Okay, ladies and gentlemen, let's go to some people who shouldn't be sleeping well. One of them is Jack Smith. Ladies and gentlemen, John Solomon will be up on our program in just one minute.
Starting point is 00:03:43 I'm checking in with my team here to see. Okay, so it looks like Solomon is set and ready to go. All right. Real quick, let's do a preview of what John exposed today. Absolute and total bombshell before we bring on the man himself. We've obtained the Penn Register records showing the FBI sat out on Susie Wiles' phone calls. Jack Smith investigation codename Plasmic Echo is the originator of the Mar-a-Lago raid. They tracked Trump's wife and his teenage son, their movement.
Starting point is 00:04:18 He was able to snitch Jack Smith and the FBI were able to snitch on Trump's chief of staff. Ladies and gentlemen, they were able to spy on reporters. All the reporters scream, shriek, and cry about being banned from the White House so they can't freak at Trump. But this is an actual attack on the free press. What they actually did by banning us from social media, by spying on journalists, by spying on Trump's campaign, by banning entire outlets like they tried to do with Fox News.
Starting point is 00:04:53 Ladies and gentlemen, this is a monster story. And the man joining us right now is the one who broke it. The great John Solomon alive right now, ladies and gentlemen. John, I hate to do the meme, and this originates from Breaking Bad. I don't know if you've ever seen Breaking Bad. I have. It's great. He can't keep getting away with it is what Jesse yells.
Starting point is 00:05:22 He screams this about Walter White. And I feel like when you come on the program, you have new, more hideous bombshell after the next. And I want you to explain what happening here in Plasmic Echo and the documents. We have them all loaded up. But I'm sitting here raging. He can't keep getting away with it. Yeah. John, please.
Starting point is 00:05:39 I suspect that they, the deep state, the people behind the 10-year weaponization, won't be getting away with it much longer. I think that the grand jury in Florida is moving towards its first decisions, and if those decisions are indictments that will send shockwaves through the country. There is a very serious investigation. There was a change in leadership, but the evidence is the same, the theory is the same, the pursuit is the same. And I think that that's a good thing. But what is it that we've discovered? First off, let me describe my role in it. So I'm not just a journalist in this.
Starting point is 00:06:11 In this role, I also am the chairman of the White House Government Transparency Task Force. And we found these documents. We got the Justice Department to allow us to release them. We got them declassified by the White House counsel, then we put them out. What they show is that in the name of investigating a classified documents case, which is a pretty narrow issue, should someone have possessed classified documents that Mar-a-Lago, President Trump being the person, Clearly, there were some issues about whether he probably legally could have. He may have been able to keep them.
Starting point is 00:06:43 That never really got resolved. But you see three major revelations in the document. The first is before the famous raid on Mar-a-Lago. And in that case, what you see in these documents is that very senior FBI officials, including an assistant director, raised concerns that the FBI had not met the probable cause standard for authorizing a raid or a search warrant on Mar-a-Lago. In fact, they were pleading. to do something less intrusive. Maybe it would be a subpoena or negotiation or a meeting
Starting point is 00:07:12 with lawyers to get the documents because they didn't think they met the legal standard for the search warrant. And the documents show they were overruled by their bosses despite the repeated concerns of the FBI. That sets up the raid. Going into the raid, they're keeping an eye on Melania Trump and Barron Trump's activities. They're tracking their travel to figure out when the opportune time is to raid a place that they may not have had legal. authority to a raid. Then of course we know they did the raid with big shock and awe and they fake some of the evidence. Remember they put those fake empty folders on the ground that didn't exist to make it look like Donald
Starting point is 00:07:48 Trump knew he had classified evidence. Then Jack Smith gets appointed and Jack Smith gets appointed right around the time that Donald Trump announces he's running for reelection in 2024. And then Jack Smith creates a massive dragnet. That's the last part of these documents. We have constitutional protections for a free press. We have constitutional protections to freely associate politically and to engage in politics without interference from the government, including making contributions, spending money on political action committees, making political endorsements.
Starting point is 00:08:21 And then we have a fourth, fifth, and sixth amendment right to have a robust and free of government interference, legal defense should the government accuse us of wrongdoing. Jack Smith, according to these documents, appears to trample on all of those constitutional protections. He is tracking the phone calls of at least five journalists that are coming into Susie Wilde's phone. It's a pen register now. They're not getting the content of the calls. They're not sitting with a wire tap on, but they're getting to see who called who at what
Starting point is 00:08:50 time, which is very valuable information. It's called a pen register and trace and trap. They're also tracking the phone calls of the legal defense lawyers. 21 of President Trump's criminal defense attorneys, their calls were being tracked in real time by the FBI and then being transmitted immediately to Jack Smith. It's very hard to have a fair legal defense that the government knows who's talking to who at what time of day and when. And that was the second part of the intrusion. The third part of the intrusion is they were exploiting President Trump's political action committee filings.
Starting point is 00:09:25 Now, there's nothing between a political action committee and classified documents that go back to 2020. There's no connection whatsoever. But for some reason, Jack Smith's team was looking through President Trump. political expenditures. They were monitoring and they set up a social media monitoring team. There's nothing in social media that has to do with classified documents in Mar-a-Lago. And then perhaps most troubling they were also tracking individual witnesses and their political endorsements, something that has absolutely nothing to do with classified documents. And in one case,
Starting point is 00:09:57 they take those political endorsements in the case of former National Security Advisor Robert O'Brien and they try to leverage those endorsements to try to force him to cooperate when he doesn't want to cooperate. You're taking politically protected, or excuse, constitutionally protected political speech and weaponizing it to try to get someone to roll on Trump. Donations, protected by the Constitution. Political speech, protected by the Constitution. Free press and news articles, protected by the Constitution. Conversations with lawyers protected by the Constitution. Jack Smith, Dragnet, vacuumed them all up without regard. And as we saw last week when he appeared before the Senate without any remorse. He doesn't believe he did
Starting point is 00:10:37 anything wrong and he said he would do it all over again. That's why so many people are hoping there will be an accountability moment from the grand jury soon down in Florida. I have Stephen Miller's tweet up here quoting your reporting saying this was a seditious conspiracy against the republic waged from within the Department of Justice at the highest levels of government. Do you agree with that? Sedition is a big word. It has a very specific legal meaning. But listen, there's no doubt in my mind that the United States government didn't put a thumb on the election scales of 16, 20, and 24 they threw their entire darn body on it and they're supposed to stay out of elections, they're supposed to be neutral but the
Starting point is 00:11:14 power of the FBI, the power of the CIA, the power of the Justice Department were waged against President Trump and then in some cases the Justice Department outsourced its powers to states to tie up President Trump at a state level and his it is clearly a 10-year conspiracy to get Trump as Alan Dore Rishowitz's book described it. In the course of that, we know there are some legal violations already. The real question is we can see it as a political conspiracy. Does it rise to a criminal conspiracy?
