, right, the quarterback has his first read.
The first read is the primary read of the play.
It is, if you see this, this is the guy to go to right away.
The next read is.
okay, if that's covered, now you've got to figure something out because maybe you're throwing
into a look that y'all don't like, but you got to figure it out. The ball's already snuck. The ball is
already in your hands. You're running, you know, deep scenes against cover four. Now you've got to
figure out what that situation is. And he is better at that than every other quarterback in
this draft except Caleb Williams. I'm so glad you brought that up. Yeah. And I'm so glad. And, like,
and because they are both in that rarefied air.
And I know people have their doubts about Caleb Williams being a little bit of a gunslinger at times.
But also remember, USC was not very good last year.
They were playing from behind.
He had to take a lot of chances that you don't always have to take depending on the talent around you.
And I was listening to Brian Baldinger on Sirius XM this morning.
And he told this story about, you know, he was running or working on a football camp back when Caleb Williams was still in high school.
and he got a chance to sit in the film room with him for about an hour,
watch him work out.
And he was like, I can't believe, first of all,
couldn't believe how smart he was when it came to identifying coverages.
And that was, you know, when he was 16, 17 years old.
And then when he actually watched him throw,
Baldinger said about Williams,
this guy would probably throw better right now at 17 years old
than a lot of the quarterbacks at the NFL Combine.
And with Drake May, I don't want to give all my compliments to a guy who's not in the
ACC, but with Drake May, the physical tools are there.
And you can talk about the mechanics.
There's not much that dude has to tweak.
And he's also got that prototypical size, along with some mobility, six foot four,
230 pounds.
You know, you also respect when it comes to loyalty, like this, and maybe he doesn't need
money the way that some players do.
But, you know, May after the 2022 season had plenty of opportunities, teams were trying
to tamper and induce him to hit the transfer portal.
I'm sure there were a lot of big money offers coming in.
for what it's worth, he stayed loyal to North Carolina.
There are family ties there, which I'm sure pulled on his heartstrings.
But I do think that this day and age where sometimes you'll see players play for three or four different schools during a four or five year college career that people probably would respect the loyalty aspect about May.
I mean, I get that.
And I'm sorry to say I'm a loyalty, loyalty.
I don't care about none of that.
Do you honor the contract?
That's all I need to do.
But that loyalty part is something that some GMs will value.
You don't see it as like a high character thing,
even though it's really just that my parents have a high bank account.
I don't eat his bread right now.
It doesn't either here nor there.
I very seriously, when I look at the concerns about Drake May,
I'm left asking people,
how could you be high on Josh Allen but not high on him?
How?
That's a good point.
I genuinely, I see the same.
And I'll say this, Drake May coming out of high school,
a lot more polished than Josh Allen.
Josh Allen wasn't an accurate quarterback until his third year in the league and he was a top 10 pick.
And that is my entire point.
If there is, again, to me, to me, because I know that I'm, there's going to be that quarterback thirst that has led to, you know, not to talk, well, I guess I got to talk bad about the Tar He said I talk good about one that led to Mitch Trubiskey getting drafted that high.
There will be the quarterback thirst that led to Kenny Picky getting drafted that.
It ain't going to happen.
I know there's a, but to me, if I'm in an NFL GM and I knew that there was a team that was quarterback hungry and I, and Drake May and Kevin Williams are off the board, I'll go ahead and try it back with you.
Yeah, give me what you got for a poke shop.
Tell me what the deal you want to make is.
Let's talk.
Let's talk about it because I don't believe in anybody else.
But again, Drake May is the type of guy.
I could definitely see him leading a team for the next 10 to 12 years.
That's not something that I have concerns at all about with them.
I haven't heard anything in terms of character concerns.
I've watched the all 22.
This young man is phenomenal.
I know that a lot of people talk about the rushing stats of Marion Hampton and all that.
Watch the film and see how many loaded boxes Hampton was facing.
It was not as many.
And guess why?
Because there was a combination of a young man named Drake,
throwing to a young man named Tess that people did not want to see one-on-one.
So I'm a little, you know, it's one of those moments for me where I feel like I'm in
bizarre world again, just like I was McKinney Picker where people are saying things where I'm like,
you know, when I watch Sam Howl Slide the Draft, I kind of wonder what was going on,
but I rewatch the tape and I say, okay, it makes sense.
He doesn't have the measurables.
He's kind of, you know, it's kind of herky jerky in terms of release and all that.
It makes sense.
When I watch Drake May play, I said that's an NFL quarterback.
even in his losses, that's in NFL quarterback.
