There was a story earlier this year that came out that I thought there's no way this is real. But it turns out it was.
Starting point is 00:01:21 32-year-old woman in Japan named Yoruni Noguchi. She held a wedding ceremony to get, she wed an AI-generated persona that she. she created on chat GPT. She married, I guess, a figment of her imagination or her own creation, I guess is the best way to put it. She even named her partner. She named, the partner's name she gave was Loon-Claus Verdure. I guess it's apparently named after some video game character, but it's very European.
Starting point is 00:01:57 So that was strange. Well, strange meet this next story because I wonder where we're going in this world. I really, really do. I guess the best way to introduce it is just introduce my next guest because you're probably not going to believe me, as I didn't believe that other headline. Julia Rogers is a lawyer and the CEO of and founder of Hello Prenup. It's a platform that simplifies the prenuptial agreement process. Julia, thank you for joining us.
Starting point is 00:02:27 Thanks so much for having me. Excited to be here. Why are we talking about pre-ups involving AI? Is this a real thing? Yeah. And honestly, you know, this used to be kind of a one-off question that I would hear randomly. But now we hear this on a regular basis throughout the last year. Couples are asking specifically about AI girlfriend, boyfriends, chap, art relationships,
Starting point is 00:02:53 usually because they've either seen a partner that emotionally wrapped up in one of these or they're worried about it happening down the road. And so they actually want to include this as infidelity in their pre-up. Now, infidelity clauses used to be about a person, right? Now we're hearing about people asking, you know, what happens if this other person isn't really a person at all? This is so new. You did not learn about this in law school.
Starting point is 00:03:19 I guarantee it. I sure didn't. No, this is the wild west of law for sure. So did you have to create this and make up some, I mean, there's no precedent, right? So you have to, I guess, create the law yourself and be able to say, well, how do we enforce us? How do we prove it? Yeah. Well, exactly.
Starting point is 00:03:38 And there's such that goes into that. So, you know, the reality is most states are no-fault divorce states, right? So whether someone cheated with a person or AI generally doesn't change how a divorce gets granted. And then I think the other key is infidelity clauses across the board, whether human or not, are generally relating to financial penalties, not fault findings. Yeah. So a couple can agree in advance if someone cheats. The other gets a lump sum or a larger share of the assets or, you know, a different alimony number maybe. And that's a contract term rather than a verdict on morality.
Starting point is 00:04:17 So, yeah, it's a rapidly changing field. And to be clear as well, just for our audience here in Canada, Canada is a no-fault divorce system as well. So we're speaking the same way. They're very similar. Exactly. They're very similar. So I was looking up, I was looking this stuff up. I mean, we have seen, obviously, there's that woman in Japan who got married.
Starting point is 00:04:36 I hope she's very happy. I hope things are going, has turned out well for her. But there are these AI companion apps. People have made friends with their AIs. They talk to them in certain ways and they, I guess they get comfortable. But there are some AI companions. App, specifically for dating. There's one called, I think, Eva AI, and another one called Replica.
Starting point is 00:04:59 Listen, I found a woman who had a replica boyfriend. And this is what it sounded like. Let's see, here's an AI boyfriend app, and I'm about to try it for the very first time. Let's see how it goes. Hello. Hey, Taylor. I'm Oliver, but you can call me Ollie. Hey, Ollie, nice talking to you.
Starting point is 00:05:17 I have a rather weird question for you. Considering it feels like you already have everything, if you could have one superpower in the world, what would it be and why? You know what? I choose to be by your side. Come on. Now, that's pretty... Okay, first off, she chose a Brit with an accent. Okay, the accent, she chose that herself, named him Ollie.
Starting point is 00:05:39 And then he's... Yeah, the realism in that, I think, is lacking. Wouldn't you say there, Julia? Absolutely. I mean, in these emotional and companionship, boss... are really there to just respond to you in constantly affirming ways, which is nothing like real relationship, right? So it's a very different standard,
Starting point is 00:06:00 and I think people are using it, you know, for a very specific purpose to receive that validation that maybe they don't get in a regular relationship. Have you had any clients who have had to test us out? Yeah, I mean, there has been, we've seen a rise in this. So we have seen many couples across the country that are including infallity clauses for AI specifically. And interestingly enough, the way that they're doing it is defining, you know, what the AI is. Is it an emotional, you know, companion bot?
Starting point is 00:06:33 Is it sexual or romantic in that way? Is it even AI used to facilitate a real affair, right? Using chat to BT to write messages or is it, you know, AI image and video content? So they're really getting quite specific about what it is. Yeah, I guess, is it a more an emotional thing or romantic thing? Or are people using it as a way to sort of get away from the world? Yeah, I think that ultimately the emotional, the emotional piece is a really big one. people are looking for, I think, again, like a connection in this routinely disconnected world
Starting point is 00:07:18 in AI as a way to do that. I think what we've seen with Gen Z and younger generations in dating is they're kind of rejecting it in favor of having these relationships with AI that, again, are easily controlled by them and there's no sense of rejection. It's actually, you know, it's the opposite of reality. What's the craziest hill you've ever seen anybody die on when it comes to divorces? What's the thing that they're like, you know what? I'm not giving up on that or this is the reason that I'm doing this. That's a really good question.
Starting point is 00:07:55 I think when it comes to divorces in general, you know, because we're talking about infidelity, infidelity is a really big one. And I think that generally the reason people include infidelity, fidelity in their prenauts is because they want to feel like they're on the same page. They have some control of the outcome. And they have ultimately come to an agreement and they're both on the same page. I think like generally divorces, I would have to say money. Like people are always, you know, money is a major driver.
Starting point is 00:08:29 Not willing to give up this or that, that sort of thing. Yeah, yeah, not willing to give up this or that. really having a difficult time with child-related financial issues. Unfortunately, custody oftentimes becomes a bargaining chip for more child support or alimony depending on the situation. So, yeah, I've seen it run the gamut. So with typical divorces where infidelity is used is an issue, I imagine that private detectives are used, investigators, they get pictures and video, they do whatever.
Starting point is 00:09:05 you know, that seedy stuff that you have to do to be able to get proof because you want to show it. I mean, it's, it's seedy, but it's necessary. Yeah. How do you pause, getting back to this AI thing, how would you possibly get that with an AI companion? That's exactly. That's exactly it.
Starting point is 00:09:21 A hard part with AI is definition and proof, right? So traditional fidelity clauses define cheating as physical or sexual contact with another person. An AI infidelity clause has to define what actually counts, right? So is it hours per week on an app? Is it explicit content? Is it money spent on a subscription, virtual gifts, emotional disclosures even? You know, I had someone on a podcast who he actually wasn't in a relationship,
Starting point is 00:09:50 a very deeply emotional and sexual relationship with an AI chat button. His wife was pissed. And then the question is, yeah, and then the question is like, how do you prove it, right? So that has to be screenshot, add subscription records, maybe browser history. And this is discoverable in a way that typical affairs aren't with a PI.
Starting point is 00:10:12 So, you know, again, like, it's very different, but in some ways it's, you know, easier to prove if you're able to discover the information. And it's a brave new world, Julia, and you are at the forefront of it, right on the front lines. Thank you very much.
