But nine years after the civil wrongful death lawsuit was filed, Michael Kalucci finally sat for his deposition after missing it twice.

Starting point is 00:02:18 And now, we need to talk about how this accused killer is still weaponizing South Carolina's broken justice system to his advantage. and how Attorney General Alan Wilson can fix the mess that he made. Starting point is 00:05:48 In June 2025, we witnessed one of the most stunning and upsetting developments we've ever seen in a case that we are covering. We were set for the long overdue retrial of a man named Michael Colucci, who was accused of strangling his wife, 38-year-old Sarah Lynn Moore-Calucci to death in May 2015. But because of a Brady violation of a sled agent and prosecutorial misconduct by South Carolina Attorney General Alan Wilson's office, well, that retrial did not happen.

Starting point is 00:06:24 In fact, Judge Roger Young threw out Michael Calucci's indictment altogether. And since that day, we've been staring at the clock, wondering when Alan Wilson, now the Republican nominee for governor, will stop kissing himself in every mirror he passes and start fulfilling his obligation to make this right. On June 17, 2025, a full 10 years had passed since Sarah Lynn's death with no justice for her mother Barbara Moore or her daughter, Bishop Venters, who was a child at the time of her mother's death. And already, it had felt like Sarah Lynn's family, this podcast and our listeners, had to literally drag the South Carolina Attorney General's office to the prosecution table

Starting point is 00:07:10 to actually get this case adjudicated. I'm not kidding. When we first learned about this case in 2024, the retrial was originally set for May of that year, and we noticed, huh, the prosecutor's office only blocked a few days off for it, which excuse us for a, for a, a common, complex murder trial involving well-known defense attorney Andy Savage, a trial that had taken two weeks the first go-around in 2018, the one that ended with a hung jury? It made us wonder if the AG's office had planned to, I don't know, go through the motions of a trial just to get the case off their docket. I'm sure that they hate it when we say that about them, and I'm sure they feel like

Starting point is 00:07:55 it's unfair criticism. But, girl, please, you cannot seriously have a word to say in defense of where this case stands today in the damage you continue to do by keeping it open. Oh, and you might be asking, why would the AG's office want to throw in the towel in a murder case? Let's just say there are a lot of elements of this case that are unfortunately very familiar to us as journalists who cover the low country, aka good old boy central. but also just as women. We have a husband who denies killing his wife

Starting point is 00:08:32 and claims it was a suicide. Law enforcement, who knows the husband, believes him, despite how little sense his ever-changing story seems to make. They barely investigate. The victim's body gets cremated post-haste. The victim's family, who knows things are not adding up here, has to fight for law enforcement to do their jobs.

Starting point is 00:08:55 and, well, oh, look, when law enforcement finally does the thing they were supposed to do in the first place, the evidence leads to a grand jury indictment of the husband on murder. The husband, who appears to have ready access to power and money, hires a high-priced and influential criminal defense attorney, and every month a new page is ripped out of the calendar, crumpled up and thrown in the AG's trash, time having once again passed with nothing happening. And that's a big problem for many reasons. Let's just list them, shall we? One, this is law enforcement's fault. Out of nowhere and days before

Starting point is 00:09:37 the retrial was scheduled to begin in June 2025, Michael's defense team filed a motion to dismiss. Accusing the state of a Brady violation, meaning the state had failed to give the defense team evidence that might help Michael's case. Michael's attorney said that they had just learned through a memo from the AG's office a few days prior that critical exculpatory evidence had not been provided to them in the first trial, that it had been in possession of the state for 10 years without them knowing. That evidence? A conversation that now former sled agent David Owen allegedly had had with Sarah Lynn's mother that he apparently neither documented nor shared. with the prosecution. According to the prosecutor at the time, Megan Berksted, who now goes by

Starting point is 00:10:25 Megan Berlinson. In that conversation with Owen, Barbara Moore allegedly said that two weeks before Sarah Lynn's death, Sarah Lynn was sobbing and seemed to be at a low point, and had told her mother that if it weren't for her daughter and stepdaughter, she would hang herself in the garage. This appears to have come up during witness prep for the state. Why didn't David Owen record this interview? Why didn't he write it down? Great questions. At the would-be retrial in June 2025, he did not have answers to those great questions other than I had a lot of cases. It was truly unbelievable, and we instantly knew this was not only a problem for the Kaluchi case, but also God helped the prosecution in Elek Murdoch's case if the state Supreme Court

Starting point is 00:11:14 ended up granting him a retrial, which they did. And like clockwork, at the latest Murdoch murders retrial hearing on August 14th, Alex attorney Jim Griffin sure did mention the Kalucci case and David Owen. With regard to credibility issues of police, we are aware that Judge Roger Young dismissed a murder case. And the name of that case is State v. Michael Kalucci. and he was indicted in 2015. In June of 2025, Colucci's attorneys filed a motion to dismiss the indictment,

Starting point is 00:11:58 saying that the state withheld critical exculpatory evidence on the eve of jury selection. The motions identify David Owen, sled agent David Owen, who was the lead case agent in this case, who after this case was received sled agent, of the year award. Judge Young dismissed the Kalucci case because of withholding of exculpatory evidence. We want to know what's in Mr. Owen, Slet agent, I think he's retired now, in his HR file, was he reprimanded, was he sanctioned, what any steps taken as a result of the Kalucci matter.

