Starting point is 00:05:09 Hang on tight. That said, let's go on a trip, Jimmy. Let's do this. We are going out to Nevada this week. Oh, boy. It's tough. For some reason, Nevada is a hard place to find good murder cases because they all take place in Vegas or Reno because that's where all the people are there.
Starting point is 00:05:26 There's very few people spread throughout these small towns and it's difficult to find good murder cases that are well covered and have all the info we need. But this week, oh, we got one here. This is West Wendover, Nevada. Where the fuck is that? Far eastern Nevada. Oh, it's on that side. Far eastern Nevada. fuck is that far eastern nevada oh it's on that side far eastern nevada yeah there's a wendover utah that it's like connected to kind of on the border of utah kind of like kansas cities so
Starting point is 00:05:52 wendover on the east side it's nowhere near anything it's like six hours to vegas in a car it's like eight hours to reno in a car so i mean it's really far almost six hours to Reno in a car. So, I mean, it's really far. Almost six hours to Lemon Valley, which was our last episode, which was a while ago. And that was Sins of the Stepfather. It was a gross one. I remember that. This is in Elko County out there. Area code 775. It has several mottos.

I mean, and it's really any Baltimore is basically where it begins, right? Let's be honest anything west of where the oregon trail starts in that computer game is the west where the west begins anything independence missouri anything west of that that's where the west begins i think
Starting point is 00:06:54 little rock's kind of where it begins why not sure let's go let's start anything of the mississippi river west of that that's the west right talle? Not quite, but it's where the Western Florida begins. So the other slogan, come grow with us. Oh. Which sounds like we're not doing well now, but if you come on board, it'll help a lot. Come grow with us. Come grow with us here. West Wendover, a little history, began to develop in the 30s and 40s when legalized gambling came to Nevada.
Starting point is 00:07:25 Oh, okay. It's just a pop-up casino town, so you can gamble on your way to go gamble. On your way, yeah. If you're on your way to Reno to gamble, you can stop here and gamble. West Wendover is the slot machine in the airport. That's what it is. That's what it is. It absolutely is.
Starting point is 00:07:39 And weed's legal here, too, so everybody goes from Utah to here. So it's basically Utah's vice center is West Wendover. They come there to gamble. Utah, vice city. Yeah, there's brothels in West Wendover. So they come there to get all their vices out of the way and then come home with a nice, you know. Just a lone Mormon all alone out there doing his dirt. Half ounce of sour diesel on the way home.
Starting point is 00:08:03 And a stinky dick. And a stinky, filthy dick. Filthy dick that he's not going to be able to show his dirt. Half ounce of sour diesel on the way home. And a stinky dick. Starting point is 00:08:15 a rest stop to travelers that were crossing the desert between Utah and Nevada because this is nowhere land. Yeah. Nowhere land. Today, this place is known as the Wendover Nug nugget that's where it is
Starting point is 00:08:27 which is a gas station yeah i think it's a casino here um it held the record as the oldest continually operated gaming license for a casino in the state of nevada for 66 years um until december 2001 when the former state line casino and Hotel came under new ownership. So that's when it stopped there. Otherwise it was the longest continuous one. 70s and 80s, 1970s and 80s, it became kind of a weird little resort town. There's more casinos,
Starting point is 00:08:56 hotels, shit like that. They have a golf course now. So I guess if you're going from Utah you can go over to here. Doing its best to be a fucking destination? In the middle of nowhere. They're like, well, I mean, Vegas and Reno are in the middle of nowhere. But, you know, Vegas is kind of in the middle of a bunch of places.
Starting point is 00:09:13 Reno's near a lake and a Tahoe and all that shit. So there's really no reason to be here. At one point in time, Vegas was nothing. Oh, nothing. So this makes sense. That's what they're thinking. Maybe it's that. In October 1999, the U.S. Department of Transportation moved West Wendover out of the Pacific time zone. Oh?
Starting point is 00:09:33 It was in the Pacific time zone due to the strong economic ties between West Wendover and Utah. They came for their whoring needs. Yeah, they have to be on the same schedule, obviously. Otherwise, a guy goes down there to get a blowy. Come back home with a dry dick, and we can't have that, obviously, in Nevada. Nevada, a hole of wet dicks. That should be on their side. And an hour late for dinner.
Starting point is 00:09:58 Yep. Hit the jackpot and get your dick wet. So this made West Wendover the only portion of nevada legally in the mountain time zone different ones jackpot jar bridge mountain city and some other place i'm not even going to try to pronounce um we're also observing the mountain time zone but on an unofficial basis so okay they're just saying it's they're just deciding it's two o'clock when it's really three o'clock. We like the hour. That is bonkers, man. That's bonkers. 2019 West Wendover's first recreational cannabis dispensary open and Utah people swarmed there to get weed. So here's from Dateline from a Dateline episode. Here's a quote about West Wendover.
Starting point is 00:10:43 You know, when they come in and they start telling you about the town? It was a quiet, dusty, you know. Yeah. He waves at you for miles, the big neon cowboy. Wendover Will is what they call him, and his job for over 60 years has been to tempt travelers off Interstate 80 on the Utah-Nevada border, pull them off the road into this tiny, dash of tiny high desert casino commerce is that where that guy's at yeah wendover will he's a big the cowboy yeah with the fucking yeah with is it with the thumb or i don't remember which one he is yeah he's they have a few of these big cowboys around
Starting point is 00:11:16 and there's one in vegas too so that's a confusing one also i've seen it then there's the marlboro man in time square from back in the day that smoked. Oh, really? All sorts of giant cowboys. So here's some reviews of the town. Okay. Reviews. Four stars. I lived in West Wendover almost all my life. The casinos are beautiful, especially from the top of a mountain.
Starting point is 00:11:39 I'll look down on those casinos. There they are. Oh, boy. A lot of people from out of town come mainly for the casinos. That's what happens. It is a really small town with little activity for teenagers or kids to do. If you get in an accident, you have to go out of town. What the hell does that mean?
Starting point is 00:11:55 They kick you out? You're not a good driver. You've got to leave town now. We packed all your shit. It's in your front yard. Pick it up and get on out of here. You're a self-offender, Bender. Sounds like you are exiled for two weeks. Goodbye. Blackballed. Ostracized.
Starting point is 00:12:10 The closest hospital is two hours. Jesus Christ! Holy shit. Don't laugh. If I start having a hint of a chest pain, call now, because by the time they get here, I could be half dead. Who knows? Wow. It's a safe area with little gang activity and violence.
Starting point is 00:12:27 Where are the gangs going to hang out? There isn't even a hospital for two. Gangs, you know what? If you looked, I bet, and had like a map that had gang activity and hospitals, I bet most of the gang activity takes place near hospitals. I think the gangs have worked that out ahead of time. Listen, we're going to be getting stabbed and shit. Let's make our home base close to be getting stabbed and shit. Let's make our home base close to an ER, shall we? Let's not do it two hours away. Come on, man. It's so small
Starting point is 00:12:53 that everyone knows who you are and what you do for a living. This is a place that I would recommend for people who want a safe environment. But if you want to pursue your dreams, I suggest you go elsewhere. This place will eat your dreams alive. So spit them out. Many people here lose their passion because they get lost in drugs. That's the middle of the desert for you. They get into drugs because we don't have anything or anyone motivating us to become a better person. I think that this town will grow one day, just not now. Based on what?
Starting point is 00:13:26 Based on its location in the middle of the fucking desert? It's going to grow? If it's a dream sucker, it's not going to grow. No, that's where people move away from. Three stars. This town is filled with casino paradise, but not fitted for anyone under the age of 18. It overall has no other big attraction other than the casinos. It's perfect for anyone who is all up for the easy casino life.
Starting point is 00:13:52 The easy casino life? What is that? What? All that buffet living. Buffet living? What the hell are you talking about? I've never gambled and thought, boy, this is easy. This is so
Starting point is 00:14:05 easy except for it's easy to give away everything you got this is great it's so easy to give away my hard-earned money this is terrific uh then there is little to no crime and community is lovely we'll be the judge of the crime we'll tell you what the stats are and there is plenty of crime there as we'll find out three stars last one three stars west wendover is a small casino town i think we've gotten the hint here it's a casino place it's perfect if you're looking for a quiet out of the way place most job opportunities are either teaching jobs or working in many aspects of the casinos teach teaching people to gamble and deal cards the largest grocery is sm Smith's with very few other options to purchase supplies.
Starting point is 00:14:48 You know, you're in the middle of nowhere when people call the store supplies. Yeah. And also, uh, that there's a Smith still open. Yeah. Yeah.
Starting point is 00:14:56 I had one in Phoenix 25 years ago. Yeah. Uh, Salt Lake city, Utah is only 120 miles East of the town. If one is looking for more resources. Oh, it's only 120 miles East of the town if one is looking for more resources. Oh, it's only 120 miles east? Then it's just right there.
Starting point is 00:15:09 That's where the fucking hospital is. Jesus, it's practically fucking next door. People in this town, 4,517 people on this island of casino desert oasis. 56% male. Almost 57%, which is way high. It's it's usually about 51 female so that is way out of whack and i don't know if that's the casino i don't know if there's mines around i don't know what's going on median age is young too 29 and a half tons of five to nine year olds and nobody over 85 so it's very weird um there are a lot of Mormons here, which would explain the five to nine year old explosion.
Starting point is 00:15:48 The family here, 55 percent married, a little higher divorce rate. A lot of people, 31.4 single with children, normally 10 percent. So it's either you're Mormon and all locked down or you're out there living the easy casino life. Easy. Easy casino life. Kicked back, hands behind your head, being fed grapes by scantily clad women. Being fed a little of the green. Oh, all of it.
Starting point is 00:16:15 Big blunt put up to your mouth. Race in this town, 32.7% white, 0.0% black, 0.0% Asian, 65.3% Hispanic, 2% Hawaiian Pacific Islander. That's it. It was the only people there. You're telling me a minority is a majority? White, Mexican, Hawaiian. That's all that exists in this town, which is very weird. It's a strange mixture in the desert.
Starting point is 00:16:42 And white is not the majority. No. That's fascinating. I mean, it's Nevada. There's a strange mixture in the desert. And white is not the majority. No. That's fascinating. I mean, it's Nevada. There's a lot of Mexican people there. Religion in this town, 40.5% are religious. I think a couple too many have prayed. It's usually 50-50.
Starting point is 00:16:54 A couple too many have prayed for that last triple seven and didn't get it, I think. And they swore it all off after that, probably. The leading ones are Catholic because of the Hispanic population. But the main religion here is Mormon. That's it. 16.7% Mormon. So a lot of Mormons, 0.0% Jewish, no Jewish people at all. Politically in this town, last election, 20.7% of the people in Elko County voted Democratic, 76.2% Republican, 3% Independent.
Starting point is 00:17:29 And the economy here, it's got a low unemployment rate because there's tons of casino work. And it's always hiring. Literally. Yeah, they're building new ones and shit. So there's tons to do there. There's tons to do there. Median household income, though, is $41,890 a year, which is lower than the national average by a good stretch. Because the casino also likes to keep the money.
Starting point is 00:17:54 Yeah, they don't pay very well. Not a lot of giving. A lot of hourly wages going on there and shit like that, which is fine, but they're a little lower in casinos sometimes. So cost of living, $100,000 being regular here, it's's 97.4. So pretty close to normal. Not even very affordable. No, median home cost here, $247,200. So, I mean, it's lower than the national average, but not too low. And if we have convinced you, damn it, that there is somewhere there's a blackjack table waiting for you to deal, we have for you the West Wendover, Nevada Real Estate Report. Your average two-bedroom rental here goes for about $1,280 a month,
Starting point is 00:18:38 which is a little higher than the national average, but in the ballpark of it. Here's a three-bedroom, one-bath, 1,388-square-foot house. It is light pink is the best way to describe it. Absolutely awful. Either a faded regular pink or someone said, just put Pepto-Bismol all over my house. Just literally just spread it and it'll harden in the sun and cause a paint type
Starting point is 00:19:05 reaction um the it's it's weird man the inside of the house the rooms are none of them look like they're in the same house you know none of the rooms match there's weird mix and match mix and match carpeting mix and match colors it needs an update it's got a lot of fucking problems here it's it's not it's not wonderful 275 000 for that that seems of fucking problems here. It's not wonderful. $275,000 for that. That seems steep. It seems steep because it's not that great. But at least it's kind of in a neighborhood. By the way, all of the
Starting point is 00:19:34 yards we're going to talk about are either dirt or yellow dead grass. There's no... Awesome. There's not a speck of landscaping or grass in any of these houses. It is the desert. Nothing green. Nothing green. Four-bedroom, two-bath, 1,244 square feet. It's just in the middle of a lot.
Starting point is 00:19:51 It looks like a tornado dropped it here. It was Dorothy's house, and now the tornado went westward and dropped it off. Is there at least land, or is it not that big of a lot? Not even that big of a lot. It's really boring. There's a weird plywood shed in the thing. It's very strange. $290,000 for this mess.
Starting point is 00:20:12 Oh, my God. Yeah. And then here's a five-bedroom, two-bath, 3,666 square feet. It says there's five bedrooms, but we can only... There's only pictures of three of them. So, I don't know if the other two are just full of shit or storage or if they're hoarders or I don't know what's going on. They just photograph bad. That's all.
Starting point is 00:20:30 It's really weird. There is a view of a mountain, though. But it's just like you're in the middle of nowhere in the desert. And then off in the distance, there's just like this little mountain out there. You're like, well, there's that to stare at. It's bleak. It's bleak. $425,000 for this little
Starting point is 00:20:45 slice of heaven on Earth here. Oh my god. Yeah. Things to do. Yeah. Gamble, number one. Obviously. Keep working because you gotta pay your fucking mortgage on these overpriced pieces of shit. No shit. Either gamble or help other people gamble. Or deal cards. Or
Starting point is 00:21:01 the Wild West Barbecue Shootout. Pow, pow. Hey. Pew, pew, bitches. Why do you have to mix the two? Oh, this is all about that. Barbecue competitions and grill master challenges can be found in nearly every town across the Silver State. And West Wendover, Nevada is no exception. While the world famous Bonneville Salt Flats crank up the high octane excitement.
Starting point is 00:21:24 I don't know what that is. Is that where it's at? I guess. Salt flats. That's where people break the land speed record. Oh, okay. I've seen that. In town you'll find thousands of pounds of ribs and all kinds of barbecue styles meticulously prepared by top grill masters, barbecue competitors,
Starting point is 00:21:39 and rib teams from all over Utah, Nevada, and the West. A whole ass team. A whole team. Rib team. You're the sauce guy. You're the fucking smoke guy. You're the fire guy.