Starting point is 00:11:44 And that's the question that Todd Blanche has to answer. And I assume he's going to answer it pretty quickly. Wow. Okay. So the criminal conspiracy is like, how could you possibly run a campaign if these are the type of violations that are happening? Yeah. If you know that the federal government is spying on your PAC, your political
Starting point is 00:12:02 your political action committee? Well, how does that have anything to do with a Jack Smith? But also, how are you supposed to live? How is your wife and kid supposed to function if they're being tracked by the federal government? And then your campaign chief of staff can't even communicate with the press. I mean, I guess what you're talking about here seems a lot more like what the KGB would do, right, to one of their political opponents. Like, it seems like something that you'd make like a spy movie about, right? and some type of sunken like dictatorship,
Starting point is 00:12:35 like how you would track like some type of political dissident and use the government to oppress them. That's what it, that's, as you're describing this, my blood is boiling, John, and that's what I think about. Yeah, listen, this is the Pelican brief Trump era, right? And you just see a big government chasing its critics. And the conspiracy, if it were to be brought criminally, is a conspiracy to use the color of government authority
Starting point is 00:12:58 to deprive someone of their civil liberties. Their right to free speech. their right to political association, political engagement, their right to a legal defense. So if the government use these powers to create a political and legal espionage campaign against President Trump, bigger than anything Nixon would have dreamed of back in Watergate, did that trample civil liberties. And if you did so knowingly and willfully, then you can make the case that it engages in a criminal conspiracy. What's important about that is a lot of the alleged activities go back to 16, the statute of limitations has long since.
Starting point is 00:13:31 since passed, one of our many frustrations in real America, but a conspiracy case would allow you to go back and charge things from 2016 forward. And I want to give you just one character, because, well, he's a fun character to throw into this. I'm going to sound biblical for a second, but in the beginning, there was John Brennan, in the beginning of weaponization. It is John Brennan in July of 2016 that finds out that Hillary Clinton's going to hang a fake Russian shingle on Donald Trump's campaign house. And he tells Brockville. and then they do nothing to stop it. And Crossfire Hurricane is created without an ounce of true evidence,
Starting point is 00:14:07 but with opposition research from Christopher Steele and the Clinton campaign, and they let it go on. Then Donald Trump defies the odds. He wins the 2016 election. And it's John Brennan that goes in and says, you know what, I don't like the career intelligence community's assessment that Vladimir Putin didn't help Donald Trump win the election. I want to change that, even though that's not what the evidence shows.
Starting point is 00:14:27 And so he changes the assessment, working with his co-conspirator, Barack Obama. It is John Brennan, then, who in 2020, when Joe Biden is facing the questions about the stories I wrote in 2019 at the Hill about Burisma and corrupt relations in Ukraine and China and other locations, he helps organize and signs the famous letter that interferes in the 2020 election, the 51 so-called intelligence agents who told us that the laptop was Russian disinformation when we now know it was in the FBI's hands and authenticated in real. It was Mike Morel who organized a letter. John Brennan signs that he's clearly part of that posse. In 2023, in these new documents, Benny, that we just put out, there is another extraordinary
Starting point is 00:15:12 reappearance. He's like Forrest Gump of the weaponization era. John Brennan shows up again. This guy, I'm sorry, but Beetlejuice. Please, it's Halloween. It's Halloween season. Yeah, Beetlejuice is much better. Just wrap your head around. He's at the CIA, and he's meeting with Jack Smith prosecutors and the FBI. The supposed stated reason for the meeting and the document we made public is that they want to talk to him about expert testimony. Now, I want you to think about this. The president of the United States may be going to a criminal trial for classified documents. A guy who's been on television for 10 years lampooning President Trump making up stories about him about Russia collusion and Ukraine impeachment, they're going to put that guy
Starting point is 00:15:51 before a Florida jury. No, they're not. There's no possibility. That's the stated reason for the meeting. But the most amazing thing is we really don't know what happened in the meeting because here's what happened. agents started their notes date John Brennan these are the attendees and they put their pens down they recorded none of the content of what occurred in that meeting now US Attorney's manual tells FBI agents as does the FBI Diag the operations guide for agents that when you do an interview witness you should take copious notes and then you should turn it into what's known as a 302 report an interview report for some reason the FBI agents put their pens down and
Starting point is 00:16:26 did took no notes after the meeting started other than who was there and what And then when they wrote their memo, they went out of the way. They don't normally do this, but they went out of the way to say, hey, our notes are attached to the report. They clearly were trying to signal to someone in future history that something unusual went on at this event. We need to know more about that. But John Brendan is at the end with Jack Smith. He's at the beginning with Russia collusion, and he keeps showing up all between. And what makes that interaction with John Brennan so important in November 2020,
Starting point is 00:16:56 It's just a few months after he's testified before the House Judiciary Committee, and he testified that he didn't try to put the Christopher Steele dossier into the Intelligence Committee Assessment. Testimony we now know to be false. That's now the focus of a criminal referral from both Jim Jordan, the chairman of the committee, and also the current CIA director, John Rackcliffe, referred Brennan for prosecution. It's just a few months after that that for some reason Jack Smith wants to talk to John Brennan in a paper. down moment for the FBI. Something fishy going on there. I've done interviews with the FBI. They've had to take notes. They sat there and took notes the whole time. We just put up the notice
Starting point is 00:17:35 completely blank. Yeah. What is the what is the possible explanation for this? Well, I have to wait and see. I mean the timing if you put it in the timeline, it's at a critical moment where John Brennan's testimony is in great question. I suspect that when we're all done and we're trying to get more documents released and of course we've done some reporting on this. others have too, that Jack Smith might still have been looking at issues related to Russia collusion. That what began as Russia, Russia was still Russia, Russia, in 23, 24. Let's see if the documents bear that out, if there was some inquiry about Russia intelligence or Russian documents. If so, John Brennan's testimony and some possible collaboration with John Brennan and Jack Smith
Starting point is 00:18:16 would be of significant new revelation, revelatory evidence for Congress, maybe for the grand jury down, in Florida. But the idea that John Brendan, eight years removed from government is somehow in bed with Jack Smith's prosecution team in November 23 on the eve of the 2024 election, that should raise all of our suspicion level, at least a little bit. Yeah, I mean quite a bit, in fact, John, could you please, since you're such a subject matter expert here, architect for us, what would the grand criminal conspiracy look like? What would a charge look like? It looks, I mean, the people that we talk with are saying that Jack Smith, John Brennan would be tippy top of the list.