Starting point is 00:12:39 But don't worry, y'all. We're not going to let Ehrlich Murdoch's retrial steal any more time away from the Kalucci case today. We'll talk more about David Owen in a future episode because, who, there's a lot there. Okay. Another reason it is a big problem that nothing has been happening with Michael Kalucci's criminal case is this. A wrongful death case was filed against him in 2017 by Sarah Lin's estate on behalf of bishop, and it is still awaiting adjudication. It's been at a virtual standstill for nine years now because of Michael's criminal case. In 2023, Michael even dropped his attorney in the civil case and went unrepresented for years. And it's a real Oroboros. You might not know that word, but you know the concept it refers to.

Starting point is 00:13:34 It's a serpent eating its own tail. In other words, a vicious cycle. In July 2019, Michael's attorney, at the time. Angus Lawton wrote a letter to the judge in the civil case, asking for him to once again amend the scheduling order. Grace, will you read this second paragraph for us? There is a criminal trial, which is related to this matter, and the result in the criminal trial could mean that the civil case does not have to go forward. Accordingly, we would like to amend the scheduling order in this civil case so that the criminal case can be tried first. We understand the

Starting point is 00:14:10 criminal trial will take place in January 2020. It sure didn't. And as y'all know, it would be another five and a half years before that day came. In the meantime, the civil case, which thus far has had eight scheduling orders issued in it, has languished awaiting the criminal case. We are now in month 14 of waiting for the AG's office to present this case to the grand jury yet again. This week, Luna Shark reporter,

Starting point is 00:14:40 Beth Braden reached out to Alan Wilson's office to ask for an update. And, well, this time they didn't even bother responding, y'all. But that is pretty much what we expected to happen. Because since when has Alan Wilson ever cared about anyone besides himself and those who can keep him in the halls of power? Ellen Wilson doesn't care about getting justice for Sarah Lynn Kalucci. He cares about winning his stupid election. And his stalling of this criminal case has only served to cause more unnecessary chaos in the civil case, meaning he is screwing up on both sides of the road here. So let's talk about where this case stands and what has happened between Michael's indictment getting quashed and today. On August 14th, Sarah Lynn's mother, Barbara Moore, filed a motion for summary judgment asking the judge to find Michael liable for Sarah Lynn's death and to grant them an expedited jury trial to determine damages.

Starting point is 00:15:52 The crux of their argument rests on Michael Kulucci's deposition and how that went down. And get ready for some bombshells, y'all. Let's start with a particular point of interest, given what's been happening in the Lunashark world for the past nine months. Turns out, accused killer Michael Kaluci did not show up at all for his October 28th, 2025 deposition. That's not even the bombshell. Accused killer Michael Kaluci also did not show up for his September 10th, 2025 deposition, meaning that was the second deposition he just didn't go to. And that's not even the bombshell. After disregarding two depositions in a case in which he has the sole defendant that has been going on since 2017, accused killer Michael Colucci got fined.

Starting point is 00:16:45 Are you ready for the bombshell? $1,283. $1,283. That's how much a South Carolina judge fined accused killer, Michael Colucci, for ditching two depositions last fall. Excuse me. What? So, hang on. Michael Colucci didn't show up to his deposition in the wrongful death case against him, and it only cost him $1,283? That would mean that his sanction for not showing up to a deposition at all was literally 0.07% of the money I was ordered to pay for a deposition that,

Starting point is 00:17:34 I was available for and a deposition that was completed eight days after the deadline. That can't possibly be right, can it? Turns out, it is right. And guess what? You actually did so much more than Michael did to show the court that you were ready and willing to be deposed. So yeah, accused killer Michael Colucci was fined less than 1% of what Judge R. Keith Kelly has ordered Mandy to pay. In a case, she is not a party in. For a deposition, she tried to make happen by following the rules and seeking emergency relief. A deposition that she sat for three full

Starting point is 00:18:18 months before Judge R. Keith Kelly's $176,500 punishment. Sorry, his discounted punishment. The punishment could have been more than $310,000 because that's how much billionaire gas station owner Greg Parker's attorneys say they spent on pursuing a contempt charge against Mandy. I'm sorry, I swear I'm not hearing this right. Michael Kalucci didn't even offer an alternative solution for his deposition. He didn't file a motion beforehand explaining his issue with the deposition time or location. He didn't have some creep on social media fixated on him and threatening to show up at his deposition. He just didn't show up.

