So when I woke up, two in the morning, which would be Sunday morning, he wasn't home. I'm talking to Aquila, Chris Sheriff's big sister. Getting her recollection of the weekend, her brother was arrested for the murder of Kim Gollum.
Starting point is 00:00:33 So I started texting him, because he never does that, because he uses my mother's car. So I'm like, parent, like, what happened? Did he get into a fender bender? Her 19-year-old brother had stayed out all night. Chris had good routines. This was out of character. He'd been a promising Canadian soccer star
Starting point is 00:00:53 until injuries sidelined him. Now he was studying to be a carpenter. He always came home. Like, what is going on? And I'm calling him like crazy. He's not answering. She's three years older. They spent a lot of time together growing up. The next morning when I left, he still wasn't home. Again, unusual.
Starting point is 00:01:14 And his phone was off by that time. Aquila had been visiting her family for the weekend and returned to her own apartment Sunday afternoon. So the next morning, when I called home just to make sure everything was okay, my mom told me what happened. What did she tell you? She said they arrested Chris for murder.
Starting point is 00:01:35 And I said, what? Murder of who? She said the one on Mount Olive. From the Toronto Star, I'm Kevin Donovan. And this is season four of Suspicion, Murder on Mount Olive. Episode 8, The Third Man. In the last episode, I gave you a window into another side of Chris Sheriff. Yes, he'd been a top athlete, was working towards being a carpenter. Then came the arrest in August 2009 for first degree murder. While on bail, he made some choices that would be portrayed at trial as serious strikes against his character.
Starting point is 00:02:26 Smoking weed with buddies, fathering two children while on house arrest, and the big secret he'd kept, a fight that led to another teen being seriously injured. But none of this has anything to do with the Kim Gollib case. It's not evidence that he's a killer. I think it's time to drill down into the weekend of the shooting and take you step by step through the events from the perspective of those involved, including Chris Sheriff, his co-accused Awet Asfaha, and two young women they hung around with just before the shooting.
Starting point is 00:03:00 So Sunday is when? Everything happened. So where were you the previous day? Let's start with Saturday. The Saturday I was home all day. I interviewed Aquila in Marjorie and Lloyd's new house west of Toronto. After Lloyd was beaten up by Toronto police,
Starting point is 00:03:17 the family moved away. Do you recall seeing Chris that day? No. No, I seen him in the morning. The Saturday? The Saturday morning. He left, like in the afternoon. Chris borrowed his mother's four-door Mazda. Marjorie said she assumed her son would be home later that Saturday evening. Never went out late at night. Never stay out late.
Starting point is 00:03:42 And that one night, that one night, Christopher go out because he went to a barbecue. It was a heat wave. Chris was wearing jean shorts, a white t-shirt, and a silver white and black sweatshirt. He had a black durag tied around his head, his normal fashion. Chris picks up the story. How about that? So Saturday first I went to a barbecue in James Town. Together on a weekend?
Starting point is 00:04:03 I feel like it's more, like when summertime happens, especially in Carribanetown, there's a lot of barbecue, a lot of events go on. These casual summer get togethers are popular in the Jamestown, Mount Olive, Orpington area, which has a big Caribbean and African population. Carribana, a cultural festival, had officially wrapped two weeks earlier,
Starting point is 00:04:23 but neighborhood celebrations continued. A lot of barbecue, a lot of get-together, a lot of clothes. If you know them, you get to go there, drink, eat some food. Chris drove to the first barbecue in Jamestown in the early evening. There were about a dozen people there. Awet Asfaha, who lived in the neighborhood, showed up. I was going to go back to Jamie's house, but I heard music in the parking lot. So I seen it was a barbecue, so I headed toward it. That's a voice actor reading from Owette's testimony at the murder trial.
Starting point is 00:04:53 You'll recall in an earlier episode, you heard his actual voice from Owette's police interview. But other than yelling at the detective to go out and do a proper investigation, he didn't say much. I tried to interview Awet, who's in a federal prison in Western Canada serving his life sentence. He declined my request.