Starting point is 00:18:56 Yeah. And that, you know, that that, that would be where this is angling in Fort Pierce. Do you agree with that assessment? And could you architect out for us like, you know, because we've never seen something like this before. Oh, this is historic. Yes, please, what would these look like? And could you put them in, if you don't mind, could you put them in context of what I'm seeing in my timeline right now, which is this is Watergate, but way worse? Yeah, Watergate may have been much smaller when you think about, at.
Starting point is 00:19:23 10-year conspiracy to stop Donald Trump using the resources of the United States government. We know something valuable from John Bunnan's lures. It's actually remarkable that they told us, but they did a court filing recently, revealing that John Bunnan has been notified that he's a target of the criminal investigation in Florida. Starting point is 00:20:19 Again, everyone's presumed innocent until proven guilty. But that is a big clue for us that John Brennan's own lawyers think that he's a target. In a criminal conspiracy to deprive one of civil liberties, according to the lawyers I talked about. I'm not a lawyer, but the reporting I've done kind of bear this out. You have to show that there was a wash, rinse, repeat cycle of intruding on someone's civil liberties. You made a false allegation. You used it to get government authority to do something. You made public statements to make someone look like they were guilty and to deprive them of civil liberties.
Starting point is 00:20:51 and it turns out it was all bogus. That would be what it is. Now, let's just take Russia collusion on that front. John Brendan knows in July, as does of 2016, as does Barack Obama, that Hillary Clinton is going to invent this fake scandal. They then allow the FBI to open up crossfire hurricane. They participate in some of the crossfire hurricane meetings and discussions. They create an intelligence product that is contrary to what the career people in the intelligence community think, meaning they want to write an evidence-free attack on Donald Trump and call it an intelligence analytical product. And by the way, to pull that off, they have to cut out most of the agencies who would disagree
Starting point is 00:21:33 with it. So they run an operation. On January 4th, 2017, Donald Trump's winning, has won the election, he's about to come in the office. The FBI informs its bosses that they've decided to clear Mike Flynn, the incoming, national security advisor for President Trump of any wrongdoing. And then the FBI agent said, don't, don't file that, don't do it. And the next day, there's a meeting in the Oval Office presided by Barack Obama with Joe Biden
Starting point is 00:22:03 and senior FBI and the Justice Department officials there. And they try to concoct a reason to keep a innocent man under investigation. The FBI's conclusion on January 4th, 2017, documents I've made public show that the FBI concluded there was no derogatory evidence suggesting Michael Flynn did, anything criminal in his dealings with Russia. The next day, the president of the United States and his henchmen and hench women are trying to figure a way to keep the investigation over
Starting point is 00:22:31 and they concoct this idea that they're gonna lure Mike Flynn into an interview. An FBI agent sitting in that meeting writes in his notes, what is our goal today? To get the truth or to take an innocent man and try to lure him into a lie so that we can prosecute him or fire him. That's what the, an FBI agent sitting in that meeting,
Starting point is 00:22:48 witnessing something occurred in the all office thought was going on. That goes on and over all through 2017. That pattern goes on. All right. Donald Trump gets cleared in 2019 of Russia collusion. What do they start right away? Ukraine impeachment. Some of the same players, John Brennan and Mike Morell. Mike Morell writes an op-ed saying Donald Trump's a threat a Russian stooge in August of 2016 as the former deputy ICI director. in 2020, he organizes the letter writing campaign that John Brennan signs. You're seeing these same players engage in similar contact. I think over the next few months, and I've already put some of this evidence out there as a journalist,
Starting point is 00:23:30 I think we'll get more out there. There'll be serious questions about the accuracy of the testimony of the impeachment, meaning that impeachment could be another Russian ruse when we're done. Let's wait and see what the evidence shows. Go to 2021. Joe Biden figures out, oh my God, or is a, But his office finds out, oh my God, Joe Biden had classified documents by his car in his Delaware home and in his UPenn office. And what do they do? The White House picks up the phone and tells the National Archives, go start a classified documents case on Donald Trump.
Starting point is 00:24:00 The FBI says, we don't have probable cause to search. And they do it again. Wash, rinse, repeat cycle, similar players, similar emotis operandi. In each instance, if someone really wasn't guilty of the crime and remember what John Durham told us in his report, not an iota of Russia collusion, not an iota, yet they investigated for three years. If you keep doing that, you're infringing on someone's freedom. There's civil liberties, there's civil rights. Get to Jack Smith, you're infringing on his legal defense strategy, his political action
Starting point is 00:24:29 committee, the travel of his wife and son. You're starting to see a pattern over a 10-year span that looks like a washman's repeat cycle of using the government to harm Donald Trump and his followers. civil liberties and I'll throw in for good measure, maybe also intrude on Congress's separation of powers. As we know last week, Senator Marshall Blackburn sued Jack Smith saying that he had no right to take her phone messages and phone records. That case could be a historic case about establishing civil liberties violations in a civil matter that then could come back and provide some insight to the criminal case. Goodness, John. It's big. What a, what a, what a, what a, I, I hope that they
Starting point is 00:25:15 make you the prosecutor. I guess you tell you tell me that you're not a lawyer, but that's a lawyer. That's a beautiful distillation of something that is very complicated and has been tough to kind of explain to people. And of course, all these grand juries are in secret. And so you're not able to really see the gears turning. And so we keep hearing these signals, right? Right. Something's going to happen. Something's going to happen. But it's very difficult to lay it out the way that you just did. It was beautiful. It was a beautiful crystallization of what's going on. everybody follow John obviously the probably if you are interested in the takedown or or the suffocating silently and slowly of the deep state you've got to follow John's reporting

What is the system produce? Well, if you become a Democrat, if you become a left-wing Democrat, you are somebody who is trying to create more of this. That is your final product. And so judge people by their fruit. This is what Christ says. Judge people by their actions. Their actions will show who they truly are. Talk is cheap. It's never been cheaper.