Starting point is 00:19:03 Just because? And for that, Judge Charles J. McCutcheon sanction him only $1,283 for the total cost of scheduling the deposition and, quote, reasonable attorney fees. How does this keep getting worse? Well, it does. After a quick commercial break, we have more outrage to share, and we'll be right back. There are no witnesses, no fingerprints, and no confession to the 1992 deaths of Tommy Griffin and his sister, Connie Branham, in East Tennessee. There are, however, for alleged and uninvestigated alternate suspects, six alibi witnesses, a disgraced medical examiner, a nearly

Starting point is 00:20:01 impossible timeline, a bad search warrant, and a man named Gary Sutton sitting on death row. I'm Beth Braden, a writer and investigative journalist, and I'm going to tell you why I believe the death penalty does more harm than good in my new podcast, Time of Death. In February 1992, 28-year-old Gary Sutton, his uncle James Dellinger, and Gary's best friend, Tommy Griffin, went out drinking. The night ended with Tommy laying dead on the riverbank. Tommy's sister, Connie Branham, went looking for her missing brother the following day and was never seen alive again. Gary and James were convicted of murdering Tommy and Connie and sent to death row, where Delinger died of natural causes in 2023, and Gary Sutton awaits his

Starting point is 00:22:21 Be sure to follow Coerced, the devotion and death of Micah Francis Miller. So Michael Colucci never faced a contempt hearing after he purposely missed two depositions. He wasn't summoned to show up in a courtroom across the state to be screamed up by an angry attorney, representing an angry and out-of-control billionaire, he was simply ordered to pay a reasonable fee in a wrongful death civil lawsuit that has been going on for nine years, where he is the only defendant.

Starting point is 00:23:03 And now, I have to say this out loud again to make sure I'm not losing my mind. He was only penalized with a $1,300 fee for this. Add to all of this, I'm a journalist who has been covering Michael Kaluci's case, as well as a whole bunch of other good old boys accused of serious crimes. You know, good old boys who have benefited from our corrupt justice system in South Carolina. And to remind you, on March 27th, after filing an emergency motion with the court because a creepy man who was harassing me was threatening to show up at my deposition in the Beachby Parker case, again, where I'm not a party,

Starting point is 00:23:47 I sat ready to be deposed at a safe location down the street from where Greg Parker's attorney Mark Moore was planning on deposing me. I also offered to be deposed via Zoom that day. They refused. And for that unforgivable act of not doing exactly what Mark Moore said he wanted me to do exactly where he wanted me to do it, I was forced to appear in a series of court hearings four hours from my home. Even after I gave my deposition at the Spartanburg County Courthouse on April 8th, I paid thousands of dollars in legal fees, security costs, and travel for those court hearings. And yet, still, Judge R. Keith Kelly ordered me to pay $176,500.

Starting point is 00:24:37 And I have to say it again, in a lawsuit where I am not a party. Based on secret invoices that I was not allowed to inspect. Now, these two cases and situations are completely different. I would argue that my situation was much less defiant, as I had nothing to do with the lawsuit at stake, and I did everything I could to show the court that I was willing and ready to be deposed, while Michael Colucci did not. But this boils down to two vastly different punishments for a misdeposition, One misdeposition that could have happened if Greg Parker and his attorneys actually wanted to depose me

Starting point is 00:25:19 and not use the legal system as a weapon against me and my voice. But turns out, my voice of speaking out against the justice system cost me literally a hundred times what it costs Michael Colucci for one misdeposition. What message does this send, South Carolina? Judge R. Keith Kelly's order specifically noted that my high fee was meant to deter others from similar conduct in the future and promote respect for the law. If you watched my contempt hearing and read those filings, the vast majority of Greg Parker's complaints about my conduct were focused on my social media post critical of him and the corrupt justice system and his,

Starting point is 00:26:05 In my opinion, evil attorneys. The conduct that the court wants to deter others from is exercising their rights to free speech. Michael Colucci has a history of disrespect for the law. Not only was he charged in the strangling death of his wife, Sarah Lynn, in 2015. He was also accused of, allegedly, injuring a friend by putting him in a chokehold in 2005, vandalizing his marital home that he was evicted from in 2015. breaking into and vandalizing his stepfamily's beach home in 2018 and spray painting penises on things. And also, allegedly, he was accused of breaking his ex-girlfriend's arm in 2018.

Starting point is 00:26:51 Yet, the South Carolina justice system is not worried about sending him a message. Just the journalist who exposes men like him in the system that enables them all. Apparently, they are 100 times more concerned about me than they are Michael Colucci. And again, Michael was never accused of contempt. Michael was never forced to defend himself in a mini-trial about why he didn't show up. He never even bothered telling the court why he wasn't going to show up to his deposition that day. He was just fine less than $1,300. Which is what I'm told is how it usually works.

Starting point is 00:27:30 People miss depositions all of the time. The cost of missing that deposition should not depend on how much money the defendant who wants to depose you has, and how much he is willing to spend to ruin your life. Apparently, as I found out, billionaires have access to a much different set of rules in a whole different justice system for punishing their enemies through the court. Again, it's hard to talk about this without sounding like I'm, always trying to make everything about this. But there is way more to this than me constantly feeling like I'm being repeatedly punished for my opinions about Greg Parker and his attorneys

Starting point is 00:28:12 and the work that I did in the Murdoch case. It's only quote unquote about me because that's just the reality of what's happening right now. But it's not actually about me, is it? It's about two systems of justice, like I've always said. And it's about the judicial system, vulnerable to law fair, and it's about making the wrong people suffer. Like Mandy said, in Michael's case, from what we understand, that's a fair and normal fine, one that Mandy would have happily paid and moved on with her life after. She would have paid it on April 8th with no contest, but she was never given that option because South Carolina.

