And he's going to talk to us about, well, this guy Merrick Garland, who we're not always happy with.

Okay, so my favorite thing about Marjorie Taylor Green is she thinks she sees so more than everyone
when really she's the embodiment of the Dunning Kruger effect.
And while she has a theory on what the Joe Biden document scandal is really about,
and I encourage you both to stay woke and keep your tin-nit oil hats pointed to Zeno's frequency where the real shit's happening.
Because of this criticism from Democrats of Mr. Biden's,
and his handling of classified documents?
Well, they're right to say those things,
but it also makes me wonder something else
that other people have been wondering,
are we seeing a setup for them to try to get Joe Biden
not to run for president and perhaps make way
for someone else to run for president in 2024?
I think those are interesting things to think about,
but I'm glad to see, you know,
Democrat senators and different Democrats
just claiming what is absolutely
claiming what is absolutely true.
How reckless and irresponsible.
It shows that he's not fit for office.
I'll say it again, impeach Joe Biden,
and now we just have more reasons to do so.
So when she says other people,
like other people are concerned,
is it the other voices in her head?
Like is it that gang that she's referring to
for her backup, like the people she hears?
So there's two things here.
One, she raises the possibility this is a setup,
which is a little weird considering that it's the Biden folks who found the documents and then
immediately turned them over. And, you know, look, I've said on this podcast, I've been harsh on Biden
for having those documents, but he has consistently done the right thing with regards to returning
them. So you would think if it was a setup, he might be trying to pull shenanigans, but he's not.
He's just trying to make right for what was clearly some mistakes. So that's one thing. The other thing
is I feel like she does not think that the documents at Mara Lago make Trump.
Unfit for office.
Unfit for office.
Because as we know, there have been reports that she's trying to set herself up as his running
mate, which not to pat myself on the back, but I called that a long time ago.
So it's a little bit of a, I know this is probably the first time in history that there
has been hypocrisy from a Republican, but I think it might be hypocrisy.
I think we might have it. We might have, you know, the first case ever of this happening.
Just side note. Like, I don't understand. Can you imagine what Vice President Marjorie Taylor Green would be up to?
Like, I literally would need another passport to get the fuck out of here. We would never return from that cuckoo train, like ever as a nation.
Yeah, I guess the plus side is you put her in an office that historical.
is pretty worthless, and so she can go rant all she wants.
But unfortunately, it's historically pretty worthless until something maybe happens to the
president.
We cannot have her, obviously, a literal heartbeat away from the presidency.
Also, if I were Trump, I would not trust her in that position, quite frankly.
I wouldn't trust her around the open diet Coke's is all I'm saying.

Literally, her and the colonel at KFC are going to be conspiring for a military coup.
Those might not be onions on that Big Mac.
They're too woke.
I just can't believe she thinks the Democrats are this competent.
Really, really, she has way more faith in them than us.

or as Danielle likes to call him on guitar.
Or as Ruben Gallego likes to call him Jorge.
And while when I listen to this clip,
I'm going to really give you guys some shocking stuff here.
We're going to hear some more hypocrisy.
So my pledge, my pledge to each and every one of you is we're going to fire Nancy Pelosi,
fire Chuck Schumer, and we're going to impeach Joe Biden from the White House.
There is no America in my book with Joe Biden as president,
and we know he cheated his way to Washington, D.C.
It's almost like Republicans are always projecting.
I don't get it.
It's amazing.
I mean, I guess the good thing is, given his history of truth-telling,
we can now assume that Joe Biden.
Nancy Pelosi will get a promotion.
Right.
Chuck Schumer will not be fired and Joe Biden will not be impeached out of the office of the presidency.
So that's good.
Talk about the gift that keeps on giving to the Democrats.
It's amazing.
And also, which book is he?
talking about. Like, you know, those golden books of fairy tales. Like, what book is he talking about?
Motherfucker, we don't even know what your real name is. Like, we don't know what to call you.
I will say that occultist, Alist Esther Crowley wrote a book called The Book of Lies, and it might be that book.

And you're seriously reformed now.

Well, I have some bad news.