Starting point is 00:05:14 To be fair to Awet, I want you to hear his account of the weekend, taken directly from his testimony. It was like a block party. There were signs up invite in the neighborhood. Awet's 24 at the time. Born in Germany, his parents were from Eritrea in East Africa. Awet moved to Canada when he was seven. That weekend, he was breaking up with a girlfriend of seven years. She told him to sleep on the couch on the Friday night, and he saw the writing on the wall. Saturday, he had the weekend off work, so he went to his friend's house. He drank a lot of beer, then ended up at the barbecue.
Starting point is 00:05:51 Chris was at the same barbecue, but they didn't notice each other. Awet's five years older than Chris, went to school with Chris's sister. At the trial, Awet testified that he sometimes bought weed from Chris, though he was a drug dealer himself. Chris denies that. Here's Chris talking about that Saturday evening. That barbecue kind of finished early, and then there's the next barbecue going on in Orpanton where we went and we're chilling.
Starting point is 00:06:17 They all walk across the field to the next barbecue. Awet goes too. At the second barbecue, Chris and Awet are standing around and they wind up chatting with two young women. Roxanne, who is 20, and Hannah, who is 19, the same age as Chris. They're students on summer break. Both declined to be interviewed for this podcast. Voice actors will read their testimony from the murder trial. I talked to one girl there. We were in the kitchen, we were talking, we were vibing, you know. And then later on, while the barbecue finished, you know,
Starting point is 00:06:50 everyone wants to go somewhere else. Awet has a similar recollection. It was starting to get a little sunset, sort of. Maybe not fully dark yet. At the barbecue, we were drinking some more, talking some more. Then everybody decided to go to Juicy Jerks. It's later than Awet says it is, closer to 11 p.m. There's about 25 people hanging around.
Starting point is 00:07:11 Some of them start talking about going to a local club. Here's Hannah. Originally from Ethiopia, her family had moved to Canada and she was going to school and working in Ottawa. Everyone started heading out to Juicy Jerks. It's a restaurant, dance hall type of place where they serve alcohol and play reggae music. Chris walks back to where he parked his mother's car.
Starting point is 00:07:33 The gas needle is close to E and he has no money. But everyone wants a ride, including a guy, Hannah and Roxanne, nicknamed Clumsy, because he kept spilling his drink. Chris says, sure, just as long as someone pays for gas. Roxanne, Hannah, Awet, and Clumsy pile in for the 15 minute drive. Pretty much everyone from the barbecue ends up there
Starting point is 00:07:56 taking cabs or other cars. We got there about 11. All we did is just dance, drink, and enjoy the music. A couple of hours later, the party is winding down. It ended up with a couple of people saying they wanted to go to an after party at a hotel. Roxanne wanted to go, so I ended up going with her. Hannah, Roxanne, Awet, and Clumsy asked if Chris could drive. They asked me, hey, we want to go to a hotel.
Starting point is 00:08:24 Like, you know, go to a hotel. Like, you know, we get a ride. So I looked at the two girls, like, I said, if I can come too. So I was sitting there, I seen the two girls, and those times, I really didn't want to go home. I just wanted to kind of enjoy my time. I didn't want to finish up my life.
Starting point is 00:08:37 So they said, sure. So the two guys and the two girls were in my car. Awet tells a similar story. He refers to Chris as Hits. I noticed him when we were starting to leave Juicy Jerks. Everyone was just going with the flow. That's when Hits was there, because that's when I noticed him,
Starting point is 00:08:54 when we were ready to go leave. And we needed a drive, because I thought we were probably going to take a taxi. Then Hits was driving, so we all kind of got into his car. That's Chris, Awet, Clumsy, Hannah, and Roxanne. It's around 2 a.m., maybe a bit later. That's roughly when Aquila, Chris's sister, wakes up at the family home and realizes her brother is still out.
Starting point is 00:09:16 I was home, and I woke up at 2 in the morning, and he wasn't home, which is unusual. So I started texting him like crazy because I'm like, where are you? Why aren't you home? Answer your phone. I probably called him a dozen times until the phone died. Chris told me his phone was dead and he didn't have a charger.