Starting point is 00:28:54 And to be clear, Michael was not found in contempt because Barbara Moore's attorneys did not waste the court's time pursuing a contempt charge. Not only would that have been a disgusting waste of money, it would have distracted from the actual issue, which is Sarah Lynn Moore-Kalucci should be alive right now. They simply wanted this jerk to sit for his deposition and answer questions about his alleged role in her death. Like most decent lawyers want when they ask someone to do a deposition, they don't want to make the process as painful and punishing as possible. It's not about retaliation, it's about getting answers, which is why they involved the court. They wanted the judge to find Michael and compel him to do the thing he's supposed to do. Of course, Michael didn't make that

Starting point is 00:29:39 easy. Before the court set its fine, Barbara Moore's attorneys filed a motion to strike, asking the court to remove Michael's pleadings thus far from the record, including his answer to the lawsuit. They argued that Michael's failure to show up at his deposition prejudiced them in the discovery process, meaning it delayed the process. That's important because the delay in Mandy's deposition did not delay the process in any way. But here Michael is eight years into the lawsuit, all along arguing that his criminal trial needs to happen first. And when that criminal trial fails to happen, because he is no longer indicted on murder and the civil case proceeds, he just doesn't show up at two notice depositions. Why? Well, let's take a look at. Let's take a look

Starting point is 00:30:27 at Michael's memo in opposition to Barbara Moore's request of the court. One, he argued that there wasn't an existing order compelling him to sit for a deposition. So how could he violate an order if there wasn't an order? Which, what is it, Officer Debbie Barbier of the backyard bathing suit patrol set at Mandy's April hearing about a subpoena? Right, right. She said it's as good as a judge's order and she is, surprise, actually cracked. Under Rule 45 in the South Carolina rules of civil procedure. This is all just to say that it's kind of an odd argument for Michael's attorney to bank. No? Of all the arguments to make to a judge about a deposition? Two, Michael argued that he couldn't come to the deposition because he had not yet secured an attorney for the civil case.

Starting point is 00:31:16 It's why he skipped the first deposition. He said he needed more time to get an attorney. And as for the second deposition he missed, well, he still didn't have an attorney. According to court records, he hired an attorney four hours after the deposition was scheduled to start, which seems like, in our opinions, a procrastination issue. But we weren't there, so we don't know for sure. We do, however, know that according to the public index, Michael did not seek relief for the court prior to the deposition like Mandy did. That seems like something you'd want to do. No? When you know you're not going to be somewhere and you have a good reason, he wasn't really facing any serious sanctions. So what the heck, right?

Starting point is 00:31:59 Three, Michael argued that because his case was dismissed without prejudice, that means he can be re-indicted at any minute. Don't threaten us with a good time, Michael. And in fact, he says in July 2025, prosecutor Joel Kozak with Alan Wilson's office told him as much, that their office intends to present the case to the grand jury again. Therefore, Michael says, this is very much an active criminal case. And therefore, he can't be deposed because he'll have to plead the fifth. And that will hurt him in both cases. Which stick a pin in that because, whew, boy.

Starting point is 00:32:34 To be clear, Michael totally has a right to plead the fifth. But it doesn't mean he has to. And also, it doesn't mean he can't be deposed. What Michael was trying to avoid was being deposed, then pleading the fifth. And then, because this is allowed in civil cases, causing the judge in the civil case to decide that he can infer guilt. Now, this is where we get really angry at Ellen Wilson. Grace, will you read the part where Michael talks about the status of his criminal case? It is the position of the undersigned that, per the language in the various scheduling orders in the case, coupled with the secretive and uncertain

Starting point is 00:33:12 status delays of Mr. Kalucci's criminal matter in the Attorney General's office, the plaintiff's attempt to force Mr. Kalucci to sit for a deposition without an attorney present, when the subject matter of said deposition would focus on allegations that Mr. Kalucci committed a serious crime, is and of itself unjust and weigh in favor of Mr. Kalucci. Likewise, the current posture of discovery in this case weighs in favor of denying this motion, as the defendant intends to pursue protective measures going forward to officially stay in this case until the motives of the South Carolina Attorney General become more clear pertaining to Mr. Kalucci's criminal matter. I give Michael Calucci and no high-fives on this, but I do approve of his use of the word secretive to describe

Starting point is 00:33:58 the status delays in his criminal case. Because too effing right, they're secretive about this. Okay, so Michael told the judge, I want you to deny this motion. And besides, I'm going to be asking you to definitely put this case on hold. With the tone, in my opinion, of someone who really seem to believe the judge would read that and be like, oh, okay, son, thank you for letting me know. You take care of yourself now. When actually, the judge said this, Grace. In lieu of any order, or in addition there too, the court shall require the party failing to act or the attorney advising him, or both, to pay the reasonable expenses, including attorney's fees caused by the failure, unless the court finds that the failure was substantially justified or that other circumstances make an award of

Starting point is 00:34:50 expenses unjust, it is uncontested that defendant did not have counsel at the time of the deposition in question. However, it is also uncontested that defendant was able to acquire counsel within a mere four hours following the listed start time of said deposition. While this court acknowledges that defendant is entitled to counsel, it also acknowledges that this failure to appear for a deposition for which the defendant was properly noticed is not substantially justified, and that the award of costs in reasonable attorney's fees would be unjust simply because a new indictment may be issued in the future. Therefore, it is ordered that the defendant is hereby sanctioned in the amount of $783, the cost of scheduling that deposition, and $500 in reasonable attorney's fees.