Starting point is 00:21:50 You keep feeding it pellets. Holy shit. Yeah, you're the cedar guy. You put like one in there just for the taste. Yeah, I guess it's this year. It brings hundreds of competitors and carnivores alike to this northeastern Nevada border town for a grill master competition you won't forget. Admission for the shootout is free and open to the public. Open to the public.
Starting point is 00:22:15 What's a shootout? What labels it a shootout? I think they're just going to have two guys both with smokers and grills facing each other. It's like Bobby Flay, probably, and they call it a shootout. Like a duel? Two fat, sweaty guys just working it, hoping their ribs are good. And when the clock strikes noon, you've got to yank one off and taste it. Yank it off.

Starting point is 00:22:53 It says, don't worry, bewilderment is common from folks who haven't yet experienced this week-long townwide full participation celebration of authentic Western cultural arts. However, attend and you'll quickly discover why thousands flock to the gathering each winter uh the gathering in quotes here not the juggalo one no no no this is the national cowboy poetry gathering it says it isn't just about poetry like the real american west it certainly isn't just for cowboys. Yes, it is. It seems like it. They call it six days of poetry, music, dancing, workshops, exhibits, conversations, food and fellowship, drawing revelers from all walks of life. So about cowboy shit.
Starting point is 00:23:37 It's for cowboys. It says the result. Consider this. Result? Consider this. How many places can you encounter a ranch matriarch, Native American poet laureate, preteen yodeling champ, and bronc riding free verse slam poet all in a single show? Say that last thing again. They do have a good point. I don't know any other place where all these things are together.
Starting point is 00:23:59 I will give them that. That's honest because I've never heard of this before. And the horse. What are you talking about? Well, I oil my six gun. This is ridiculous. So I don't know what's happening, but it says you can discover horseman cultures from around the world, learn a traditional skill, dance the two-step, plan for the West's future with ranchers and conservationists, watch homemade films of rural life.
Starting point is 00:25:16 This sounds more exciting. Please show me your home films of you standing in a field. That would be great. Wow. Look at that. Yeah, it sure is wide open. Well, guys, then all of a sudden you hear, and the horses are coming. You're like, oh, that's the free verse slam poet on his front.
Starting point is 00:25:34 Perfect. I don't know what the fuck's going on here, but it's a tradition upheld since 1985. Cowboy poetry is a community bound together by their shared interests of love of a shared interest in love of poetry music art and making a handcrafted life in the american west that's what it is holy shit crime rate in this town here wow if you're ready for a western cultural bash that takes place as much on stage as off that's that's the last line. That's hilarious. Okay. Crime rate. Property crime is about 20% high. Holy. So not non-existent. No.
Starting point is 00:26:09 High. And then violent crime, murder, rape, robbery, and of course assault. The Mount Rushmore of crime, more than double the national average. What? Starting point is 00:26:56 They're fighting. It's a feud between East and West. And then, you know. And they're just out there branding everything. They're like, yo, Pacific time zone, bitch. And they make like a P with their hands. And then this, I don't know what's going on, but I don't like it. My Honda Civic has a Circle J branded on it.
Starting point is 00:27:11 What the fuck? What's up, bitch? So that said, let's talk about some murder, shall we? Oh, boy. Hey, let's get into this. Let's talk about some people to start with. We'll start with a young lady, let's say. That's a good place to start.
Starting point is 00:27:26 Let's start with a young lady named Michaela Costanzo. Just like George Costanza, but with an O at the end. Costanzo. Michaela or Michaela? Michaela, I guess. M-I-C-A-E-L-A. Michaela? Mickey. She goes by Mickey, so
Starting point is 00:27:44 it's Mickey. Doesn't matter. She helped us out by having a nickname. She knew. She knew it was up. She's the youngest of three sisters, Mickey. She's 16 years old back in 2011. So she's born in 95. I mean, young girl, 94 actually.
Starting point is 00:28:02 She is altogether, she's kind of what anybody would want their daughter to be. She is smart. She's athletic. She runs track. She's a top student. She's the editor. Punctual. Punctual.
Starting point is 00:28:16 Editor of the stool. Editor of the school newspaper. Not editor of any stool. Editor of the school newspaper. Very mature. She wants to be an author someday. She's into writing. She's very pretty.
Starting point is 00:28:30 She's very popular. Got it together. She likes poetry. I don't know if it's free verse slam. I'm not positive. I don't know if that was part of it. I don't know if that inspired her. She went to the throwdown one day and was like you know what i'm not positive but she uh either way that she's like what you think of
Starting point is 00:28:50 if you go wow who do you what would you know some if any girl who's like 16 you go you know who's a bitch in your school and they describe this girl not that she's bad but they'd be like she's perfect you know what i mean does everything right everything right everybody likes her she's well liked too because she's very nice she's perfect. You know what I mean? She does everything right. Everything right. Everybody likes her. She's well liked, too, because she's very nice. She's not a bitch at all. She's a super nice kid. Everybody likes her on top of everything else. So in May of 1980, near Anaheim, California, Dorothy Jane Scott noticed her friend had an inflamed red wound on his arm and seemed unwell.

Her sister said, quote, she's the one out of all three girls that I say was just going down the path you would want any child to go down. She was doing it the right way, stereotypically. Yeah, hardworking girl that just earns everything she's got and she's doing it. Yeah, hardworking, good athlete, very smart, does all the activities, you know, gets great grades. Everybody likes her.
Starting point is 00:31:27 Sweet to people, nice to people. She's a track star. She runs track in school and she's also known, she's always in a leadership position in any of the things she's doing. She's always head of the this committee and the editor of the newspaper. People just look to her as a leader. She's just because she's very reliable and smart and dependable so um she's also plays basketball as well as track track was her main thing though she was a she was a star in track and um yeah she does she's very close with her family as well
Starting point is 00:31:57 um really wants to be an author uh she her the middle sister dj is and her are very close in everything. They're only a couple years apart in age, and they're kind of inseparable. Okay. DJ said, I consider us twins. Everything we always did had to be together. If we weren't in the same place, we'd always had to know where the other one was at all times. Okay.
Starting point is 00:32:19 So they had a very twin relationship. How much older than her is she? She's 18 at this point. So, yeah, because she's looking at colleges. So it's, you know. She's named after the kid from Full House, huh? Probably DJ Tanner there. So possibly, possibly.
Starting point is 00:32:34 Next, well, let's introduce a young man into the equation here. This was a childhood friend of Mickey's, known her since they were little, and were also kind of an item at one point sort of but like kid item they weren't yeah they weren't fingering each other or anything they were just you know each other well i don't know we don't know what kids do nowadays good point you know who knows what kids are up to i don't know it could be fingering each other post 9-11 all bets are off 2011 i think you know i you know, I think you just, yeah. Yeah, you just wing it.
Starting point is 00:33:06 Who knows what's going on out there? I'm saying, I haven't been a teenager out there anymore. That might be part of the protocol now. It's been a long time, yeah. It's been a while. It's been a while since I've been a teenager, since I've been out on the fingering circuit. So, I don't know. I don't know what's happening now.
Starting point is 00:33:23 Yeah, I don't even know who books it anymore. No clue who books the finger and circuit. No idea. I wouldn't even know how to get back on the card anymore, how to get back on the bill. And did they grow up in West Wendover? Yeah, yeah. They're all from West Wendover, all these kids here. This kid's name, the boy, he's two years older or a year and a half older.
Starting point is 00:33:42 He's 18. She's about to turn 17 yeah so they're they're similar in age or yeah but i think he's a little maybe a little younger than dj because he's still in high school as well his name is cody with a k yep everyone in his family has k names um cody lee patton p-a-t-t-N. Cody Lee. Cody, obviously, goes by here. Now, like I said, he dated her a little bit, dated Mickey a little bit, and they've known each other forever. But they broke up because she wasn't really allowed to date, and he was interested in somebody else, apparently, as well, after a little while. But Mickey's sister said they grew up together.
Starting point is 00:34:24 They were friends. while uh but her his mickey sister said they grew up together they were friends mickey was not allowed to date until she was 16 but i'm sure it was probably like puppy love what i would call puppy love okay that makes sense now cody is fucking humongous by the way really he's huge he is i see him listed big dude cody big old cody fucking humongous. Fucking huge. Well, I see him listed as either 6'6 or 6'8. And he's 18? Yeah, and he's a monster. That's huge. I mean, he's huge. He's a huge guy and he's thick, too. He's humongous, yeah. He's a football
Starting point is 00:34:53 player. Okay. He's a big, giant fucking kid. I mean, he's a huge kid. He wants to be a Marine after high school. That's his goal, to go to the Marines. He wants... The way they got close, him and mickey was he lived in the same apartment complex as the costanzo family so if you've ever lived in an apartment complex you know that like whatever your school friends are and all that your apartment complex
Starting point is 00:35:16 friends the people who live there the people you hang out with even if you have no connection with them in school at all we're all home you're all around the complex, so you're going to hang out together. It's very strange. So now he'll be described in numerous different ways, Cody, here. One person said he was best described as a bully by teachers and faculty and other people at the school. Well, yeah. I mean, he's probably just frustrated.
Starting point is 00:35:42 He's 6'8". He doesn't fit here. He doesn't fit. And they said they thought some teachers were even afraid of him and all that sort of thing. But at the same time, the same person says a lot of people spoke highly of Cody and that he helped them in a lot of different areas. And he's very friendly and outgoing as well. So they don't know. Later they'll say, I think depending on who you were, Cody treated you in different manners.
Starting point is 00:36:07 Some people he was a real asshole to apparently and some people sweet as can be, which is very, very strange. But there's some hostility between Cody and Mickey somehow that builds over this time period. Who's mad at who? period who's mad at who well it's it's a strange thing because mickey seems to try to kind of he's she's trying to kind of stay away from him because he's got a new girlfriend that we'll talk about but some reason it just seems to be a problem the new girlfriend i guess had been bad mouthing mickey all the time because her boy sounds jealous her boyfriend's ex and um and dj mickey's sister said she saw cody play all sorts of nasty pranks all the time um one does this is not a prank really this is assault is what this sounds like uh quote he had a little box cutter blade i don't like the way this is starting that's not a prank no matter
Starting point is 00:36:59 what it is now yeah and he swiped it across her arm, meaning Mickey's arm. And at first she said, I didn't even know. And then I looked down and I'm bleeding and I look at him and he's laughing. He just sliced her with a box cutter in the arm just like as a joke. Like, I got you. Tag, you're it. Tag, you got hepatitis. Like, what the fuck? Thanks, asshole.
Starting point is 00:37:20 Tag, get a tetanus shot. Yeah, totally. This is crazy. That is wild um and he's laughing and um the sister said after that mickey said she he's not worth it and i really don't want a person like that in my life anymore you know he's a uh he's a dick he's cutting her worth it or not let's call the cops he sounds terrifying yeah that's, that's assault. That's not what they don't. They're just like, well, he's a jerk, I guess. They took it more as just a pranky type thing.
Starting point is 00:37:50 Holy. Which any kind of knife wound is beyond a prank, I feel like. Yeah, and if my daughter's bleeding, we're fighting, sir. Yeah, a prank would be the blade is closed and you swipe it on or acting like it's open and they're like, oh, my God. And then it's closed. That's a prank. It's dangerous.
Starting point is 00:38:09 It's certainly a fucked up prank. It's the type of shit my friends would do to each other as teenagers. But you wouldn't do it to a girl. No. I mean, you do that to one of your asshole friends. That's to go. Ha ha. You thought you thought you were you thought your arm was opened up.
Starting point is 00:38:24 To go, ha ha, you thought your arm was opened up. So, yeah, I guess from then on, Mickey would avoid Cody and not speak to him anymore. Just try to, he'd go to the other side of the hallway if he was coming. Yeah, because he caught me. Yeah, DJ said he grew really angry at her after that, would do things to try to make her mad just so she'd talk to him. Just to get a reaction it was a real shock to him all of a sudden to have her there through thick and thin and then never have her at all well that's what happens when people are afraid physically of you because you're cutting them yeah people stick around when you treat them nice when you treat them with a fucking box cutters
Starting point is 00:39:01 yeah yeah you're it's gonna go to go appropriately it's really weird and the sister said that um that mickey came to her and said he keeps wanting me to come hang out with him and his girlfriend like yeah just that's what he wanted to do go out with me and my girlfriend she's like i don't want to fucking hang out with him and his girlfriend this is stupid you know i have a life i'm busy i have a yearbook to edit and shit. Like, I'm not dicking with this stuff. I got track practice. I have a meet this weekend. She'd say all the time, I don't like drama.
Starting point is 00:39:30 I'm not into drama. I want everything to be smooth. She's fucking got a head on her shoulder. She's not an idiot who wants to get, you know, enmeshed with morons. So let's talk about this girlfriend here. Yeah. Her name is Tony with an I. Tony Fratto. F-R-A-t-t-o oh so now tony fratto you think what do you picture uh gangster or a guinea girl i picture like yeah i picture
Starting point is 00:39:57 like girls i grew up with with like hair and you know yeah her her dad's a bad man something yeah but she's actually a ginger Mormon, which makes no sense. It is the weirdest disconnect ever to hear Tony Fratto. And I look her up and I'm like, wait a second. You what? You look like fucking strawberry shortcake. What's going on here? Is Carrot Top's real name Fratto?
Starting point is 00:40:21 It's so strange. She's a ginger Mormon. It's odd. Wow. So what are you going to do? Now, Toni, she's 18 as well here. She is no slouch herself. It's not like she's some loser or whatever.
Starting point is 00:40:35 She was a beauty queen at age 13. Oh. Yeah, she is a crowned, sashed beauty queen. Pippi Longshoreman. Pippi Longshoreman. Pippi Longshoreman. That's right. I love it. Pippi Longshoreman.
Starting point is 00:40:51 That's her. Old Pippi over here. Yeah. That is perfect. She was West Wendover Junior Miss. Okay. When she was 13. Yeah.
Starting point is 00:41:00 The prettiest 13-year-old in all the town. Yeah. Pippi Longshoreman. There she is. That's fucking awesome. So the prettiest 13-year-old in all the town. Pippi Longshoreman, there she is. That's fucking awesome. Strawberry Cutthroat, that's her. That's my girl. She's got many nicknames. She does.
