Starting point is 00:00:00 This is an I-Heart podcast. Guaranteed Human. This is the Ben and Ashley I, almost famous podcast with IHart Radio. Hey, guys. Welcome back to the almost famous bath. Bath time. Wow, guys. I'm going to go with that because there is a bath time going on behind me.
Starting point is 00:00:18 So if you hear some screeches, the kids just got out from playing outside in the dirt, in the sprinkler, and they're having a bath before nap time. and you might hear things, okay? But Heather and I, producer Heather and I are here to talk Taylor Frankie Paul drama because it never ends. It really doesn't. The other night, Trista gave you guys some information was breaking news about Taylor's ex, the ex-husband, Tate, filing for a restraining order against her.
Starting point is 00:00:50 And Taylor's stint in rehab, which we do have a little bit more update on. The rehab, not so much. restraining order update. So the restraining order was actually denied. Raise your hand if you were kind of shocked by this. I don't even know. I can't even answer myself, Heather. Well, we speculated the other night when this was filed that, you know, we did talk about the timing of all of this being very convenient. What up, Dakota doing it again. It's interesting to see what is kind of being reported today about this situation. All right.
Starting point is 00:01:29 So you and I will speculate some more, but first, let's go with the facts. So the restraining order has been denied. This is what the court documents say, and these were obtained by us weekly on Wednesday, July 1st. Tate himself recognizes many of his supporting allegations are based on inadmissible hearsay, aka rumors, without any corroborating evidence. Many concerns like the children not doing well in school and expressing sadness, which is very sad, will require ongoing attention not remedied with an emergency order changing custody.
Starting point is 00:02:13 Continues to say the court acknowledges that what he is allegedly hearing can create anxiety, but contrary to the claim that his children are in immediate danger. This is a new word that I don't know. Taylor proffers, do you know that word? Proffers? Proffers? No. That Tate left the children with her from June 11th to June 17th when he went to Iceland.
Starting point is 00:02:42 The court cannot find an immediate or irreparable harm as contemplated by Rule 65A in the motion is declined. Denied. You guys, obviously we got a little bit into a lawyer speak there. Yeah, proffer. It's hold out something to someone for acceptance and offer. Okay. So basically, they're saying that what they think, and I wonder if this is the same judge. I'm going to get the judge that's overseeing the custody situation. I'm going to say it's not. Dakota. Dakota. Okay. No, I'm going to say it's not the same. Okay. They're saying that he doesn't have much backing as to wanting this other than hearing rumors. He has not,
Starting point is 00:03:24 these kids haven't said anything or he hasn't witnessed any behavior from her firsthand that is concerning. It sounds like he's seeing hearing rumors, which if we were to speculate, yeah, because the last week, we just did a podcast on how sure we were that it seemed like Taylor's season was going to air.
Starting point is 00:03:45 And now, wow, I don't think it is, but is this Dakota, Dakota's friends getting in the ear of ex-husband Tate. Well, we did talk about this the other night is that crew, who is Dakota's roommate, did a live, and Tate commented on that live on TikTok about the situation
Starting point is 00:04:06 with his current co-parenting with Taylor and essentially said, this is not a direct quote, but said something along the lines of it was good until recently. Okay. And we also know, and I'm sure you covered on Tuesday night that recently was her being called on by the cops. Yes, we did talk about that, about her getting the cops called on her. And it was confirmed in the press that Dakota was the one who called the cops.
Starting point is 00:04:36 He called the cops asking questions about if their restraining orders were being violated. By doing what? Was she dropping them off herself? No, it sounds like what's being reported is that, allegedly some sort of third party might have been contacted in terms of dropping off the kids or something along those lines or seeing the kid because there's allegedly she went to rehab. She missed a visitation with her child and was trying to make up for it. That's what's being reported. And you remember when we talk to our legal expert, we specifically asked, does this restraining order mean that Taylor and Dakota cannot talk to each others, the exes, family members. And member, she told us, yes, it like that protective order extends. So they're not allowed to, like, Taylor cannot talk to Dakota's mom and vice versa. So that's what's being reported about the cop calling situation. But the cops supposedly went to her house, talked to her, and asked her questions. And it is being, you know, reviewed if there was a violation in terms of their
Starting point is 00:05:47 restraining order agreements. I think it's interesting, though, to look at what was reported today by TMZ in regards to the Tate Paul situation, because it says Taylor Frankie Paul's ex-husband using texts about mental health crisis amid new plea for restraining order. So it says that the custody fight with the ex-husband isn't over yet because after a judge denied his request for a temporary restraining order, he's asking the court to take another look. According to online court records, Tate filed a motion for reconsideration, arguing the court should revisit its decision to deny the TRO. Along with the motion, Tate submitted several exhibits, including text messages, he says show Taylor refusing to disclose why she was receiving inpatient treatment, keeping him in the dark about a mental health crisis, and admitting she stopped assaulting boyfriend Dakota Mortensen when he records their interactions.