Sean Hannity has thoughts, which always leads to bad things, as we know.
And, you know, he's talking to one representative James Comer of Kentucky.
And, well, I'll let the brain geniuses do the work.
If there was any quid pro quo pertaining to the United States and Ukraine, it was
with Joe Biden on that deal he made. Didn't we impeach Donald Trump over a non-quid pro quo?
All Donald Trump said, be responsible with taxpayer money. If we're going to help you out,
and don't be corrupt like the people before you. And now it turns out, by the way,
Zelensky had to fire top aides because they misused appropriate money, appropriated money that
we gave them. Right. And, you know, Donald Trump was right to ask the Ukrainian president
whether or not there was corruption being involved with respect to foreign aid for the United States.
I hope every president would do that with this foreign aid, which I don't like foreign aid going
anywhere.
But if it's going to them where the president of the United States better make darn sure
that it's being spent where it's supposed to be spent.
I don't like money, foreign money going any.
What?
Yeah, I mean, that was a hell of a quote.
And also Donald Trump said to President Zelensky, can you do me a favor, though?
I don't remember it going into a whole dissertation on how said money should be spent.
He was holding aid to Ukraine hostage because he wanted a favor.
Like the ability of these people to rewrite history, to like rewrite just facts and reality, it's terrifying.
Like I have to laugh because otherwise I don't think I could sleep at night.
Yeah, I don't know if Comer knows what a quid pro quo is. I don't know if he knows what it means
because it was literally a quid pro quo, as you said. It was literally, do this for me, investigate
Joe Biden and Hunter Biden, the point that whether it was said or unsaid was basically that,
and then we'll free up the aid to you. And so it's like, look, as you said, this is what they do.
They try to rewrite history and he sits there and says that. And Sean Hannity nods along
and, you know, is entirely complicit, this is what they do.
And I'm with you.
I mean, I'm losing the ability to laugh at it at the shit like this,
but I'm hanging onto it by a thread, Danielle, a thread.
A thread.
It's like, you know, it needs, it's dental floss, you know,
to get all of the shit talking out of their teeth.
I just, I can't.
And it's that waxy kind, so it's hard to grip.
I'm just amazed Sean Hannity's.
I mean, obviously, I'm never.
amazed by his poocracy, but like talking about holding people accountable for misappropriating funds,
and there was this like war in Iraq when George Bush was president where he just covered all that up for years.
I wish you would stop talking about facts.
Okay.
Well, sadly the fun isn't done.
Elise Stefonic, the most ambitious person in her district, has a thought because she needs to make sure she keeps ascending the ladder in her party.
important. In the case of Vice President Mike Pence, he came forward and proactively reached out and is following the process. In the case of Joe Biden, he has had classified documents going back to his time in the Senate, where he started serving before I was born. So this is a longstanding national security threat, setting aside the very important fact that Hunter Biden also had access and used as his home address where those classified documents were improperly and illegally stored.
This will be a part of the oversight agenda.
And on the House Intelligence Committee, we absolutely want to make sure we have all of the facts.
She doesn't believe any of that shit.
There's a little bit more dumbness.
Give it a second.
Well, let's highlight the difference here in what the consequences have been.
You had the FBI raid Mar-a-Lago.
You did not see any of that happen for President Joe Biden, who illegally did this.
What also is different is President Trump as President has the right to declassified documents.
So the media should cover the fact that the FBI has been weaponized against President Trump and clearly has covered up for sitting President Joe Biden.
Okay, she doesn't believe any of that shit.
There are fucking morons who do believe that shit because they've been told it by people who don't believe it like Elise DeFanick.
She does not believe any of that shit.
Up until not that long ago, she was like a fairly sane, moderate Republican.
and she just now she's got the Kevin McCarthy disease where she will just say or do anything
that she thinks will increase her power and she's up there with Ted Cruz and McCarthy and people
like that she's one of the most reprehensible members of Congress right now because she doesn't
even believe the absolute bullshit that comes out of her mouth.
I think sane was doing a lot of work in that sentence of description.
Relatively sane compared to where she is now.
Okay.