Starting point is 00:35:36 For a total of $1,283. This amount is to be paid to plaintiff's counsel within 30 days, of the entry of this order. In other words, you didn't do what you were supposed to do, so here's a fine that will punish you and hopefully compel you to do the thing that you are supposed to do now that you have your attorney. Michael finally sat for his deposition six months after he was sanctioned. And guess what Michael Kalucci did?

Starting point is 00:36:04 He pleaded the fifth a hundred times. Which brings us back to Barbara Moore's motion for summary judgment. Oh, wait, I almost forgot. there was Michael's motion to indefinitely delay this case even more. And this is where the vicious cycle really comes into play. Michael argued that because the plaintiff had agreed to years of delays, the plaintiff should be open to more delays. Snakehead, snake tail.

Starting point is 00:36:34 Prior to 2025, he argued that those delays were necessary while he was awaiting a criminal trial. Now he's arguing that those delays are necessary. necessary while he's not awaiting a criminal trial. Snakehead, snake tail. Grace, will you read the part in Michael's motion about the Attorney General? Moreover, the criminal matter is not merely a single murder case, but a continuing effort against the defendant by the Attorney General's office that has so far lasted approximately 10 years. As of June 2025, in addition to the previous prosecutions, It has now been established that important evidence supporting the contention that the victim committed suicide was withheld in the previous prosecution.

Starting point is 00:37:20 And as a result, the Attorney General's office will have an especially heightened interest in motive to glean new information to present to a grand jury through the potential deposition testimony of Mr. Kalucci. Gosh, dang it, Alan. See, this is what happens when you allow your office to sit on a case for this long. You cause this kind of nonsense. Oh, I know. It's sled chief Mark Kiel's fault, right? For not getting David Owen a tutor in his basics of investigations class? Oh, wait. It can't be Mark Kiel's fault this time if you want his endorsement for governor, right? And therefore, law enforcement's endorsement. So what's happening here? Grace, will you read the part of Michael's motion that is so over-the-top oral abortion that it basically created a black hole, which is now sucking up the remaining parts of our

Starting point is 00:38:15 souls that don't already feel like we're living in another universe. This is an unprecedented situation. Mr. Kalucci has already stood trial for murder once and was on the brink of standing trial a second time before his indictment was dismissed without prejudice due to discovery violations in the criminal case. This is also a high-profile case and there exists heightened public pressure on the Attorney General's office from certain groups to re-indict Mr. Colucci at a time when the Attorney General is running for higher political office. Moreover, the Assistant Attorney General already communicated to defendant's criminal defense counsel that his office is considering seeking new indictment.

Starting point is 00:38:57 All of these circumstances put an undue amount of hardship and prejudice on the defendant if he is forced to invoke his Fifth Amendment rights with an automatic attachment of adverse inference. Such situation could, merely due to Mr. Kalucci's invocation of his Fifth Amendment right, increase the chances of a plaintiff's verdict in this civil case, which will, in turn, apply even more public pressure on the Attorney General's office to reindite. To summarize once more, the case can't go forward because I've been indicted for murder and might be cleared of that. And now the case can't go forward because I've not been indicted for murder and might not be cleared for that. Again, Alan Wilson is eating Alan Wilson's tail. Sorry, snake hit.

Starting point is 00:39:42 Snake tail. But that's rich, right? You can't let this case that's been delayed nine years now go forward because Alan Wilson's office might use it to re-indite him. Oh, Michael Calucci. You accused killer you. That's such an adorable argument. You think that Alan Wilson?

Starting point is 00:40:02 South Carolina is chief law enforcement officer. would wait to see what happens in a civil case before seeking criminal charge. Oh my God, Liz. What? Are you being serious? Nah, I was just playing. Of course Alan would. Weldon Boyd and Bradley Williams, the Scott Spivey case,

Starting point is 00:40:21 where Alan is doing exactly that very thing, waiting on the civil case before deciding on the criminal case. Michael Koichi gets half a point for calling that one out. Nope, he gets no points. But again, this is an Alan Wilson. problem. He is literally in an embarrassing standoff right now with Michael Kaluci. Both are waiting to see who moves first. My wife has passed away, and it was self-induced, and it was up in North Carolina. Y'all pray for me and my kids and everybody. My name is Mandy Matney,

Starting point is 00:42:06 together with journalist Liz Ferrell. This new drop feed titled Coerce, the Devotion and death of Micah Francis Miller is a Luna Shark production based on True Sunlight reporting. Yeah, he said my blood is going to be on your hand. But prior to that, he was threatening to come in here and he said, call the cops, I don't care. I'm armed and ready. Her story is about everything that led up to her death, the alleged coercive control that she faced in her relationship with her past her husband and all of the systems that failed her when she tried so hard to report that alleged abuse and escape from him. And she said, you know, he's such a liar.

Starting point is 00:42:42 And she actually said the FBI is looking into it. But now, I mean, what's come out, they have been. Be sure to follow Coerced, the devotion and death of Micah Francis Miller. While the Kalucci case has been endlessly frustrating for those who want to see justice for Sarah Lynn for over a decade now, there was a glimmer of good news recently in the civil case. On April 22, 2026, the court denied Michael's motion to delay the civil case into eternity. And now we know that Michael Colucci considers himself to be a victim of the H.E.'s office. The very office that, from our perspective, seems to have protected Michael from prosecution over and over again in its own perverse way.