Starting point is 00:41:27 She's also really, really religious, super into Mormonismism really close to her parents not a bad kid not like she's not some gangster kid we've described her as like she's got a switchblade in her purse and she's gonna be like were you talking to my boyfriend i'll cut you i swear to god i'll cut you i swear use uses cross the line now like that's but she's not like that at all she's just okay she's five foot one uh-huh that's the other thing he's six six six eight she's five one yeah which is fine i'm six four sarah's five one so i mean i've seen it yeah it works it works i'm never we've never we've never been in the middle of a fight and she's like you're just too tall for me i'm like i know you fucking tiny midget person what the fuck like that never happens we never never comes up it's fine it's not a thing never a point of contention uh it's not like you know we're not bloods and crips over here it's fine so yeah she um uh she did that uh her her mom said
Starting point is 00:42:18 she always went to church with us and you know a lot of kids you have to force them to get out out of bed and go it was was never that way with Tony. Really? Ready to go. Yep. Just all polished up. In high school. She's up and ready. Ready to go to Mormon church.
Starting point is 00:42:32 Can't wait. She didn't have a lot of friends outside her family, though. She'd go to church and do family stuff and do church activities and come home, hang out with her family. She was really pretty closed in except for cody who became her boyfriend he became kind of the only real person she's really close to outside of her family and a couple of church people so they started dating in the ninth grade they've been together for a couple years now yeah and uh they were inseparable from the time they they started dating um right away yeah the mother said she loved him she really thought she loved him a lot um but they also say about him he was very very possessive and didn't
Starting point is 00:43:10 like her time uh being taken up by anybody else but him what's happening with this why is he so insecure at six eight it's six eight and like an athlete and he's going to the marines you think he would be a little more secure with himself but he's not fucking yeah confidence i would have you're gonna go from port to port here pretty soon i can open every pickle jar in this house and i can reach them also before yeah i can not only get them off the shelf i'll pop it open for you too you can do it all so her parents names are cassie and claude oh cassandra goes by cassie and claude cassie and claude here yeah so january 30th 2011 cody moves in with the fratto family what moves in yeah they got probably he's got problems at home they live in a trailer too by the way they don't have like a sprawling house where you know oh well
Starting point is 00:44:00 he does he could yeah the fratto family it's not like, he can move. Claude does? Yeah, the Fratto family, it's not like, oh, well, he can move into the servants' quarters or, like, we have the West Wing open. They live in a trailer. Oh, my God. So even a double-wide is something. That's not much bigger than an apartment. That's what I mean. It's not a lot.
Starting point is 00:44:17 So January 30th, he moves in. He's had problems with his father, Cody has. He's been getting in fights with his father, whose name is Kip, with a K. Oh, K. Yeah, so name is Kip, with a K. So they like Ks in this family. So problems with him, and Tony's parents were conflicted. Claude and Cassie
Starting point is 00:44:33 were conflicted. Claude and Cassie were conflicted about Kip. About Cody moving away from Kip. Claude and Cassie were concerned and conflicted about Kip. The confrontation between Cody and Kip. And the cohabitation of Cody as well. So, Cody, they were conflicted about Cody's cohabitation.
Starting point is 00:45:02 Jesus Christ. A little conflicted about Cody's cohabitation. Jesus Christ. A little conflicted. Their primary concern was they knew that Tony was in love with him, though. They'd been together for a couple years, and they were worried that she was 18. So they're like, if we don't let him move in, he's going to have to go find someplace to live. And what if it's someplace not right around here? She's going to go move in with him. She's 18.
Starting point is 00:45:23 We're going to lose our daughter. We're going to lose our daughter. So they said, fuck it. It's going to go move in with him. She's 18. We're going to lose our daughter. We're going to lose our daughter. So they said, fuck it. It's better to have them here under our roof. At least she's here. They can keep an eye on them and make sure everything's going okay. So apparently as soon as he moved in, everything was fine though. The relationships
Starting point is 00:45:38 were going well. The parents liked him. They considered him part of the family right away. The father said, we became his second family and more importantly we were really invested in his success and he said he was like a son to me so right away this is how marriage is supposed to go though yeah this is they're still in high school both these kids yeah this is how you're supposed to accept your your daughter's husband not her fucking high school boyfriend come back after college and we'll try this again.
Starting point is 00:46:06 That's... Nope. They said she encouraged him, meaning Tony encouraged Cody to do schoolwork. She encouraged him to keep on track to graduate, and she encouraged him to try and be a better person, they said. In January, he was baptized as a Mormon so they could get married in the temple. Oh, wow. He converted and everything for her.
Starting point is 00:46:28 He went full Mormon for her. Fascinating. Yeah, that's what I mean. They brought one in off the sidelines. You know, and as much as I— Picked somebody up on the roster. Yeah. Got a new free agent.
Starting point is 00:46:42 Our bench is deep. We'll walk on. Got a new free agent. Our bench is deep. We'll walk on. As impressive as that is, the problem is he's making incredibly adult decisions at a far too young of an age. I'm going to join the Marines, get married, be a Mormon. These are a lot.
Starting point is 00:47:01 In 1952, this was great because you can move forward in life. But this is fucking dangerous. This is a lot in 2011 so um now cassie fratto tony's mom said that tony started to change the year kind of the year 2010 ish um they allowed obviously cody to move in here um they said quote we thought cody was really trying to put his life in order uh he has always had a lot of problems. The side of Cody which we knew was completely different from the side of Cody we know now. This was said later
Starting point is 00:47:30 on. Yeah. So early 2011, this is February 2011 after he's moved into the trailer and everything. Security cameras at West Wendover High School, where all three of these kids go to school, catches a crazy thing on the camera
Starting point is 00:47:47 here um they catch this is terrifying they catch cody pushing tony against a wall what in a violent manner yeah then lifting her legs off the ground as he choked her he choked her off the ground he grabbed her by the throat and lifted her up off the ground against the wall. Her fucking feet were dangling. Like a fucking movie. Like a movie. And that's caught on security camera. Jesus.
Starting point is 00:48:15 That is terrifying. He's sick. He thought nobody was looking. Yeah. You think so? Gee, I would hope so. Christ, if he was doing that when he thought people were looking imagine what he does behind closed doors holy fuck and as somebody who is with somebody way smaller than me like you know fucking 70 pounds and 75 pounds and a foot and
Starting point is 00:48:38 change smaller you do not you can't do that you you that they feel no it's you got to be gentle like i'm very gentle with yeah she's a lot smaller than me i could knock her down by running into her you know what i mean and that and she's not fragile that's skipping the very obvious you never do that to a girl no not at all or you shouldn't lift anybody off the ground by the throat. Girl, guy, anybody. But this is even crazier. That's nuts. The fact that he can lift her up off her feet, that's bonkers. That shows you right there he shouldn't.
Starting point is 00:49:14 That's crazy. He has that much strength. And they say this isn't the first or the last time that something like this has happened. Wow. But Tony will not file charges, and the parents don't want charges filed filed either the whole family says we don't want to file charges we're trying to help cody well the church will help him you know that's we can help him we can we can help him we can in house we can redeem him yeah much like a diddling priest they decided to handle it in house and um they said this is the parents here her explanation was that if something like this happens, he will not be accepted into the Marines.
Starting point is 00:49:50 And she said she didn't want to stand in the way of that. No. Hold on. He won't be accepted. He's standing in the way of that. Not you. Come on. She doesn't.
Starting point is 00:49:59 Yeah. But she has taken it as her. Yeah. It's on her. It's on her. It's her responsibility. Wow. Not him to not choke people in
Starting point is 00:50:05 public places or private but fuck you know um they said somebody said you have to realize what her goals were and her expectations and the final result of this was to get him into the marines because that's what he wanted she's also mickey's sisters who you know are around tony because dj had gone to school with them, they remember some stuff here. They said, quote, Tony used to get so upset if Michaela was seen talking to Cody and she would just yell and holler and say horrible things to her, meaning to Mickey. She said, you know, don't talk to him and she'd call her every name imaginable. Wow. Just get real nasty with her, cursing at her.
Starting point is 00:50:45 I'm a woman of her. Super not junior Miss Junior West Wendover Mormon ginger girl. Right. It's got to look weird. Tiny, just a flurry of expletives coming out of her. Jesus Christ. She went from the Wendy's mascot to actual Pippi Longshoreman. Yeah, to actual Pippi.
Starting point is 00:51:05 So they called her DJ. The sister said that Tony was an intensely jealous person. She said, quote, he couldn't be around girls, especially my sister, but he couldn't go do certain things. She couldn't do certain things. And if one did it, the other was like it was World War III. The insecurities are feeding the insecurities. It is codependent city and everybody's very insecure here. Yeah.
Starting point is 00:51:30 They said that Cody was on a tight leash is what one of Michaela's other sisters said. Quote, I must have been doing laundry or something. Or not Michaela. This is, yeah, somebody, Tony's's family said I must have been doing laundry or something and here Tony came in uh Tony came walking in and he was like gotta go and I was like you can't even talk to me he was like no I gotta go I can't be seen she'll get mad this was like yeah she's not allowed to talk to anybody or he's not allowed to talk to anybody and neither is she it's like this that's very unhealthy it's not allowed to talk to anybody or he's not allowed to talk to anybody and neither is she. It's like this very unhealthy.
Starting point is 00:52:06 It's not healthy for anybody, but especially teenagers. Jesus. Now, her best friend, Mickey's best friend, is named Tiffany Rasmussen. And she said she got weird text messages. Mickey did. messages uh mickey did got weird text messages uh from cody here in march and said that this tiffany said that cody and um and mickey they don't speak anymore so it was very weird and tiffany said he was wanting to do a project and saying that cody didn't explain in the messages what sort of project but he wanted to do something.
Starting point is 00:52:45 And she said Mickey was just as confused as I was. We're like, what the hell does he want to do a project with me for now? We don't even talk. It's really weird. Like at school? Yeah, like a school project. Like we want to do a project together. And she's like, what are you talking about?
Starting point is 00:52:59 So very strange how all that goes. March 3, 2011. It's a Thursday. Now, I guess DJ usually gets her and drives her home from school. She's got an older sister, too, who does it if the other one's not available. And if nobody else can, mom picks her up. Okay. But she only lives about a mile away from school.
Starting point is 00:53:23 Okay, so it's easy. It's easy. This particular day, she has track practice, goes till about 5, 530. No one's available to pick her up. Her sister's looking at a college. Her other sister is in Las Vegas with her husband, and her parents are out of town.
Starting point is 00:53:37 So she has nowhere to go. She's got to walk. She's got to walk home, but it's less than a mile, and it's track. She runs track, so she could probably fucking sprint there. I mean, it's fine. So, yeah, she was intending to walk home. Everybody was going here.
Starting point is 00:53:52 And her one sister said before we had left, me and or my husband would always pick Michaela up from school. And so we were like, are you sure you're going to have a way home? And, you know, they said it's something they did every day. And her sister said, this is the first time I left her. And yeah, so she said, her mother, Celia, this is Mickey's mother, said, she's not your typical teenager. The girl would check in with me all the time. So we have a routine. I'm changing.
Starting point is 00:54:19 I'm going to be heading out. I'm heading out the back. You know, I'm heading home. I'm home. So between track practice ending and the time she gets home, she'd get six updates from Mickey, say, on every step of the thing. And she was asked, does she always keep in touch? And her mother said, to a fault. I'm like, okay, we get it.
Starting point is 00:54:42 You're in the car and now you're home. Okay. I figured since you were in the car, now you're home okay yeah i figured since you were in the car you got home um three wet wipes good for you terrific shit so this day she cleans up after track practice and she is seen on security camera footage leaving the school at about 5 15 p.m okay um so she um as uh her her mom works at one of the local casinos, obviously, and never gets the check in texts and calls. Oh, like usual. Yeah. She said, quote, she did not call me to tell me track practice was over and she was getting ready. She didn't call me to tell me she was walking home. And so I started calling her phone and it rang and rang and rang the first time.
Starting point is 00:55:24 Then I called it right back because that was unusual. And it was like you hit the ignore button. Oh, straight to voicemail. Yeah. She said, so this is not her. She's like, that's super weird. And her sister Christina was in Las Vegas, like we said. And the mother called the sister in Vegas to say, have you heard from Mickey?
Starting point is 00:55:43 And the sister Christina said, I said, Mom, she's probably at practice. And she says, no, no practice. They ended and she's not home. I said, Mom, calm down. You're probably just missing her and she's probably fine. And so Christina tried calling her as well. No answer. Christina said, and I'm thinking maybe for the first time in her life, she's just being a normal teenager.
Starting point is 00:56:07 You know, she went, she just got distracted, is hanging out with one of her friends. They went, let's drive around for a minute. She's not thinking, let me text my mom first. She's being normal. Christina's prayed for this day and she's finally gotten it. She's now a normal kid. Yes, yes. And that's, I get that because I have a daughter who's very nice too.
Starting point is 00:56:24 And I would, she's very studious and nice. And it would be like, go do something crazy, you'd tell her. Go. Go. Do something you'll regret tomorrow. I don't care. Go hit your head on something. Don't get hurt, but go have fun.
Starting point is 00:56:38 I don't know. And so I get that. She said that DJ said my mom came in in and she said, Mickey's not here. And they said, you know, she said, where is she? This isn't funny. So DJ said, so I immediately went out and searched for her, called her friends, called all my friends. If you're here for Mickey, you need to tell me, you know, all that kind of shit. So Celia, by the way, took off from work and she was trying to find find her.
Starting point is 00:57:06 So driving around. That's a great mom. Yeah. Oh, she's she's like, this is not like her. Something's wrong. So DJ said, I called her phone real mad. And I said, this isn't funny. You need to tell me where you are. What's going on? And I just kept calling her phone, crying, begging her, please answer. Please be OK. begging her please answer please be okay so cecilia said quote by the time i had already called the by that by the time i had already called the police there was already over 80 people starting to look for her they organized a posse like that i mean the cops weren't even there yet and there was an 80 person search party that is awesome that's really fucking amazing um the police asked me did you check with this one and all of her friends?
Starting point is 00:57:47 Did you go any place that she would go? I'm like, yes. And they're all panicked and they're all out looking and everything. So they immediately knew something was wrong. And she said, Celia went on to say, it was horrible. I didn't sleep. I had to stay home in case she came home. They said, you have to guard home base in case she gets here.
Starting point is 00:58:06 And I watched the door and they kept saying, you have to be home. And I'm like, this doesn't help. That would be horrible to sit there. Oh, God. Like a prison. Yeah. This is torture. Torture chamber.
