Tomorrow, the Supreme Court will hear a case determining if states can ban transgender procedures for minors.
I'm Elizabeth Mitchell, and this is the Daily Signal, Top News, N10, for Tuesday, December 3rd.
The Supreme Court will hear oral arguments on Wednesday in a case deciding the constitutionality of a Tennessee law that protects children from gender transition procedures.
Tennessee Governor Bill Lee, a Republican, signed the bill banning puberty blockers, hormone replacement regimens,
and transgender surgeries for children into law on March 22, 2023.
In April 2020, the ACLU sued the state of Tennessee on behalf of Samantha and Brian Williams,
whose 15-year-old son says he identifies as a transgender girl.
The Biden-Harris administration joined the lawsuit, contending that Tennessee's law is unconstitutional.
After a federal district court blocked the law from taking effect,
the U.S. Court of Appeals for the Sixth Circuit reversed that and allowed the law to go into a
finding that Tennessee was likely to succeed in arguing that the law is constitutional.
The Supreme Court agreed to review the Sixth Circuit's decision after Biden's Justice Department and the ACLU
appealed the case. The defendant in the case is Tennessee Attorney General Jonathan Scermetti, a Republican.
Organizations in favor of child sex changes will protest the Supreme Court as the nine justices here,
United States v. Scrimetti. LGBTQ activists with the American Civil Liberties Union,
Lambda Legal, Human Rights Campaign, Gender Liberation Movement, Young Feminist Party, and other groups
are busing in protesters for a Free to Be Ourselves rally on Wednesday morning outside the Supreme Court building during the arguments.
The first transgender identifying person to argue before the Supreme Court will represent the ACLU in its argument Wednesday.

Lawmakers in South Korea vote.
voted to lift President Yun Suk Yul's Tuesday martial law declaration.
Youen agreed to lift emergency martial law and withdraw troops.
Yun declared martial law on Tuesday night.
He accused the country's main opposition party of plotting insurgency
and trying to overthrow the free democracy.
This was the first martial law declaration in more than four decades in South Korea.
Yun said he was making the move to defend the Free Republic of Korea
from the threats of North Korean communist forces, and to eradicate the shameless pro-North Korean
anti-state forces that are plundering the freedom and happiness of our people, and to protect
the free constitutional order. Through this emergency, martial law, I will rebuild and defend
the Free Republic of Korea, which is falling into ruin. When martial law is in effect,
the military commander of an area or country has unlimited authority to make it enforce laws.
According to South Korea's constitution, the president can declare martial law when required to cope with a military necessity or to maintain the public safety in order by mobilization of the military forces in time of war, armed conflict, or similar national emergency.
Democratic California Governor Gavin Newsom wants $25 million in funding for legal battles against the incoming Trump administration.
Newsom and state legislators return to the state capital on Monday to be.
begin a special session for the purpose of Trump-proofing California. If the lawmakers
approved Newsom's request, the California Department of Justice and the state agencies would get
the extra funding for court battles. Newsom released a statement last month announcing the special
session. The freedoms we hold dear and California are under attack and we won't sit idle, he said.
California has faced this challenge before and we know how to respond. We are prepared
and we will do everything necessary to ensure Californians have the support and resources they need
to thrive. Newsom continued, but when there is overreach, when lives are threatened, when rights
and freedoms are targeted, we will take action. According to San Francisco Chronicle, several of the
policies that California Democrats want trump-proofed include rules that block local and state authorities
from working with federal law enforcement, as well as rules on California standards for vehicle
emissions. Now for our quick hits, the Daily Caller News Foundation's Megan Brock,
reported that the Biden administration is to blame for an increase in child gender transitions.
From January 2018 to September 2023, 16 states spent more than $165 million funding gender
transition services. This includes puberty blockers, hormone replacement regimens, and sex change
surgeries for kids. More than $45 million was spent on medical interventions for children ages 17 and younger.
The Daily Caller News Foundation, in order to find this data,
asks states to provide reimbursement information for gender transition services
covered through state insurance and medical assistance programs.
The states that provided data to the Daily Caller News Foundation include Michigan, Idaho,
Illinois, Virginia, Nevada, Wisconsin, Massachusetts, Louisiana, Maryland, New Hampshire, Wyoming,
Kentucky, North Dakota, Oregon, Utah, and Washington.
The three states with the highest states with the highest,
amount of reimbursements for gender transition services for adults and children were Illinois,
Oregon, and Washington State. A New Jersey resident was required to leave a town council meeting
for waving an American flag. The resident did this in protest of a new rule in the township
of Edison, New Jersey, banning items like flags in the U.S. Constitution. Residents of the New Jersey
township called the ban disgusting. The township passed an ordinance that cuts down the time
residents have to address the council. It also prohibits them from using props in their remarks.
This includes American flags during public comments. Mycentraljurisy.com first reported.
For our last quick hit of the day, the Department of Justice filed a reply on Tuesday
supporting its motion for a gag order against Dr. Etonheim, a surgeon indicted by the Biden administration,
after he blew the whistle on sex change procedures for minors.
The gag order would prevent the defendant and his attorney from making, quote-unquote,
inflammatory and unfairly prejudiced statements.
Heim initially came forward as an anonymous whistleblower to expose gender treatments being performed on minors
at Texas Children's Hospital in Houston.
He is facing four felony counts of violating the Health Insurance Portability and Accountability Act,
also known as HIPAA, according to journalist Chris Rufo,
who first reported on Hymes story.
The Burke Law Group, which is representing Hymn, said on X that the prosecutors in Himes' case
are doubling down on their shameless effort to ask the court to censor us and our client on X.