Starting point is 00:09:35 This was a time before an abundance of smartphones and everyone having chargers readily available. I have no way of proving that. He told me he always called home if he was out late, but this time he decided it would be fine. He didn't want the night to end. He said he reminded everyone in the car that he needed some cash. So before we went there I said listen I'll drive you guys there but yes I have to pay me gas. My gas was almost like on E.
Starting point is 00:10:00 A 15 minute drive south brought them to the Lodge, a hotel near Toronto's Pearson Airport. Others from Juicy Jerks showed up, and three rooms were booked. Depending on who I've told this story to, a bunch of young adults getting hotel rooms in the middle of the night either gets me yawns or raised eyebrows. The yawns come from people of similar age to the youth in this story. They said, sure, it happens. Hot night, nobody has air conditioning, hotels do. Then I asked parents of young adults.
Starting point is 00:10:33 Different reaction. What the heck were these kids planning to do? Have an orgy? Do drugs? Plan crimes? It was platonic. We were watching TV, we were drinking, smoking, and having fun. That's the second young woman, Roxanne. She was home for the summer from school in London, Ontario. In her hotel room, there was Chris, Awet, Clumsy, and Hannah. By the way, Clumsy is Akeem Bailey. He's also 19. Someone who in cop jargon was known to police. Several years later,
Starting point is 00:11:07 Clumsie will be arrested on gun charges after a brazen shooting in Toronto that wounded several people. That night, Clumsie is bouncing between the two rooms. People are smoking cigarettes and weed. Someone had brought a bottle of Appleton rum. During the trial, Roxanne was asked if anything untoward was happening in their room. Also, what were they watching on TV? Wipeout, America's Funniest Home Videos. We were just flipping through channels. Even watched National Geographic on Discovery. Basically just chilling. We were just hanging out, nothing else happened. We just fell asleep. Hannah said pretty much the same thing. We were just, we were still drinking.
Starting point is 00:11:51 We were watching TV and playing music and smoking cigarettes. That's about it. Same story from Awet. We're all hanging out, drinking some more, watching TV. We watch America's funniest home videos and the Discovery Channel. Awet says he was tired and a little drunk.
Starting point is 00:12:08 They had this thing on the Discovery Channel about smallie pirates. We're all kind of laughing that they pirated a crude oil ship and they had no way of unloading the oil so they negotiated it for a measly one million or two million dollars when they had over 100 million of crude oil. Clumsy was still popping back and forth between the rooms. Eventually, he fell asleep on a small couch, griping because he was the one who paid for the room. Chris told me everyone was getting along.
Starting point is 00:12:37 It was just a continuation of the night in his mind. He said he was really hitting it off with Roxanne. She liked him in the hotel robe. I took the robe and I took out my shirt and I put the robe on and as soon as I did that, the girl see me and she like, no, I want to talk to this guy. So she didn't.
Starting point is 00:12:52 Why? I guess she liked, she said I look like a football player. Roxanne said the feeling was mutual. It was all positive. He was a nice guy. I was attracted to him. Chris and Roxanne fall asleep on one bed, Awet and Hannah on the other. Chris told me that while he was attracted to Roxanne, he's too shy to make out with
Starting point is 00:13:12 someone when others are around. Clumsy, who'd paid for the room, was the odd man out. Clumsy, he got up in the morning. He was complaining because he had to sleep on the couch and the beds were all taken. So he left on his own. I guess it was a bit of a triangle. Clumsy had been attracted to Roxanne and was miffed that she was spending time with Chris. Someone arranged for a very late checkout so they could sleep longer.
Starting point is 00:13:37 It's after 1pm when they all leave. Video from the hotel lobby security camera shows the four of them heading out. Chris is wearing a long white t-shirt. Awet has on a gray hoodie sweatshirt. They exit the lobby and walk to Chris's car at 1.24 p.m. First he needed to get gas, so we stopped at a gas station. Chris tells a similar story. My first thing to do is go to the gas station. And I know the area because once I reached there, I'm like, okay, I used to work there.
