Jurors in the Duane "Keffe D" Davis trial were played a 2008 recording of Davis admitting he handed over the gun that killed Tupac Shakur. And Philadelphia police have identified the Chucky mask suspect accused of terrorizing more than a dozen people in Center City. Evidence jurors never saw is coming out in Carmelo Anthony's case, and it could help his fight for new trial. But of course, you know, there was a number of attorney of events that happened today that is going to make this hearing even much longer. And a decades-old recording is taking censor stage in Tupac's murder trial, and it's in Keefee Dee's own words. He said, we did the other. And so at that point, what did you think he was talking? Me personally, the only other one was too hot.

And police say they've identified the man behind that Chucky mask, terrorizing people in Philadelphia. You think it's funny to make people run? Get your sneaks. Here are the day's biggest stories. Stay with me. A Collin County courtroom made history yesterday as the public heard for the first time the character evidence that was kept out of Carmelo Anthony's June murder trial. Retired Kaufman County Judge Michael Chitty is presiding over Carmelo's motion for a new trial. This is the judge who took over after Judge John wrote was officially recused earlier this week. Carmelo's appellate team led by Russell Wilson spent the day walking through what they they call errors in the original trial and laying out just how much evidence was sealed off from the jury. Defense attorney Wilson said Judge Roach ran what he called, quote, a shadow docket, filings hand delivered instead of posted publicly, and a courtroom that Wilson says was closed to

the public in violation of the Supreme Court's Waller v. Georgia decision. But the biggest moment of the day was when former trial attorney Mike Howard took the stand. Howard walked through a defense document that had never before been made public. Fifty-three separate incidents listed all involving Austin Metcalf and his twin brother, Hunter, all kept out of the jury's view. Here's some of what was in that document. Photos from a juvenile offense report allegedly showing graffiti that read, quote, KKK, kill all black people, hail Hitler, and multiple uses of the N-word. A text message from Austin Metcalfe on the day he died telling another student to quote, kill that MF in reference to a Hispanic student sitting behind him at the meat.

Videos from Austin Metcalf's phone allegedly show him hitting a black classmate, filming a black student eating a banana, multiple videos of him using the N-word and making racist jokes, videos of him holding a butterfly knife saying, quote, come F with me now. Hunter Metcalf allegedly threatened cheerleaders calling one, quote, Fat B, and saying his hands were, quote, bisexual, meaning it would hit girls too.

The document also says both twins were suspended repeatedly for verbal abuse of teachers and other students. Now, none of this was ever shown to the jury. Now the prosecutor's side, first assistant district attorney Bill Worski said he was the one who offered the agreement to keep this evidence out. Werski said this quote, I offered the agreement, let's stay away from historical character and stick to the facts. What happened under the tent? He said his goal was to quote, keep the best. peace and prevent the trial from becoming a national bonfire.

Worski also revealed evidence against Carmelo that was kept out too. A text message reportedly sent by Carmelo the morning of the stabbing that read, quote, I'm low key on the verb. Pages of Apple notes on his phone that allegedly discussed violence, a message that read, quote, I'm a stab someone and lick the blood off the blade and a photo of Carmelow holding a gun. Worski admitted he wanted Carmelo to testify and said, quote, There's nothing better in my business than a testifying defendant. Mike Howard testified that Carmelo only had about 10 minutes to decide whether to take the stand after the agreement broke down.

And jurors have now heard Duane Keepee Dee Davis in his own words describe his alleged role in Tupac's killing. The recording is from 2008, 12 years after Tupac was shot. And here's why Davis is talking to investigators in the first place. At the time, police were investigating the murder of the notorious BIG.

Davis sat down with an investigator under the agreement that was supposed to give him some protection for what he told them. But during that interview, the conversation turned to Tupac. And Davis told investigators he was inside the white Cadillac involved in the shooting and that he handed the gun to the back seat. Let's listen. when he said we didn't have anything to do with that one did that trigger anything in your mind as to what he was saying would i recall yes we're like that one what do you mean and then we said we did the other one he said we did the other one and so at that point what did you think he was talking um me personally the only other one was too pop but we

had nothing, we didn't think he was, we were talking about Christopher Wallace. We didn't ask him any questions about Tupac. He offered that on his own. And so when he does that, is there some discussion then of maybe having a conversation about Tupac? It was a surprise to us, number one, we were shook. Mr. Davis stated that his nephew, Mr. Rolando Anderson, was jumped and beat up in a club or in a hotel in Las Vegas after the Tyson fight. He came and told Mr. Davis what happened.

They went looking for Tupac, Shug, anybody who was involved, basically, in the beat down of Mr. Anderson. And he couldn't find him at first, and then they saw him, and basically, Mr. Davis had the gun at first, but they came up on the passenger side of Shignight in Mr. Shakur's vehicle, so he couldn't shoot across the driver. Now, Davis did not say he pulled the trigger. He told investigators his nephew, Orlando Baby Lane Anderson, fired the shots. Prosecutors say all of this started earlier when Tupac and members of his group beat Anderson inside the MGM Hotel Grand. Their argument is that what happened next was retaliation. Davis told investigators that he, Anderson, and two other men later went looking for Tupac and shook night. When they found him, Davis said he passed the gun to the back seat and Anderson opened fire.

Tupac was shot four times and died six days later. He was 25 years old. Now here's the problem prosecutors are trying to overcome. Davis has told different versions of this story over the years. In an earlier interview with investigators in 1998, he denied knowing who killed Tupac. And today, his own defense is essentially telling jurors, you can't trust everything Keefe De has said. His attorneys argue Davis exaggerated or made up stories about Tupac's murder for attention and money, including books and interviews. So that is becoming one of the biggest questions of this trial.

When Kipi D talked about Tupac's murder over the years, was he confessing or was he telling stories? Prosecutors say his own words help prove their case. The defense says his own words cannot be trusted. Davis has pled not guilty. And lastly, an update out of Philadelphia, police say they now know who was behind that creepy mask chasing people near City Hall. Police have identified the suspect as 22-year-old Zymyr Hughes,

and there's now a warrant out for his arrest. You think it's funny to scare people? Well, get ready to get scared by us. because we got the handcuffs, we got the jail cell, we got the Philly jury that's going to tell you it's not funny at all. You think it's funny to make people run? Get your sneaks because that's what Zymer Hughes is doing right now. Mr. Big and Bad is on the run. We're not having it in this city. We are not tolerating it.

Investigators say Hughes approached as many as 15 or 16 people while wearing the mask, holding up a phone apparently recording the encounters. One woman told police Hughes chased her and asked, are you ready to die? She seriously injured her leg trying to get away. Police believe Hughes may have already left Pennsylvania and says he has ties to California and Nevada. The U.S. Marshals are now helping find him. That's your front page. I'm Mimi Brown.