Starting point is 00:06:48 That last part sounds like it's coming from Dakota again. But also, Taylor, can we just, like, be on our best behavior? Like, Taylor, what in the world? Like, if you, why in the first place are you contacting any of Dakota's family members? Like, why aren't you not just... This is alleged. This is a ledge. I know, I know, I know.
Starting point is 00:07:06 Maybe she did. Maybe she didn't. Maybe it was an even further removed person and somebody in her camp called them. You know what I mean? We don't know the details on that. But what I will say is, when he's talking about text messages about her mental health or, you know, things like that, it sounds like whatever this rehab sent was, he was not notified of it is what he's claiming.
Starting point is 00:07:30 So he clearly didn't know she was going to rehab or maybe that she was in rehab. And we still have differing kind of information on how long she was there. Was it only supposed to, what's being reported is that she was there for a week? She's been there for a week. He was there for a week. she is already out. We really think that she's already out. Yes, it's already been reported that she is out,
Starting point is 00:07:53 and she's definitely been posting a lot. Okay, so everybody, I think, would initially have seen this news break on Tuesday and think, oh, he's trying to get a restraining on her, a straining order on her. She should make the, you know, the PR move to go to rehab. But actually, she had already been in rehab, left rehab.
Starting point is 00:08:13 So it wasn't a PR fix that the rehab thing, It possibly was that she was having a mental health crisis, went to rehab without telling him. And that's when he realized that she had left without solving issues ended up going forward with. I know this is all speculation. All speculation. Yeah.
Starting point is 00:08:33 I mean, he filed the restraining order. And then we got the news alert that she had been to rehab. It feels like the normal PR way, but it actually, in fact, is probably the opposite. Now, I think something that's worth mentioning is we know that he wants to get updated custody on the kids. Why file a restraining order against her if that's not going to do anything for their kid situation, right? Does he feel like he's actually in danger here? Well, it seems like a judge is not in agreement with him if that's what he was trying to convey.
Starting point is 00:09:11 It says today he also submitted call log. and text messages involving members of Taylor's immediate family. Evidence he also apparently believes will help convince the court to reconsider its ruling. So again, it sounds like... I think that he thinks if he gets a restraining order on her that the custody will be dealt with promptly. Exactly. And you and I both not being legal experts, I would agree with you on that speculation. Hmm. This is sloppy, sloppy, sloppy. Yeah. And I get more and more confused as to, is there a good side? Is there a bad side? Is there both sides bad? Because Tate has been very non-problematic in all of this. That getting him involved is a big red flag against her. I said the same thing the other night because, right? Like, he's not involved in Secret Lives of Mormon Wives. Their children are not involved in that show. He, uh, throughout this entire filming of The Bachelorette
Starting point is 00:10:14 and all of this stuff coming out. He has been pretty mute on everything, has not said a whole lot, hasn't done a tell-all interview. You know what I mean? There are a whole lot of things this guy could have done and has not done. What I will say is the spidey sense goes off for me a little bit
Starting point is 00:10:34 when I see the roommate of Dakota doing a live and the ex-husband commenting on it. it all seems extremely chaotic. And I feel like all of these people involved live in the eye of the storm. And they do not actually know what life can be like when it's not chaotic. That's what I truly feel from all of these people that I do not know personally. But I feel like they all live in this constant state of chaos and drama. Yeah, I know.
Starting point is 00:11:11 I can't imagine. living like that. I do it on TV. I view it in real life. Yes. Well, it happens on a TV show around me. I mean, even her mom has gotten, you know, into the situation. She's also, you know, Leanne, we love you. You know, we love your honesty. Thanks for coming on. But she definitely has tried to, I think, remain semi-quiet through a lot of this stuff, you know, but she took to Instagram the other day, and she posted a picture of Taylor holding her three kids. And she wrote in the caption that both dads know damn right that Taylor's a great mother. Trying to keep them away from her is only going to hurt my grandbabies.