Starting point is 00:58:18 Her older sister, Christina, was in Vegas attending a NASCAR race with her husband. And at first she was the one saying, she's just fucking being a teenager. She's probably hanging out with a boy or something. Leave her alone. Now she's scared. She said, I looked at my husband and said, you need to take me home right now.
Starting point is 00:58:35 He says, what changed your mind? And I said, because nothing happens. And now something probably did. And he took his truck and drove me straight home. How about that? So the Wendover Police Department is involved right away, the West Wendover Police Department. The detective in charge said they started looking right away,
Starting point is 00:58:55 even though she's a teenager and normally being two hours late isn't a cause for a full-scale police investigation. He said, though, in this case, there's no point in waiting. The longer you wait, the bigger problem you have, the harder it's going to be to find them. Good answer, sir. Yeah, that's a real good answer. We said, well, why not now?
Starting point is 00:59:14 You know what? I'm not busy right now. Let's go. Let's take a peek. They said that they were worried. They were worried because it was dark and it was cold and she had no jacket. And her mother said she's that she's worried about that logistical things and she was she
Starting point is 00:59:29 knew something was really wrong um the police guy here police detective said police guy hi flash his bag flash his badge police guy west wendover police department police guy hi how you doing i'm a police guy i have a police guy can you answer some questions for me it's about pippi long shorman he said we didn't know where whether she'd met with foul play or she'd just been restrained and held somewhere against her will it was obvious we had more than just a runaway juvenile, but we didn't know how far it had gone. So they talked to police again, talked to everybody else. They talked to her boyfriend. She's got a boyfriend.
Starting point is 01:00:16 Oh. So they're like, well, that's interesting. Love to have a chit chat with him. Her boyfriend, Javier, and he came down to the police station and they said how she'd been acting lately and he said quote I don't know she's been acting pretty fine like if she's such a high school boyfriend right I don't know she's acting pretty fine I don't know she didn't dump me or nothing like I don't fucking pay attention stuff yeah like if she's if something is wrong she'd vent she's not one of those girls that hides her feelings, like puts her emotions in her. Okay?
Starting point is 01:00:48 He sounds like a high school kid. Javier. Javier is not going to be giving any press conferences anytime soon, I have a feeling. Maybe a nice kid, though. Puts any emotions in her. I don't even know what that means, Javier. What the fuck are you talking about? He just probably trailed off you know 16 year olds trail off they don't even give whole sentences they're like then i went there you know what the fuck are you talking about
Starting point is 01:01:16 speak whole sentences uh she's been acting pretty fine you know something puts your she's not the type of girl like put your emotions in her. You know, something. Starting point is 01:02:52 put her emotions in i don't know hold on i'm on instagram wait a second wait you fucking shut up poor javier he didn't do anything wrong. Maybe he did. We don't know. But at this point, we don't know. At this point, he's just talking. Police said, well, let's check out Mickey's cell phone. She always has her cell phone on her. She keeps in touch. Maybe there's recent calls, texts, something that would give us a clue of something.
Starting point is 01:03:19 And so they pulled up her cell phone records. And they said that there was a lot of text and phone calls transpiring just immediately after school ended and up until five. And they said they abruptly stopped at the time she had left the school. OK. So that would makes them think that whoever she was texting with is who she's with at that point. Yeah. So, yeah, they said the so they were pinging off a local cell phone tower all from one number. Local number, local guy, local tower, one number, Cody Patton's number.
Starting point is 01:03:52 Not Javier. Not Javier at all. She's just like letting her emotions out. So, police bring Cody in for a chit-chat here. They sit him down and they say, when's the last time you saw her? He said about 530. Okay. That's the last person that's seen her now.
Starting point is 01:04:10 Well, they said where? He said at the high school. He does sports too. So, you know, he's around. They said, was she with anybody? And he said just some, I thought it was her boyfriend because it was a short Mexican. Jesus. Everybody just looks like a short Mexican to this guy, though.
Starting point is 01:04:30 He's 6'8". You know what I mean? He's like, I don't know, some short Mexican. What the fuck do I know? That's 68% of this town, Cody. Yeah. I don't know. A bunch of short Mexicans. Most of this town is short and Mexican.
Starting point is 01:04:41 They say, Javier, her boyfriend? And he says, yeah, yeah, yeah. But he said, I'm not sure it was javier then he says yeah i think it was javier i'm not sure but i think it was pretty sure it was um and they he said he'd been out the night before looking for mickey too so you know i don't know i wish i could find her and they said do you have any questions for us? And he said, yeah, find her, please. That's a good question, Cody. He wants her. Well, it's a statement.
Starting point is 01:05:10 It's kind of an ask, I guess. It's an ask. So that's Thursday, March 3rd. Nope, they don't find her, obviously, Mickey, the whole night. Now we've got two days of her missing. That's the first day. That's Thursday, March 3rd. Oh, Thursday.
Starting point is 01:05:22 Yeah, yeah. By the end of the first night, they're looking at cell phones. They're talking to Cody. They have it all. March 4th, 2011, they said that hopefully, Celia said her last hope was that Mickey would show up at school in the morning. Maybe she's out. She blew off some steam, but she's not going to miss school. She's going to show up at school on Friday.
Starting point is 01:05:41 She has stuff to do. Worried everybody's sick, and now she regrets it, and she's back at school. She's going to show up at school, and we're has stuff to do. Worried everybody's sick and now she regrets it and she's back at school. She's going to show up at school and we're going to find out that there was something wrong that we didn't know about and she didn't tell us. She's upset at us or something like that. But she doesn't show up at school on Friday. Oh, no. So her mom says, when she didn't go to school on Friday morning, I knew I wouldn't see my daughter alive and I felt like a failure as a parent, not just for her but for DJ too
Starting point is 01:06:04 because I couldn't make it better. Oh, this poor woman. This poor fucking woman's going through hell. Jesus Christ. The self-imposed hell that she's doing too, man. Fuck, man. Jesus, poor thing. That's crazy.
Starting point is 01:06:16 Now, the older sister, Christina, said I went to my mom's house and I told her what was going on to find my, told her that I was going to find my sister. Even though she's not okay okay I will bring her home and for whatever reason in my mind at that point I knew that I was going to find her and that I wasn't going to find her the way we wanted to but that I was going to bring her home she searched all night Christina she went out in the desert all night drove around and searched in a big truck. Yikes. She said that, quote, I stopped and looked at any little mound of dirt that looked weird in the desert. Yeah, there's so many.
Starting point is 01:06:51 It's all, you could look and go, there's a thousand places. It's all mounds, and it all looks weird. She said, I stopped and looked at all the mounds of dirt, and she said, I went to the gravel pits also. So March 5th, Saturday. Oh, boy. Comes around. pits also so march 5th saturday oh boy comes around a volunteer driving along a road here observed an area where they thought the ground had been stirred this is about five miles outside of wendover out in the middle of the middle of the fucking desert oh boy so they looked they thought it was a little bit odd and uh they also found fresh tire tracks veering off the desert
Starting point is 01:07:25 road. So they followed the tire tracks and that's where they found the dirt that looks disturbed. So the cop later on would say about the volunteer, quote, he stated he seen some stage, some sagebrush that appeared to be disturbed and was covering some ground.
Starting point is 01:07:41 So he looked underneath the sagebrush and saw what he thought appeared to be blood and decided that he needed to call the authorities. Good call, sir. Good idea. This is in the gravel pits where Christina was looking, by the way. Oh, no. Police take a camera to record what they might find,
Starting point is 01:07:59 and they said, there, you remove the sagebrush. He gently dug into the area, and they found what they thought was a part of a human body. Jesus. So they stop the cops and they go, oh, can't disturb this anymore, calling the crime scene guys and homicide and all that sort of shit. So the closest CSI, crime scene investigative unit, that can handle something of this nature. Salt Lake. Is Reno. Because it's in the state. It's not going to be from another state.
Starting point is 01:08:27 Oh, yeah. Good point. Yeah. So they have to come all the way from Reno, which is 400 miles away. Holy shit. It took them from the time they called nine hours to get there. They drove? Yeah.
Starting point is 01:08:39 They don't have a police helicopter or some shit? Well, they need all their equipment. They need all their equipment. They have a big truck they drive there. Oh, my God. So they had to drive it there. They had nothing to do until they arrived. They had to leave a body in the ground.
Starting point is 01:08:51 I don't know whose body it is. This is the desert outside of where casinos are. So this could be anybody, literally. No, they think it's a human body. They've seen skin, but it could be anybody. I mean, fucking anybody here. So, yeah, they said uh and they were just they had to wait imagine the family waiting for nine hours to find out um it's crazy christina
Starting point is 01:09:15 said i just felt it just felt like your heart sunk i saw the unmarked police car driving on the gravel pit road that i was on the night before, and it just sank. So she went home, picked up her mother. They went to see the police chief, and he told them, quote, and she said, quote, and he says, we have found a body. So we called off the search, and I guess out of hope, I say, well, can you see her? And he says, no. I say, well, then you don't know it's her. And he says, no. I say, well, then don't you don't know it's her. And he says, you're right, Christina, but that she's the only one missing.
Starting point is 01:09:49 So we're pretty sure it's her. We've got one missing person in town in one body. It's possible. It could be anywhere from anybody from anywhere, though. So they didn't know they had to wait till the forensics team arrived. And Christina said, and then I said, you're going to leave her out here all night again? Like, that's, can you imagine that? Yeah.
Starting point is 01:10:10 That's horrible, though. We have to. We'll guard it, but I mean, yeah. She said, and he said, yes, we have to. And I remember saying that I'm not leaving, and he told us we had to, and I said, I'll have somebody, and I said, he said, I'll have somebody out here all the time.
Starting point is 01:10:24 And I said, it shouldn't be strangers. She shouldn't be left with strangers. She's got a point. Everybody would feel like that. Yeah. And she said, for them to look at me and tell me we'll all be here, she won't be alone, made me feel pretty good, I guess as good as you can feel.
Starting point is 01:10:39 So, yeah, the discovery was outside the city limits, so it was outside of the jurisdiction of the sheriff's department there in Elko. So it was a mess in terms of whose jurisdiction this is. Yeah. They said, quote, they started sifting and it didn't take very long once it started. And there was definitely Mickey in there. I mean, she's only been there a couple days. In a shallow grave beneath a clump of sagebrush.
Starting point is 01:11:08 God. That was there. Yep. The cops even said, quote, it was very emotional. The age of the victim and the brutality, I guess disturbing would be the word. How bad? Well, she'd been beaten, throat slashed, cut, stabbed repeatedly. What?
Starting point is 01:11:27 Just terrible. She looked like she'd been, you know. Just destroyed a little girl. Destroyed her. They said, quote, several jagged slashes across her face, neck, and head. Yikes. Oh, that's horrible. They said the blood loss had saturated the ground underneath her.
Starting point is 01:11:44 It was very aggressive. It was not a precision type of injury. This was just hacking a poor girl apart. That's all it was. It was nothing to do with, you know, this wasn't, you know, like I took her and cut her throat like a Colombian drug hitman or something. And even that's brutal, but at least it's fairly humane. And fairly quick. This is a horrible, brutal attack.
Starting point is 01:12:09 Brutal attack. They also said, quote, there was a zip tie bound around her wrist. Oh, why do you zip tie her and restrain her and then do that? This is fucking horrific. They said it indicated to me that she was restrained and more than likely taken from the school against her will. So now they're thinking it was a kidnap situation. Yeah. Oh, my God. So the chief medical examiner for the county pointed out bruises on her back as well. Bruises all over her where she'd been beaten. beaten, stab and slash wounds to her face and neck, including one that cut her jugular vein. And the cause of death is bleeding to death from these wounds. Her backpack is found near her body as well.
Starting point is 01:12:55 Personal effects, things like that. Celia, mom, said, quote, the one thing I will never, never forget in my entire life is watching my daughter, DJ, scream the scream I haven't heard even from her as a baby and fall to the ground in shock and disbelief. She physically did what I felt like I wanted to do, but I couldn't do because I'm the mom. I had to keep myself together. I had to be the strong one. That is horrifying. Jesus fucking Christ.
Starting point is 01:13:21 These poor people. This is terrifying. So, wow. Um, she said it was, sorry. She said it was, it was horrible.
Starting point is 01:13:30 She said, um, this is not over yet until the person or persons responsible are brought to justice. She said, she said, I wanted to see everything. She said,
Starting point is 01:13:40 I saw every autopsy photo that was taken of my daughter. I guess everybody grieves differently. Well, she said, I saw it all because I didn't want to go into the courtroom and see my daughter like that. Good answer. She wanted to know what she was expecting, and she said, for the first time, I didn't want to see it in public with everybody else. I mean, that's also a form of self um self self abuse yeah you're just abusing yourself because you feel guilty so you're like well i'm gonna torture myself with every single fucking moment of this that i can which is horrifying but she also doesn't know that they're
Starting point is 01:14:19 gonna show every picture in court too you know yeah she just wants she doesn't want to be all of them just in case it's one that she didn't see doesn't want to be surprised so they have no hairs fibers or fingerprints uh they have nothing of her of a victim of a perpetrator okay yeah they have nothing like okay there's a foreign piece carpet sample here's a thing's her yeah no hair they have nothing to go on pointing to anything um they said, quote, we started doing a little digging. We went back to the school. We obtained some video surveillance. Okay.
Starting point is 01:14:52 Now, one of the officers going through the surveillance video found a grainy image of her just outside the girl's locker room with another person. Okay. So they said just prior to her leaving from the back of the school, we saw Cody Patton leave the same doorway. Oh. That's not good. But he did say he saw her at that time. Yeah, he did.
Starting point is 01:15:11 He did. They said that Cody Patton was probably the last person to have seen her due to the fact that she had left through the southwest doors and he was in that area. That's not good for Cody. Not good, but it's also exactly what he said. Yeah. So I saw her at school at 530.
Starting point is 01:15:26 So if he didn't see her at school at 530 and they didn't see him in there, they go, why did he say he saw her at 530? So it makes sense. They said, though, why didn't Cody tell them that that's where he saw her? So they went to Mickey's mother and they went to Celia to try to find out a little more about Cody. You know, what the fuck? what's up with this guy so they said one cop said cody is a very interesting young man that's not great coming from a homicide detective not at all um cody could be the sweetest person in the world and then turn right around and just not be okay cody had a tough temper cody has a hot temper so he does so they they want to talk to Cody again.
Starting point is 01:16:06 Yeah. With the video and all that kind of thing. This time he's brought in by his dad, Kip. Kip and Cody. Oh, the ones that don't get along. They don't even get along. He moved out because they don't get along. Yeah.