Even when he plays poorly, I'm like, there are some things for him to clean up in there.
But I think his absolute floor is like a mid-level starter, like a starter that doesn't,
he doesn't move the needle to win you games, but he also doesn't lose your games in league,
which is more than I can say for the floor of everybody after him in terms of quarterbacks.
So Drake May, I think he's going to be a top five pick tonight.
Now, there are three other players out of the ACC who are projected to,
go in the first round. We'll talk about them. And should there be more than three? You want to keep it

So elsewhere in the first round, Kenton is as May,
May is going to be the first pick out of the ACC.
There's no doubt about that.
Other players projected to go in the first round.
Jared Verse, edge rusher from Florida State,
Graham Barton, offensive lineman from Duke,
Nate Wiggins, cornerback from Clemson.
Now, let me say, I am a huge Graham Barton fan.
Now, I, you know, offensive linemen don't often get talked about enough when it comes to the draft.
Yet building a successful offensive line, college or pro, one of the toughest things to do.
And somebody's going to be very happy with that Graham Barton pick.
I know that, you know, my local, the Miami Dolphins are being talked about as a potential suitor if he falls as far as number 21, which I don't know if he will.
because Kenton, the thing that separates Graham Barton from most of the other
offensive line prospects in this drafts are not only can this guy be a very high level
guard in the NFL, which is probably where he projects to be.
It can also be a high level tackle.
He can also play center for you.
That's how he started his career at Duke.
So the versatility factor, and he's not one of those jack of all trades,
master of none.
He's excellent at all of those trades, Kenton.
So you may find a few.
offensive linemen in this draft who maybe have higher upside than him.
I know Jackson Powers Johnson is a very popular guard in this draft,
but you're not going to find somebody with higher upside and versatility than Graham Barton.
No, and when you talk about Graham Barton, it's all about like the value of the skill set, right?
So like look at Joe A.
From Notre Dame.
Is he nearly as versatile as Graham?
No.
But how valuable is it to have a left tackle that you feel good about?
Like, I can leave you one-on-one with Michael Parsons.
I may not need to chip, right?
Like that's a little bit more valuable than what Graham offers in an offensive line that can slide up and down the offensive line and be really good at those spots.
And I'll tell you what, Graham Martin, to me, is so intriguing because it, he begs that question of how much do you value how good a player is against positional value?
Because I think he's a phenomenal player.
I just think teams are undervaluing how much a versatile interior offensive line.
piece is. And I'm going to tell you, if you think about all of the recent teams that have gotten
good out of nowhere, it started up front. People talk about my lions and how they've transformed.
Taylor Decker, Peney Sewell, Frank Ragnon. That's what you're looking at. Three first round
guys that made that team what they were, all on the offensive line. You look at the 49ers,
more offensive line in the first round that you could imagine, even the guys they trade for,
like a Lake and Tomlinson, was a first round.
kick out of Duke as a guard.
So it's, it's, you know, it's so interesting to me to see the teams continue to try to
build from the outside with dynamic pieces on the outside.
When it's clear, a guy like Graham Barton, to me, you have to value him highly because
if you have an offensive line that can, he combines that ability to be a role grader with
the ability to give you a lot of work in past pro as well.
I would not want him at left tackle in the league.
I think that's a little worrisome, having him do those deep.
vertical sets against some of the best pass versus in the league.
But every other position, all the other four, let's hear me out.
Hear me out.
I think we can go with him there for a little bit, you know?
So Graham is absolutely a guy that I think should be going early in the first,
but who knows, he may slide to your dog's.
And I'll tell you what, if he slides to that real back half now, Lions, talk to me.
You know, I'm there.
I know that my eyes make it look like I've been on some substances,
but I'm sober when I say this, Lions, pick him up.
And I think Jared versus another one back.
phenomenal positional value, phenomenal player.
And I think that his stock was hurt a little bit this year in terms of not seeing high-level
production, like some people thought.
But again, turn on the film.
Teams were terrified of him.
He got better as the year went on.
Because his stats were a little slow out of the jump.
But, I mean, he ended up finishing the year with nine sacks and 12.5 tackles for loss.
Exactly.
The production is one thing, but turn on the film and watch how he impacts pass blocking schemes.
Teams had to basically make their pass blocking scheme revolve around.
Where's Jared?
We got to make a check to get our double team to Jerry.
We got to get our back to wherever he is so he can chip him on the way out.