Starting point is 00:28:21 Somebody who has, well, not had to talk a lot because his actions for 30 years as a federal prosecutor demonstrate that he has a love of the laws of our land and he wants law and order. He wants the right to be stronger for law and justice. And he's somebody who has constantly been on the forefront of fighting for a stronger judiciary system. is the great Brett Tolman, who joins the show live right now to talk through this and some other very exciting news. So I guess I want to like take maybe a step to back on this whole question about what Jack Smith did and how the FBI abused themselves in this scenario to go after Donald Trump as though it was the KGB. And it certainly didn't see. like it's acting like an American law enforcement branch. It seemed like the FBI under Joe Biden and then certainly under some of the Barack Obama era and then through the Trump term one, was acting as a political entity like a political attack vector entity that had like the force of law behind it and was trying to in any way they could kneecap and buckle under the Trump
Starting point is 00:29:53 campaign and do so with taxpayer funding. What is your assessment on this? most recent news about these spying on Donald Trump's Kim, Chief of Staff and Family and the pulling of the records for his PAC and for these journalists that were speaking with them, your open assessment. Yeah, let me go back to a couple of things you said that are very important. You said, you know, it's acting like the KGB. I think a lot of people need to understand the pivotal moment that changed the FBI and change the hierarchy of the FBI and why they did what they did,
Starting point is 00:30:29 with Trump comes as a result of consequences of right after 9-11. So right after 9-11, the FBI was exclusively a law enforcement agency. Very rarely did it even function in the intelligence community. After 9-11, with the passage of the Patriot Act, we altered the FBI. And we also altered their tools. we changed in the Patriot Act, their main priority to that of an intelligence agency. Now, think about that, Benny.
Starting point is 00:31:07 They did not remain just a law enforcement agency that's bound by the fourth, fifth, and sixth amendments. Under the Patriot Act, we took shackles off that are constitutional shackles, and we said your main priority is now intelligence gathering and eliminating terrorist threats. We expanded their use. use of national security letters, NSLs, these are search warrants without a judge weighing in on it.
Starting point is 00:31:34 We expanded their ability under FISA to actually use the FISC. So the national security court to actually use that to get around the Fourth and Fifth and Sixth Amendments if they so chose to do it. Now, Jim Comey at the time of the Patriot Act, reassured Congress, and I was there, said, we will not abuse this power that you're giving us. We are just going to work hand and glove with the intelligence agencies and we're going to root out terrorism. So fast forward. Jack Smith now believes in his mind through manipulation through however, you know, you get to that point that Donald Trump, they convince themselves is a threat to national security. Once that happened, Benny, once that
Starting point is 00:32:21 happened, national security letters, FISA warrants, hidden FISA warrants. In fact, under one provision of the Patriot Act, we allowed for searching without notification. And DOJ could extend the secret search for as long as it could say, yes, we think, you know, we think that Donald Trump is a security risk in this country. So it is not surprising to me that we are now uncovering the scope and that Jack Smith's Sands sits defiantly in front of Congress and feels justified and arrogantly says he was doing his duty and he'd do it again. Because we changed the way the FBI and the Department of Justice functions and what their main priority was. Once we did that, it expanded their power so they could
Starting point is 00:33:13 target people like Donald Trump, Melania, his son. I mean, look at the scope of this thing is, outrageous and should offend every sensibility of anyone who cared about the constitutional protections we've lived under. So, Brett, you're making the argument that September 11th and Patriot Act changed everything with the FBI. And while that makes a ton of sense and that effectively, they put a mark on Donald Trump, that he is a threat to national security, a threat to national intelligence. He is himself a domestic terrorist. I think that's probably what January 6 was about. And that now we can just do whatever we, we can, we can, we can, we can, we can violate any type of civil right in order to ensure that he doesn't get power again.
Starting point is 00:34:00 Is this your argument? Well, yes, exactly. They no longer abound by the Fourth and Fifth and Sixth Amendment of the Constitution. So they can act and function as sole arbiters of how they go about investigating someone that's a threat to security. So my counter argument to that, which I'd love to hear what your take is on this is, hasn't the FBI always functioned like this when you look at some of the MLK files, when you look at what they were doing to those that they deemed political enemies back in the 1950s and 60s, Jay Edgar Hoover, and you looked at some of the violations then.
Starting point is 00:34:42 Wasn't the FBI certainly stretching in that season as well, the boundaries of law enforcement? Yeah, the difference was they were doing it in secret. After 9-11, they could do it in the open. So they've always been doing it. They've just hit it better in a different time. They also didn't have their agency-wide priority, still remained law enforcement, drug interdiction, you know, terrorism was certainly part of it, but it was very, very small fraction.
Starting point is 00:35:16 And when I was U.S. attorney, we had, we just started the, very first human trafficking task force in my district. You know, this is 2006, right? And human trafficking had been going on for a long time. But the priority of the agencies was never national security. And the other thing we did is very different. Back then, they were assisting CIA. They were, they were, they were the partner in some of those operations that you listed, you know, those, those, those,
Starting point is 00:35:49 clandestine, very political, those operations, they were the partner of the intelligence agency. Now they lead it and they are the intelligence agency utilizing the new laws, the new priority, and frankly the new politicization of the agency itself. So I don't think it's inconsistent. But we were unaware of a lot of what happened before because it was not the priority. It was not the primary function and it was clandestine. Now, Jack Smith's very, very out in the open about how they utilize it. And they now also co-op the judges to help them do it.
Starting point is 00:36:30 I mean, the FBI had the pivotal role in Watergate, correct? Yes. The FBI's role in the Kennedy assassination, who will ever know. Both led by the CIA, both led by, you know, my belief is both led by the CIA, but the foot soldiers become the FBI agents that get assigned from the top down to do it. But deep throat, the whole scandal of Watergate is actually insulated. It's incubated inside of the FBI. It's certainly led by CIA.
Starting point is 00:37:00 There's major CIA connections. But it's the FBI that is the muscle men taking down the president, right? Yeah, because the CIA is forbidden to acting, right? It's a bit forbidden from acting in the United States. I mean, I'll give you an example. I'm a U.S. attorney. I have an individual call me up, wants to meet me the new U.S. attorney in Utah. He says, I'm excited to work with you.