Starting point is 01:16:14 So the cop who was interviewing him said, he looked like your average high school student to me. Tall, lean, clean cut, polite. He was very self-confident. Really? Seemed fine. Yeah. Which is strange for a guy who's so jealous and everything. It. He was very self-confident. Really? Seemed fine. Yeah. Which is strange for a guy who's so jealous and everything.
Starting point is 01:16:28 It's very odd. Self-confident. So they said that after police told him that he'd been seen on school surveillance video and that a tire track at the scene of the crime matches a tire on an SUV that he earlier had said he borrowed from a friend, said cody we got a lot to chit chat about here buddy i mean let's let's get scatter this up here so they ask him this is right from the recording right from the you know the tape here um of the interrogation did you sleep okay last night and he said no i've slept horrible since mickey went missing and they said how come he said it's one of my friends so he tells us the same shit he said the few days earlier he was calling and texting mickey asking
Starting point is 01:17:11 for help to move some car parts why i don't know why i don't know why he'd be like i need to move some car parts i'll call my ex-girlfriend who i don't talk to anymore who i'm not allowed to talk to anymore doesn't want me not allowed to talk to anymore. Doesn't want me to. My current girlfriend will get pissed. Yeah. That's what will help me with the car parts. That makes no sense.
Starting point is 01:17:35 He said, and then he saw her walking toward the front door of the school, which is what he said before. And he said, this is in the tape here, and I said, okay, are you all right? And she goes, yeah, I'm fine. And I said, okay, well, no worries. Have a good one. And she said, all right, you all right? And she goes, yeah, I'm fine. And I said, OK, well, no worries. Have a good one. And she said, all right, bye. And that was it.
Starting point is 01:17:51 That's all. He said he had seen her at the front door of the school with her boyfriend. And everyone else had last seen her exiting out of the back door of the school. So everybody that said they saw her last said back door. He said front door with Javier. They said back door by herself. So different. Not to mention, obviously, the security footage shows that Mickey was walking toward the rear exit, not the front exit alone.
Starting point is 01:18:18 So they said he said, what are you getting at? Cody said, OK, so what are you getting at? Because they explained this to him. Everybody else said front. You said back. What the fuck? Or everybody else said back. You said front. because they explained this to him.
Starting point is 01:18:22 Everybody else said front. You said back. What the fuck? Or everybody else said back. You said front. They said, what I'm getting at is you're not being totally truthful with us. And he says, yes, I am. And they say, no, you're not.
Starting point is 01:18:35 Literally. Yes, I am. No, you're not. Yes, I am. Am too. Am not. Am too. Am not. Okay, we need a break.
Starting point is 01:18:42 So they said, look, there's the video. They said the video from the school indicates to us that you were waiting for her. He said, I wasn't. He said, because that was the time she disappeared, and that was the time she died, and you were involved. And he said, I wasn't involved in her death, which is actually good. He's not minimizing. People would say, I didn't hurt her. I didn't do anything to her.
Starting point is 01:19:07 But to actually say death is also a slight minimization because he doesn't say, I didn't kill her. I didn't murder her. I didn't do anything like that. But he said, I wasn't involved in her death. At least that's kind of a middle ground. So they said, the cop goes, I think you were. Matter of fact, I know you were. He said, I did not michaela costanzo
Starting point is 01:19:27 uh-oh that's not great you say didn't sir you're a teenager how often do you say did not never never i did not lie full name and everybody did say kill at that point so they said i did they said quote i don't think you planned on it. I don't think you intended to. And he said, I didn't. I didn't do anything. So then Cody says, but we got to take a break. He says, you told me I could stop whenever we want. No, no, no.
Starting point is 01:19:56 I want to spend a minute alone with my dad. Oh. I want to talk to my dad for a minute alone without you fucking guys here. Most recent time I've seen that was real bad. That never works out well. Yeah.ris watts had the exact same talk it happens all the time actually i know but that was an ugly conversation yeah well i've seen i've watched i watched one recently where they these people killed this girl and uh the one kid that's how they cracked him he finally said well let me talk to let me call my mother and
Starting point is 01:20:25 they were like okay so he called his mother and said i'm in trouble i fucked up blah blah blah blah and then he confessed the whole thing so yeah you know that happens it's it's a it's a good tool too for a cop to be like if you want to talk it's fine great but we're and don't obviously don't tell him we're recording this but certainly listen in because it's so much easier to confess to somebody that you feel is going to judge you for this terrible thing. Yeah, yeah, yeah. Based on the way, at least I can control the narrative of how they hear it. Exactly. And also, too, a lot of the times the cops like this because a lot of the times the parents are the ones telling them to just tell the truth, just be honest.
Starting point is 01:21:03 These aren't Italian parents, obviously, but they're. My mother would never be like, tell the truth. Be honest. She's like, OK, here's what we're going to do. You don't talk anymore. That's what we do. Everything would start out with, all right, shut your mouth. Here's what we're doing.
Starting point is 01:21:17 That's how any Italian parents. Shut your mouth. I'm calling the lawyer. Shut your mouth. First of all, we're calling your cousin. He's a lawyer. We all have the same thing. I have an uncle. That's who they would call. they would call my godfather we'd call him up literally my godfather that's who we'd call that's how it works and that's it but not this kid not this kid no yeah
Starting point is 01:21:38 so the detectives leave the room and kip goes in the room closes the door behind him and uh the cops said they couldn't tell exactly through the door closes the door behind him and uh the cop said they couldn't tell exactly through the door what was going on but he said the cop said it didn't sound happy not at all it was some swearing yeah outside they said outside the door i didn't hear what was said but at one point i heard some wailing from the father i could hear him yell it sounded to me like he was crying that's a bad sign so back in the room a few minutes later, the detectives walk back in, and his father tells him that he needs to tell the cops everything that happened. Yeah.
Starting point is 01:22:14 He says to his son, quote, be a man. Be a man. Do 40 to 60 in the state pen. Be a man. Die in prison. Be a man do 40 to 60 in the state pen be a man but you know yeah but you know he's saying fucking fess up to what you did yeah yeah you know if it's something where like oh you know i had an equal beef with this person and whatever but this is a 16 year old girl there's no reason to be on your son's side here there's no reason to shield him from anything no you get what you deserve on this. So he said, be a man.
Starting point is 01:22:47 And Cody said, mm-hmm. And then so they said, you got to start fixing this now as much as you can. What you did is heinous, Cody. I don't want to abandon you at all, okay? You've got to do what's right for Michaela as well. And so then he says that he picked her up at school yeah picked her up at school and when they started driving Mickey insisted this is what his story that Mickey told him that he had to break up with Tony and date her
Starting point is 01:23:17 instead oh yeah Mickey got real jealous and said you got to break up with Tony and get back together with me this is ridiculous okay he's got a boyfriend. Exactly. That's why this story doesn't really fly too well. And she doesn't even like him now. She's scared of him, for Christ's sake. So he said that when he refused, she got upset. Okay.
Starting point is 01:23:38 He said, quote, she started yelling at me and said that it's because I'm not leaving Tony. Then she started on how she started like, is his words by the way because he's trying to dig uh she started like pounding on my chest and stuff you know like on a tv show like you big brute like on his chest you know the flintstones yeah um he said that they were out of the car and in the desert by this point. Why did you drive to the middle of the desert? Let's go back to that. I would be like, but how do we get one thing before the other here? But he wants to tell the gross parts first.
Starting point is 01:24:16 That's fine. So we were out there out of the car out in the desert. And he said she hit him. And he said he pushed her back to get her off of him from punching his chest he says quote she fell down and hit her head and she just laid there and was looking up at the sky and like her eyes started to turn black she turned into vecna what's going on what's happening her eyes started to turn black and I didn't know what to do. I just sat there, and she started to shake and seize, saying she fell over, hit her head, and started having a seizure is his story.
Starting point is 01:24:54 Okay. Okay. So he said he tried to check her pulse right away because he's actually had EMT training as well. Right. So he has. I'm serious. You're right. You're right. But there's a seizure, and now he's actually had EMT training as well. So he has. I'm serious. You're right. You're right.
Starting point is 01:25:06 But there's a seizure and now he's checking pulses. We're checking pulses. We're going to make sure that everything's fine. We've got to check the pulse rate before he can start a drip on her or whatever the fuck they're doing. I don't know. So he says then she started flopping around. So he said he got no pulse, but then she started flopping around. So somehow she's dead but very active very active dead person at this point so he then said so
Starting point is 01:25:34 obviously what do you do when someone falls hits their head and they're having a seizure he went to his car to get a shovel obviously oh because that would be my first thought. The shovel will help a lot. Not let's make sure she doesn't swallow her tongue and then start the long two hour drive to the hospital here. He's skipping a lot of very obvious injuries that he is not even answered for. Well, he's about to give a little bit of it here. So he grabbed the shovel from his car he said quote i just i kind of just tried to hit her on the head you know right here somewhere pointing at his head just trying just to knock her out you know for her own good because she's flopping around right obviously so trying just to knocking her out you're just beating the piss you're just beating the piss out of her. I'm just trying to just knock her out. And it hit like right here.
Starting point is 01:26:30 And it hit like hit and tore it up pretty bad. Tore it up pretty bad. That's what he said. The cop said, quote, he was very tearful. We had to stop several times to allow him to gain his composure back. A couple of times he told us he was getting physically ill while he was describing the details to us. But then he continues and he said he panicked. He said he panicked because she wouldn't stop and she was making sounds and noises and groaning and yelling. So he didn't know what else to do. He hit her with the shovel, which is obviously the first thing you try to do when someone needs medical attention, try to knock them out with a shovel.
Starting point is 01:27:06 And when that doesn't work, he said to try to stifle the sound, he cut her throat. What? Cut her throat to, you know, keep her quiet. So he beat her like crazy with a shovel, and in order to stop sounds, he opened her throat. He opened her throat because obviously that would stop the sounds. This is the worst story I've ever heard. This is his clean version, by the way. Yeah, I believe it.
Starting point is 01:27:29 This is his fucking, you know, non-parental advisory version. He said, quote, and then she stopped. Yeah, obviously. I believe it, yeah. I didn't know what to do. I was going to call my dad, but I knew he would freak out.
Starting point is 01:27:45 I don't know. You could have called was going to call my dad, but I knew he would freak out. I don't know. You could have called the ambulance when she started fucking convulsing. So I put her in the little grave thing I dug by the big bush, and I covered her up, and I took the clothes over to the gravel pit area and burned them. Okay. The cop said he stated he was alone with her. He never implicated anybody else, even being present or being aware of it. It's just him out there doing it on his own.
Starting point is 01:28:15 He did this all on his own based on she was smacking his chest and telling him that she wanted to get back together, so he did this. After he drove her to the desert to argue about it for some reason, which is the place she wanted to argue. It's the least culpable believable story i've ever heard police then find out that cody's been seeing another woman oh he's not cheating on uh on all uh what's her fuck apparently yes with an older woman oh yes an older woman and um apparently her name is wendy so wendy from wendover stop it he dates a girl
Starting point is 01:28:46 that looks like wendy and then dates wendy from wendover this whole thing and he's got kip kip cody and this is crazy fucking claude and cassie conflicted over cody's cohabitation the whole thing's a mess this is unbelievable this whole thing's a mess so um they find out that not only is he dating an older woman, but guess what? She owns an SUV with tires that match that. And guess what they found out from her? He borrowed that SUV on Thursday, March the 3rd from her. Get fucked.
Starting point is 01:29:17 Oh, yeah. So they said that she, Wendy said she knows both Tony and Cody. This is the other woman. that she Wendy said she knows both Tony and Cody. This is the other woman. She will say that she loaned her white SUV to Cody earlier that day because he needed it to to move from some wood and metal from the school. He's doing a lot of moving shit, a lot of moving shit, packing shit, moving shit. Interesting.
Starting point is 01:29:40 He was supposed to return the vehicle by 5 p.m. Mm-hmm. But at 5.45, now this Wendy, she needed the car to get to her son's basketball game. Where's the fucking guy with the car here? She's got a kid that goes and plays basketball? Yeah, big enough to dribble. Old enough to have a kid that dribbles. Is this a 30-something-year-old woman? We don't know. So she texted him to ask him where he was she said quote
Starting point is 01:30:07 he said he was not finished he said i'm still moving things but then he didn't bring the car back till 8 45 p.m oh she didn't hear from him or anything and then he finally pulls back in at 8 45 and by that time he had tony with him at 845. So he dropped the car off with Tony there. When police say, we'd love to take a look at that SUV and see if we can search that, they search it. They find a clothesline. They find a used bar of soap as well. Both of these items were not in the vehicle when she loaned the car to cody by the well by the way okay so clothesline and what else a used bar of soap you know to clean the
Starting point is 01:30:52 blood off of you yeah yeah go return a car right and a clothesline probably to tie her up i would think there you go yeah so yeah when they hear all of this and Cody's confession, obviously they go ahead and cuff Cody up. They cuff Cody. And you'd imagine Claude and Cassie are going to be, you know, confounded by this whole thing at least. So they said Patton has been enrolled as a student in West Wendover Junior Senior High School and has been attending until the time of his arrest. That's the press release. Charges include kidnapping, murder, conspiracy to commit murder and or kidnapping, murder committed during the perpetration of a kidnapping with the use of a deadly weapon, destroying evidence and attempted willful destruction of evidence. That is a bunch of bad charges.
Starting point is 01:31:46 Very bad charges. Not good. Now, Celia, Mickey's mom, couldn't believe it. Really? She wouldn't believe it was him at first. Really? She's like, no. She said, quote, I was completely shocked. It's not the person that I knew.
Starting point is 01:31:59 And my husband was there when I said, Cody didn't do this. He would never hurt her. And he says, babe, he did it. Yeah. He would never hurt her. And he says, babe, he did it. Like he confessed. They have evidence. He said so. Yeah. And then I said, then somebody made him do it. And I said that every single day since then, somebody made him do it. She's like, that's not the Cody I know. He said she would never hurt her. He would never hurt her. I don't understand why he ended up confessing to it. I'm still like there's something more to this story. She doesn't get it. So at the funeral, they have to rent a
Starting point is 01:32:30 1,000 seat concert hall to make room for her funeral. A thousand seats. There's only 4,000 people in this town. They all want to go. Everybody wants to go. They said that she was like the town's daughter. Everybody thought of her as at this point because she died. They said the entire town suffered as if the town was her parent. Now, the big question is, why the fuck did he do this? What the fuck, Cody? What the fuck, Cody? Now, we've had Codys on Crime and Sports where we're like, Cody, you asshole.
