Starting point is 00:00:02 I'm Daily Wire, editor-in-chief John Bickley with Georgia Howe. It's Tuesday, December 5th, and this is your Morning Wire afternoon update. University presidents from Harvard, UPenn, and MIT faced questioning today from lawmakers in Congress about their response to alleged incidents of anti-Semitism on their campuses. Harvard, Penn, and six other colleges, as well as a number of K-12 schools, are among the institutions being investigated by the Department of Education. During the hearing, lawmakers demanded that the university presidents tell them what steps have been taken to mitigate hate on campus. Here's chair of the House Republican conference, Elise Stefonic, questioning Harvard's president about protected free speech on campus. Does that speech not call for the genocide of Jews and the elimination of Israel? You testify that you understand that is the definition of intifada. Is that speech according to the code of conduct or not?
Starting point is 00:00:56 We embrace a commitment to free expression and give a wide birth to free expression, even of views that are objectionable. You and I both know that's not the case. You were aware that Harvard ranked dead last when it came to free speech. Are you not aware of that report? As I observed earlier, I reject that characterization of our campus. It's the data shows it's true. Alabama Senator Tommy Tuberville said today he's dropping his hold on hundreds of military nominations. Tuberville told reporters he will allow the promotions of three stars and below to move

The senator has been holding up nominations for months in protest of the Defense Department's policy of allowing service members to be reimbursed for travel costs used to get an abortion. Here's what the senator told a reporter with CNN. It was pretty much a draw. I mean, they didn't get what they wanted. We didn't get what we wanted. And, you know, when they, when they change the rules, it's hard to win. And so they changed the NDAA. rules, we didn't get to fight for it to leave in the Senate. And so just unfortunate, the American people didn't get a voice. A house in Arlington, Virginia suddenly exploded last night. The incident happened as police executed a search warrant on the residence due to reports of an individual
Starting point is 00:02:14 shooting off a flare gun several times. Daily Wire reporter Tim Pierce has more. Police say they responded to the Arlington neighborhood on Monday afternoon to reports of possible shots fired. Ashley Savage, the public information officer with Arlington County Police Department, said, the suspect inside the residence discharged several rounds. The house subsequently exploded. Law enforcement officials say that a preliminary investigation revealed the suspect fired off a flare gun 30 to 40 times that led police to obtaining a search warrant for the residence. After officers failed to make contact, the suspect discharged several rounds from what is believed to be a firearm inside the home. Soon after, an explosion occurred.
Starting point is 00:02:54 Officials say the suspect is presumed to be dead. The House Oversight Subcommittee on Healthcare and Financial Services is currently holding a hearing on the importance of protecting female athletics and Title IX. Several witnesses are set to testify, including former University of Kentucky swimmer Riley Gaines, as well as Sarah Partial Perry, senior legal fellow at the Heritage Foundation. Former Women's Lacrosse coach Kim Russell
Starting point is 00:03:24 and the president and CEO of the National Women's Law Center are also on the panel. A case that many say could have sweeping implications for the U.S. tax system has made its way to the nation's highest court as oral arguments began today. Daily Wire's senior editor Cabot Phillips has the details. More of the United States goes back to the early 2000s, when Charles and Kathleen Moore invested in an India-based startup. The couple invested $40,000 in exchange for 13% of the company's shares. While they did not receive any distributions, dividends, or other payments,
Starting point is 00:03:57 They learned in 2018 that they had to pay taxes on their share of the company under the Tax Cuts and Jobs Act, which became law a year earlier. The legislation required U.S. taxpayers who owned at least 10% of a foreign company to pay a one-time tax on their proportionate share of the company's earnings. The mores were assessed to have additional taxable income that was over $130,000 and owed more than $14,000 in taxes. The couple did pay the tax, but also filed a lawsuit for a refund, claiming that the mandatory repatriation tax was a violation of the 16th Amendment, because it taxes unrealized gains and not income.
Starting point is 00:04:31 A man convicted of election interference for posting memes that told voters to cast their ballot via text in 2016 will stay out of prison for the time being. A federal court halted the prison sentence for Douglas Mackey yesterday after a Brooklyn federal district court judge in October sentenced Mackey to seven months in prison,
Starting point is 00:04:50 a $15,000 fine and two years of probation. However, Judge Omar Williams of the Second Circuit Court of Appropriation, Appeals reportedly overruled the appellate court by granting a motion for bond pending appeal. Mackey was accused of a scheme to deprive individuals of their constitutional right to vote. After a Twitter account he ran under the handle, Ricky Vaughn, posted memes in the lead-up to the election. All right, those are your drive home updates this afternoon.