Starting point is 00:37:21 He comes walking in and he hands me a card and it says FBI special agent, Salt Lake City Field Office. And I look at him, Benny, and I go, I know every agent that's been in this office for a decade. You're no FBI agent. And a few months later, I learn he's a CIA officer. that's assigned and just has the card made that he's an FBI agent. Now, I became friends with him. It was very telling that this, he handed me a card to tell me that he's an FBI agent. These creepy people. Is what, okay, so, all right, is what they're doing right now worse than Watergate? Yes, by far. By far. This was the takedown of an entire, you know, it's a takedown of an entire movement,
Starting point is 00:38:13 including a president that wasn't going to play the way they wanted it to play, and was going to try to dismantle the power that they saw. That's no different than certainly what JFK started to realize was the power of the national security agencies. The intelligence community scared him to death. And literally, you know, we know now with the release of the documents, the heavy involvement of the intelligence community and the assassination of JFK. So now fast forward on steroids, they've gathered power over the decades since John JFK and Trump gets in. And you see it involved this time it involved a sitting president.
Starting point is 00:38:56 It involved the heads of agencies. It involved, you know, bureaucrats. They had all of it. The fact that Trump survived assassinations, survived election, you know, and threats to, election integrity and is sitting in the Oval Office, I still shake my head at his ability to do it. And perhaps the only way that could happen is by divine intervention. Yes. Divine Providence. I think everybody can see it at this point. And if you don't believe it, then you just don't know history and how many people. Yeah. You know, how easy it, frankly,
Starting point is 00:39:34 is to kill a president, especially if the state is against them. Yes. Those kind of things never fail. So yes, divine providence. All right. So they wanted an execution for President Trump. They wanted it live on camera. I don't have you ever tried any death penalty cases? Tom, I have worked on some cases, you know, on the federal system. Federal prosecutors don't have very many death penalty cases, only in Indian country.
Starting point is 00:40:04 I worked on a couple of those cases. Interesting. But we do have cases like the Oklahoma. Oklahoma City bombing, which was a death penalty and the last time that the death penalty was applied in a federal case. And that was prosecuted by one attorney general Merritt Garland as a young prosecutor. I don't know if you, I don't know if you've seen, I don't know if you've seen Nadal Hassan execution by firing squad ordered this morning. And this is a military, obviously, the execution.
Starting point is 00:40:41 Our audience is cheering for this. I want to sort of know your, you know, know your thoughts on this as far as a precedent. Obviously, Nadal Hassan is the Fort Hood shooter. In Killeen, Texas, he kills 13. He kills 14, actually. One of the women were pregnant. So he kills 14 different other service members.
Starting point is 00:41:00 They were unarmed. And he shot 32 people. He yelled Ahola Akbar and then told investigators that he was doing this in order to, create a Islamic caliphate and defend the Islamic states here in America. And I'd love to just chat about this, you know, with you. Yeah, the law is very clear on the consequences. And we... Jim Rome takes on sports.
Starting point is 00:41:22 Everybody pointed out the obvious Harbaugh connection and everybody, as it turns out, was right because 9 is officially now a New York giant. You know, you talk about selling low. Even the 9 has got a fourth for Trey Lance. He's out of the building. We will take that fifth pick. and we will surely turn it into something more valuable than nine ever was to this organization. The Jim Rome Show podcast.
Starting point is 00:41:44 Follow and listen on your favorite platform. As a country have ruined, you know, the use of the death penalty. I mean, we have the, we cannot deliver it swiftly. It's not done decisively. When the, you know, when the laws of this country were formed, they were very clear about treason. they were very clear about terrorist acts against the United States. And the penalty was death. And that really hasn't changed.
Starting point is 00:42:16 What's changed is the appetite of, you know, individuals, the division among citizens on its application. And the softness of the military in terms of, you know, military justice has been documented for years. So it's not surprising to me. I mean, I think President Trump is his administration. And he personally is very interesting because he has a, He has a compassionate side of wanting to allow second chances for individuals who may commit crimes but are not necessarily criminal.
Starting point is 00:42:47 But he's also been very decisive on those who are enemies of the United States or that they have intention to harm, you know, its citizens. And I think in that case, punishment we've learned deterrence, real deterrence is not necessarily the type of punishment. It is the predictability of the punishment. So if you've operated for decades without applying, you know, the death penalty or without, you know, going after those that have committed treason or terrorist acts, it is not a deterrent. And that's what we've seen. We, I mean, look at the what's happening with the ice, you know, the, the revolt and the riots and all of that is because we have failed to, you know, have predictable consequences for people attacking ice. agents, et cetera, and all is the same sort of model. So if we are going to be tough on crime, it has to be predictable and it has to be consistent. I don't know if they're taking volunteers for this firing squad. I'm not sure if they're live streaming it. Yeah, but like good for them for finally getting it right here. It's been 17 years, Tom. It's been 17 years. What the hell?
Starting point is 00:44:01 Yeah. I mean, what the what the what the what what? It's accurate. Why, why isn't it taken? Why? Why, didn't take 17 minutes? Why doesn't it take 17 hours? Well, it goes back to, you know, something I always say as well is, you know, lawyers are painful and, and very, I like very few lawyers. And that's what's happened with a lot of our, you know, cases that should have had swift justice. Will we be seeing more of this? Why are there terrorists, why are the 9-11 guys rotting in Guantanamo Bay? It's 25 years out. why are they not suffering the firing squad as well well that's that's a lot to unpack but i'll say at the very heart of that answer of that question is that it was fumbled in the beginning they should have never been extended you know some of the constitutional protections they were truly enemy
Starting point is 00:44:57 combatants they were truly you know terrorists and that it should have been treated under an entirely different set of laws. One quick word on that, if you don't mind the original, this happened, this attack in Fort Hood, the deadliest massacre on a military base in American history. It happened in 2009. And originally, the Barack Obama administration did not classify this as terrorism. They classified this as some type of like military assault or some type of like, military assault or some type of like, Like, I think that I don't know exactly what the, they didn't want to charge it as terror.
