Starting point is 00:01:01 The courtroom was silent as the lawyer read the Carson family's statement. It was one of those silences that isn't just the absence of noise, it's heavy, like the whole building is holding its breath. In that statement, Eve's parents and brother said something that broke everyone's heart all over again, even though the outcome of that night had been anything but fair, even though the result was unbearable, they chose to honor Eve's love for life and her love for people. That line landed with so much weight, we honor Eve's love for life, and for all people. It was such a contrast to what DiMario and Lawrence had shown when they killed her, a total lack of consideration for the life of someone so valuable.
Starting point is 00:01:45 The two young men had chosen cruelty. Her family chose compassion. Of course, their request for mercy wasn't something the court could decide right there on the spot. It had to be weighed carefully, discussed with prosecutors, and balanced against the laws of the state. Still, the statement shifted the tone of the entire case. Everyone in that room, including the defendants, knew this family was extraordinary. A year later, a university remembers. March 5, 2009, marked one year since the attack. For Eve's family, it was a day of grief. For UNC, it was a day to prove that she wasn't forgotten.
Starting point is 00:02:31 The Chancellor asked students, faculty, and staff to do something that mattered, engage in public service in her honor. Go out into the community. Volunteer. Give back. Do exactly the kind of work Eve had been known for. In his statement, the Chancellor reminded everyone, that Eve had never stopped pushing people to do more for the world around them. If something needed fixing, she was the one who stood up and said, we can do better. The best way to honor her wasn't just a plaque on a wall. It was action. That same year, the university created the Eve Marie Carson Merritt Scholarship, a permanent way to carry her spirit forward.
Starting point is 00:03:16 The scholarship would help other students chase big dreams, just as she had. It wasn't just about remembering her, it was about making sure her legacy lived on in the form of opportunities for others. DiMario's turn to face justice. Fast forward to April 2010. After two years of legal maneuvering, DeMario Atwater finally broke. He stood before the federal court and pleaded guilty. The charges were heavy, carjacking, kidnapping, and possession of weapons. He admitted to all of it.
Starting point is 00:03:53 And then, just a few weeks later, he went before the state court and did it again. This time, he pleaded guilty to first-degree murder, armed robbery, possession of a firearm by a felon, and possession of a weapon of mass destruction, because that sought-off shotgun definitely counted. Why plead guilty after so much denial? Because the deal on the table was clear, if he admitted what he had done, prosecutors would not put for the death penalty. Instead, they'd settle for life in prison. And so that's exactly what happened. The sentencing of DiMario Atwater. Five months after those guilty pleas, the federal judge in Winston-Salem handed down the sentence, life in prison, mandatory drug abuse treatment,
Starting point is 00:04:42 and restitution payments of exactly $2,947. That number, $1.2.9. 47, seems almost absurd compared to the weight of a human life. But that's how the system works. It wasn't meant to replace Eve. It was just part of the formality of justice. Then came the state sentence. The judge in Hillsborough delivered another life sentence, this one without parole, plus a concurrent 23 to 29 years for the other crimes.
Starting point is 00:05:16 DiMario was officially done. He would never again walk free. During that sentencing hearing, something unexpected happened. DeMario spoke. He turned to Eve's parents and told them he was sorry. He admitted regret. He said that no matter what sentence he received, he knew he wasn't getting what he truly deserved.
Starting point is 00:05:41 It was a strange statement, half apology, half self-condemnation. Some in the courtroom thought he sounded genuine. Starting point is 00:07:25 The more complicated trial, Lawrence Levette. If DiMario's case was wrapped up quickly with guilty pleas, Lawrence's case was the opposite. His trial dragged on for years. The main reason, he had been only 17 at the time of the murder. That meant the court had to carefully weigh issues of culpability, rehabilitation potential, and juvenile sentencing laws. He insisted from day one that he was innocent. He denied first-degree murder, denied kidnapping, denied armed robbery, denied everything. But denial wasn't enough to stop the evidence from piling up.
Starting point is 00:08:08 The trial finally began on December 6, 2011, over three years of. after Eve's death. Lawrence stayed stone-faced. He refused to testify in his own defense. The prosecution, meanwhile, brought in a parade of witnesses. They painted the picture of what had happened that night, in agonizing detail, how Eve was taken from her home, how she begged for her life, how she was kept captive, and how she was shot.
Starting point is 00:08:38 And then, the prosecution revealed something no one had publicly known until that moment. the identity of the confidential witness who had helped crack the case wide open. Enter Jason McNeil. His name was Jason McNeil. Up until then, all anyone knew was that prosecutors had a secret witness. Suddenly, he was no longer anonymous. Jason wasn't some clean-cut good guy. Far from it.
Starting point is 00:09:09 He was a 20-year-old convicted drug dealer with a rap sheet that stretched back years. He was known around Durham for stealing cars, for hustling, for trouble. But here's the key detail, he had never been involved in violence against another person. He was a criminal, yes, but he wasn't a killer. And back on the night when DeMario and Lawrence had cooked up their plan, Jason had been invited to join in. He said no. That refusal ended up being the decision that saved him from becoming a murderer. Jason's testimony On the witness stand, Jason laid everything bare.
Starting point is 00:09:50 He told the court that from the moment Eve was dragged from her home, she begged her attackers not to kill her. She pleaded for her life. He also confirmed what many had suspected, Lawrence wasn't just a bystander. He was actively involved. Jason explained how, the night of the crime, Lawrence had asked him for a ride. him for a ride. Jason turned him down. Then, the next day, Lawrence called again. This time, he said he had a woman's ATM card and wanted Jason to meet him at a strip mall in Durham. Transaction records show dozens of failed withdrawal attempts that day. Lawrence had been trying
Starting point is 00:10:33 again and again to pull money from Eve's account. Jason said he never saw him succeed, because Lawrence never gave him the cash he promised. But what stuck with the jury wasn't the money. It was the violence. The gun and the altercation. Jason recalled how, as he and Lawrence left a store that same day, a group of guys from a rival gang started trouble. They squared up, ready to fight.
Starting point is 00:11:03 Lawrence didn't back down. Instead, he pulled out a .25 caliber pistol and waved at a point-25 caliber pistol and waved around until the other guy is scattered. Jason swore in court that this was the same pistol Lawrence had gotten from DiMario's brother. Investigators later confirmed that Eve had been shot with a .25 caliber gun. That detail tied Lawrence directly to the murder weapon. The confession to Jason. The final nail came when Jason described a conversation he had with Lawrence shortly after DeMario was arrested. Lawrence was panicked.
Starting point is 00:11:42 He was convinced DeMario would snitch. He begged Jason to help him escape town. And in his desperation, he spilled the whole story. He told Jason everything about what he and DeMario had done to Eve. That confession, combined with all the physical evidence, left very little doubt about his guilt.