Starting point is 00:14:07 I used to work at the restaurant just down the street. Which restaurant? I used to work at Longstarr, and I used to work at Outback. Roxanne was in the front passenger seat, Awet and Hannah in the rear seat. Awet got out to buy cigarettes. Chris followed him inside.
Starting point is 00:14:23 Here's Awet. I get out at the Shell station. I get cigarettes, pay for them. Chris isn't pleased. I was really annoyed from him because he didn't give me gas money. Chris says Awet told him, sure, he'd give him 10 bucks later when he had the money. So no gas. They both got back in the car. Something I want to point out, at no time did either Hannah or Roxanne see a gun, bullets, or anything else weapon related. But Hannah, who was in the back seat, did hear something from Awet. When we were at the gas station,
Starting point is 00:15:00 Mr. Asfaha told Mr. Sheriff that he wanted to go stop somewhere. Hannah and Roxanne made it very clear they were tired and wanted to go home. No problem, Chris said. Mr. Sheriff said, let's hold on, let's drop the girls first, and then we'll deal with whatever they had to deal with. Roxanne, who was in the front seat, has no memory of this conversation. Chris told me he does remember Awet saying he needed to make a stop. I remember him saying that.
Starting point is 00:15:29 I don't exactly, I didn't know what he was talking about, but I told him okay. Chris said the four of them discussed getting together later that night. The girls back up the story. So does Awet, though Awet said he wasn't being sincere. He figured he should spend some time with his girlfriend. Hannah kept saying, are we going to meet up later?
Starting point is 00:15:49 I said, yeah. I just didn't want to be rude and say no. But I was like, OK. We did exchange numbers. Chris was feeling tired and low energy. Wanted to drop off the girls, drop them home, and whatever, and go on my own way. Chris said they headed towards Roxanne's apartment
Starting point is 00:16:07 on Kipling Avenue, following her directions. The video camera at the building shows Hannah and Roxanne walking into the lobby at 1.42 p.m. Keep that time in mind, 1.42 p.m. As she got out of the car, Roxanne said they were going to take a nap but were good to meet up later. We exchanged numbers. We were supposed to hang out later in the evening. Awet moved up into the passenger seat. Chris says he turned left out of the driveway and headed south on Kipling. This would take him towards Jamestown, where he was going to drop off Awet
Starting point is 00:16:46 before heading home to his parents' house. Then, according to Chris, Awet tells him to make a right turn on a street called Mount Olive. He said he could go pick something up. Chris says he doesn't think anything of the request. He's the guy with the car, and people are always getting him to drive places.
Starting point is 00:17:06 This is not my first time. Again, I grew up in this area where it's not my first time everyone asked me for a ride. Sometimes I'll leave early because someone's going to ask me for a ride. This area is notorious. If you have a car, a lot of people don't have cars there. So I have people on the regular asking me for rights. They drive west along Mount Olive, passing a high school on their right. On the left, just before a stop sign, is the barbecue at Winsome Santokis. This is the time when Kim Gollum, wearing his red shirt, has stopped his car, put on his four-way flashers, walked up to the gate, and asked people at the barbecue if the food is ready.
Starting point is 00:17:48 Chris says he didn't notice the car or the barbecue, which would be across the road to his left. A video of the street shot by police later that day shows the fence that runs along the yard. It's overgrown with bushes and vines, which would block the view of most of the yard from the street. At a stop sign, just past the barbecue, Chris says Awet told him to turn right and let him out.
Starting point is 00:18:17 So he asked me to drop him off. As you see, he says, on the way. I drop him off on the way. And I think it was at a stop sign, where I let him go on the way. And I think it was at the stop sign, where I let him go. And I parked. Chris does a U-turn so that his car is facing south. We'll be right back.

In Chris's trial three years after the murder,
Starting point is 00:19:15 he testified it was a wet who told him to make the U-turn. Today, Chris tells me it was his idea. He says it was a natural thing to do as it left his car pointing in the direction he would drive to take a wet home and go to his own house. That's not the street, you don't have to wait for it, man. I'll wait for him.