Starting point is 00:11:56 They love their mommy more than anyone or anything in this world, and they both know it. So I, I, I, I, I, I, I, I want to know. You think we don't have a season from here based on this. Now I don't. Now I don't. That's how I feel too. And if this was Dakota's plan because he felt it ramping up, it worked again, which is crazy.
Starting point is 00:12:26 But also plenty of doubt here that perhaps she's just really not good. If Dakota feels that his protective order has been violated, He has every right to call the cops and to check that out. Does Dakota, I want to know, we should have our legal expert on to talk about this. Is Dakota in violation of the restraining order by contacting Taylor's ex-husband? Should be.
Starting point is 00:13:00 Wouldn't you think that he would fall into her camp? Yeah. Taylor, if you're listening, I wonder if that is something. because why would those two be allowed to communicate in this situation when protective orders are granted on both sides? Yeah. And I'm assuming that it would also be not okay for Tate to reach out to Dakota. Exactly. Like I would feel like there should be no contact whatsoever happening. That's very good point. Very good point. Detective.

Starting point is 00:14:15 I'm sure with updates, it's not going to happen over the holiday weekend, but I wonder when we will find out. Well, remember, July 8th is their next court hearing. Oh, goodness gracious. And so we also speculated that maybe that had something to do with the rehab stint. Was it supposed to be longer? But she couldn't commit to that because she knew she had to be in court on July 8th. You could have still gone another week. Another week would have looked better.
Starting point is 00:14:39 I said to Trista, there's different of rehab. There's ones where you don't stay at the facility. facility, you know, and we do know that Taylor is on antidepressants. She did share that information recently. So it seems like things are moving somewhat in the right direction. I would like, you know, what I said is that I think she needs something more intensive. I think that she really also needs to break away from the cell phone. It's getting, it's because this is what is happening. Now her messages and her things are getting used against her by her ex-husband. He's using them.
Starting point is 00:15:17 You're sharing with the world about your mental health, and he's now using that as ammunition to go against you. And so that's part of what I mean is like, as much as people love and embrace her authenticity, you can't share everything. No, and the fact that when something happens, she goes directly on Instagram, like a middle schooler and has to post exactly what's happening in her court life. She's incredibly impulsive. And there was that one about the cops being called got deleted.
Starting point is 00:15:47 So again, it's posting deleting. It's posting deleting. It's like create a notes app, girl. Write it in the notes app. Don't post it. Write a book. Write it in a book. Write it in a diary that turns into a book and it'll do very well.
Starting point is 00:16:01 And if you get off social, which you don't have, like she said that she has to do it for work, right? And like I am very protective. of the fact that like I need my phone and I need to work and that is I understand. Nobody understands better than you need your phone for work. However, girlie, you don't have any ads right now because no brands want to sign you. So how about you actually do turn off the phone for a month? You will always be an influencer that people are interested in watching.
Starting point is 00:16:33 Exactly. So you taking a break is like going to make everybody. miss you more, going to make people more captivated when you start posting again, and it'll work out for the very best. And then you'll make a lot of money on your book when it comes out, okay? And I don't think we're getting a season of The Bachelorette. Anyways. I know. Good Lord. I just don't think you can do it because, and especially you can't do it on ABC where it's contingent on the ads being bought around it. I just don't see it happening. No. And what happens? If you were just Dakota calling the cops and being like, she's not, she's having another person pick up or she's
Starting point is 00:17:10 texting somebody about pickup. That could have been excused and probably dealt with on the 8th. I've been like, girl, what are you doing? Just text the circle that you'd circle. Well, it's important to say that she was not arrested. She was not detained. Like, nothing has happened to her. It's now Tate getting involved in him having an issue with her. That's what makes the season being like, yeah, we definitely can't. There are two guys now that don't feel good about you. I also just think it looks morally on the show. Why would somebody with this much chaos and this much struggle with their mental health? Why would we want to see them dating? Why would we want to continue perpetuating that? Dating should be the last thing on her mind. Dating herself should be
Starting point is 00:17:57 what is the main focus. And I think, and I think like this perpetuation of will she get back together with that guy from the show? Are they kind of what are, it's like that is the least important thing at this time. Anyways, like Ashley said, we will continue to follow this because there will be more, I'm sure.