Elise Stefanik is an asshole. And I say that because, first of all, when she talks about Mike Pence,
oh, Mike Pence is on the up and up. He returned the documents. Bitch, so did Joe Biden. Right.
Right. Like, so, I mean, he was the first one to come out. His attorneys came out and said,
oh, we found these things. Then they had more documents that were found. Okay. And then the DOJ does a different sweep.
Okay, fine. Let us also understand that the reason why there was a quote unquote raid on Mar-a-Lago,
is because of their president, Donald Trump, twice impeached, lying, grifting, former president
of the United States, refused over the course of a year and a half to return documents that
were quietly being requested by the National Archives. He refused to return them and said that
they were his. And he had boxes and boxes of documents that were in an unsecured location.
So the FBI doesn't have to go in. Unfortunately, I wish they were.
would have kicked in the door waving the 4-4, right?
Like, I wish that that was the fucking case when they went to Mar-a-Lago.
But they didn't have to do that for Joe Biden because guess what?
When he discovered that he had something, he had a sensor on his blouse from fucking Target
and walked through the security thing, the beeping went off.
He didn't get in his car and drive away.
He turned around and said, oh, my bad.
I have something here.
Like, big fucking difference.
And so the way that these people spin the lies and then just throw in the,
in Hunter Biden's name. It's just like, just throw it in there. As if we don't know that Donald Trump,
Jr., Eric Trump, and all of those spawn of Trump don't have access to their daddy's like
unlocked drawers. Give me a break. Not to mention, you know, the $2.2 billion that Jared Kushner just
somehow got after he left the White House from the Saudis, just saying. I just want to say that I think
it's, you referred to Elise DeFatic. You said, bitch. And I can't.
do that. And I think that's really unfair. And I am now beginning my journey to the alt-right.
I just have to say, too, that the pretending the FBI is woke, I know conservatives are always getting
worse. And we had the woke generals a while back who are apparently reading CRT all day. But the idea
that the fucking FBI has anyone on the left in it is the stupidest shit I hear them say these days.
That's the stupidest, Jesse. Are you sure?

Folks, I cannot express how much I adore this next guest for the new abnormal.
Ellie Mistel is the justice correspondent for the nation.
He is the author of Allow Me to Retort and an all-around absolute.
extraordinary badass if you ever get to catch him ripping Republicans and our injustice system to
pieces on MSNBC.
Ellie, I don't quite know where to begin because everything just feels like shit.
So if we're on a scuba tour of the sewer that is now America's justice system, I can't express
enough that the anxiety, the stress, the fear about our impending doom and our disdainting doom and
our democracy is not necessarily falling just on the shoulders of the 75 million Americans
that voted for Donald Trump and voted for insurrection and vote for white supremacy.
I feel like we're here in this moment in large part because of Merrick Garland.
And I am often on social media railing against Merritt Garland, particularly as we cross
the two-year anniversary of the insurmount.
and none of the architects of January 6th, not even after thousands of interviews and millions of pages
of documents from the January 6th committee, do we have any real indictments?
Not even after you have the oathkeepers, members get guilty charges on seditious conspiracy.
Still, no indictments coming down.
So you tell me your feelings about Merrick Garland and the responsibility.
responsibility that he bears for the disarray that our government and our democracy is still in.
Woo! First of all, good morning. Nice. Good morning. Nice to be here. Hope you had a good new year.
Yeah, no. If you're trying to figure out, you know, the sinking ship that is in America, you got to
start with the captain. And right now, when it comes to our justice system, the captain is Merrick Garland,
and he has been a failure. Now, I don't say that lightly. I don't say that to rile people up. He's
objectively failed because when he comes into office, when he gets a point, remember,
Merrick Garland was supposed to be announced for his job on January 6th.
That was actually what was scheduled to happen that day.
He kind of got pushed off the news by the attempted coup.
So when you come into office, literally on the day of an attempted coup,
when you're announced for your office on the day of an attempted coup,
you should well know that your primary job is to hold the coup plotter,
responsible. That is what a responsible attorney general would do. That is what a responsible
country would do. And Merrick Garland thus far has failed in that effort. And when I say failed,
I don't want to hear it from the like, oh, don't worry. Merrick Garland is playing 4D chess and
eventually all of the bad guys will go. No, no, spare me. For two reasons. Number one,
the failure already happened because he needed to hold these people accountable before they
ran for office again.