Starting point is 00:19:36 Now it's 1.48 p.m., six minutes after Roxanne and Hannah were dropped off. That's when three shots are fired outside Winsome Santokis BBQ. Chris said he heard nothing. He had music on in the car. He's parked around the corner about 100 meters from where the BBQ is.
Starting point is 00:19:58 Marjorie Boland, in her unit two doors away from the shooting, does hear the shots. Can you tell me the police phone number? A gentleman just went by here. My heart's beating so bad. He had a gun in his hand, and there were shots. According to Chris, Hawet returned to the car
Starting point is 00:20:18 a few minutes after he got out. Hawet got in, and they drove off. Chris turns right from Silverstone onto Mount Olive, heading the opposite direction from where the shooting is, but in the right direction to take Awet to his apartment. I asked Chris, look, a man has just been shot down the street. Didn't you see anything as you drove away? He says no. To refresh your memory, here's the description of what happened at the barbecue from eyewitness Kimora Robertson.
Starting point is 00:20:49 I was talking to my fiancee, Kurt, and my grandmother, Nevis, was sitting there, my cousins, and my boys, all three of my boys were there. And we were, you know, conversating and laughing and stuff. Kimora says a man walks up the sidewalk. And then this guy, it was a black guy, he walked up from the, it would be the left-hand side. I had noticed him from the left-hand side and he walked up.
Starting point is 00:21:19 I didn't really take nothing of it. And he walked up and then he stopped. He stopped just before the bushes in front of the house and he put up his hood. And I thought, well, you know, it's hot maybe, you know, just to shield the sun. And he flipped up his hood and then he walked up a little bit more to where the bushes were because I couldn't see. He was standing in front of the bushes. And then we just heard the shots hurt. I heard three shots. You know, pow, pow, pow.
Starting point is 00:21:53 And then he took off running back the same way. The man with the hoodie was holding something. He took off running. I seen a flat gun in his hand. Police told Chris his story, that he heard and saw nothing, made no sense. They look at me and they're like, oh, you should have known.
Starting point is 00:22:10 I'm like, I don't know nothing. Like I'm going there to enjoy my time. I'm not thinking about a random situation that's gonna happen. Like, you know, I'm going there to enjoy my time. I'm going to drop off the girls, drop them home, and whatever, I'm on my own way. Chris has never accused Awet of being the shooter,
Starting point is 00:22:28 not in his police interrogation, the trial, or in my interviews with him. And that's it. There was no planning. There was no nothing. There was no him saying, hold on. I'm going to go shoot this person right here. And I'm going to come back to your car,
Starting point is 00:22:39 and we're going to drive off. And I'm going to chop you here, and you're going to go here. I pressed Chris. Shirley Awet said something about why he was stopping. I mean, you're already ticked at him for not giving you gas money. Was he going to do a quick drug deal, maybe to get the gas money he promised? He says he had no idea why Awet asked to stop.
Starting point is 00:23:15 I wasn't really thinking of anything. I thought he probably knew someone there or he was probably going to go get something or I have no idea. Chris says he has no recollection of what he was doing at that time, other than listening to music. But that's not what he said at trial. When he was on the witness stand, he said he had his head down
Starting point is 00:23:33 and was rummaging under the dashboard for a CD. He regrets saying that now. He says he was coached. So like I was just sitting there, but my lawyer, when I was going to court, my lawyer was like, listen, you might have to say like, what you're doing,, but my lawyer, when I was going to court, my lawyer looked at this and he might have to say, like, what you're doing, why you never seen what was going on. So, I just said, okay, I'm going to say I'll look for CDs and whatever in my car, listen to music.
Starting point is 00:23:55 I was listening to music, but I don't know exactly at that moment what I was doing, but I just said it, I think it would have helped. I asked Christopher Hicks, Chris's lawyer, about this. He told me he never coached Chris to lie, but he may have asked him to concentrate on what he was doing at the relevant time. It's not great that Chris lied when he was asked this question at trial.