Starting point is 01:33:00 Shut up, Cody. Shut up, Cody. That's where we're at right now with this Cody. They said, why the fuck would – none of this makes sense. They're like, in his confession, why would Mickey demand he dump his fiance when she's happy with her boyfriend? None of this makes any sense. And her mom said, too, she wouldn't have done that. She just wouldn't have done that.
Starting point is 01:33:20 She had her own steady boyfriend. And she said – her sister said this, too. Out of respect for tony she'd been going out of her way to avoid going near cody because she didn't want to get yelled at just not into the drama her mother uh her mother said she never liked confrontation she did not like drama she hated drama if it was going to cause an issue she would just stay away now where's tony in all this she's standing by her man. Of course she is. She's sending him love letters in prison, promising to be faithful and true. I'll wait for you?
Starting point is 01:33:50 I'll wait for you. Yeah. Oh, my. I'll be faithful and true. She drive four hours to visit him in jail. This is very, very questionable and psychotic. That's crazy. They talked on the phone.
Starting point is 01:34:03 Here's one of their phone calls, by the way. Oh, yeah tony said not to see you every day and talk to you like things to think and everything um hold you in my arms or anything it's just hard and cody says because he's a romantic he says quote yeah i know because he's he's a cowboy poet. He said, I know it's hard for me too. It really is. What's up, bro? How much you bench? He then asked her how much she's benching nowadays.
Starting point is 01:34:37 Not a lot of thoughts in that head. Not a lot of thoughts, it seems like. Tony's parents visited Cody as well to provide support. One of her parents said, quote, I said, I don't understand this. Why? Why did you do this? Why did this happen? And he just said, I don't know.
Starting point is 01:34:55 I can't tell you anything. I don't know. What? Now, Cody's lawyers at this point are telling him to shut the fuck up about talking about it with anybody. Yeah, yeah. Because the lawyer said, quote, because the chances of him getting the death penalty are quite high oh yeah oh yeah he said i think they're very high uh it was the identity of the victim it was the brutality of the killing it was the poignancy of some of the photographs in the case they would just break your heart yeah it's
Starting point is 01:35:20 the whole fucking thing he killed the worst person to kill if you don't want the death penalty. So they said not to mention his confession, which would fuck his defense completely. Yeah. They said, I think he really regretted doing that because the confession early on was the strongest piece of evidence against him. What Cody had in mind when he told him that that he was involved in the killing or that that he did the killing. God only knows what the fuck. Why the fuck would he say that? Because his dad told him to.
Starting point is 01:35:46 Yeah, right. So they said the more his lawyer said, the more he studied the confession, the more he came to believe that there's something about, something just doesn't add up, his lawyer said. Not telling the whole truth. So he hired an investigator to do some further digging, a former Secret Service agent named Bill Savage. And he asked him, find out about all this
Starting point is 01:36:06 shit do it i want your murder investigation right what the fuck happened so they said uh quote some of the details that mr patton reported cody didn't quite pass muster uh didn't quite pass the sniff test to me they said mickey's wounds for example were so severe so brutal they certainly didn't seem to be the result of an accident like he claimed or from a shovel of all things. They said, quote, horrible slicing disfigurement to Mickey's face. Yeah, that doesn't happen. A beating with a shovel. Fuck.
Starting point is 01:36:37 Somebody wanted to say you're not so fucking pretty now, are you? That's horrible. Taking away one of her assets. Fuck my life. That is what a piece of shit. So asked tony maybe tony knows yeah the lawyer spoke to tony here kip cody's lawyer spoke to tony and um they said did she have any idea and he said absolutely not no idea they said you know they said how would you describe her? And he said, I would describe her aspect as deadpan. I would describe her as emotionless.
Starting point is 01:37:08 He said it was odd, very odd. So Mickey's sister DJ also remembered that after this all happened, the murder and everything, she said, Tony just seemed to shut down. She said she refused to look at me, refused. I understand that you're not going to be very social because it's you know it's your you know significant and they're doing this but she wouldn't talk to certain people anymore but she normally would i wouldn't if i was sticking with him i probably wouldn't go be trying to be social with the dead girl's sister either knowing my fiancee murdered her i would think she probably doesn't want to talk to me i'll go the other direction you know i kind of don't want to even be in their eyesight because yeah they probably don't want to see me
Starting point is 01:37:48 because then it reminds them of cody that's what i'm saying so totally fucking so april now comes yeah the next month and um tony goes to have a chat with kip okay okay this is uh you know cody's cody's dad here she didn't tell her parents she was going her parents were out of town she went wearing her pajamas and just took off in the car with him now emergency talk well not quite together they're going to cody's lawyer's office oh okay tony said she has some stuff she needs to tell that might help Cody. Oh. Okay. Now, this is from the recording. They said, are you willing to proceed? She said, I think so.
Starting point is 01:38:29 Yeah. All right. So she said, they said, am I to believe that you were in fact present when the girl got killed? And Tony says, yes. And yeah, she said that started with a text from Cody saying, quote, I have her. Oh, God. Meaning he grabbed Mickey and put her in the SUV.
Starting point is 01:38:52 Uh-huh. Okay. He wanted Tony to join them, she said. Cody picked her up. She said the three of them drove around and ended up at the gravel pits. Okay. Then Mickey and Cody got out of the car car and she said that Mickey started yelling at him and pushing him.
Starting point is 01:39:10 She says, quote, I looked away for like a split second and then heard a loud thud on the car or whatever. So I got out to see what happened. They say, well, what did you see? And she said, um, Michaela was on the ground and she wasn't really moving at that point. She said at that point, Cody started digging what appeared to be a grave. Already. Just pushed her and was like, well, dig a shallow grave.
Starting point is 01:39:36 This doesn't match the story anymore. Joe Pesci in Casino didn't dig this many, like that quick of a fucking grave. You know what I mean? Yeah. Jesus Christ. She said um and when he'd finished she started digging the grave and when he'd finished she he said mickey was she said mickey was lying in a semi-conscious state on the ground tony said they both started kicking
Starting point is 01:39:57 and punching her this poor girl and then then hit her with a shovel. She says, quote, she wasn't moving. And so we moved her to the grave. And then we were kind of standing there deciding what, you know, what do we do? We didn't know what really we had just done. And they said, okay. And she goes on. This is fucking horrible. Quote, I remember, like like holding down her legs and um
Starting point is 01:40:28 we had slit her throat why hold down her legs if she's already out and unconscious that's what i mean you don't have to hold her legs down at that point so they said who cut her throat and she said it was both of us i don't know how two people hold one knife but but it was both of us. So that's a bad one. It's both of us. It's not great at all here. She just fucking admitted to murder. Yeah, it's wow. So they said, yeah, I remember her not moving.
Starting point is 01:40:57 We were freaking out. We didn't know what to do. I wasn't mad. I was kind of frustrated, but I wasn't mad at her. I don't know what I was thinking, she said. Wow. Now, Cody's lawyer said she wanted to come forward with it. She was having a hard time with it.
Starting point is 01:41:13 She didn't want Cody to have to pay for something. They both participated in it. So they go on to say, all of a sudden, it changed from one crazed killer to two people who committed a homicide. And it gave us something to point the case toward other than just cody's what the fuck why did he do this yeah and she thinks she's helping him all she's doing is just damaging both of them so much and she's also thinking she's not talking to a the cop she's talking to a lawyer so she's fine but she doesn't have any privilege with that lawyer because that's not her lawyer that's the problem so anybody he can he can release that to the press if he wants that's you know uh so they search under tony's trailer oh they find the knife uh-oh she had it it was burned by the way they tried to burn the
Starting point is 01:41:59 knife i guess to burn any dna off it or whatever they burned it, along with some of Mickey's possessions and a shovel they found under there. They just hid everything under the trailer. Now, Tony's parents don't believe it. No? Right away. The mother said, my immediate thought was she's been coerced into saying this. They think, we leave, this guy who's got a son who might be on death row soon,
Starting point is 01:42:24 picks our daughter up, takes him to this lawyer's office, and they get her, oh, you'll really help Cody if you say this. So, I mean, I could see it. They think she's a perfect little Mormon beauty queen. What the fuck? She's not doing this. But she also had the shit at the house. Come on. That's the thing.
Starting point is 01:42:41 They said, well, they asked her, you thought somebody made her do it? And they said, yeah. And they said, well, thought somebody made her do it? And they said, yeah. And they said, well, who would have made her confess? And they said, Cody's dad. He's got everything. They said she didn't believe that she's confessing to law enforcement. She's just talking to attorneys, asking them if it's going to help. But they also have two very different stories, by the way, obviously.
Starting point is 01:43:01 So they said, you know, the mother mother said i don't believe that she had anything to do with the knife there was no fingerprints no dna anything to indicate anything that she was there um they said the striking her with the shovel was an order from cody oh that's what the mother says um that's what they always say it's an order from cody now they start saying that he always gives her orders he's very possessive he's physically intimidating more than a foot taller than her often angry and abusive they said he would yell at her he'd be pushing her around he would be pretty strange restraining her throwing her down why are you allowing this that's a good question in your own house he would be buried under my
Starting point is 01:43:41 fucking trailer yeah for sure yeah him it would be him under my fucking trailer. Yeah, for sure. Him. It would be him under my trailer. I'd be fucking smiling, happy to tell you about it, too. So they said that they think Tony was abused. They said, quote, she was living in fear of what she thought the repercussions would be if she brought it out. So fearing that Tony would kill her, too. Tony's parents said that their daughter had no choice but to cooperate with Cody. Okay. So her participation, as people say in what happened that night, was strictly out of fear, controlling manipulation and orders by the one she had already been suffering abuse from for two or three years.
Starting point is 01:44:17 Cody. Cody. So they said, the mother was asked, she participated though. And the mother said, participated, participated, though. The mother said participated. Participated under extreme orders. Yeah, directs. She was afraid that she would be the one lying next to McHale if she didn't follow his orders that evening. And they asked the attorney about that that took the statement from her.
Starting point is 01:44:41 And he says, baloney. There's nothing in their relationship ever that would indicate she was ever abused by Cody. I don't know. There's a videotape of her lifting her off. Unless they were practicing to reenact the 1998 Hell in a Cell match between The Undertaker and Mick Foley, I feel like probably. Well, here's the thing, James. She really was into Cirque du Soleil, and he just giving her uh some extra training today lessons in choke slamming that helps just wanted to feel less gravity holy shit um so tony's mom says that um when then this is later on she'll say this because they talk about how when he picked tony up that night cody picked tony up he already had mickey in the
Starting point is 01:45:26 truck for about 90 minutes probably an hour and a half an hour and a half yeah they said when cody picked up tony she had no idea what was going to happen and she said quote she did not believe that she would ever see her family again talking about tony this is tony's mom she knew her life was in danger she knew cody very well we all knew knew Cody very well. She knew Cody and she knew the frame of mind he was in that night. And she knew as soon as she got in the car, she told me, mom, I knew I wasn't coming home. They have the transcript the confession and uh the cops said i determined that we had probable cause to arrest her just based on her own admission
Starting point is 01:47:10 so she is booked held without bail and facing a capital murder charge as well oh boy yep uh they said um i i in my heart of hearts knew tony had something to do with it because they were a couple it was very hard for me to know. She was at school wearing his engagement ring, acting like nothing happened, and she knew nothing about it. Well, I knew she knew. I said, I'm glad. I'm so glad she's now sitting and facing what he is. Now it makes sense.
Starting point is 01:47:38 This is from Mickey's parents. So the prosecutors have decided to seek the death penalty against them both. Whoa. They're going for it all. District attorney filed the paperwork. He said he was considering it for a while. Then a week later, he said, filed the paperwork. For sure did.
Starting point is 01:47:53 Yeah. Capital cases. We have confessions recorded for both of these fucking idiots. Let's get it on. So in May, they have a birthday celebration at the high school track for Mickey. Is that right? Yep. Mom said, I bought a cake, balloons, took it down at the high school track for Mickey. Is that right? Yep. Mom said, I bought a cake, balloons, took it down to the high school, invited her friends, and that was the hardest day next to finding out that she was murdered.
Starting point is 01:48:13 Yeah. That would be easy. Right away, they're talking about Tony's mental state. Oh. She is examined by some psychiatrists and some state people. And they said she has the mental and emotional maturity of a 15-year-old. She's 19 at this point. Okay.
Starting point is 01:48:29 Which is, you know, I mean, a lot of boys I would say, that's not bad. A 19-year-old boy, I'd go, 15's pretty good. That's not bad. I'd say 12 for the most part. They said she was under the influence of Patton, who was jealous, possessive, and isolating. That's what her people say. They also found a diary that she's been keeping. Oh boy.
Starting point is 01:48:47 Oh boy. She's been keeping a diary. She gave it to Cody's parents who then turned everything over to the defense investigator and that's how they got her in here. They said, in my opinion, there was some valuable information in there in regards to Tony's personality and her
Starting point is 01:49:04 feelings. That's the investigator. She poured out everything into this shit. She said, quote, one, Cody will leave me for someone else or cheat on me. She put in one entry. Then she said, Cody and I won't last forever. We won't get married in another one. She also wrote of being scared of her relationship that it wouldn't work out with cody and if so there was no point in living she said oh which sounds like just teenage diary shit
Starting point is 01:49:31 it's you know it's certainly dramatic it's dramatics yeah i'm very but it's also could be cry for help too but i mean also could be just with teenagers right i'm very angry today so angry that i'm trying to overdose after i got off the phone with Cody, I went and took four aspirins. Listen. Okay. I never want to laugh at a suicide attempt, but that's not an attempt at overdose. No. That's just my head hurts real bad.
Starting point is 01:49:58 Or I'm planning on giving myself a terrible stomachache. That's it, one or the other, because a lot of times my neck's all fucked up. It takes four Advil to fix it. So four aspirin is definitely not a suicide attempt, I would say. But that's what it said in her diary. She was afraid of losing him to Mickey.
Starting point is 01:50:17 It said a lot in the diary. She said in one, we might as well break up so he can get back together, by the way, with a two. With a two, yeah. Because she's a teenager up so he can get back together, by the way, with a two. With a two, yeah. Because she's a teenager. So he can get back together with her.
Starting point is 01:50:29 He will be much happier and can see her a lot, a lot more than he will ever see me. They are perfect for each other. How? You live together. Right? Then she says, they would be so happy together, together, if I didn't steal him away. I know in my heart he really doesn't love me. Oh, my.