Mm-hmm.
That was the actual timeline.
The timeline is not holding them accountable sometime in 20, 26, when they're already
president again, for instance, just to pick one guy out of the hat.
The event horizon was to keep the people who try to attack our government on January 6,
2021 from running for office in November 22.
And Merritt Garland failed to do that.
Oh, he threw the book at some...
low-level people who breached the capital and, you know, knocked over some statues. Oh,
he throwed the book of that. And look, you know, Danielle, your black listeners will understand
this implicitly because this is what law enforcement already always does, right? They always go
after the hoppers. They always go after the street corner people, right? They never go after
the actual kingpins. They always want to find some black guy in Harlem selling rocks. They never
want to go to some Colombian bring in the rocks, right? That's Merritt Garland. He's he's the classic
prosecutor who wants to go after the small time people instead of the masterminds, right? So that's
failure number one. Failure number two, even in this world where, where people think that he's playing
40 chess and that everything is going to work out fine in the end, I just want to get people to
understand the timeline of this thing, all right? There have been no charges thus far. There have been no charges
thus far. Let's assume
in the best case, rosy
scenario, that Merrick Garland
does charge these people, let's say
by March, right? March or
April, let's say the actual charges
show up for something, right?
For obstruction or whatever.
How long do you people think
it takes to go from
a charge, an indictment,
to an actual trial?
At warp speed, we're talking eight months.
At regular speed, we're talking
a year or more. So now you go, let's say,
he's going at warp speed. So now you got charges in March or so. Now warp speed, you have a trial.
Wait, we're going to have a trial after Thanksgiving, you know, sometime December 2023.
This is, you know, accepting for the fact that Donald Trump will appeal every single motion,
every single shred of evidence. All of those appeals will have to go all the way up to the Supreme Court.
Let's assume, for reasons passing understanding, let's assume that for some reason the Supreme Court wants to act
quickly and answers those appeals in a timely matter to keep us at this warp speed.
be place, which they probably won't, but let's say they do. So now we're in December. We got a two-week
trial. All right. Let's say the jury comes back quickly because it's obvious. So now he's convicted,
let's say, again, at Warp 5, let's say he's convicted around Christmas. How long do we think
we take to get to sentencing, right? We got another month, month and a half of a sentencing trial,
some deliberations and some more appeals then. Oh, dear God. Folks, the
The New Hampshire primary is February, 2024.
And if you think that Merrick Garland is doing his job by not even getting to the point where the mastermind of the coup could be conceivably sentenced until after or right around the New Hampshire primary, I don't know what kind of job you think he's supposed to be doing.
To say nothing of the fact, the fear is absolutely nothing that we've seen from Merrick Garland.
or his office or his sycophants, which includes a wider array of former Department of Justice's
officials on the televisions and all around the internet, to say nothing at his sick ofance.
There's nothing to suggest that this man will continue to prosecute, try, sentence the presumptive
frontrunner of the Republican Party after the primary start.
So let me ask you this, because everything, the timeline that you just laid out made me want to
throw up in my mouth a little bit. Because all of it makes a hundred percent sense. We know that we love
to hear from the Department of Justice when they say none of this is political and no one is above
the law. And we know that that's nothing more than a bumper sticker or a t-shirt that maybe
Merrick Garland wears around his house when he's doing nothing. And so the anger that I have, I know,
is shared, not just with people whose jobs and lives have been invested in, you know, working towards
justice in this country. But for people who are looking around and
saying, man, I couldn't have gotten away with not even a quarter of this shit. The people who were at
the Stop the Steel rally who are in jail right now. And they're like, but we were working at the
hest of our president who told us to go take our country back. He told us that we were patriots.
And it's just like, no, you were duped just like the other people who have been duped by Donald
Trump in business and in politics. And so I wonder, Ellie, if this timeline,
And this attorney general is completely working against the American people, our justice system, and our democracy.