Starting point is 00:45:37 They wouldn't want to charge it as the Islamic terrorism. Yeah. It is a red flag that we should have seen and exposed much earlier. I mean, what president doesn't want. I mean, can you even imagine any president? Go back to all of our historical presidents and even our worst ones would have said, this is a terrorist attack on our land. I mean, it tells you more about, you know, Barack Obama and that administration and what they
Starting point is 00:46:02 think of the United States, then it does anything else. What does it tell you, maybe in closing? What did it tell us during that time? I have no doubt that Barack Obama had nothing but contempt for the United States. And if that is your starting place, you are not proud of your country. You are not trying to defend it. You are, you are aiding and abetting Iranian terrorists. you're funding, you're doing what you think fits your narrative, which is, you know, he was
Starting point is 00:46:35 very vocal privately about wanting to tear down, you know, the United States as it is and to reconstruct it. And that was divisive. And part of why our country is so divided today is not like everyone wants to suggest that it's Donald Trump that divided this country. Donald Trump exposed the division that was underneath the surface that was very. And now the attempt is to try to get the country back together again. I think I'm like, I'm totally seeing a new political movement here, Brett, like run on more firing squads. Like I'm seeing it. You got the firing squad in Utah, right?
Starting point is 00:47:15 You got firing squads. You can do firing squads in Utah. You can. I think they're also looking at bringing it back in Idaho and they may be looking, you know, interesting you raised that, Benny, because I did, I did become aware when I was first in office. of a couple of individuals that were facing the death penalty who believed that because they shed blood that they should be killed by firing squad and they actually requested it,
Starting point is 00:47:44 which was interesting because it was very tied to a belief, you know, a biblical belief of shedding blood and of another and the consequence for such. So, you know, I think whatever system, and we've seen this with the recent botched, you know, death penalty in Tennessee, whatever system we use, it has to be swift. We need to stop.
Starting point is 00:48:05 You know, if you're going to use the death penalty, it's got to be applied in a manner in which it's predictable. It's swift. And it is, you know, something that as citizens, we have confidence that it's applied fairly. And we have had none of that over the last, you know, 20, 30 years. No, I was reading about how Japan, which is proving to be one of the last adult countries in the whole world, has like, an hour between a accused learning that they have been found guilty of murder and that they will
Starting point is 00:48:40 be hung by the neck. They actually take them to the next room. They do the hanging and it's done in less than an hour. Yeah, Ben, we live at a very odd time. Is that the way it used to be? You're out west. Isn't that the way it used to be? I think it is the way it used to be.
Starting point is 00:48:56 But what an odd time where a culture is embracing a Mangione who. will kill an executive of a health care company on the street, but is outraged by, you know, the application of the death penalty, for example, for some of some of the worst offenders in history. Now, the death penalty is complex politically, but I've said, you know, many times that if you're going to have, don't have it if you can't apply it swiftly and fairly. And life in prison then is your your, your, your, your, your most serious pun And we have a lot to fix before we get to that point. And I haven't followed closely, Japan, but I know other countries that do and don't, they're like any other.
Starting point is 00:49:42 Some get it right and some get it wrong. But the United States right now, it's wrong in the United States. And we do have to fix it. Well, fixing it starts by talking about it and being able to have open and honest conversations. And it can't be immoral if it's what God commands in the Old Testament to do to murderers. I mean, this is the consequence of murder. If God's commanding you to do it to have a just and righteous society to wield the sword against evil men, it can't actually be immoral. So there is really, frankly, no even Christian argument, if you would argue that America is a Christian nation.
Starting point is 00:50:14 There's no Christian argument against them. And I would love to see the firing squad movement happening. And Brett, maybe we could start that. Thank you. It's always a ray of sunshine in our show
Starting point is 00:51:03 as when we were able to bring on the great Scott Pressler, who joins us live. Scott Pressler, welcome back to the program, my friend. Hey, Benny. Well, you have to, when you say Scott Pressler Killer, you have to say peacefully. Because otherwise, I don't want that sound clip to allow the Democrats to say Scott Presler, this hater, this horrible guy, we got to put in peacefully in there somewhere. They do hate you, Scott, because you actually follow the numbers, apply the law.
Starting point is 00:51:40 you are simply a killer for voter registrations. And you have some unbelievable numbers here that my producer just sent me from Pennsylvania. That looks like there are some real bright spots on the ground. You have 81 staff on the ground right now in your home state of Pennsylvania where you are a candidate this year. And I want to talk to you about voter returns. So what are we seeing right now on the ground? Thank you, Benny. Well, I won my election on May 19th of this year, so I am an elected official in Pennsylvania,
Starting point is 00:52:15 but we do have our general election this November. So my organization is early vote action. And I want to remind the listener that in 2024, we had 87 staff on the ground for a presidential election. This year for a midterm election, I have 81 staff. So we are treating this midterm like a presidential election. And I really believe that the media, which we all know is just another arm of the Democrat Party, their entire MO is to discourage, is to depress, is to derail the conservative movement into thinking that we can't even win. Listen to these numbers, ladies and gentlemen.
Starting point is 00:53:01 In 2022, at this same point in time, there were 50,000 fewer Republican vote by mail in the Commonwealth of Pennsylvania. And there were 90,000 more Democrat vote by mail. So what I'm telling you is right now, four years later in 26, in the swing state of Pennsylvania, Republicans are up 50,000 vote by mail, and Democrats are down 90,000. vote by mail. So don't believe the phony bologna that you are hearing from the propaganda arm of the Democrat Party, CNN, and all of their different auxiliaries. All they want is to make you believe that we can't win so you won't vote and they can say, see, we told you so. But we are not seeing those numbers on the ground, Benny and the Commonwealth of Pennsylvania. We're starting to see a little
Starting point is 00:54:01 breadcrumb trails of this all over, Scott. I was my timeline. I saw this weekend, a Politico article saying that Democrats' voter turnout model is completely broken and that they are not seeing the same returns that they saw in 2020 or 2022 or 2024, that they are actually behind right now. And it's causing a bit of a panic inside of Democrat Party leadership. I have my own theories as to why that is. I guess they're pretty simple that the federal government, specifically the DOJ and Harmie Dillon, is enacting voter fraud prosecutions. And a day doesn't go by without 10, 12, 20 different fraudsters getting prosecuted and dragged before the American people. And so the delta for committing voter fraud has actually increased parabolicly because now if you commit voter fraud, there's a real chance that you'll be stripped of your right to vote.