Starting point is 00:24:20 I think his legal team was just trying to help him explain why he didn't notice anything. I asked Chris if Awet had something in his hands when he got in the car. Witnesses saw a man running with what looked to them like a gun, but the closest witness did say the man appeared to be tucking the gun inside his hoodie as he ran. Chris said no, he saw nothing. I asked, did you notice any unusual behavior from Awet? It's at this moment that Narjit Singh,
Starting point is 00:24:54 the fellow who was walking nearby with a friend, calls 911. Emergency, do you need a police fire ambulance? Silverstone and what? Police, fire ambulance. Hello, I'm just walking here on a silver stone. Somebody shoot here three times. Silver stone and what? Silver stone and the mountain. That's all English? Somebody shoot three times, three shots.
Starting point is 00:25:16 And the guy is right down here and is in a red T-shirt. But the person shoot and he run away from us. The 911 operator wants more details. OK, how many people were in the car? Two people. One is driver, one the guy shoot. And another guy stopped car on Silverstone, and he run away. Singh testified that the man who ran by
Starting point is 00:25:40 was wearing a gray hoodie. That's what Awet was wearing when he left the hotel. Singh also said he saw the silver Mazda turn right without stopping at the stop sign. I asked Chris about this. He said he was driving normally, not in a particular rush. It's important to note that none of the witnesses reported squealing of tires, and police looked but found no tread marks on the pavement that would indicate a fast acceleration.
Starting point is 00:26:12 I just dropped in there, drove off, went home, took a shower, went to sleep, woke back up, ready for my day. Well, ready for my day was more like ready for my night. Now, I want to tell you a wet story, beginning from the point when they dropped off Hannah
Starting point is 00:27:08 and Roxanne at Roxanne's apartment. His version differs dramatically after the drop-off. This set up a very specialized type of defense that occurs when you have one crime and two defendants with different stories. The legal concept goes back hundreds of years. Here's a description from the classic British television series, Rumpole of the Bailey. Do you know what's going to happen when you and Cyril get into the witness box and start blaming each other?
Starting point is 00:27:36 It is called a cutthroat defense. And the prosecutor will be chortling in his joy and handing out the raises and you will both be found guilty. A cutthroat defense. One murder, two accused. Fingers pointing in different directions. Our case is not a perfect example. Because Chris Sheriff doesn't accuse a wet Asfa, he doesn't accuse anyone. But a wet does. All of a sudden there's a man running towards us. I'm thinking this guy's about to shoot us. A third man.
Starting point is 00:28:07 I pick up Awet's story after he, Chris, Hannah, and Roxanne leave the hotel. Awet says on the drive he was getting worried about Chantel being angry when he got home. They were pretty much broken up with but still together, and he'd been out all night. On the drive, Hannah, the girl who appeared to like him, made a request. Hannah wanted cigarettes. I wanted cigarettes. We must have smoked all of them that night. I wanted to go home and face Chantal.
Starting point is 00:28:37 I know pretty much I'm in deep trouble. They go to the Shell gas station. Awet buys cigarettes. He doesn't buy gas. He says he tells Chris, drop me off first. I was telling Hits from the hotel already to drop me off home. I don't want to be rude in front of the girls, but I'm saying like, take me back. I got to talk to Chantel, but I'm kind of saying it in different terms that the girls
Starting point is 00:29:00 don't understand. Awet says Hits, Chris Chris is not paying any attention. He's more laughing and stuff because maybe he knows I'm gonna get in trouble, but he kept insisting on dropping the girls off instead. It's a 15 minute drive north from the hotel to drop off either the two women or Awet, whose places are just 10 minutes apart. According to Roxanne and Hannah, they were both pushing to be dropped off first. Chris was on their side, and Awet said he finally gave up.
Starting point is 00:29:32 I mean, he's the driver. He controls the car. I mean, whatever. They pull into the driveway of Roxanne's apartment on Kipling Avenue. Hannah kept saying, are we gonna meet up later? I was like like yeah. I think I gave her my number. Then I jumped into the passenger seat. I assume Hitz is
Starting point is 00:29:51 going to drop me off home. We're going south on Kipling and he makes a right turn on Mount Olive. Hawet says that made him nervous. He lives in Jamestown and though he's not in a gang, he knows the Jamestown and Mount Olive Crips have a feud. I mean Mount Olive came into Jamestown and Mount Olive Crips have a feud. I mean, Mount Olive came into Jamestown that summer and shot it up. And Jamestown kept going back. I know this because like the streets talking, people are talking about it. Awet says he tells Chris this is a bad idea.