Is this just the train that just gets away, meaning that are we just set for a course that is going to smash against the wall or go over a clip or whatever analogy that we want to use?
Like, is this just done?
Because even if Merritt Garland were to find a backbone, you know, search for something somewhere,
and actually do something, the time is already lapsed.
And these people have already become emboldened.
And now these insurrectionists are representatives of government.
Yeah, I mean, look, Trump's getting away with it.
Trump's getting away with it.
Mo Brooks is getting away with it.
Donald Trump Jr. is getting away with it.
Andy Biggs is getting away with it.
Lowen Barbert, getting away with it.
Marjorie Taylor Green, getting away with it.
They are getting away with it because we picked,
and I say we in the most,
expansive use of the word.
We picked an attorney general who wasn't up to the job.
We picked the wrong guy at the wrong time.
And I've said it, you know, since like January 7th.
Like, you know, everything in Merrick Garland's history suggested that he would behave
exactly in the cowardly useless way that he's behaved.
This was the problem, right?
I wanted Doug Jones.
I wanted Sally Yates.
Like Merrick Garland is Danielle.
The worst appointment in two consistent.
consecutive Democratic administrations, right? He was the worst possible pick that Obama could have made
to fill Antonin Scalia's seat because Obama tried to find a guy who would get votes from McConnell.
McConnell was never going to vote for any Democrat. The best play would have been to nominate
somebody who was probably number three on the short list in 2016, a young lady named Katanji
Brown Jackson. She was number three then. If Obama appoints her, now at least in 26, when she
doesn't get confirmed, at least in 2016, we're running on, look at what these evil Republicans
have done to this qualified black woman. And that changes the tenor of that election, I think,
significantly. But Obama thought he could get the votes. He appointed Garland, wrong person at the
wrong time. And now Biden has done it again. Biden has compounded the mistake by giving him
this job. It's not that he's not qualified for the job. It's that, again, he attacks the job.
I can't emphasize this enough in such a normal white prosecutor way.
And that normal white prosecutor way is to take the easy way out.
That is actually what prosecutors do.
You mentioned Danielle, but sometimes I'm on the television.
If you ever see me on the television, right,
you'll notice that I'm not one of these former prosecutor lawyer type people on the television
because I don't like prosecutors, right?
Some of them are fine.
Like Joyce fans, right?
She's a wonderful lady if you've ever met her, like, just honestly.
Love Joyce.
She's like, but like I don't come from her world where prosecutors do good things.
I come from the world where prosecutors usually do horrible things and manipulate the law and manipulate their discretion to, again, punish the weak and look the other way for the strong.
And that's what Merritt Garland has been doing on a national stage since he got the job.
I mean, it's just, I guess, you know, it is really hard.
to muster hope, for the American people right now,
to muster any type of hope.
Hope of a better future.
I mean, we're just dealing with so many compounded crises,
and they're all man-made.
And dare I say, they're all white man-made.
Right.
Right?
Because I'll be explicit.
And there is no political will to actually do something
that would change the course of our history.
I mean, I posted the other day,
literally saying that the doomsday clock
that has been used since 1947 to kind of be this theoretical clock of how close we're coming
to pretty much the end of days as we know it is now in 2023 at 90 seconds to midnight,
the closest it's ever been to like full on human catastrophe. And all of the things that they
have listed have said, guess what? We could actually prevent this. It doesn't have to be the way,
but there is no political will to shift course.
Yeah, I mean, it's closer than it was during the Cuban Missile Crisis, right?
I mean, that's, that's a, that's a nice kind of coda on where we are as a society.
But as you said, there isn't, there isn't white political will to do anything better.
And in fact, you know, we've got white people out here, instead of trying to correct history, they're just trying to erase history, right?
They've literally become more concerned with not telling their own white children what happened, to keeping their white children ignorant.
and stupid about what actually happened in this country, as opposed to fixing things.
I want to say it's a function of whiteness, but it's also a function of unchecked hegemonic
power. These are not the first white people in the world who've tried to rewrite history
and control the flow of information so that the populace remains ignorant, unable to understand
what's going on. They're not the first that have tried this, right? This has been successful
over the course of world history. This has been successful in the past. We, we, we, we, we,
We had a good millennia of it in ancient Europe.