Starting point is 00:55:01 deported, potentially have your life ruined in every conceivable measure, you will spend five years in prison. That's a mandatory minimum, $250,000 fine. Well, they're not getting paid $250,000 to vote fraudulently. That's a real risk. That's a real parabolic risk that they are taking now, because the Trump administration has taken this issue. Seriously, I want to know your thoughts on this. Yes. Well, there's a lot to impact. So one thing I can break on your show is, you know, in 2024, we flip to Bucks County from blue to red in terms of voter registration, Trump ends up winning the county by 300 votes for the first time since 1988. So yes, number one, voter registration does matter. I can tell you that Democrats are panicking because you know what they did? In Bucks County,
Starting point is 00:55:47 they usually have three early voting locations. They have upped the three to seven for this midterm election when in the presidential, they only had three. And four, of those new early in-person locations are at community colleges. I don't think that is a coincidence. They are trying to use the institutional advantage of Democrat-leaning colleges and universities to try to galvanize what they believe are blue voters. Now, my team is out there at these community colleges, and the young audience out there doesn't even know there's an election, isn't inspired to vote. So number one, we're seeing the panicking happen by what they're trying to utilize on the ground. And Harmeet Dillon is a hero.
Starting point is 00:56:40 The work that the DOJ has done prosecuting and indicting. And I want to say this clearly for your audience, we always knew illegal aliens are voting in our elections. We never could prove it because under the Biden administration, they didn't have a DHS worth of the worst list. They weren't actually prosecuting a legal alien fraud, and we didn't know about the non-jurer records that we are exposing in Pennsylvania. But I can firmly tell you from cross-referencing non-jurists, people that are ineligible to serve on juries, that with the voter rolls, we are finding thousands of illegal aliens that are both registered and actually voting in our elections. Another hero besides Harmeet Dillon is an attorney in the state of Pennsylvania, David Metcalf. Yesterday, he just announced that four additional illegal aliens were indicted for voting in our elections. Now, this is important, Benny, because this is a deterrent.
Starting point is 00:57:43 The message is, and this is coming from Secretary Mark Wayne Mullen, too, if you vote illegally or fraudulently in our elections, the government is going back, as recent as five years, you will be found, you will be prosecuted, you will be charged, you will be indicted for voting fraudulently in our elections. And I think that deterrent is so important. But all of that goes away if we are not successful this November, Benny. Can you please give me one more crack on how you were able to uncover mass voter fraud from a legal, in Pennsylvania because I think people were quite inspired about how you were doing this. And it took quite an effort, a grassroots effort, but you were able to actually get it done in spite of a bunch of Democrats trying to block you.
Starting point is 00:58:41 Entire counties trying to block you. You got it done. Yes. Well, I have to give a couple shoutouts. We have a gentleman by the name of Anthony Ferlini. He's running for SOS in Michigan. He's in McComb County, Benny. This is a swing county in the swing state of Michigan.
Starting point is 00:58:57 You know what Anthony Ferlini did as county recorder? He found that there were non-jurers, people that should not be eligible to serve on juries who were receiving jury summons. So Anthony Ferlini in Michigan took it a step further and he goes, wait a second, why are these people receiving jury summons if they're ineligible? And he found out that they were voters. He found out that they were voting. So county recorders across the country have. immense power to bypass your secretary of state, to bypass your governor. And I want to give a shout out to Justin Heap. He's the county recorder from Maricopa County, the most populous county in the
Starting point is 00:59:35 great state 48 in Arizona. It was Justin Heap and Anthony Fralini that inspired me in my state of Pennsylvania to go, wait a second, if they're finding these non-jurer records, why am I not able to do this? And Benny, my Commonwealth, Pennsylvania, is the only state in the union. And you. that has an explicit law that allows for non-jurer records to be open to public inspection and the reason for disqualification. So it will tell you if it's because they're too old, if they're if they're a family member of the person that is indicted or if they're a non-citizen. So what I need is I need North Carolina, Michigan, Wisconsin, Florida.
Starting point is 01:00:23 I need every state in the country to pass legislation to open non-jurer records to public inspection. So when you say the firing squad, yes, we need that. And we need non-jura records open to public inspection at the state level. And then I can help all of you find non-citizens, couple them with the voter rolls, and we can help clean the voter rolls in all 50 states and United States territories. And this would be an act of the state legislature, Scott? Yes. That's why governors are important.
Starting point is 01:00:59 That's why state houses are important. That's why state senators are important. And that's why it's not just voting federal this November, but also governor and state legislature. This would be at the state level, Benny, for all 50 states. Very important. I would love to join with you and pushing that at every state. Do you know if Florida allows for this? Florida does not.
Starting point is 01:01:22 Florida does not. So a wonderful Governor DeSantis who's been a champion for all things liberty. I'm asking before the governor is replaced by our next governor, Byron Donald's, maybe he can do a special session. And on his way out, Governor DeSantis can ask for the legislature to put on his desk a non-jurer open records piece of legislation that then we can discover any non-citizens on the voter rolls. I just love this strategy, Scott, because it doesn't matter who's president, right? It completely doesn't end around. If you have a Mayorkas back at DHS, it still doesn't matter. You would be able to align on a state level whether there are illegals voting in your state. This is federalism.
Starting point is 01:02:13 It's checks and balances. It is power to the people. And it is power to the states as our government was designed. A state is a check imbalance against the federal government. Yes, sir. So real quick, if we could broaden out to the federal elections and to what you call a sci-op, a nationwide si-op to get Republicans to not vote, to get Maga to not vote, to get America First to not vote, to get young people to not vote their future and their interests in the future.
Starting point is 01:02:42 What are you seeing on the ground when it comes to enthusiasm? What is your message to people that say, oh, gas prices are high, so I'm not going to vote Republican? Thank you. So we are knocking on doors, not just low propensity. We're knocking high propensity too. I want every single Republican voter that gave Donald Trump the popular vote in 2024 to come out in this election. And so, Benny, I haven't said this yet on my social media. And I know that your show is very loyal. But this message is not only to your audience. This message is to people who maybe don't watch the Benny show loyally, but we'll see this on social media. And this is from my heart, and I mean this genuinely and sincerely. I understand that we're all struggling right now. I understand that America isn't affordable. I understand that the American dream is getting harder every single day to achieve.
Starting point is 01:03:39 I understand that gas prices are high. I understand that we don't want the Iranian conflict. I understand that we don't want to be funding. other countries and that we need and must be America first. This is for the safety, security, well-being, and prosperity of the American people, period. My ask of you is I really want you to question as you go into Tuesday, November 3rd, 2026, if we are America first, if we are truly want to make our country great again, does electing or allowing Democrats to win this November put the safety, well-being, safety, and security of the American people first.