Starting point is 01:50:48 So, a deal emerges for Cody. Yeah. Based on this diary, they think that maybe Tony's the one that this is all about. Yeah. She wants to get rid of Mickey is what they're thinking. So, they said, okay, here's a deal, Cody. You plead guilty to first-degree murder. You get life in prison, but with the possibility of parole.
Starting point is 01:51:09 Okay? No death penalty. In exchange, you have to testify against Tony. Yeah. He took the deal. Okay? Takes the deal. Yep.
Starting point is 01:51:18 And he starts making a sworn statement to the DA, as he has to. It was going to be a full, this is it. This is really the full deal of what happened. Anything he lies about, then the deal's off, and he has to. It was going to be a full this is it. This is really the full deal of what happened. Anything he lies about, then the deal's off, and he'll get the death penalty. So they said there was an incident the afternoon of the murder, and just
Starting point is 01:51:36 down there at the school, Tony had confronted Mickey in a school hallway, is what he says. Tony saw Mickey in the hallway and called her a slut. said look at look at there there's that slut out loud okay now the girls then argued because she said why are you yelling calling me a slut in the hallway and so they argued and cody uh intervened and told tony to knock it off that's what he says oh boy Oh boy. Now you're taking her side. You son of a
Starting point is 01:52:05 bitch. Son of a bitch. Now, before anybody had heard this, Mickey's sister DJ had said Tony really hated Mickey. She'd walk by and Tony would say something rude under her breath all the time. Right. So this is for a couple of years this has been going on. So this is kind of believable. The sister DJ said it just grew more and more. I don't even know why, but it just escalated. So Cody tells the DA that it escalated to out of control that day. He suggested, is what he's telling the DA, quote, why don't you guys just talk it out? Yeah. Just argue, talk it out, and it's over with.
Starting point is 01:52:40 So Tony agreed. She said she wanted to duke it out with Mickey. She wanted to fight her. That's Mickey she wanted to fight her that's what she wanted we're gonna throw down now so Cody said I relayed this message to Mickey that Tony wants to fight you and I said well she wants to fight it out and Mickey came to the resolution she's like okay so Mickey decided sure I'll fight her why not so uh that's what cody says now um he said that mickey got in the car with him voluntarily they drove around for a while uh then they picked up tony they all headed to the gravel pits i guess to have a rumble that's what we're gonna do it
Starting point is 01:53:17 yeah and um he said that nothing happened out there uh well this is where he starts talking they're like okay you get out to the gravel pits what happened just as he starts describing what happened his attorney bursts into the room at this point and um his attorney bursts in and meets with cody talks to him for a minute and cody stops talking don't say any more don't say any more. And he rejects the plea deal and doesn't tell the story again. He says, never mind. I'm out of the plea deal. Fuck it. It's all over again.
Starting point is 01:53:50 Are you out of your fucking mind? You've given too much. So they take half his statement. They file it away. And so, yeah. Now, the lawyer, his lawyer says, my guess would be that there was an opportunity for Tony to confront Michaela. And they went out to the desert to have the confrontation away from prying eyes. I think something bad happened.
Starting point is 01:54:09 Well, no shit. Obviously. Yeah. He said a bad idea became a horrible idea. A bad idea that went very, very bad. You think? So then the next day the DA goes, hey, Tony, would you like a deal? Someone's getting a fucking deal and someone's testifying.
Starting point is 01:54:26 She said, I would love a deal. Why not? Sounds great. This is a better deal, as a matter of fact. Not even the deal Cody was getting. If she agrees to testify against him, she'll be allowed to plead guilty to second-degree murder with a chance of parole after only 18 years. Holy.
Starting point is 01:54:48 So that would make her 37 when she got out of 36 37 and um she said fuck yeah sign the papers immediately now she's got to tell the full truth yeah and uh or what's convenient for her the full truth whatever the one that benefits her best yeah but at this point too it's it's you know who knows so this is on the recording she said i'm a person to tell the truth and deep down i wanted people to know the truth because i knew i knew cody wasn't going to come forward and tell the complete truth so she gives a three and a half hour statement here oh boy whole new story whole new story now cody was pissed off at mickey he said he hated the sound of her voice hated everything about her couldn't stand her anymore so it was uh he said he got a text she said again she got a text from cody march the third
Starting point is 01:55:39 one of over a hundred they exchanged that day by the way. Holy. Jesus Christ. Police weren't able to recover any of them, by the way, somehow. What? I don't know how, but Tony said she knew this one. She said, it said, I have her. It's that text. Yeah. Now the story changes.
Starting point is 01:55:59 She said as they drove off into the desert, she looked back and saw mickey stuffed in the back section of the suv mickey looked scared tony said had her hands up toward her face like she was crying yeah she said cody looked determined and angry like she put her back there like the dog like i would assume she'd get out if she wanted to or move around so i don't buy this already unless she's tied up so she said c Cody looked determined and angry but wouldn't talk to her. Cody wouldn't talk to Tony even. Then as they approached the gravel pit
Starting point is 01:56:31 Cody sent her a text from the driver's seat to the passenger seat. So that Mickey can't hear it. And it said we have to kill her. She said she just kind of looked at him and mouthed well why so um anyway they said he pulled over and tony cody ordered tony to stand guard as he dug a hole be the lookout
Starting point is 01:56:59 then he took mickey out from the car and pushed her to the ground and demanded that Tony hit her. She said, quote, All I remember is him pulling her hair back and I've went up and I had need her in the face. Jesus fuck. Tony claims she was an unwilling participant and said she backed off while Cody started punching and kicking Mickey. And then he issued an order. She backed off while Cody started punching and kicking Mickey. And then he issued an order. He said, she said, quote, I remember looking up at Cody and him telling me, hit her with the shovel, hit her with the shovel.
Starting point is 01:57:37 And so I hit her on the back with the shovel, the back of the shoulder with the shovel. She said, Cody took the shovel back and whacked Mickey in the head. And then in the hole that he dug, Cody got on top of her quote. And then I remember going up and holding her legs down. So she'd stopped kicking. And then all of a sudden her legs went completely still and she wasn't moving. And that freaked me out. So I backed off and jumped up and walked off a little bit. Now she remember,
Starting point is 01:58:02 she said she claimed she helped cut her throat now? Right. The last story. Now she says Cody used the knife alone while she was wandering around the desert afterwards. On a walkabout. Yeah. Quote, she said then she saw Mickey in the hole look up at Cody and ask, quote, am I still here? Am I still alive?
Starting point is 01:58:24 Oh, Jesus. She was very aware of what was happening to her. She then said after all was done, throat cutting and everything, she said Cody ordered her to get in the car. And she said that she was sitting by herself. She heard, you know, the last gasps here of Mickey. And she said that Codyody buried mickey by himself once in the car uh she said they drove back into town went to mcdonald's for a drink and then they cruised across the state line into utah pulled off into the desert and burned mickey's clothes
Starting point is 01:58:59 and belongings the ones that they didn't bury yeah why do they strip her yeah what that's what i'm saying stripping her and slicing her face yeah that that's that's i want to stick it to you i want to embarrass you i'll show you you're not so fucking pretty i want you to have nothing that is that's all what that is that to me that's what that is stripping everything from her so they said you can't tell me to this day what happened. And she said, no. They said, he never told you that? And she said, no.
Starting point is 01:59:29 So they do a reenactment to see if this is plausible. Okay. They suggest that 55 minutes was enough time, but just barely, to do all this shit. Because in the timeline, that's how it works. Following Tony's version of events in the police report, the newspaper timed the drive involved. The time from West Wendover to the Nevada gravel pit took approximately 10 minutes.
Starting point is 01:59:51 The drive back through Wendover to the Utah gravel pit took 15 minutes, and the drive back from the Utah gravel pit, where they burned her shit, to the Fratto house another 15 minutes. With the drive time subtracted, the couple, tony's account is true had about 20 minutes to commit the murder destroy the evidence across town then
Starting point is 02:00:11 return home to clean up before tony was seen again with her parents and he was seen by wendy with no blood on him and that's hauling ass that's hauling ass so they don't know they don't know who's telling the truth but they they know they were both there they both participated yeah and this poor girl has her throat slashed and she's been beaten cut stabbed bruised buried alive all these locations for sure yeah it's fucking gross so tony pleads guilty to um second degree murder with a deadly weapon. And her sentencing here, during her sentencing, there's a lot of leeway here. Kip, Cody's dad, testified. He said
Starting point is 02:00:52 that Tony confessed to him and he says, quote, Cody got out of the car to start digging while Tony and Michaela were still in the vehicle. They got out standing next to the vehicle with Cody facing Michaela. Tony hit her with a shovel in the back. He then said they took Michaela over to the hole, and that was when her throat was cut.
Starting point is 02:01:12 This is Kip testifying to what Tony told him. Right. Which I don't understand how that's not hearsay, but whatever. But if she's there, that's not hearsay, right? I guess it's not because she didn't overhear it, But it's still you're telling me what somebody else told you. Right. But she's there. It's a direct thing.
Starting point is 02:01:29 Yeah, I guess so. Yeah. And if she's there to refute it, then it's okay, right? Well, she could get up there and refute it if she wants. So they said she remained stoic during the hearing here and sobbed quietly during most of Kip's testimony. Well, I'm sure. So the defense here. Okay.
Starting point is 02:01:47 They say that she was not a black widow. Instead, she's a sheep. She was forced and she had to follow. Psychological testing shows that she has the mental and emotional maturity of a 15-year-old. What are we talking about here? Yeah, right. Said that she was being controlled by a boyfriend who was jealous, possessive, and isolating. That's true.
Starting point is 02:02:07 Which is what the report said. So her attorney said that the only piece of credible evidence against his client was the recording, you know, of her describing what she did. Her own words. The only piece against her is a confession that she made twice. So they said there's no forensic evidence indicating Ms. Frotto participated in this crime at any time. Her statement to the lawyer and investigators, complete
Starting point is 02:02:31 rubbish. That statement was taken in utter violation of professional conduct. Is it? It doesn't seem good. I don't know. With all respect to my former partner, his former partner is the other attorney.
Starting point is 02:02:49 He knows him very well. They lied to her when they got that statement from her. Everything about Michaela Costanzo's death points to someone else. They're saying they told her if you just tell us what happened, it'll help Cody, but you'll be fine. That's what they're saying. And then she said that to try to help Cody. be fine that's what they're saying and then she said that to try to help cody he's there her lawyer is essentially saying that cody's lawyer kind of told her what to say so that would help cody but then there's then they turned it into the cops and it's on her which is i don't know think that doesn't sound right either so they asked uh when asked to explain why his client
Starting point is 02:03:22 went along with the killing and didn't try to help Nikki, he didn't have an answer to the defense attorney. I don't know. This is what he said. Quote, we're pretty clear that adolescents do unbelievably stupid things. Yeah. Which is a really glib. That's a statement. You went over that real fast.
Starting point is 02:03:39 Either side of that argument, too. That is crazy. Yeah. They do unbelievably stupid things. Okay. Where are you going with that yeah and and her psychological profile shows that she while she's 19 years old now mentally and emotionally she's much younger and typically adolescents do not think things out he said i'm not sure i'm not going to try mr patton's case but according to the statements
Starting point is 02:04:01 and according to everything we know it was mr Patton who was getting all the materials together. It was Mr. Patton who said she had to die. So you can draw your own conclusion as to who was the organizer. But the girl I'm representing did not seem like the organizer to me. Okay. I don't think it was her. You can take my word for it. That's not a great defense.
Starting point is 02:04:21 She's paying me to say this. Yeah. They said that she scored below average in her pre-sentence psychological evaluation. She's mentally and physically abused by Cody, they say also. They talk about the video incident of her being choked on a camera in school. Prosecutor doesn't see it quite that way. Prosecutor, DA, says that this murder is, quote, as horrific a murder as I suspect you will ever see. Made only worse because Costanzo was as innocent a victim as you can imagine.
Starting point is 02:04:53 That's pretty true. All that shit here. Celia pleaded for the maximum sentence for Tony. She said, there's a part of me that's just been ripped away and I'm not whole. There's not a day, not a moment, not a second that I don't think about her. And her father came in and asked for the maximum penalty as well, saying he still dreams about the murder. And he said about Tony, quote, I don't want nothing good for her ever. Yeah. Of Tony. So Mickey's mom, again, said she can't cook, she can't go to the grocery store or even read books with her grandchildren because those events remind her of what she used to do with her daughter. Of course.
Starting point is 02:05:31 She said that she thinks about her all the time. She said, I can't even go out and have lunch because that was kind of our thing on Mondays and Tuesdays. With Michaela gone, there is a part of me that's just been ripped away. She said she would have graduated from high school in a few weeks. Not only was she a star athlete and on the track team, she was also editor of the school newspaper and had aspirations of becoming a writer. Because by the next year, she would have been a senior when this is all going down. I don't have that chance to see Michaela grow up and to become the author, the mom. I can't make this right for Michaela.
Starting point is 02:06:03 Only the court can. Well, nobody can, really, honestly. She's dead on. That sucks, man. She said also it's affected her sisters. Quote, my daughter's not the same girl at all. She can't live in Wendover. She quit college.
Starting point is 02:06:16 She's struggling just to go on day by day. She's pulled herself away from everyone because she and Mickey were so close. She just can't be. She said she's had a hard time being around anything that reminds her of mickey and they always did everything together that's just fucking horrible her sister christina gets on the stand here she says now i'm just scared all the time i beg you to give her the same thing she gave my sister she didn't give her a chance she could have helped her so um mickey's dad he says, I wouldn't know where to start because I think I'm still dreaming. I think this can't be happening here. He said, I don't want nothing good for her ever. That's what I say. That's what I want.
Starting point is 02:07:06 Get it. Tony's mom said that, you know, every Sunday after church, they visit her in the county jail. They say that she's changed a lot in the last year. I say, quote, we have our Tony back. She's not acting wild anymore with her boyfriend there. Cassie says she hopes her daughter will one day be able to have a productive life. She said the teen has a dream of helping others. She said, quote, she wants to help others who have suffered through abuse or the pain and anguish of having someone take your life away from you. She said that's the biggest question of all of this. She just said to me a few days ago, why?