Starting point is 00:43:31 Now that I'm thinking about it, it takes a real dufus of an attorney general, a real dupus of an inept and craven man to have both the criminal defendant and his alleged victims feeling the exact same way about him. Isn't one side supposed to think you're the bees' knees, Alan? If it's not the victims, then it should be the defendant, I guess. Michael Colucci doesn't even seem remotely thankful for your constant delays, which we all know only helps defendants like him. David Owen isn't even a sled agent anymore. You think the EMTs and the officers and the medical examiner and the coroner

Starting point is 00:44:07 and the witnesses to Saralins and Michael's relationship are going to be easy to round up? That's not even to mention the fading memories of these people. You have one job, Alan, to prosecute cases. Seems pretty straightforward, no? And yet, look at what a mess you've created here. Okay, now let's go back to Sarah Lynn's mother's motion for summary judgment. Here's what the first page of that motion says. Grace?

Starting point is 00:44:33 This case exists because a young mother is dead, and her mother has now spent more than a decade waiting for someone to determine in any forum what happened to her daughter. Michael Kaluci, the only individual who was with Sarah Lynn at the time she died, has repeatedly failed to provide a consistent account of the events and has now invoked his right and privilege under the Fifth Amendment of the United States against self-incrimination and answers to any questions relating to events, conditions, and details surrounding Sarah's death on May 20, 2015.

Starting point is 00:45:09 Like we said, Kaluche invoked his right and privilege under the Fifth Amendment of the United States to answer any questions about details surrounding Sarah Lynn's death. Actually, he refused to answer any questions. He didn't answer a single damn question. The only thing he provided was his name. When Michael Colucci finally sat for his deposition in July, a full 10 months after he was originally deposed, they asked him whether he had changed his last name from Antonio to Kaluci, which he had when he was 18, and what seems like an effort to co-op his stepfather's

Starting point is 00:45:49 influence and credibility in the community. Well, he invoked the fifth to that. They asked him what the color of the tie that he was wearing that day was. And he pleaded the fifth. When was he born? He said, I respectfully declined to answer any questions today under the rights and privileges afforded to me and every citizen under the Fifth Amendment to the United States. Constitution. This will be my answer to any further questions. Do you think he committed that to memory, or did he read from an index card? Or did he write it on his hand? Anyways, after some preliminary and standard unanswered questions, they got into some really interesting unanswered questions about the case. We have to give it to attorney Benjamin Smoot,

Starting point is 00:46:37 who was representing Sarah Lynn's estate. He sure did bring the heat. David, will you read some of those questions? On June 5, 2015, about two weeks after Sarah died, you gave Brian Whitfield a $7,000 check for a two-carat diamond he co-signed to Kalucci's jewelry on March 21, 2015, for $8,500. That check could not be cashed, correct? Uh-oh. With someone having financial problems at the time of his wife's sudden death under strange and inexplicable circumstances?

Starting point is 00:47:19 Can't say. He pleaded the fifth. Sorry, David, go ahead. If you could just rattle off a few and everyone just know that the answer to every one of these questions was me plead fifth. Between October 2nd and October 5th, 2014, you reported a $33,000 diamond ring missing from your business. Did you make an insurance claim on that ring? Mr. Kaluchi, did you have any life insurance policy on Sarah's life? During your marriage to Sarah Kalucci, did you regularly use and consume marijuana, cocaine, and narcotics? Did Sarah call 911 during arguments with you in your home in the months before her death? In the days before May 20, 2015, were you aware that Sarah intended to leave you and file for divorce? Were you ever physically violent with Sarah's father before her death?

Starting point is 00:48:23 Before Sarah's death did you choke Curtis Reed and flip him onto the floor breaking his lower left leg and ankle. Were you and Sarah using cocaine in the days before and on the day of Sarah's death? May 20, 2015. Were you consuming alcohol on May 20, 2015, and if so, where did you purchase it? Do you disagree with the statement of a neighbor of yours at 177 Woodbrook, Bob O'Leary, who characterized your behavior with Sarah as aggressive in the spring of 2015? Did Sarah Kalucci have keys to any of the doors or locks at that physical location on the day of her death? When you and Sarah arrived at 2206 North Main Street on May 20, 2015, Mr. Kalucci, who got out of the vehicle first. I have seen photographs of the vehicle at the property address.

Starting point is 00:49:25 It appears to me to have had two gates leading into the property. Was the first gate locked when you and Sarah Kalucci arrived to that location on the afternoon or evening of May 20, 2015? Whoa. Okay. First, that question about whether Sarah Lynn had keys to any of the doors at the warehouse feels like a good one because during the first trial, things got silly with attorney Andy Savage, repeatedly referring to Sarah Lynn as someone who was known for peeing outside. As in, it wouldn't have been unusual for her to ask Michael to pull over so she could go in the open. But see, he pulled over at his warehouse. property that had a bathroom.