So I truly think that he is, even though his stock has fallen a little bit, I believe he'll go in the first half or the upper half.
or the upper half of the first round.
And there are a few guys that are on the cusp.
I wholeheartedly believe should be squarely in the first round.
Yeah, you also have a projected first round pick in Nate Wiggins,
the corner back from Clemson.
You can't teach speed.
And he's the fastest corner in the draft.
That's not going to hurt his stock one bit.
Oh, he's the fastest.
And to me, he's the most fluid as well.
And that combination, hey, like I said, if he falls deep enough,
how the little blue might look good on.
You know what I mean?
But very seriously, Wiggins is one of those guys that he can run extremely well,
but it's not just about running because we've seen quarterbacks in the past who they were flying,
4-3, low 4-4 guys.
But when you put them on the field and you made that translate into,
okay, yes, you can roll, but how fast can you stop?
Okay, yes, you can roll, but do you understand route concepts?
Do you understand how you're supposed to check the smash concept if you're on cover three and all that type of stuff?
Nate has that as well.
Obviously, he's a man guy.
He's a guy that you want to follow people around and say,
hey, me and you, friend, let's do the doce dough all game long.
And I think that's extremely valuable.
I think that the concerns about his tackling are slightly overblown.
I really and truly do.
Yes, he's a thinner guy.
Yes, he has missed him tackling and all that.
You show me a corner that hasn't missed the tackle,
and I'll show you a car salesman that's never sold a limit.
Like, that's just the reality of what we're looking at, okay?
It's highly unlikely to find a corner
that you're just like, hey, every time the opportunity to tackle comes up, he knocks it out of the park.
But Wiggins, I truly believe it's, he has shut down corner written all over him, honestly and truly.
He really does.
So those are four players projected to go in the first round in the ACC.
Is there anyone else who could slide in?
Because I'm looking at players who are second round, maybe early third round picks.
Keon Coleman, excellent receiver out of Florida State, who it's a pretty deep receiver class.
And so I could understand if he falls out of the first round,
it should be an early second round pick.
Braden Fiske, another defensive lineman out of Florida State,
an excellent combine.
Peyton Wilson, your guy, linebacker out of NC State,
probably going to be a second round pick.
Trey Benson, running back from Florida State could be a second round pick.
They kind of have Tess Walker from UNC just kind of right on the edge.
If he's a third round pick, someone's getting value in the third round there, Kenton, in my opinion.
Yeah, yeah.
I'm going to tell you this.
I wouldn't be surprised if the first two names you mentioned slid up.
Keanu Coleman has his traits are freakish.
And I know everybody likes to throw around the word freaking all that.
That young man is it.
High points the ball extremely well.
Doesn't have problems with concentration drops.
A lot of people talk about, well, how fast is he?
What's the top end speed?
Turn on the film.
I've got one and a half good eyes right now.
And when I watch the Florida State film,
I see him running away from guys.
I see him getting downfield in a hurry.
And I see him as a guy who is good enough
with the ball in his hands for Florida State to say,
let's make you our pump return.
That guy, I'm telling you,
you can coach up the little ends and outs of route running
and all that good stuff.
And, you know, you can expand his route tree.
I wouldn't be surprised if he slipped into the first.
Braden Fiske, he's another guy as an interior defensive tackle.
He can play the one, he can play a three.
I might not want him to play to zero if I'm running a three, four.
I think he's a little light for that.
But he can play the one or to three at a high level.
And that, to me, it adds to positional value.
But defensive tackles for whatever reason, we don't get the love and respect of the edge rush.
So I wouldn't be surprised if he stayed in the second.
And you're absolutely right about Ted Walker.
If he goes in the third or later, that young man is six three and runs a four, four, four, three.
He looks like a first round pick to me last year.
Well, now listen, I understand that he has some games where he got absolutely lit up, right?
But when people look at those games, who's checking them?
Who's checking them?
One of them was Wiggins, and even in that game, he got some of Wiggins.
Let's be clear about that.
He got some of Wiggins that game.
The other one was against Aid and White.
And as much of people like to pretend that Aiden White isn't a top corner for whatever reason,
he should be in the draft this year, in my opinion.
He's got these stats, yeah, yeah.
He's locked down everybody.
Every top receiver in the ACC that's faced Aid White has had their day in hell.
That's what he gives God.
So with all due respect, I don't understand why he would be around in the third,
but if he is around in the third, somebody's going to get themselves a heck of a receiver in the third round.
honestly and truthful. Amen to that. Well, everyone enjoy first round of the NFL draft tonight.