Starting point is 02:07:35 Why, why, why did this happen? I don't understand. The hope that I have for Tony is for her to be able to, and then she says, to move on with her life, her dream, and be able to fulfill those dreams in a way she has recently talked to me about. This incident has made her stronger in her belief in helping others. Oh, good. She'll have a chance when she's fucking 40. When she's 40, she can come on out and see how that goes. And, you know, I don't know what to tell you otherwise because, yeah, fuck off. Jesus Christ. She's going to have to get and uh start over as if she
Starting point is 02:08:05 just had a divorce after 20 years no problem so then tony speaks as well before sentencing she's she's gotta she's gotta apologize she said quote i know what i did was wrong and therefore i'm taking responsibility for my actions she said i'm sorry for what i did and i'm sorry for what i did not do and that is protect michaela she said she um uh she came from a family that offered her unconditional love and she um you know she said that she's just very sorry and all that shit she's you know had no reason to do this i fucked up i threw it all away so the judge said that you were a well-liked student. You have no criminal history. He said it is.
Starting point is 02:08:48 It's puzzling that a person like you could participate in such a terrible crime. He also said this is as violent of a killing as I've seen in 20 years on the bench. Wow. That's not good. The attack on Michaela was brutal. It was vicious. It was violent. All shockingly so.
Starting point is 02:09:04 He then said, the innocent is a victim as you can imagine. She's a top student, sports star, editor of the newspaper. She said, that's what makes us even I don't understand how you can participate. McCalla's loss to her family, to her school, to the community of Wendover
Starting point is 02:09:20 will be felt forever. I hope that someday, Ms. Fratto, you'll be able to get your life back in order. You have to live with this forever. She suffered during the attack. It took a long time for her to die. Horrible suffering. You, young lady, may fuck off
Starting point is 02:09:36 and she gets sentenced to, it's life, but with parole, sentenced to life behind bars. It's two, basically it's a minimum of 10 years for the second degree murder, but with parole, sentenced to life behind bars. Basically, it's a minimum of 10 years for the second-degree murder, but then an additional 8 to 10 years for the use of a deadly weapon and commission of a crime. So she must serve at least 18 years to get the parole for both, but it could be longer. Yeah, she'd have to get paroled after 10 for the first one to start the to start the 8 to 10 on the other one yeah exactly yes it's consecutive so uh as the judge and other everybody left the courtroom um she just tony put
Starting point is 02:10:14 her head down on the table and cried and she was allowed a conversation with her father before being led away shackled on all to start her time um yep and obviously the family is happy but they're not you know i mean they don't know what to think about it doesn't fucking matter they're thinking you know that's all it is it's nice but it's also like my daughter's dead so who cares so um her mother tony's mother declined to specifically address cody's upcoming court shit because he's going to go to trial but she described her daughter as a girl with a bright future, an active volunteer in the small community who became a victim in an emotionally and physically abusive relationship. Tony's not a monster.
Starting point is 02:10:55 She got wrapped up with the wrong person is what she said. I'm going to blame it all on Cody. It's all Cody. Fuck. Shut up, Cody. Cody's going to go to trial, but he ends up making a deal. Oh, really? It's not a great deal for him, but it's death penalty is off the table.
Starting point is 02:11:13 The good one's already gone. Yeah, you're fucked and they don't have to give you shit. No. So he ends up making a deal. It is first degree murder he pleads guilty to. Wow. And they said he had no choice uh that his lawyer said it was the sensible thing to do it would be difficult to avoid the death penalty yeah because he goes on to describe when they see those autopsy photos and they're they're putting
Starting point is 02:11:36 him in the fucking chair period and as and as big as he is exactly it's he's not sympathetic that might be the worst time to be that big fuck yeah you want to be tiny in a court i'm weak i don't know being big is very beneficial for a lot of reasons this ain't not this not this yeah so during sentencing mckayla's mother and sisters say uh things have been worse since the death. They say they continue to have nightmares. The mother here says, quote, this man should never see the light of day or be given the chance to see the light of day ever again. He took my daughter's life. He didn't give her a chance to finish high school or to get married or to have children or go to college. He had no right to take her. So he has no right to have a life or have anything. should never be free to do anything ever again it's a packed courtroom too i mean it's a it's a fucking big deal um
Starting point is 02:12:31 his lawyer makes the case for eventual parole basically begging the judge for mercy begging mickey's family for forgiveness um he speaks publicly as well he He does. He says, quote, I've sat and I've tried to go over it and over it. This is Cody to the judge at the end. There's no reason. There's no why. No justification for it. Sorry is not enough. I apologize for everything.
Starting point is 02:12:58 I'm sorry. I can't describe what happened. Can't even begin to describe it. Sorry isn't enough. I wish I could ask for forgiveness, but i don't feel i deserve it he said that mickey was always good to me and that uh anything a friend she was anything a friend could ask for he said the more i stand here the more i see how horrible this is her family didn't deserve it mickey didn't deserve it all this is what you want the guy to say yeah but it doesn't matter but it's that's
Starting point is 02:13:24 if you're a law if you're his lawyer you go okay that's what you want the guy to say yeah but it doesn't matter but it's that's if you're a law if you're his lawyer you go okay that's what you need to say is that right there i'm not saying that that's going to help anybody i'm just saying that's the lawyer saying yeah it's horrible i'm horrible i i know i know what they're feeling and it and makes me feel worse knowing that they feel that you got the right guy all this shit shit. All that shit, yeah. He said he then recited part of a poem that Mickey had written. Oh, boy. Talking about a glimmer of beauty beneath all the ugly in the world. And he said Michaela was the glimmer of beauty for people.
Starting point is 02:13:58 Michaela wrote the poem? It was a poem that she had written for him back in the day. He read her words, her words. Oh boy. Yup. Then he said to the court, I just want to state that my co-defendant Tony Fratto was not at all to blame.
Starting point is 02:14:17 Okay. That's what he says at his sentencing, which is weird because that's, he has no reason to say that she's already been sentenced. So it's, he must really believe that um they also the court the defense reminds the court that cody has had emt training he had already been accepted to join the u.s marines and even given a deployment date before the murder his attorney yeah why would you do this you have no reason to you're gonna get away from all of this all of this this so soon. So soon. Hate that shit.
Starting point is 02:14:48 So he implored the judge to uphold the principle of hope, redemption and compassion and give Cody both a chance to prove and improve himself while in prison. Now, the judge says that Patton wrote a letter to him at first in the pre-sentence report, Patton wrote a letter to him, Cody did, denying that he killed Mickey. What? Now he's out here saying he killed her, and it's all, he's so sorry and so sad. He said he laid the blame solely on Frodo, saying that she slit Mickey's throat. And the judge says, quote, your blood runs cold, Mr. Patton. Oh, no.
Starting point is 02:15:26 This is the best. There shall be no possibility of parole. You, sir, may fuck off life without. He hit him with a cowboy slam poem. That was, yeah, your blood runs cold, no possibility of parole. All this while on a horse that was trying to buck him off. That's the impressive part. That shows what an Old West judge does that no other judges do.
Starting point is 02:15:53 That's impressive. Bushwhacking ass judge. That's right. So they're in separate prisons. Cody is in one side of the state. Tony's on the other side of the state. Oh, suck it. we're near each other um like i said tony has a chance for parole but cody is cody's gonna die in prison unless yeah that's not he gets a an appeals miracle of some kind it's over for you bud
Starting point is 02:16:15 tony did an interview with anderson cooper what yeah she was asked why she hit mickey with the shovel and she said c Cody told her to. He said, just do it. It's okay. Just do it. She said she was terrified, didn't know what to do, blah, blah, blah. Obviously, Celia, Mickey's mom, said she doesn't understand the motives either, and she still thinks that Tony's holding back information. I do, too. I do, too. I don't think we've heard the whole story. No. She said
Starting point is 02:16:45 she's got to know why she participated. You cannot do something so horrendous and not know why you can't. Yeah. And especially something like this. This is very jealous, jealous lover fucking murder kind of behavior. They had a knife. They had a shovel. It wasn't like he just had this shit in the back of his car
Starting point is 02:17:01 because he had to put this shit in the back of someone else's car because he borrowed this car. this is he borrowed the car specifically for this this is certainly predetermined we just are premeditated we just don't know was tony in on the planning or did he plan it all and then grab her and take her in on it or did they plan this together which is much grosser right did do this, plan this to prove his love to her and then bring her along to show her? Or was this, you better do something about this because I'm tired of seeing you two together?
Starting point is 02:17:33 Exactly. Or did they do this together? They gassed each other up to, well, fuck it, we'll get rid of her. She also did an interview for Dateline. And by the way, a lot of good facts came out of the Dateline show that they did on this. They did some good work on that.
Starting point is 02:17:44 So in an interview with Dateline from jail, she said, this is Tony. And they asked her, there are people who say you were very jealous and that you manipulated him into committing murder. She says, I was not jealous of Michaela. Yes, that one thing that I had wrote in my diary. But that was way long early in our relationship. It was never brought up again. Nothing ever recent. He said, did you ever tell him to get rid of her? She said, no, I did not.
Starting point is 02:18:13 They said, get rid of her or you lose me? And she said, no. Didn't say it's her or it's me. She said, no. Didn't give him that choice? Absolutely not. No. I don't know about that um
Starting point is 02:18:25 none of those types of words nothing even close nothing yeah nothing during that they talk about the murder and the night of the murder they said when you put yourself back in there in your memory what does it feel like inside and she says my heart just sinks and you know to be honest it's like it takes my breath away it's like it's hard to breathe and everything what that's it's like hard to breathe and stuff you know what i'm saying is she does she mean mickey or herself it's like totally hard to breathe and stuff and you know idiot that's fucking yeah she just doesn't want to explain because what the feeling is is going to sound so cold and she's like 26 in
Starting point is 02:19:06 this interview yeah so she sounds like a fucking 17 year old still very much so um she said it's hard to breathe and everything it's not it's not something you know you want to sit there and talk about oh that's what you mean yeah clearly they said well there's differing stories so that's why i have to ask these questions they said and you hit her with a shovel? And she nods and says, yes. They say, why? She says, because I was told to. I did not want to do anything to her and everything.
Starting point is 02:19:34 She just says and everything at the end. I didn't want to do anything to her and everything. Yeah. That must be something going around the jail that they all say and everything. It may just be a tick that she has. I got a jail that they all say and everything it may just be a tick that she has i got a friend that says sit there and and he says it yeah all the time what what are you saying i don't know why shopping what who knows do both of those things and what she she goes on to say he kept telling me over and over again just do it i was like you work for nike
Starting point is 02:20:03 motherfucker or are we killing a girl what's happening she said uh it's okay to just do it is what what cody told her and then i just remember him putting her down and standing over her and him standing over her and they said she was struggling trying to get free and she said right they said then you backed off she said yes i don't know what he was doing up toward the top of her body. I could not see because he was standing in the way. And she said that she did not help Cody with the slashing and the stabbing. They said, and you didn't hold the knife and you didn't cut her. And she said, correct.
Starting point is 02:20:42 And they said, so it reduced your culpability. Got you, you know know not life without right she said you can say that yeah yeah that's that details a lot she said i'm not trying to diminish my actions or anything of what i did but i won't take responsibility for something i did not do okay you know yeah that fair. But I think you did do something. Yeah. As she said frequently, they said as Tony has distanced herself from the crime, she looked through at her mother through this interview because her mother's there. And she said, quote, I was too much in fear. I was scared.
Starting point is 02:21:19 I was terrified. She said she was an abused woman. He was afraid she'd kill her. He'd kill her, too. she said she was an abused woman he was afraid she'd kill her he'd kill her too she said quote when you're going through a type of abusive relationship you don't always fight back with your abuser to be honest i after finding everything out that i know now i believe i was next and they said why would he kill you right and she said because i was a witness and i was there with michaela now she made it sound like her and Michaela came together.

They said, well, anything you could say? And she said, I don't know. I know sorry is not enough. If I could go back, I would, and protect her and make sure that this wouldn't happen and everything. And everything.
Starting point is 02:23:16 And everything. I would go back and protect her and make sure this didn't happen and everything. Oh, God. And everything is her throat being slit, her face being cut and being buried probably partially alive uh she said that you know she would still be here today yeah which is dying for an and everything for me to call her a slut and everything that you know she'd still be here today and everything that way i could still call her a slut and stuff because we live in the same fucking place and everything. God, she sucks so much. She really does suck bad, dude.
Starting point is 02:23:47 She really does suck. So April 2021, she has her first parole hearing. And well, yeah, if she's granted parole on this murder charge, she wouldn't be released from prison. She'd rather start serving the second sentence at that point. So they're consecutive. She does her whole parole hearing she says she's a changed woman yeah um she was a in a terrible spot she's abused woman she never happened again she's a super nice she's a better man now she just wants to get out there and have a big mormon wedding and you know all that stuff and they say denied fuck off Serve at least another year.
Starting point is 02:24:27 Yeah, that's right. Fuck off, Pippi, life without. Go ahead. So she is denied parole. Cody is not enough for parole at all. Yeah, because he's not going to, right? He's not going to. He's life without.
Starting point is 02:24:41 Now, Mickey here, her burial spot here, they say that this is kind of peaceful anyway. It's really nice. They'll read right from this article. Up in the high desert mountains outside Wendover is a ranch with a small family cemetery. Their family has a ranch, I guess, with a small. With all their family in it. Yeah, like a pioneer woman yeah fucking grave out there but now i know why because if the hospital's two hours away where the fuck's the cemetery
Starting point is 02:25:11 yeah you're just gonna have to bury him here we can't if you're sick we can't get you to the hospital you'll die before we get there yeah it's been it's been all full up since 1894 it's like you know so uh they she's in there they say it's a peaceful sacred place where she uh where she rests they say quote the ranch is home she's exactly where she would have wanted to be she's laying right next to my father that's her mother saying that and yeah and she is uh in the most beautiful spot in the world to me she's like sitting on top of the world we all know that my mom myself we'd all eventually be there just not in the order that it seems to have happened oh fuck that's fucking terrible so
Starting point is 02:25:50 yeah she's there tony remains in prison and um it's so weird her pictures over the years like she's obviously almost 30 now yeah yeah but she looks i can't explain it to you but she always has this like child thing going on really it's fucking weird i don't know if that's because she went to prison very young and like that's her role is like a younger person i don't know what it is but she just looks young to me still you know i i don't know because I don't know what she looks like. Starting point is 02:28:24 So it's ridiculous. But anyway, that is West Wendover, Nevada. And what a place, what a story. And it really is kind of its own little island, this West Wendover. It's its own little island, sort of connected to Utah, not on Pacific time. Yeah. Like carved out little niche. It's so fucking weird.
Starting point is 02:28:44 It's very weird then they had like they went back and forth with the town fighting over whether they were going to annex it to utah i'm like how do you we're not moving the border so these people can combine a wendover's right pick your shit up and go to utah if you want so fucking bad otherwise what do you want or you people come over here if you want if you want brothels and gambling and weed so bad.