Starting point is 00:50:11 So the story becomes, we were at a place where Sarah Lynn had access, presumably, to an inside bathroom, but she instead chose to pee outside where she subsequently died. And hey, maybe she did choose that. We've all been there, right?

Starting point is 00:50:27 When you have to go so badly, it doesn't matter where it happens so long as it happens now. But it is kind of weird because depending on which version of Michael's story we go, with, that Sarah neither killed herself intentionally, or that she tripped and fell into the hose loop and accidentally killed herself, which, okay, sir, there had to be some explanation for why they

Starting point is 00:50:51 were there, and why Sarah was outside on the other side of the gate? Because here's the thing, why was she on the other side of that gate? Was she heading to go inside? I mean, if she was a chronic outdoor urinator, then why not squat behind the car? Why squeeze her? Why squeeze her? in between the wall and the closed gate just to do the same thing that could have been done on the outside of it without that hassle. Second, can we talk about the wording of that last question? Did you notice how they referred to the time period of Michael and Sarah Lynn being at the warehouse as afternoon or evening? Was that intentional? Is there a thought that they were at the warehouse for longer than Michael says they were? Did they get there earlier than he said? Let's hear some more

Starting point is 00:51:34 of the questions Michael Calucci didn't answer. David. From the time, Mr. Kalucci, that you and Sarah arrived at 2206 North Main Street that day, to the time that you have previously indicated you came to Sarah, did you get out of your vehicle at any point in time and get back in? You have said in prior statements, Mr. Kalucci, that Sarah went between the building and the fence and stood there for several minutes, about seven minutes. Is that your testimony here today as well? You have said, Mr. Kaluji, that you never took your eyes off Sarah.

Starting point is 00:52:19 Is that true? Is that your testimony also here today? At what point in time, Mr. Kaluji, after you and Sarah arrived at 2206 North Main Street in Somerville, Did you first observe Sarah either handling the hose at issue in this case or with it around her neck? At the scene, sir, you had blood coming from your mouth. You told a deputy, quote, it was from me doing CPR, end quote. Is that your testimony today? You had two cell phones at the scene, sir.

Starting point is 00:52:56 One was yours, one was Sarah's, Sarah's with a shattered screen. Are you able to testify today as to why Sarah's cell phone was shattered? On the day of the incident, May 20, 2015, did you decline to give a recorded interview to law enforcement? Did you retain an attorney for the matter involving Sarah Colucci's death on the day of her death? Did you have Sarah's body cremated? If so, when and why? Do you agree, Mr. Calucci that the last activity on the last activity on the day of the day? On your cell phone on the day of Sarah's death was 5.46 p.m. until you called 911 at 7.12 p.m. that day.

Starting point is 00:53:43 Well, now, that is interesting. What was Michael doing during that time? Just contemplating life? Obviously, we would need to see what Michael's phone habits generally look like to know how significant this is, if at all. But going back to our question, were Sarah Lynn and Michael at the warehouse for longer than he said that they were? Let's hope this long and unexplained delay from the Attorney General's office means that they are putting together a stronger and more detailed timeline of that night. Because the AG's office seems to be getting outpaced by civil attorneys left and right here. Okay, let's hear what questions Michael Colucci didn't answer about the forensic evidence.

Starting point is 00:54:30 David? Sir, you understand that Dr. Lee Marie Tormose performed Sarah's autopsy and found the cause of death to be exphyxia by neck compression? And that autopsy performed by Dr. Tormose describes multiple separate parallel furrows on the front of Sarah's neck, five inches long, about five-eighths inch apart, crossing the midline over the hyoid bone oriented horizontally. Were you aware of that, sir? The furrow was essentially horizontally, not angled sharply upward toward a suspension point as one would suspect in a hanging. Can you explain how a person hangs themselves on a fence post and leaves a horizontal mark? In light of your

Starting point is 00:55:23 prior statement, sir, that you had never taken your eyes off of Sarah. and the findings from the autopsy which found a fracture of Sarah's superior horn of the right thyroid cartilage with hemorrhage, do you have any explanation for those internal neck injuries, sir? In prior statements, sir, you have described finding Sarah leaning forward at a 45-degree angle and also standing straight up. Which is it, sir? And what is your testimony here today? Mr. Kalucci, the autopsy documents, abrasions, and contusions on Sarah's arms, elbow, both knees and right foot. How did Sarah get those injuries that afternoon? A clump of Sarah's hair was found wrapped around the garden hose at 2206 North Main Street and her DNA

Starting point is 00:56:20 matched the hair on the hose according to Sled's DNA analysis. How does How does hair become wrapped around a hose if she simply slipped a loop over her own head, sir? Mr. Colucci. Sarah had dirt and mud on the back of her left hand, her ring finger and both palms. Her left little fingernail was missing. A broken acrylic fingernail was found on the floor of the vehicle that you all arrive to the property location in. Are you able to testify today as to any of those conditions that I've just described? At the scene, sir, Sledd documented two recent abrasions on the knuckles of your left hand with skin still moist and attached,

Starting point is 00:57:15 a swollen right lower lip and abrasions on both biceps and the inside of your left arm. How did you get those injuries on May 20, 2015? Starting point is 00:59:12 I respectfully declined to answer yada, yada, yada, blah, blah, blah, blah. Fifth Amendment, blah, blah, blah. Because you didn't want to incriminate yourself in the possible criminal case. But gosh, this is one heck of a complaint. collection of adverse inferences for the judge to sort through, isn't it? David, will you read the final set of questions that Michael didn't answer? Sir, did you tell Barbara Moore that something happened to Sarah in the car on y'all's way to 2206 North Main Street, Somerville on May 20, 2015?