We call it the Dark Ages.
You know, when we look at everything that's happening, Ellie,
when you look at the purposeful misses that Merrick Garland is doing,
when we look at, you know, what you wrote about recently,
Kathy Hochel, governor in New York,
and her decision after nearly, nearly
Losing the governorship and only by virtue of pro-choice, like, you know, thoughtful progressive New Yorkers is Lee Zeldin, a fucking Maga trumpet who like represents Long Island where I grew up, right?
Mm-hmm.
The only reason why she won is because people were like, oh my God.
Like New York may not be a safe haven for much longer, for sanity.
if we allow this Lee Zeldin person to become governor.
And then Hockel goes ahead and you say in our first decision with the judiciary to go
ahead and nominate a man who is against unions, is quote unquote pro-life, right, is all of these
things.
And you're saying to yourself, why do Democrats?
Because she is emblematic.
She's emblematic of the choices that Biden made, right, with Merritt Garland.
Why do you choose people who are so contrary to the base that got you to where you are?
Democrats continue to make those same mistakes that then affect the rest of us.
Why is that?
Yeah, there's a reason why this party is always losing or almost losing, right?
And it's not because we don't have the votes.
We are the more popular party, issue by issue.
Democrats are more popular.
Like the idea that this is a center-right country has never been true.
This is a center-left country at worst.
But the political leadership of the Democratic Party is and has been for a while kind of a joke, a sad joke.
And part of it is the idea that we don't even know we're in a war, right?
So, you know, one of the analogies I've made, you know, especially with the hocal situation in New York, it's like Republicans came in and try to light the house on fire.
right. Hockel's response to somebody trying to light our house on fire was not to go run and get the water, right?
Was not to go run and call the fire department. Her response was to try to negotiate with the arsonist.
Maybe arsonist, if you understood how much my house is really important to me, you wouldn't want to burn it down.
Was her response? Which feels like an idiot's move, but you can't even call her an idiot's move. But you can't even call her an idiot.
it because it's such a classic democratic response, right? It's such a classic response from this party
to try to negotiate with the people who are trying to destroy you instead of trying to beat them,
instead of trying to destroy them first, right? That is the weakness of our party. And look,
it's part of the weakness of liberalism. I get it. I talk a big game, but I can be susceptible to the
same thing. Part of what makes me liberal is my belief in the power of argument, right? And I can also
fall into the trap, and it's a trap, right? I can fall into the quicksand of trying to argue with
people, you know, with the knowledge that I have the better, stronger, more logical arguments,
hoping that I will bring them to see the light, as opposed to ignoring people and spending all of my time trying to inspire the people who already agree with me to go out and kick their ass.
Yeah.
Ellie, that is it right there, is that the expansive we, as you said, we have wasted too much time believing that we have the power to convince the 25 to 30% of the population that is gone.
They are never coming back.
And I'm not interested in spending my energy and time going down to their low vibrational level
to try and convince them of my humanity, right?
To try and convince them of what equity looks like.
It is the 70% that needs to be activated to the fullest extent of their power to understand
that like, no, we actually are the majority.
It's just that some of us are still in slumber.
And one of the things, you know, I just, because I, this is why I love coming on your show because I can say these things, right?
I have this whole theory, Danielle, that this is part of the problem here is that too many white folks, too many white liberal folks have these racist MAGA people in their family.
And they just, they can't cut them out.
And so they've got to believe I can get granddad back if I just, maybe if I explain it to him.
Maybe if I could just turn off the Fox News, grandpappy will come back to me, right?
I'm black, I don't got this problem.
My family is not, you know, I don't have to worry about, you know,
grandpa going down to the local bar and needing to take his hood with him
for a good night out with the boys.
That's not my problem, my family.
And so I think it's a little bit easier for me not having those familial connections
with racists to not spend a lot of time worrying about how I'm going to show racist to
light and instead spending time worrying about how I'm going to beat race racist and protect my
family from them.