Starting point is 00:30:19 As soon as he turns on Mount Olive, I say, I thought you were going to drop me off first. And Hit says he's going to pick up one of his friends. And from there, I didn't say much. He said it's on the way. Having driven this route many times as part of my investigation, it makes sense. It's the way I would drive to get to Awet's apartment.
Starting point is 00:30:40 Though there's another route that wouldn't involve Mount Olive that Awet says he wanted to take. Regardless, they're now heading west on Mt. Olive, passing the barbecue. I didn't notice it, but there's... I noticed there's people in the field. He's talking about a grass playing field that is directly across from the barbecue. Then Hits turns right on Silverstone. He makes a U-turn and parks so it's facing south. He says he's picking up a friend and then he tells me to jump into the back seat. I took it as a sign of disrespect. It's like it was a demotion to go in the back seat.
Starting point is 00:31:14 Awet says he does what he's told. I was like, whatever. It's his friend. I jumped in the back. I was tired anyway. Hungover. I didn't really mind too much. Two to three minutes pass. Awet says he sits up straight in the back seat. I hear three shots, three to four shots. I'm like, did you hear that? Let's get out of here.
Starting point is 00:31:36 What the fuck? And Hitz doesn't move. Then I see a male running towards us with a gun in his hand. Awet recalls being terrified. So this guy's running towards us with a gun in his hand. I start panicking. I'm like, drive!
Starting point is 00:31:48 Let's go! I'm kind of tapping his seat. And this guy's getting close. I just ducked. I thought this guy was about to unload. I'm expecting the glass in the car to burst. Hawet says the guy with the gun gets in the passenger seat and yells at Chris.
Starting point is 00:32:03 He says, drive, drive, drive. And then the car starts moving and we turn right. And I pretty much flew to the other door. I hit it hard. Just to keep us on track, I want to play for you again how Narjit Singh, the fellow walking nearby, described what he saw to the 911 operator. Emergency, do you need police, fire ambulance?
Starting point is 00:32:23 Hello, I'm just walking here on the Silverstone. Yeah, somebody shoot here three times. Okay, how many people were in the car? Two people. One is driver, one the guy shoot. And another guy stopped car on Silverstone and he run away. Narjit Singh says he saw two people in the car, including the driver and the man who ran back to the car. But in Awet's version, there's a third man.
Starting point is 00:32:49 He kind of looks back, glances back at me. He shoots a cool look at me and says, yo, who's that nigger? Awet says Chris turns and looks at the guy, says not to worry. He's one of my friends. At one point in the drive, Awet gets a look at the man in the passenger seat. He says he's wearing a gray hoodie with a hood up,
Starting point is 00:33:10 but it drops down, and he sees the back of his head. He's young, probably 19, 18. He's dark skinned. He's got braids, cornrows, going tightly on his scalp, going to the back. Awet says he can smell BO, body odor, oozing off the man with braids. He doesn't say much, just one quick remark.
Starting point is 00:33:29 I ear that nigger out. Awet says Chris and the man with the braids drop him off at his apartment, a basement unit in a bungalow. I didn't say goodbye. I just got out. I was walking and looked back, and I saw his eyes burning into me. I just kept walking. I was walking and looked back and I saw his eyes burning into me. I just kept walking.
Starting point is 00:33:47 Awet goes inside. Chantel's not there. He says he's weirded out by what happened and doesn't want to be alone. He goes over to a friend's house and has a beer with a friend and a few other guys. At some point, Awet and the guys go to the beer store and bring a case back. Meanwhile, Hannah has been texting Awet, hoping they can all meet up. This is confirmed by text messages I've seen. Then, just after 6pm, Awet sends a text to Chris.