Starting point is 01:04:23 Does it stop funding other countries? Does it stop illegal immigrants from pouring into our country? Does it stop the funding of non-governmental organizations? Or does this feed into exactly what the Democrats want going into the 2028 election when we are two years away from Alejandro Mayorkas 2.0, allowing upwards of 20 million illegal aliens into our country? country. Where I think we're getting this wrong, Benny, and where I think the Republican Party needs to get back on track for the next 30 days, the single most important issue the American people
Starting point is 01:04:59 care about is stopping illegal immigration. Sure, no tax on tips is great. No tax on Social Security is great. Sure, all of those wonderful things are great. That pales in comparison to deportations. that pales in comparison to a secure border because everything stems from stopping illegal immigration. We want crackdowns on fraud for SNAP. We want crackdowns on fraud and Medicare and Medicaid. We want crackdowns on the illegal aliens voting in our elections. Every problem systemically in our country stems from the problem of illegal immigration. And if we get two more years, if you come out, if you entrust the Republican Party, if you vote with me, if you vote with Benny, if you vote with turning point action, if you vote with everyone that is loyal to Donald Trump and the Republican Party, give us two more years to fight for you. And I promise you, we will stop the onslaught and we will never allow 2020 to happen again. And we will stop a disaster. from happening in 2028.

Starting point is 01:07:32 You're going to be governor of Pennsylvania one of these days, Scott. And I don't know if your lieutenant governor will be John Federman. I don't know. I'm not sure. I don't have a crystal ball. Last time you were on the show, you endorsed John Federman if he would back the Save Act. So, you know, you never know, I suppose. But I do have like a quick note on gas prices because it does seem to be something that is obviously everybody's talking about.
Starting point is 01:07:56 It is too high. It's extraordinary. I don't like it. I, you know, I want our Rand War to end hopefully today. Maybe it ended while we were live. That would be awesome. I don't want gas prices to be high. But I do have all these clips and Klein, you can just pop it up of like, do you understand like,
Starting point is 01:08:14 where we came from here. Like at the very least, Donald Trump's saying gas price is too high, they need to be back to two bucks a gallon. That's where they were in December. Gas price is too high. They need to be back to $1.80 a gallon. That's where they were in January in some places.
Starting point is 01:08:27 We have a live chat on the show. People were paying $170, $180 a gallon in Colorado and Oklahoma and in Texas. The alternative, we've already seen the alternative, is this guy who says that he wants to end all fossil fuels. Correct. That's the official. Joe Biden goes up and. looks a kid in the eye and says, I guarantee you we will end all fossil fuels.
Starting point is 01:08:49 We will end all. You won't be allowed to buy a tank of gas. And so, like, please, please don't punish the repos. I don't like it. I don't want it. I'm not celebrating it. I want gas prices to be docked to $2 a gallon or lower. That's where we were.
Starting point is 01:09:04 That's where it should have stayed. And if I had a magic wand, that's where it'd be today. But please, like, understand that, like, to give these people power, they've also shown you, they have no interest in low gas prices. They have interest in a million dollars a gallon for gas or making gas, making gas illegal. And they've said that before. And so, you know, I just think it's a very easy argument. Like, I think it's a pretty simple argument.
Starting point is 01:09:29 Final, final question for you, Scott. Yes. It was, it did make a lot of news, you saying that you would endorse John Federman if he would back the Save Act. John Federman did end up cutting a video for the RNC convention. I don't know. I guess he did he's never said he I guess he's never said no. Do you think that we'll get another shot at this? What do you know, how is this shaking out? It's seen as one of the biggest betrayals of our time. I wish this had been what we had led with, honestly, in Congress. But, you know, where is that? What is your messaging still on the SAVE Act? I judge a man or a woman by his or her actions. John Federator. has voted against the Save America Act every single time. You know, I was hopeful that there would be an opportunity that he would go, hey, my party's
Starting point is 01:10:22 probably going to primary me. And hey, I'm probably not going to get the Democrat nomination in 2028 when he's up for a reelection, by the way. And then we have a bill that the House banned insider stock trading, 198 Democrats voted against banning insider stock trading. they brought up that same bill in the United States Senate and every single Democrat, including the two independents that caucus with them, and John Federman voted no to banning insider stock trading and voted no to photo ID for our elections.
Starting point is 01:11:00 So as far as we stand right now, we gave him a shot peacefully. We gave him an opportunity, but John Federman's actions are not meeting the requirements of what would be deserved to get an endorsement or to join the Republican Party. He continues to caucus with the Democrats. And so at this point in time, we are going to primary repeal and replace John Federman and replace him with a Republican senator in 2008. And then Pennsylvania can have two senators. One nice thing, Benny.
Starting point is 01:11:31 I don't know if I'm going to come back on your show before November. So I have to say this. Everyone at home, please consider voting early. In 2016, Hillary Clinton pushed early voting in Ohio and Florida. I remember this clear as day. Everybody on the media said Hillary Clinton is going to win. There's no possible way that Donald Trump can win because of the early voting numbers. How many people were depressed?
Starting point is 01:11:56 How many people were discouraged? How many people didn't vote because they thought Hillary Clinton was going to clinch the win because of early voting? Fast forward to 2022. Governor DeSantis is running for re-election. Do you remember during early voting? Broward County, Hillsborough County, West Palm Beach, historically blue counties, Republicans were winning early voting, and I'll never forget it.
Starting point is 01:12:21 The same media that told us that Hillary Clinton was going to win in 2016 was forced to decree that Republicans were winning early voting in blue counties in Florida. You know what that did? That encouraged the vote. That motivated Republicans, that galvanized Republicans. that galvanized Republicans. And then we had a crushing historic win in Florida. And Florida now has over, I don't know,
Starting point is 01:12:45 1.2 million more registered Republicans in Florida. Moral the story. If you vote early, it allows organizations like mine to save money. We save time on text messages, phone calls, emails, knocking on doors, postcards. And it tells the media that they must actually tell the truth on early voting. Please consider early voting in your election. We'll be doing this in Pennsylvania.
Starting point is 01:13:10 God bless our country. And I hope, Benny, that we can have a big historic win for the Republican Party on Tuesday, November 3rd, 2026.