Starting point is 00:59:50 Did you later tell Barbara Moore, sir, that you weren't sure if Sarah tripped and fell into the hose? Did you describe Sarah to Barbara at one point as leaning back against the building and at another point as leaning forward at a 45-degree angle? When Barbara pressed you on how you could have never taken your eyes off of Sarah at 2206 North Main Street in Somerville, yet not see her with a hose around her neck. Did you raise your voice and say, well, that's what happened? Did you ask Barbara Moore whether she thought you killed Sarah, sir? Mr. Calucci. Did you tell Shane Sandusky that Sarah squeezed between the fence post and the building when you got to 2206 North Main Street in Somerville, that you went looking for her

Starting point is 01:00:50 and that she hung herself at the fence? Is that your testimony, sir? In one version, you told Kevin Bilbrough you were in the car on the phone and looked up. In another version, you told Billbrough that you were drinking and nodded off. In a third version, you told Billbro that you had gotten out of the car and went to the other side of the building, of the gold standard at 2206 North Main Street in Somerville. Which version, sir, is true. and what is your testimony as to what you told him regarding Sarah's death today? To EMS first responders, sir, you said that you stayed at the car.

Starting point is 01:01:37 You saw her not moving and found her hanging. Is that true today? In the days and weeks after Sarah's death, sir, did you tell Barbara Moore that you took a polygraph that was inconclusive and couldn't be used in court. Would you agree, sir, that multiple people who knew and were close with Sarah, neighbors, friends, and her mother did not believe that Sarah was suicidal? Would you agree that the proximity position of Sarah's body, as depicted in this photograph, to the vehicle is approximately 20 feet,

Starting point is 01:02:20 and provides a clear, unobstructed view of that location from where the vehicle is positioned in this photograph. Did you touch, change, or manipulate that garden hose in any way, shape, or form before Sarah Calucci died? Mr. Kalucci. Did you change or move the gate depicted in this photograph before Sarah's death? Sir, do you contend that you bear no responsibility? civil or otherwise for Sarah's death.

Starting point is 01:02:54 Sir, is there anything about your multiple accounts of May 20, 2015 that you wish to correct, add, or supplement before we conclude today? That is a whole lot of questions not to answer because if you did, you might incriminate yourself. And it will be interesting to see what happens now as a result. In Barbara Moore's motion for summary judgment filed on August 14, she argues that even though Michael had a right to invoke the Fifth Amendment in answering these questions, this invocation, paired with what she refers to as a, quote, preponderance of evidence, is more than enough to establish his liability for Sarah Lynn's death.

Starting point is 01:03:36 The motion argues, quote, defendant has now been asked under oath to identify any fact supporting an alternative explanation for his wife's death. He has offered nothing responsive to any of it, where a party with you, unique personal knowledge of the operative facts declines across the entirety of a deposition to offer any competing account, the adverse inference is permitted. Barbara Moore points out that throughout the deposition, Michael, quote, hindered the fact-finding process by refusing to answer the simplest of questions. Grace, will you read this next part? Mr. Colucci would not answer whether he believes that compressing a person's neck is a forcible harm.

Starting point is 01:04:21 or whether he bears any responsibility for Sarah's death. Mr. Kaluci obviously has answers and opinions to these questions, but with a culpable state of mind, he is seeking to undermine the civil justice process by refusing to answer. Sarah Lynn's mother then lays out which questions she wants the judge to apply adverse inference to, and there are 28 of them. Even if the judge refuses to apply adverse inference to the answers Michael didn't give in his deposition, Barbara Moore argues that there's enough evidence to establish Michael's liability in Sarah Lynn's death,

Starting point is 01:05:02 starting with her injuries from that night, Michael's injuries, Michael's multiple versions of what happened, along with the circumstances of their marriage at the time and his many financial problems. Barbara Moore also argues that she expects Michael will point to the medical examiner's finding of undetermined as evidence that supports his lack of liability in Sarah Lynn's death, as well as to the statement that Sarah Lynn made to her two weeks before her death about how the kids were keeping her from quote unquote hanging herself in the garage. Barbara dismisses this as a moment of situational despair and not a statement about Sarah Lynn's mindset at the time of her death. Michael has not yet submitted a reply to this motion, which is the likely next step here before a judge ultimately rules on this motion. There's going to be some back and forth, and we cannot wait to see how this judge decides. In the meantime, it is your turn, Alan Wilson. You need to make things right in this case. You do not deserve to be our governor

Starting point is 01:06:16 without making things right in this case. And also, don't make things worse for Mrs. Moore and Bishop. They deserve a chance at some kind of justice in this case. And how sad does that sound? A chance. Just a chance. It's stunning and devastating how expectations. are so low for the South Carolina justice system at this point. Good old boys like Michael Colucci just keep on reminding us how our justice system was built for them, to make money off of it, to escape accountability, and to get away with everything.