Starting point is 00:34:18 Those bitches are texting me. What are we dealing with? Awet said he sent this to get Chris to call him so he could find out what was going on. Not with plans to see the two young women, but to find out about the mystery man with braids. I'm trying to get him to come meet me. Later that night, Chris does drive out to pick up Awet and meet Hannah and Roxanne.
Starting point is 00:34:40 Awet tells him where to pick him up, a short distance from Awet's basement apartment. The police surveillance team is watching. I keep saying like, what's going on? What happened? Like who is this guy? Do I need to worry about this guy?
Starting point is 00:34:57 And Hitz goes, are you going to come and meet with the girls? I'm like, no, I'm not meeting up. He says, then why did you text me? And I say, I need to know what's going on. And he pretty much starts walking off away from me. Awet says he decides he'd better go with Chris if he's going to learn anything. They walk to the Mazda, get in, and head off to meet Hannah and Roxanne. On the way, Awet tells Chris he needs to go to his apartment and change clothes, because it'd be embarrassing to show up in the same shirt he was wearing at the hotel.
Starting point is 00:35:29 Besides, it was a hot day and I smell. I haven't even taken a shower. Then I see there's a car following us, and when Hits pulls into the apartment, this big black guy with a big gun is coming towards me saying, get down, get down. And I'm shocked, frozen. He grabs me, throws me to the ground. Awet and Chris are handcuffed and taken to the nearest police station.
Starting point is 00:35:52 You've heard what Chris told police in the interview room, that he didn't have a clue about what happened. In his interview, Awet says he doesn't know anything about a murder, doesn't mention the third man. It's not until three years later, at his trial, that Awet comes out with that story. On the witness stand, Awet is asked why he waited so long. I was afraid.
Starting point is 00:36:19 I can't just go tell them something and put my security at risk and my family's security at risk. This story of the third man, which implicated Chris, wasn't the only allegation Awet leveled at his co-accused during the trial. Awet also suggested there was bad blood between Chris and the young man nicknamed Drops, who is rumored to have lived at one point in the same housing complex as Winsome Santoki, the barbecue host. Drops is a name you'll recall from episode 6, when I told you about the report Officer
Starting point is 00:36:55 Nasser prepared based on his confidential informants. It's a report that was shared with all lawyers at the trial. When he testified, Awet took the drop story one step further. He said he'd heard, third hand, that Chris got into a fight at a local mall with drops and ripped a pendant and chain off the man's neck. Awet said that's a sign of disrespect, and he left the jury with the impression that somehow that factored into the mistaken shooting of Kim Gollop.
Starting point is 00:37:28 Here's what Awet said on the witness stand. Awet says, Ever since this trial, I've put everything together. Everybody knows hits and drops have beefs. If you're keeping track, this is the third theory that's been advanced about the case. Bloods versus Crips, Crips versus Crips, and now two young men who didn't like each other. When I asked Chris during one of our prison interviews about drops and the chain story, he said it never happened. So as I go on, I learn more.
Starting point is 00:38:03 I'm thinking, why didn't my lawyer call this guy to the court? Like you know if their witness is saying this call them to the court see what he says and see if it's true because obviously it's not true. No witnesses were called to debunk the theory but a WETS lawyer Liam O'Connor raised this chain theory with many of the people he cross-examined. O'Connor raised this chain theory with many of the people he cross-examined. He just kept bringing it up. None confirmed it or had even heard of it. But I think O'Connor's tactics in front of the jury left its mark. As I've pieced together the shooting based on the stories of Chris, Awet, the police files, and the witnesses. I realize I need to go back to the crime scene.
Starting point is 00:38:48 Some things match up, make sense. Others, not so much. Maybe Chris has been lying to me all along. You see, Chris parks his car. He's got the music on. And witnesses describe the shots as similar to a balloon popping. So it's quite possible he wouldn't hear anything. But surely he would have seen something. And then there's the trial. Just what happened in that courtroom?
Starting point is 00:39:27 Next time on Murder on Mount Olive. It was well believed, at least in the Don jail around that time, that if you were to draw a U.S. chuck in your block, you're getting convicted regardless.
